Thursday, June 27, 1974 Council Chambers, Municipal Building Meeting No. 74 -4 A. CALL TO ORDER A meeting of the Board of Appeals and Adjustments of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 12:06 A.M. by Chairman Murdock. B. ROLL CALL Burton A. Murdock, Chairman Present Robert T. Bruton Present John C. Greavu Present Donald J. Wiegert Present Norman G. Anderson Present C. APPROVAL OF MINUTES Councilman Wiegert moved that the Minutes of Meeting No. 74 -3 (June 18, 1974) be approved as submitted. Seconded by Councilman Greavu. Ayes - all. D. PUBLIC HEARINGS 1. Sideyard Setback Variance - Northwest Corner of Lark Avenue and Barclay Street (9:30 P.M.) a. Chairman Murdock convened the meeting for a public hearing regarding the request of Peter Urbanski to construct a single family residence on a corner lot with aside yard setback of less than 30 feet. The clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report with the recommendation that the variance to the minimum side yard be denied. C. Manager Miller presented the following Planning Commission recommendation. "Commissioner Barrett moved that the Planning Commission recommend to the City Council denial based on the fact that the variance has not been justified by the applicant.'` Commissioner Batie seconded. Ayes - all. Motion carried." d. Chairman Murdock called for proponents. None were heard. e. Chairman Murdock called for opponents. None were heard. f. Chairman Murdock closed the public hearing. g. Councilman Wiegert moved to deny the request of a side yard setback variance based on the staff reports. Seconded by Councilman Anderson. Ayes - all. (1) Urbanski for na Commissio 6/27 2. Sideyard Setback Variance - 1168 South Century Avenue (9:45 P.M.) a. Chairman Murdock convened the meeting for a public hearing regarding the request of Mr. R. W. Crossley to construct a garage within one `''' foot of a side property line instead of maintaining the required 5 foot separation. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report with the recommendation that the proposed variance be denied. c. Manager Miller presented the following Planning Commission recommendation. "Commissioner Waldron moved that the Planning Commission recommend to the City Council the variance of R. W. Crossley be denied be- cause he felt the garage could be accomplished by other means to meet the Code requirement. t Commissioner Howard seconded. Motion carried. Ayes - all." d. Chairman Murdock called for proponents. The following were heard. Mr. R. W. Crossley, the applicant, 1168 South Century Avenue. Mr. K.R. Erickson, 1160 South Century Avenue. e. Chairman Murdock called for opponents. None were heard. f. Chairman Murdock closed the public hearing. g. Councilman Greavu moved to approve the request of Mr. R. W. Crossley for a side -yard setback variance to construct his garage 1 foot from the property line based on the topography and the situation of the homes. Seconded by Councilman Anderson. Ayes.- all. 3. Parking Variance Northeast Corner of White Bear and Beam Avenues. (10:00 P.M.) a. Manager Miller stated he received a letter from G. Jack Hillstrom, Executive Vice President of Maplewood State Bank, requesting the variance application be withdrawn. b. Councilman Greavu moved to accept the letter requesting the matter be withdrawn.
