CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:34 P.M. by Mayor Bruton. B. ROLL CALL Robert T. Bruton, Mayor Present John C. Greavu, Councilman Present Donald J. Wiegert, Councilman Present Norman G. Anderson, Councilman Present Burton A. Murdock, Councilman Present C. PUBLIC HEARINGS 1. Special Exception (B -C Zone) and Special Use Permit (Height Requirement) - Parkside Apartments (Larpenteur Avenue and Parkway Drive) a. Mayor Bruton convened the meeting for a public hearing regarding a special use permit requested by Ban Con, Inc, to construct apartment buildings to ex- ceed Maplewood code provisions. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and stated the proposed use does comply with the land use portion of the Plan for Maplewood and it is therefore recommended that the special exception from the BC zoning be approved; however, it is also recommended that the variance from the parking requirement and the special use permit to exceed height requirements be denied. c. Chairman Lyman Coombs presented the following Planning Commission recommend- ation: "Commissioner Singer moved to table the proposal until the Planning Commission meeting of April 15, 1974. Commissioner Batie seconded. Motion carried - Ayes all." d. Mayor Bruton called for proponents. None were heard. e. Mayor Bruton called for opponents. None were heard. f. Mayor Bruton closed the public hearing. g. Councilman Wiegert Seconded by Mayor Bruton. x1 to table the matter until a r - 1 - 4/11 Councilman Wiegert moved to amend the motion to establish the date of May 9, 1974 for continuation of the public hearing. Seconded by Mayor Bruton. Ayes - all. Vote now taken on the original motion. Ayes - all. Mayor Bruton recessed the meeting at 7:46 P.M. to reconvene as the Board of Appeals and Adjustments. Mayor Bruton reconvened the meeting at 7:50 P.M. D. COUNCIL PRESENTATIONS 1. Mayor Bruton stated he was called by the Metropolitan Council and asked if Maple- wood was willing to host a meeting of Maplewood and seven adjoining communities to meet with the Metropolitan Council. A date of May 13 has tenatively been set and wished to know if this was agreeable with Council. This is agreeable with Council for 7:30 P.M., Monday, May 13, 1974. 2. Mayor Bruton stated the City of St. Paul sent a letter stating that there will be another meeting concerning the Battle Creek Joint Powers Board on Thursday, April 18, 1974 at 4:00 P.M. 3. Mayor Bruton stated he received a letter from the State Chapter of the Minnesota Public Works Association requesting that he proclaim a National Public Work Week in Maplewood. In agreement with the Council, he issued the following proclamation: WHEREAS, public works services provided in our community are an integral part of our citizen's everyday lives; and WHEREAS, the support of an understanding and informed citizenry is vital to the planning and construction of public works programs and systems such as water, sewer, streets, highways and other types of facilities; and WHEREAS, the health, sanitation, safety and general well -being of this community depends, to a great degree, on these services and facilities; and WHEREAS, the quality,o-; efficiency, and effectiveness of these facilities, as well as the planning, design, and construction of future facilities, is vitally dependent upon our public works engineers, administrators, and technicians; and WHEREAS, retaining and attracting qualified and dedicated personnel to staff public works departments is materially influenced by the people's attitude and understanding of the importance of the work performed by such employees; NOW, THEREFORE, BE IT RESOLVED, that I, Robert T. Bruton, Mayor of the City of Maplewood, do hereby proclaim the week of May 19th thru 25th, 1974, as NATIONAL PUBLIC WORKS WEEK and call upon all citizens and civic organizations to acquaint themselves with the problems involved in providing public works facilities and ser- vices; and recognize the important role in our safety, health and well -being that is played by the public works officials in our community. - 2 - 4/11 Councilman Wiegert moved the Seconded by Mayor Bruton. lamation be from the Council as wel Ayes - all. 4. Mayor Bruton stated the coverage in the Newsletter was very good, covering each department. 5. Mayor Bruton commented that having read the Ramsey County Minutes, he finds them almost impossible to read and has come to appreciate the minutes of Maplewood. 6. Mayor Bruton noticed that the Ramsey County Board donated some money to the St. Paul Chamber Orchestra. Council discussed whether or not they could made a con- tribution to the Fall Festival Association and decided that it was not possible, but it seems that this would be the same situation and is confused. Attorney John Bannigan stated he has looked into this and studied a lot of attorney general's opinions on this and felt we could not do this. He will look into this further. 7. Mayor Bruton stated he has never seen an annual report from the Community Design Review Board. Manager Miller stated they are not required to make one. Staff will draft an ordinance change so they will have an annual report next year. 8. Councilman Murdock wished to know if there are any fees attached to the process of going to the Community Design Review Board. Manager Miller stated there was no fee for Community Design Review Board pro- cedure, but there is for rezoning, Planned Unit Development, etc. 9. Councilman Anderson wished to know if the office building on Cope was to put up a fence behind the building at the end of their property. Staff will investigate. E. ADMINISTRATIVE PRESENTATIONS 1. Manager Miller stated the Director of Public Works had talked to Mr, and Mrs. Bah on Brookview Drive about their drainage. They wished to wait on this, so nothing was done. 2. Manager Miller presented the 1973 Audit reports. The shorter one is a summary and the long one is the actual audit report. Council is to look at these for a week or two, then if they have questions they wish to speak to the auditor about, a meeting will be arranged. If there are no questions, then it will just come up as an acceptance. 3. Manager Miller stated next Tuesday there is a meeting here with North St. Paul Council and ofcourse, next Thursday is a Council meeting, which he hopes will be short, because he has a mediation meeting at 9:00 o'clock the next morning. 4. Manager Miller stated our ordinances provide that on property that is platted, it should be immediately rezoned by the City. Mr. Lais states that the way the or- dinance now reads, the Maplewood Mall property, technically, should be rezoned. It is SC now and suggests that Council vary from the platting code and presented a resolution. - 3 - 4/11 Councilman Wiegert introduced the following resolution and moved its adoption: 74 -4 -80 BE IT RESOLVE) by the Council of the City of Maplewood that it finds that to apply Section 1004.070 of the Platting Code to the Maplewood Mall situation would violate the intent of this Ordinance and that to grant a variation from said Section of the Ordinance would not adversely effect the plan and spirit of the platting Ordinance. IT IS HEREBY RESOLVED by the City Council of the City of Maplewood that the provisions of Section 1004.070 of the Platting Code are hereby waived as to the Maplewood Mall.. CALL TO ORDER A meeting of the Board of Appeals and Adjustments of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:46 P.M. B. ROLL CALL Robert T. Bruton Present John C. Greavu Present Donald J. Wiegert Present Norman G. Anderson Present Burton A. Murdock Present C. APPROVAL OF MINUTES 1. Minutes No. 73-9 (October 25, 1973) Councilman Wiegert moved that the Minutes of Meeting No. 73-9 (October 25, 1973) be approved as submitted. Seconded by Councilman Greavu. Ayes - all. D. APPOINTMENT OF CHAIRMAN 1. Councilman Greavu moved to appoint Burton Murdock as Chairman of the Board of Appeals and Adjustments. Seconded by Councilman Anderson. Motion carried. E. PUBLIC HEARINGS Ayes - Mayor Bruton, Councilmen Anderson, Greavu and Wiegert. Nays - Councilman Murdock. 1. Board of Appeals and Adjustments, Special Use Permit (Parking Variance) - Parkside Apartments (Larpenteur Avenue and Parkway Drive) a.
