A. CALL TO ORDER
A special meeting of the City Council of Maplewood, Minnesota,
Council Chambers, Municipal Building and was called to order at
Mayor Bruton.

1. Zone Change (R -1 to LBC) - West Side of White Bear Avenue, Frost Avenue to Ripley
Avenue and Larpenteur Avenue between Flandrau Street and White Bear Avenue (3 lots)
7:30 P.M.
a, Mayor Bruton convened the meeting for a public hearing for a zone change
on Lots 1 through 12, Block 1, Garden Acres and Lot 25 except the easterly 115
feet, Block 1, Garden Acres. The Clerk read the notice of hearing along with
the dates of publication.
b. Manager Miller read the staff report.
Councilman Greavu arrived at 7:43 P.M.
c. Manager Miller presented the following Planning Commission recommendation:
"Commissioner Batie moved that the Planning Commission recommend to the City
Council that the proposed zone change be denied and further, consideration be
given to all 25 lots being rezoned to LBC after further information has been
developed as to how to properly proceed with that development.
Commissioner Howard seconded. Voting on the motion: Ayes - Commissioners
Singer, Howard, Batie, Waldron, Kishel (5); Nays - Commissioners Prew and
Disselkamp (2);"
d. Mayor Bruton called for proponents. The following were heard:
Mr. Robert Hulke, 1831 White Bear Avenue;
Mr. Gale Pettee, owner of 1865 White Bear Avenue;
Mr. Harry Jonsson, 1717 White Bear Avenue;
Councilman Wiegert stated Robert Hejny could not attend the meeting, but
wished Council to know he was for the zone change.

e. Mayor Bruton called for opponents. The following were heard:
Mr. Paul Holt, 1895 White Bear Avenue;
Mrs. D. Desrosier, 1909 White Bear Avenue;
Mr;.David Dufresne, 1751 E. Larpenteur Avenue;
Mr. James Carney, 1856 Flandrau Street;
Mr. George Schultz, 1864 Flandrau Street;
Mr. Tony Greezyna, 1812 Flandrau Street;
Mr. Phil Rivard, 1714 Flandrau Street;
Mr. Len Klein, 1741 E. Larpenteur Avenue;
Mr. Louis Furlong, 1725 E. Larpenteur Avenue;

Mayor Bruton called a five minute recess.
Mayor Bruton reconvened the meeting at 9:46 P.M.
D COUNCIL PRESENTATIONS
1. Councilman Wiegert stated he had received a call from a resident complaining of
dogs running.
Staff stated the animal control had been notified to increase their hours of
patrolling.
2. Councilman Wiegert wondered if it would be in order for the Council to congratulate
the official City newspaper on their awards from the Minnesota Newspaper Association.
Councilman Wiegert moved that a letter be sent to the Maplewood Review congratulat-
ing them for the two awards.
Seconded by Mayor Bruton. Ayes - all.
3. Councilman Wiegert stated Council had received a letter from Mr. Gallagher, 1953
White Bear Avenue regarding the White Bear Avenue zone change. Mr. Wiegert wondered
if research can be done on the nine points in Mr. Gallagher's letter and a reply be
made.

4. Councilman Greavu stated he had received calls regarding the Forest Green's
road to the south.
Staff will investigate.
5. Councilman Greavu wished to know if the Manager had contacted Mr. Peet regarding
insurance evaluation.
Manager Miller stated he hadn't, but would have by the next meeting.
6. Mayor Bruton stated he was interested in how the water situation is coming with
the City of Saint Paul.
Attorney Lais stated there is a meeting March 15, 1974 at 2:00 P.M.
7. Councilman Anderson wished to know if there was anything new on the resolution
which was sent to the Highway Department regarding the stop signs at Frost and
English.
Staff stated nothing has been heard, as yet.
8. Council wished to know about signalization of Cope and White Bear Avenue.
Engineer Collier stated he had been unofficially informed that the County or
the State plans to signalize the off - ramps of Highway 36 and White Bear Avenue.
They are to let a contract in September, which means they would be ordered in-
stalled in 1975.
ADMINISTRATIVE PRESENTATIONS
1. Manager Miller presented the completed agreement regarding signals on White Bear
Avenue at the Maplewood Mall. The agreement was approved by Council at the last
meeting.
2. Manager Miller stated staff had received a request for variance from the zoning
code. Such a variance is heard by the Board of Appeals and Adjustments. The ordin-
ance provides that the Council can appoint itself as acting Board of Appeals and Ad-
justment.
Councilman Greavu moved that the Council act as the Board of Appeals and Adjust-
ment.
Seconded by Councilman Anderson. Ayes - all.
3. Manager Miller stated there has been an application received from Ban Con to con-
struct an apartment complex on a portion of land where their driving range is located
now. There are three actions applied for and all three require public hearings. 1)
Variance in Zoning Code;2) The land is zoned B -C, which permits Council permission to
construct apartments in a B -C zone;and 3) to be allowed five story buildings. Hearing
date of April 4 or 11 is suggested.
Councilman Wiegert moved to set April 11, 1974 for the three hearings requested
by Ban Con.
Seconded by Councilman Greavu.
