CALL TO ORDER A Special meeting of the Village Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:37 P.M. by Mayor Axdahl. B. ROLL CALL Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Present Harald L. Haugan, Councilman Present Donald E. Olmstead, Councilman Present Donald J. Wiegert, Councilman Present C. PUBLIC HEARINGS 1. Water Improvement - Bellaire Avenue, between Lydia Avenue and Beam Avenue 7:30 P.M. a. Mayor Axdahl convened the meeting for a public hearing for the proposed construction of water improvement on Bellaire Avenue between Lydia and Beam Avenues. The Clerk read the notice of hearing along with the dates of publication. b. Village Engineer Collier presented the specifics of the improvements. c. Manager Miller presented the following Planning Commission recommendations: Commissioner Prew moved that the Planning Commission recommend to the Village Council that they concur with the consultant and staff as to the feasibility of water main construction on Bellaire Avenue between Beam Avenue and Lydia Avenue, water main construction on Elm Street from County Road C to Kohlman Avenue and on Kohlman Avenue from Elm Street to T.H. 61, water main construction on County Road C from the present terminus at T.H. Westerly, approximately 300 feet, however, would recommend that if the projects are pursued they should be incorporated into one project so as to establish the economy as suggested by the consultant. Commissioner Bruton seconded. Motion carried. d. Mayor Axdahl called for proponents. None were heard. e. Mayor Axdahl called for opponents. - Ayes. all. The following were heard: Leonard Kuehn, 2899 Bellaire Avenue Charles L. Watterson, 2997 Bellaire Avenue Melvin Kuehn, 2937 Bellaire Avenue Donald Kuehn, 2911 Bellaire Avenue - 1 - 12/13 f. Mayor Axdahl closed the public hearing. g. Councilman Haugan moved to deny the proposed improvement, Seconded by Councilman Olmstead. Ayes - all. 2. Water Improvement.County Road C, West of Trunk Highway 61 (7:45 P.M.) a. Mayor Axdahl convened the meeting for a public hearing on the construction of water improvement on County Road C from the present water terminus point on the West side of Trunk Highway 61, for a distance of approximately 200 feet westerly. The clerk read the notice of hearing along with the dates of publication. b. Mr. Bruce Rikley, Kirkham, Michael and Associates presented the specifics of the improvement. c. Manager Miller presented the following Planning Commission Report. Commissioner Prew moved that the Planning Commission recommend to the Village Council that they concur with the consultant and staff as to the feasibility of water main construction on Bellaire Avenue between Beam Avenue and Lydia Avenue, water main construction on 'Elm Street from County Road C to Kohlman Avenue and on Kohlman Avenue from Elm Street to T.H. 61, water main construction on County Road C from the present terminus at T.H. 61 westerly, approximately 300 feet, however would recommend that if the projects are pursued they should be in- corporated into one project so as to establish the economy as suggested by the consultant. Mayor Axdahl called for opponents. None were heard. f. Mayor Axdahl closed the public hearing. g. Councilman Greavu introduced the following resolution and moved its adoption. 73 - 12 - 287 WHEREAS, after due notice of public hearing on the construction of (water mains, service connection, appurtenances and necessary street reconstruction) on County Road "C" from the present water terminus point on the West side of trunk Highway #61, for a distance of approxinately 200' Westerly, a hearing on said improvement in accordance with the notice duly given was duly held on December 13, 1973, and the Council has heard all persons desiring to be heard on the matter and has fully considered the same; - 2 _ 12 -13 NOW, THEREFORE, BE IT RESOLVED IN THE VILLAGE, COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. That it is advisable, expedient, and necessary that the Village of Maplewood construct (water mains, service connections, appurtenances and necessary street reconstruction) on County Road "C" from present water terminus point on the West side of trunk Highway 1661 for a distance of approximately 200' Westerly, as described in the notice of hearing thereon, and orders the same to be made. 2. The Village Engineer was designated engineer for this improvement and is hereby directed to prepare final plans and specifications for the making of said improvement. 3. This improvement is hereby designated Water Improvement Number 73 -19. Seconded by Councilman Wiegert Ayes - all. 3. Water Improvement - Elm Street, Kohlman Avenue, T.H. 61 frontage road, ;English Street and Clarence Street (8:00 P.M.) a. Mayor Axdahl convened the meeting for a public hearing on the construction of a water improvement on Elm Street from County Road C to Kohlman Avenue; Kohlman Avenue from Fitch Road to T.H. 61; The east frontage road of T.H. 61 from Kohlman Avenue to County Road C; English Street from County Road C to Kohlman Avenue; Clarence Street from Kohlman Avenue north to its terminus. The Clerk read the notice of hearing along with the date of publication. b. Mr. Bruce Rikley, Kirkham, Michael and Associates presented specifics of the proposed improvement. c. Bauerfield, 2688 Maplewood Drive - 3 - 12/13 f. Mayor Axdahl closed the public hearing. g. Manager Miller read a letter from Mr. and Mrs. Paul Luxem, 1390 Kohlman Avenue objecting to the proposal. h. Councilman Olmstead introduce adoption. (approving the entire 73 -12 -288 resolution WHEREAS, after due notice of public hearing on the construction of (water mains, service connections, appurtenances and necessary street reconstruction) on A. Elm Street from County Road "C" to Kohlman Avenue; B. Kohlman Avenue from Fitch Road to trunk Highway 4161; C. The east branch road of trunk Highway 4161 from Kohlman Avenue to County Road "C" D. English Street from County Road "C" to Kohlman; E. Clarence Street from Kohlman Avenue north to its terminus, a hearing on said improvement in accordance with the notice duly given was duly held on December 13, 1973, and the Council has heard all persons desiring to be heard on the matter and has fully considered the same. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. English Street from County Road "C" to Kohlman; E. Clarence Street from Kohlman Avenue north to its' terminus as described in the notice of hearing thereon, and orders the same to be made. 2. The Village Engineer, is designated Engineer for the improvement and is hereby directed to prepare final plans and specifications for the making of said improvement. 3. This improvement is hereby designated to be improvement Number 73 -20. Seconded by Councilman Haugan. Ayes - all. D. COUNCIL PRESENTATIONS 1. Mayor Axdahl stated there will be a meeting with the Board of Water Commissioners next Thursday at 2:00 P.M. in Room 216, City Hall. Village Attorney Don Lais will represent the Village. 2. Councilman Wiegert presented clippings from the Minneapolis paper re- garding county redistricting. He attended the Monday evening meeting. 3. Councilman Wiegert stated that regarding the fees for sewer, the Village will have to pay regardless of the law suit. If the Village wins, we will receive a refund. - 4 - 12/13 4. Manager Miller stated he recommends holding a public hearing on December 20, 1973 at 7:30 P.M. for the Bingo License for the Lions and Lionells. Councilman Olmstead moved to set December 20, 1973 at 7:30 P.M. for the public hearing for the Lions and Lionells Bingo License. Seconded by Councilman G ?iegert Ayes - all. S. Mayor Axdahl stated the Council members Village employees requesting a shirt sleeve Following a lengthy discussion, Councilman ' to staff to obtain legal and labor advice. Seconded by Councilman Haugan. Ayes Motion carried. received a letter from some session. Jiegert moved to refer the matter - Mayor Axdahl, Councilmen Haugan, Olmstead, and Wiegert Nay - Councilman Greavu Council directed the Manager to report back on this matter at the next meeting as an agenda item. E. STAFF PRESENTATION 1. Manager Miller stated it is recommended that Village Hall be officially closed `N on December. 21: and 31 to conserve on energy. The State of Minnesota has announced ?, the closing of State Offices on those dates and Roseville, White Bear Lake and North St. Paul will be making like announcements of such closings in the near future. These govermental units are requiring make -up time for the closing, and I would suggest that Village offices remain open from 8:00 A.M. to 6:30 P.M. on January 7 through January 10 to offset the closings. The recommended closings are an energy saving device and are not to be considered as precedents. Councilman Wiegert moved that Village Hall be closed December 24 and 31, 1973_ and that the Village offices remain open from 8:00 A.M. to :30 P.M. from January 7 through 10 to make up the time.
