A. CALL TO ORDER
A meeting of the Board of Appeals and Adjustment of Maplewood, Minnesota was held
in the Council Chambers, Municipal Building and was called to order at 8:04 P.M.
by Chairman Haugan.

C. APPROVAL OF MINUTES
Councilman Greavu moved that the minutes of Meeting No. 73 -6 (August 16, 1973) be
approved as submitted.
Seconded by Councilman Wiegert. Ayes - all.
D. PUBLIC HEARINGS
1. Set Back Variance - 2153 Sloan Street (8:00 P.M.)
a. Chairman Haugan convened the meeting for a public hearing on the request
of the Sussel Company for a variance from the side yard setback requirement
at 2153 Sloan Street. The Clerk read the notice of hearing along with the
dates of publication.
b. Manager Miller presented the staff report with the recommendation that the
request be approved.
c. Commissioner Chuck Kent presented the following Planning Commission report:
"Commissioner Barrett moved that the Planning Commission recommend to the
Board of Adjustment and Appeals that the requested setback variance be approved
due to the lack of alternates available to the applicant and a lack of site
obstruction to the intersection of County Road B and Sloan Street.
Commissioner Kent seconded. Motion carried. Ayes - all."
d. Chairman Haugan called for proponents.
A representative of the Sussel Company spoke.
e. Chairman Haugan called for opponents.
None were heard.

f. Chairman Haugan closed the public hearing.
g. Councilman Greavu moved to approve the variance reguuest of the Sussel
Company to construct a garage at 2153 Sloan Street 6 feet from the side yard.':

Seconded by Councilman Wiegert. Ayes - all.
2. Set Back Variance - 2108.Barclay Street (8:15 P.M.)
a. Chairman Haugan convened the meeting for a public hearing on the request
of Mrs. Evelyn Larsen, 2108 Barclay Street, for a variance to construct a
garage six feet from the lot line. The Clerk read the notice of hearing along
with the dates of publication.
b. Manager Miller presented the staff report with the recommendation that
the requested variance be denied due to the excessiveness of the variance and
the availability of alternate construction location on the lot. It is suggest-
ed that the real question involved in this request is whether or not Eldridge
Avenue can realistically be expected to be improved in the future. If the
answer is no, then the street should be vacated and the variance will not be
necessary. If the answer to the question is yes, °then the 30 foot requirement
is necessary to insure adequate site clearance for vehicular traffic at the
intersection. In either case, the question of the future of Eldridge Avenue
between Barclay Street and Hazelwood Avenue is a question properly possed at
a vacation hearing.
c. Commissioner Chuck Kent presented the following Planning Commission report:
"Commissioner Barrett moved that the Planning Commission recommend to the
Board of Adjustment and Appeals that the requested setback variance be denied
based upon the reasons stated in the staff report.
Commissioner Wldron seconded. Motion carried - Ayes ail."
d. Chairman Raugan called for proponents. The.following were heard:
Evelyn D. Larsen, 2108 Barclay Street
William Harrison, lives south of Mrs. Larsen, has no objection to the
variance. He would not like to have the street constructed.
e. Chairman Haugan called for opponents.
None were heard.
f. :Chairman Haugan closed the public hearing.
g. Councilman Greavu moved to approve the variance request of Mrs. Larsen,
2108 Barclay Street, with the condition the garage be no closer than 16 feet
from the side yard lot line.
Seconded by Councilman Olmstead. Ayes - all.
