A. CALL TO ORDER
A special meeting of the Village Council of Maplewood, Minnesota was held in the
Council Chambers, Municipal Building and was called to order at 7:33 P.M.

C. PUBLIC HEARINGS
Manager Miller explained the procedures for the assessment hearings. Forms are
available for adjustment or deferment of the assessment. If there are not many
requests for adjustments or deferments, they can be heard on August 16, 1973; or
if there are too many requests, they can be held over until a special meeting on
August 23, 1973.
Council agreed to hear the requests on August 16, 1973 if there aren't a large
number of them.
1. Improvement No. 71 -18 Sandhurst - Prosperity Water (7:30 P.M.)
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for Water Improvement No. 71 -18, Sandhurst Drive, Prosperity
Road. The Clerk read the notice of hearing along with the dates of publication.
b. Village Engineer Collier explained the specifics of the proposed assessment
roll and how the rates were computed. The rates for this assessment are:
Water Main $7.85 per front foot and Service Connection $350.00.
It is recommended the assessment roll be adopted.
c. Mayor Axdahl called for persons who wished to speak for or against the
proposed assessment roll. The following were heard:
1. Mr. Tony Pappelars, owner of the building at 2225 White Bear Avenue,
stated he is paying for water assessment on White Bear Avenue, objects to
an assessment on Prosperity Road.
2. Mr. James G. Guertin, owns property fronting on White Bear Avenue,
County Road "B" and Prosperity Road. He stated he was over assessed for
the property on County Road "B" and wishes that fact to be taken into con-
sideration on the Prosperity Road assessment.

3. Mr. Ira Rawls, 1622 E. Sandhurst Drive, wishes to know why he has to
pay the $75.00 Water Availability Charge.
4. Mr. Uzziel Rogers, 1610 E. Sandhurst Drive, paid for water on Germain
Street, wishes to know why he has to pay for 10' on Sandhurst Drive.
d. Councilman Greavu introduced the following resolution and moved its adopt-
ion: (adopting assessment rolls pending corrections)

WHEREAS, pursuant to proper notice duly given as required by law, the
Village Council has met and heard and passed upon all objections to the pro-
posed assessment for the construction of water mains, service connections on
Sandhurst Drive - Prosperity Road as described in the files of the Village
Clerk as Water Improvement No. 71 -18 and has amended such proposed assessment
as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINN-
ESOTA:
1. Such proposed assessment, as amended, a copy of which is attached here-
to and made a part hereof, is hereby accepted and shall constitute the spec-
ial assessment against the land named therein, and each tract of land there-
in included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of nineteen (19) years, the first of the installments to be
payable on or after the first Monday in January, 1974 and shall bear inter-
est at the rate of seven (7) percent per annum from the date of the adopt-
ion of this assessment resolution. To the first installment shall be added
interest on the entire assessment from the date of this resolution until
December 31, 1974. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
3. It is hereby declared to be the intention of the Council to reimburse
itself in the future for the portion of the cost of this improvement paid
for from municipal funds by levying additional assessments, on notice and
hearing as provided for the assessments herein made, upon any properties
abutting on the improvement but not made, upon any properties abutting on
the improvement but not herein assessed for the improvement, when changed
conditions relating to such properties make such assessment feasible.
4. To the extent that this improvement benefits non - abutting properties
which may be served by the improvement when one or more later extensions
or improvements are made, but which are not herein assessed therefore, it
is hereby declared to be the intention of the Council, as authorized by
Minnesota Statutes Section 420.051, to reimburse the Village by adding any
portion of the cost so paid to the assessments levied for any of such later
extension or improvements.
5. The Clerk shall forthwith transmit a certified duplicate of this assess-
ment to the County Auditor to be extended on the property tax lists of the

County, and such assessments shall be collected and paid over in the same
manner as other,municipal taxes.
Seconded by Councilman Wiegert. Ayes - all.
2. Improvement No. 71 -21 VanDyke - Kohlman Avenue Water (8:00 P.M.)
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment rolls for Improvement No. 71 -21, VanDyke- Kohlman Avenue Water.
The Clerk read the notice of hearing along with the dates of publication.
b. Manager Miller explained the procedures of the assessment hearing. Appli-
cations for deferment or adjustments are available. Decisions on same will be
made August 16, 1973.
c. Village Engineer Collier explained the specifics of the proposed assessment
roll and how the rates were computed. The rates for this assessment are:
Water Main $8.39 per front foot and Service Connection $350.00.
Adoption of the assessment roll is recommended.
d. Mayor Axdahl called for persons who wished to speak for or against the
assessment roll. None were heard.
e. Council questioned if the Village owned property had been assessed. Staff
stated it had not been.
f. Councilman Haugan moved that the Village owned property be included in the
assessment roll and that the rates be adjusted to include the property.
Seconded by Councilman Olmstead. Ayes - all.
g. New rates: Water Main $6.99 per front foot and Service Connection $350.00.
h. Councilman Haugan introduced the following resolution and moved its adopt-
ion: (adopting assessment roll pending adjustments)

i. Council directed Staff to investigate if payment for assessment 71 -21 is
going to be paid out of Park Funds, if so, Council should consider ,putting
monies into the Park Fund Budget.
3. Improvement 72 -4 - Larpenteur Avenue Water (8:30 P.M.)
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for the Larpenteur Avenue Water Improvement No. 72 -4. The
Clerk read the notice of hearing along with the dates of publication.
b. Manager Miller explained the procedures of the assessment hearing. Appli,
cations for deferment and adjustments are available. Council will review them
August 16, 1973.
c. Village Engineer Collier explained the specifics of the proposed assessment
roll and how the rates were computed. The rates for this assessment are:
Water Main $5.92 per front foot on the south, $17.76 per front foot on
the north and service connection $275.00.
Adoption of the assessment roll is recommended.
d. Mayor Axdahl called for persons who wished to speak for or against the
proposed assessment roll. The following were heard:

Mr. C.RMcReynolds, 2384 E. Larpenteur Avenue, requested more information
regarding the Water Availability Charge.
Council and Staff explained the WAC charge.
e. Councilman Wiegert introduced the following resolution and moved its adopt-
ion: (Adopting assessment roll pending adjustments)

Village Council has met and heard and passed upon all objections to the pro-
posed assessment for the construction of Water Mains, Service Connections on
Larpenteur Avenue as described in the files of the Village Clerk as Improvement
No. 72 -4 and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINN-
ESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made apart hereof, is hereby accepted and shall constitute
the special assessment against the land named therein, and each tract
of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extend-
ing over a period of nineteen (19) years, the first of the installments
to be payable on or after the first Monday in January, 1974 and shall
bear interest at the rate of seven (7) percent per annum from the date
of the adoption of this assessment resolution. To the first installment
shall be added interest on the entire assessment from the date of this
resolution until December 31, 197`7+. To each subsequent installment when
due shall be added interest for one year on all unpaid installments.
3. It is hereby declared to be the intention of the Council to reimburse
itself in the future for the portion of the cost of this improvement paid
for from municipal funds by levying additional assessments, on notice
and hearing as provided for the assessments herein made, upon proper-

which may be served by the improvement when one or more later extensions
or improvements are made, but which are not herein assessed therefore,

ing any portion of the cost so paid to the assessments levied for any
of such later extension or improvements.

Seconded by Councilman Haugan. Ayes - all.
Mr. McReynolds also stated he is having problems with the culvert on his
property.
Council directed staff to assist Mr. McReynolds with the problem.
DUTCH ELM DISEASE
Council questioned if there had been any new information on Dutch Elm Disease.
Village Engineer Collier stated he had contacted North Saint Paul and would
be meeting with them. They have indicated they would work with us.
Councilman Olmstead moved that the

4. Improvement No. 72 -6 Myrtle Street Water (9:00 P.M.)
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for Water Improvement No. 72 -6, Myrtle Street. The Clerk read
the notice of hearing along with the dates of publication.
b. Manager Miller explained the procedures of the assessment hearing. Ap-
plications for deferment and adjustments are available. Council will review
them August 16, 1973.
c. Village Engineer Collier presented the staff report and specifics of the
improvement. This consists of installation of water mains, hydrants and ser-
vices on Myrtle Street from Larpenteur south to the dead end of Myrtle Street.
The assessment is proposed at $8.12 per foot and a service connection of $363.11.
It is recommended that the assessment roll be adopted.
d. Mayor Axdahl called for persons who wished to be heard for or against the
proposed assessment roll. The following were heard:
Jim Mueller, 1568 Myrtle, wonders where the extra amount comes from in the
assessment. At the hearing it was stated it would be approximately $7.50
per foot and $250 for hookup.
e. Following further discussion, Councilman Wiegert moved to adopt the rates
for Improvement No. 72 -6 As: 87.71 ner front foot and 8146_61 carzrirw �, ..

f. Councilman Wiegert introduced the following resolution and moved its adopt-
ion:
WHEREAS, pursuant to proper notice duly given as required by law, the

Myrtle Street as described in the files of the Village Clerk as Water Improve-

ESOTA:

5. Improvement No. 72 -9 - County Road B Water (9:30 P.M.)
a. Mayor Axdahl convened the meeting for a public hearing on adoption of the
assessment roll for Water Improvement No. 72 -9, County Road B from Day Road
west. The Clerk read the notice of hearing along with the dates of publication.

b. Manager Miller explained the procedures of the assessment hearing. Ap-
plications for deferments or adjustments are available. Council will re-
view them August 16, 1973.
c. Village Engineer Collier explained the specifics of the proposed assess-
ment roll and how the rates were computed. The rates for this assessment are:
Water Main, $9.50 per front foot, 1" service connection, $318.83 and
6" service connection, $510.12.
Adoption of the assessment roll is recommended.
d. Mayor Axdahl called for persons who wished to speak for or against the pro-
posed assessment roll. The following were heard:
Mr. Marvin Stoll, 1108 E. County Road "B ",objected to the 10 foot assess -
ment that he received. He stated ILeller Golf Course is the only one ben-
efited and he did not sign a petition for this improvement.
e. Councilman Haugan introduced the following resolution and moved its adopt-

a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for Adele Street Water Improvement No. 72 -21. The Clerk read
the notice of hearing along with the dates of publication.
b. Manager Miller explained the procedures of the assessment hearing. Ap-
plications for deferment or adjustment are available. Council will review them
on August 16, 1973.
c. Village Engineer Collier explained the specifics of the assessment roll
and how the rates were computed. The rates for the assessment are:
Water Mains - $7.50 per foot and Service Connection - $250.00.
