A. CALL TO ORDER
A special meeting of the Village Council of Maplewood, Minnesota was held in
the Council Chambers, Municipal Building and was called to order at 7:31 P.M.
by Mayor Axdahl.

C. PUBLIC HEARINGS
Mayor Axdahl stated the purpose of this meeting was to hold a public hearing re-
garding the adoption and levying of the assessment rolls.
1. Project No. 70 -5 Beam Avenue, Storm Sewer - 7:30 P.M.
a. Mayor Axdahl convened the meeting for a public hearing on adopting
the assessment roll for Beam Avenue Storm Sewer Improvement No. 70 -5
(Area involved County Road D, White Bear Avenue, Beam Avenue, Kennard
Street extended.)
b. Village Engineer Collier explained the specifics of the proposed
assessment roll and that all the property is zoned commercial and a
rate of $.04 per square foot is used.
c. Mayor Axdahl called for any persons who wished to be heard or had
questions to be answered. No one wished to be heard.
d. Mayor Axdahl called for formal objections. None were heard.
e. Councilman Greavu introduced the following resolution and moved its
adoption: (adopting assessment roll pending adjustments)

WHEREAS, pursuant to proper notice duly given as required by law,
the Village Council has met and heard and passed upon all objections to
the proposed assessment for the construction of Storm Sewer in an area
of County Road D, White Bear Avenue, Beam Avenue and Kennard Street
extended as described in the files of the Village Clerk as Beam Avenue
Improvement No. 70 -5 and has amended such proposed assessment as it
deems just,

NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute
the special assessment against the land named therein, and each tract
of land therein included is hereby found to be benefited by the pro-
posed improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments ex-
tending over a period of nineteen (19) years, the first of the install-
ments to be payable on or after the first Monday in January, 1973 and
shall bear interest at the rate of seven (7) percent per annum from
the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from the
date of this resolution until December 31, 1973. To each subsequent
installment when due shall be added interest for one year on all un-
paid installments.
3. It is hereby declared to be the intention of the Council to reim-
burse itself in the future for the portion of the cost of this improve-
ment paid for from municipal funds by levying additional assessments,
on notice and hearing as provided for the assessments herein made, upon
any properties abutting on the improvement but not made, upon any proper-
ties abutting on the improvement but not herein assessed for the improve -
ment when changed conditions relating to such properties make such
assessment feasible.
4. To the extent that this improvement benefits non - abutting properties
which may be served by the improvement when one or more later extensions
or improvements are made, but which are not herein assessed therefore,
it is hereby declared to be the intention of the Council, as authorized
by Minnesota Statutes Section 420.051, to reimburse the Village by add-
ing any portion of the cost so paid to the assessments levied for any of
such later extension or improvements.
5. The Clerk shall forthwith transmit a certified duplicate of this
assessment to the County Auditor to be extended on the property tax
lists of the County, and such assessments shall be collected and paid
over in the same manner as other municipal taxes.

2. Project No. 69 -1 Clarence Street Water - 7:45 P.M.
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for the Clarence Street Water Improvement No. 69 -1. (Clar-
ence Street from Frost Avenue to Skillman Avenue)
b. Village Engineer Collier explained the specifics of the proposed assess-
ment roll and how the rates were computed. The rates for this assessment are:
Water Main $7.99 per front foot
Service "Connection.:; $199.33 each

Mr. Collier stated the property the village Garage is located on is owned
by the Soo Line Railroad. Staff recommends the assessment for
that property be deferred.
c. Mayor Axdahl called for any persons who wished to be heard or had quest-
ions to be answered. The following were heard:

d. Mayor Axdahl called for formal objections. None were heard.
e. Councilman Greavu moved to defer the assessments on the property owned

e. Councilman Greavu introduced the following resolution and moved its
adoption:

3. Project No. 69 -15 Kohlman Lane Sewer and Lift Station - -8:00 P.M.
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment rolls for Improvement No. 69 -15, Kohlman Lane Sanitary Sewer and
Lift Station.
b. Village Engineer Collier explained the area to be assessed and reviewed
the assessments.
c. Mayor Axdahl asked if any persons wished to speak in regards to the assess-
ments. The following were heard:

as described in the files of the Village Clerk as Kohlman Lane Improvement
No. 69 -15 and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute
the special assessment against the land named therein, and each tract
of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.

a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for the Edgemont, Kingston, Arkwright Water Improvement No.
71 -7.

b. Village Engineer Collier explained the specifics of the proposed assess-
ment roll and how the rates were computed. The rates for this assessment
are:

c. Mayor Axdahl called for any persons who wished to be heard or had quest-
ions to be answered. The following were heard:

posed assessment for the construction of Water Main, Service Connections on
Edgemont, Kingston, Arkwright as described in the files of the Village Clerk
as Improvement No. 71 -7 and has amended such proposed assessment as it deems
just,

MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached

5. Project No. 70 -16 Eleventh Avenue Water and Sanitary Sewer - 9:00 P.M.
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for Water and Sanitary Sewer construction on Eleventh Avenue
from Ariel Street to White Bear Avenue.
b. Village Engineer Collier explained the specifics of the improvement and
how the assessments were computed. The assessment rates have been established
as follows:

c. Mayor Axdahl asked if any persons wshed:to be heard or had questions to
be answered. Several residents of the area spoke.
d. Mayor Axdahl called for formal objections. None were registered.
e. Councilman Haugan introduced the following resolution and moved its
adoption:

WHEREAS, pursuant to proper notice duly given as required by law, the
Village Council has met and heard and passed upon all objections to the pro-
posed assessment for the construction of Sanitary Sewer Mains, Water Mains,
Sewer Connections on Eleventh Avenue from Ariel Street to White Bear Avenue,
as described in the files of the Village Clerk as Eleventh Avenue Improvement
No. 70 -16 and has amended such proposed assessment as it deems just.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute

Mayor Axdahl stated those persons who wish to request an adjustment or.a deferment
on their assessment, should fill out the Adjustment and Deferment Form and return
it to the Village offices, no later than Tuesday, September 12, 1972. Council will
consider the applications at the regular meeting of September 14, 1972.
6. Project No. 69 -19 Lark Avenue Improvements - 9:30 P.M.
a. Mayor Axdahl convened the meeting for a public hearing on adopting the
assessment roll for Lark Avenue Improvement No. 69 -19 (Storm and Sanitary
Sewer, Water, Curb and Gutter, Street Grading and Paving. (Lark Avenue from
Hazelwood Street to Birmingham Street.)
b. Village Engineer Collier stated he had been negotiating with the contract-
or. The contractor is reducing the price for the construction of the street
by approximately $1.50 per foot.
d. Village Engineer Collier explained the specifics of the proposed assess-
ment roll and how the rates were computed. The rates for this assessment are:

Village Council has met and heard and passed upon all objections to the pro-
posed assessment for the construction of Curb and Gutter, Street Paving and
Grading on Lark Avenue from Hazelwood Street to Birmingham Street as describ-
ed in the files of the Village Clerk as Lark Avenue Improvement No. 69 -19
and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute
the special assessment against the land named therein, and each tract
of land therein included is hereby found to be benefited by the pro-
posed improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments ex-

proposed assessment for the construction of Storm Sewer, Sanitary Sewer
mains, Water mains, Water and Sewer connections on Lark Avenue from Hazelwood
Street to Birmingham Street as described in the files of the Village Clerk as
Lark Avenue Improvement No. 69 -19 and has amended such proposed assessment
as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA:

assessment: roll for Gervais Avenue Sanitary Sewer Imp. No. 70 -2. Gervais
Avenue from Kennard Street approximately 950 feet east.
b. Village Engineer Collier explained the specifics of the proposed
assessment roll and how the rates were computed. The rates for this
assessment are:
Sanitary Sewer $6.10 per foot
Service Connection $293.25 each
c. Mayor Axdahl called for any persons who wished to be heard or had
questions to be answered. No one wished to be heard.
d. Mayor Axdahl called for formal objections. None were heard.
e. Councilman Wiegert introduced the following resolution and moved its
adoption: Adopting assessment roll pending adjustments.

Village Council has met and heard and passed upon all objections to the
proposed assessment for the construction of Sanitary Sewer mains, and
services on Gervais Avenue from Kennard Street approximately 950 feet
east as described in the files of the Village Clerk as Gervais Avenue
Improvement No. 70 -2 and has amended such proposed assessment as it
deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute the
special assessment against the land named therein, and each tract of
land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of nineteen (19) years, the first of the
installments to be payable on or after the first Monday in January,
1973 and shall bear interest at the rate of seven (7) percent per
annum from the date of the adoption of this assessment resolution.
To the first installment shall be added interest on the entire assess-
ment from the date of this resolution until December 31, 1973. To
subsequent installment when due shall be added interest for one year
on all unpaid installments.

3. It is hereby declared to be the intention of the Council to
reimburse itself in the future for the portion of the cost of this
improvement paid for from municipal funds by levying additional assess-
- ments, on notice and hearing as provided for the assessments herein
made, upon any properties abutting on the improvement but not made,
upon any properties abutting on the improvement but not herein assessed
for the improvement, when changed conditions relating to such properties
make such assessment feasible.
4. To the extent that this improvement benefits non - abutting properties
which may be served by the improvement when one or more later eMensions
or improvements are made, but which are not herein assessed therefore,
it is herebychclared to be the intention of the Council, as authorized
by Minnesota Statutes Section 420.051, to reimburse the Village by
adding any portion of the cost so paid to the assessments levied
for any of such later extension or improvements.
5. The Clerk shall forthwith transmit a certified duplicate of this
assessment to the County Auditor to be extended on the property
tax lists of the County, and such assessments shall be collected and
paid over inthe same manner as other municipal taxes.

f. Mayor Axdahl again stated those persons who wish to request an adjust -
mentor a deferment on their assessment, should fill out the Adjustment and
Deferment Form and return it to the Village offices, no later than
Tuesday, September 12, 1972, Council will consider the applications at
the regular meeting of September 14, 1972.
