TUESDAY, AUGUST 31, 1971 COUNCIL CHAMBERS, MUNICIPAL BUILDING MEETING NO. 71 - 34 A. CALL TO ORDER A special meeting of the Village Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:37 P.M. by Mayor Axdahl. B. ROLL CALL Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Arrived at 7:50 P.M. Harald L. Haugan, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present C. PUBLIC HEARINGS - Adoption of Assessment Rolls. 1. Storm and Sanitary Sewer, Water, Concrete Curb and Gutter, and Street Grading and Paving - Cope Avenue - Hazelwood to White Bear Avenue (7:30 P.M.) Imp. No. 69 -23. a. Mayor Axdahl convened the meeting for a public hearing on adopting the assessment roll for Cope Avenue Improvement No. 69 -23 (Storm and Sanitary Sewer, Water, Concrete Curb and Gutter, Street Grading and Paving. Cope Avenue from Hazelwood Street to White Bear Avenue). The Clerk read the notice of hearing along with the date of publication. b. Village Engineer Collier explained the specifics of the proposed assessment roll and how the rates were computed. The rates for this assessment are: Streets - Commercial $ 40.365 per foot Residential 26.91 per foot Sanitary Sewer 10.05 per foot Storm Sewer - Commercial 0.04 per square foot Residential 0.02 per square foot Water Main 8.75 per foot Water Connection Commercial 416.11 each (1 1/2 ") Residential 287.00 each (1 ") Sanitary Sewer Connection Commercial 200.00 (6 ") Residential 150.00 (4 ") Driveways 9.00 per square yard. c. Mayor Axdahl called for any persons who wished to be heard or had questions to be answered. No one wished to be heard. - 1 - 8/31 d.' Mayor Axdahl called for formal objections. The following objectors were heard: Mr. J. Peterson, John J. Kirby Law Firm, representing Mr, and Mrs. R. Ristrom, 1633 Lark Avenue Received a letter objecting to the assessment from Mr. Frank Bradac. James Regrigeration Co. Mr. Gene Hawkinson, 1665 Lark Avenue John Kavanagh, Kavanagh Realty, 597 E. Seventh Street representing Meister Land Development and Mr. Madigan. e. Mayor Axdahl stated those persons who wish to request an adjust- ment or a deferment on their assessment, should fill out the Adjust- ment and Deferment Form and return it to the Village offic<s, no later than Tuesday, September 14, 1971. Council will consider the applications at the regular meeting of September 16, 1971. f. Councilman Greavu introduced the following resolution and moved its adoption: Adopting assessment roll pending adjustments. 71 -8 - 187 WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the construction of Concrete Curb and Gutter, Street Paving and Grading on Cope Avenue from Hazelwood Street to White Bear Avenue as described in the files of the Village Clerk as Cope Avenue Improvement No. 69 -23 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended,a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the land named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual install- ments extending over a period of nine (9) years, the first of the installments to be payable on or after the first Monday in January, 1972 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assess- ment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1972. To each subsequent installment when due shall be added interest for one year on all unpaid installments. - 2 - 8/31 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improve- ment, when changed conditions relating to such properties make such assessment feasible. 4. To the extend that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the Village by adding, any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Haugan. Ayes - all. g. Councilman Greavu introduced the following resolution and moved its adoption: Adopting Assessment Roll pending adjustments; Storm and Sanitary Sewer, Water. WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the construction of Storm Sewer, Sanitary Sewer mains, Water mains, Water and sewer connections on Cope Avenue from Hazelwood Street to White Bear Avenue, as described in the files of the Village Clerk as Cope Avenue Improvement No. 69 -23 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named `therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual install- ments extending over a period of nineteen (19) years, the first of the installments to be payable on or after the first Monday in January, 1972 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. Seconded by Councilman Haugan. Ayes - all. 2. Sanitary Sewer Area Assessment - County Road C - Linden Lane Imp ;, No. 68 - SAS - 1 (8:00 P.M.) a. Mayor Axdahl convened the meeting for a public hearing to adopt the assessment roll for Sanitary Sewer Area Assessment, County Road C - Lind2n Lane Improvement No. 68 - SAS - 1. The Clerk read the notice of hearing along with the date of publication. b. Village Engineer Collier explained the specifics of the assessment roll and how the assessment rates were computed. The rates for area assessments had been established at a previous hearing. Residential $200.00 per lot 750.00 per acre c. Mayor Axdahl called for any persons who wished to be heard or have any questions answered. d. Mayor Axdahl called for formal objections. The following objectors were heard: Elmer Stanke, 910 E. County Road C Paul H. Stanke, 930 E. County Road C, represented by his son Elmer Stanke Elmer L. Schlattman, 2686 Keller Parkway Dr. George Schaffhausen, 3 Raccoon Road Rudolpho Gonzalez, Keller Parkway - 4 - 8/31 Donald McClellan, 961 E. County Road C William Howard, 931 E. County Road C e. Mayor Axdahl stated application forms for Adjustment or Deferment of the assessments are available. If any persons wish to fill the forms out and return them to the Village offices before September 14, 1971, they will be considered by the Council at the regular meeting of September 16, 1971. f. Councilman Greavu: introduced the following resolution and moved its adoption: Adopting assessment roll pending adjustments. 71 -8 -189 WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the construction of Sanitary Sewer Area Assessment as described in the files of the Village Clerk as County Road C -- Linden Lane Improvement No. 68 - SAS - 1, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual install- ments extending over a period of eighteen (18) years, the first of the installments to be payable on or after the first Monday in January, 1972 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3.
