CALL TO ORDER A special meeting of the Council Chambers, by Mayor Axdahl. B. ROLL CALL the Village Council of Maplewood, Minnesota was held in Municipal Building and was called to order at 7:36 P.M. Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Present Harald L. Haugan, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present C. PUBLIC HEARINGS - Adoption of Assessment Rolls 1. Street Improvement - Lydia Avenue - McIZnight to Furness (7:30 P.M.) a. Mayor Axdahl convened the meeting for a public hearing on the adoption of the Assessment Roll for Lydia Avenue Improvement No. 69 -8. The Clerk read the notice of hearing along with the public - ation dates. b. Village Engineer Collier explained the specifics of the proposed assessments. The rates of this assessment are: Street $ 14.05 per foot Driveway 5.75 per foot of width Water Connection 176.23 each Sewer Connection 365.54 each c. Mayor Axdahl called for persons who wished to be heard. A gentleman from the area questioned if Mr. Tilsen was to pay for this. Staff stated that to their knowledge, Mr. Tilsen had money in escrow to pay for this improvement, but that they had nothing in writing. d. Mayor Axdahl called for formal objections. None were heard. e. Councilman Greavu introduced the following resolution and moved its adoption: (Adopting the Assessment Rolls 6 €;'Imp. No. 69 -8) 71 - 8 - 183 WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the construction of sanitary sewer and appurtenances as described in the files of the Village Clerk as Street Improvement No. 69 -8 and has amended such proposed assessment as it deems just, - 1 - 8/30 NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is here- by found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual install- ments extending over a period of nine (9) years, the first of the installments to be payable on or after the first Monday in January, 1972 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1972. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the Village by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Wiegert. Ayes - all. Representatives from Netnorlin arrived late for the 7:30 P.M. hearing and requested that they have their questions answered. Is the cost per foot on the street assessment in addition to what they were charged last year? (Approximately $3.50 a foot) Staff stated it was. What were the street assessment cost that were levied last year? Approximately $15.00 per foot. - 2 - 8/30 Netnorlin did not wish to file an objection to the Assessment Roll for Imp. 69 -8. 2. Storm Sewer Improvement - Robert Tilsens Maplewood Heights No. 7 (8:00 P.M.) A. Mayor Axdahl convened the meeting for a public hearing to adopt the assessment rolls for Robert Tilsen's Maplewood Heights No. 7 Storm Sewer Improvement No. 71 -3. The Clerk read the notice of hearing along with the publication dates. b. Village Engineer Collier explained the specifics of the proposed assessments. The rate of this assessment have been established at $.02 per square foot. c. Mayor Axdahl called for any persons who wished to be heard. None were heard d. Mayor Axdahl called for formal objections. None were heard. e. Councilman Haugan introduced the following resolution and moved its adoption: (adopting assessment roll) 71 -8 -184 WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the construction of Storm Sewer as described in the files of the Village Clerk as Storm Sewer Improve- ment No. 71 -3 and has amended such proposed assessment as it deems just. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended,.a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Mayor Axdahl convened the meeting for a public hearing on adopting the assessment roll for Edgerton Street - (Skillman Avenue to County Road B) Water Improvement No. 69 -24. The Clerk read the notice of hearing along with the publication dates. b. Village Engineer Collier explained the specifics of the proposed assessment and also how the rates_.. were computed. The rates for this assessment are $8.71 per foot and water service connection $160.50. c. Mayor Axdahl called for any persons who wished to be heard. No one was in attendance at the meeting. d. Mayor Axdahl called for formal objections. The Clerk read a letter received from Mr. Hartford Langer, 2674 Edgerton Street, stating he did not intend to pay for Lot 14, Thiedes Edgerton Villas because half of the property is under water. e. Councilman Wiegert introduced the following resolution and moved its adoption: (Adopting the assessment roll as amended) 71 -8- 185 WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard and passed upon all objections to the proposed assessment for the construction of Water mains, service connections , appurtenances as described in the files of the Village Clerk as Edgerton Street Water Imp; No. 69 -24 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. - 4 - 8/30 2..
