A. CALL TO ORDER
A special meeting of the Village Council of Maplewood, Minnesota was held in
the Council Chambers, Municipal Building and was called to order at 7:35 P.M.
by Mayor Axdahl.

1. Deferred Assessments
a. Mayor Axdahl stated the public hearings on the deferred assessments
were held on August 12, 1971 and adjourned until August 26, 1971 to ''allow
persons to file, in writing for continuance of their deferred assessments.
b. Councilman Greavu moved that those deferred assessments that are
denied would be held over to a meeting in December, 1971 for final
decision and then levied.
Seconded by Councilman Haugan.

c. Village Engineer Collier presented a list of the property owners that
filed the form for continuing the deferred assessments.
d. Mayor Axdahl stated each application would be considered individually
by Sanitary Sewer Improvement Number.
2. Sanitary Sewer No. 1
a. Mrs. Lenora McArdle, 2080 Prosperity Road. Councilman Greavu moved
to deny the request of Mrs. Lenora McArdle, 2080 Propserity Avenue to
continue the deferred assessment, Code No. 57 6810 061 06.

Council of Maplewood, Minnesota adopted September. 1, 1960, the
special assessments for the construction of Sanitary Sewer No. 2,
were levied and deferred against property described as Code No.
57 3400 151 00.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
MAPLEWOOD, MINNESOTA, that the deferred assessments for Sanitary

Code No. 57 3400 151 00 be, and the same thereby are, canceled.

7. Balance of Deferred Assessments.
a. Councilwoman Olson moved that the Council intends to assess the
balance of the deferred sanitary sewer assessments No. 1, 2, 3, 4, and
5 ( the persons who were notified but did not make application for
continuance) at the meeting in December, 1971.

b. Councilwoman Olson introduced the following resolution and its
adoption requesting the Ramsey County Auditor to levy deferred assess-
ments for a period of time:

WHEREAS, it appears that the County Auditor has expressed
reluctance in spreading the assessments which had previously been
deferred and collecting them over a term of years as it would work
an extreme hardship upon the property owners involved to require a
lump sum payment; and
WHEREAS, the Village of Maplewood is not equipped to make
separate cash collections over a term of years.
BE IT RESOLVED, That the Village Attorney is hereby instructed
and requested to convey and work out some means with the County
Auditor to accept and spread and collect the assessments, commonly
called deferred assessments over a term of years, or however within
the statutory limits.
BE IT FURTHER RESOLVED, That the Village Attorney deliver a copy
of this Resolution to the County Auditor of Ramsey County, Minnesota.

C. Councilman Haugan moved to authorize the Village Attorney to negotiate
with the Ramsey County Auditor regarding levying deferred assessments.

Lydia Avenue Storm Sewer Project 71 -8
a. Village Engineer Collier stated bids had been received Tuesday,
August 17, 1971. There were four bidders. The apparent lowest
bidder was Julian M. Johnson Construction Co. of Minneapolis in
the amount of $23,756.55. Staff recommends awarding the bid to the
apparent low bidder.
b. Councilwoman Olson introduced the following resolution and moved
its adoption:

BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA,
that the bid of Julian M. Johnson Construction Company of Minne-
apolis in the amount of $23,756.55 is the lowest responsible
bid for the construction of Lydia Avenue Storm Sewer Project
71 -8, and
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby
authorized and directed to enter into a contract with said
bidder for and on behalf of the Village.

C. Edgerton School Playground Water Improvement Project 71 -10
1. Village Engineer Collier stated the 3 projects were advertised
.at the same time and the bids were of the 3 projects together.
Three bids were received on August 23, 1971. The apparent low
bidder was Erwin Montgomery Construction Company in the amount
of $50,949.00. Staff recommends awarding the bid for the 3 projects
to the lowest bidder. Staff requests authorization to negotiate
for the sodding and bituminous surface replacement for a more
favorable price and that the two items be deleted from the bid
contract.
2. Councilman Haugan introduced the following resolution and moved
its adoption:

BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD,
MINNESOTA, that the bid of Erwin Montgomery Construction
Company in the amount of $50,949.00 is the lowest
responsible bid for the construction of:
A. Ripley Avenue and Furness Street water main and
connections - Project No. %6_wg $13,587.50

B. Main extensions and water connections on Arkwright,
Edgemont, Kingston and Larpenteur - Project No.
71 -7 $28,859.00
C. Water main installation to Edgerton School Play-

BE IT FURTHER RESOLVED, that the quantities and prices
for sodding and bituminous surface replacement be deleted
from the contract and the Village Engineer be authorized to
negotiate for a more favorable price, and
BE IT FURTHER RESOLVED, that the Mayor and Clerk are
hereby authorized and directed to enter into a contract with
said bidder for and on behalf of the Village.

3. South Frontage Road (TH 36 and Private property easement) Water
Improvement Project 70 -8
a. Village Engineer Collier stated bids had been received Monday,
August 23, 1971. The lowest apparent bidder was Erwin Montgomery
Construction Company. Staff recommends awarding the bid to the
lowest bidder and, also, requests authorization to delete sodding
and bituminous surface replacement from the contract. Staff stated
they can receive a more favorable price by negotiating the items
separately.
b. Councilwoman Olson introduced the following resolution and moved
its adoption:

BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA,

of water mains on South frontage road (T.H. 36) and private
property (easement) Project No. 70 -8, and
BE IT FURTHER RESOLVED, that the quantities and prices for

contract and the Village Engineer be authorized to negotiate for
a more favorable price, and
BE IT FURTHER RESOLVED, that the Mayor and Clerk are hereby
authorized and directed to enter into a contract with said bidder
for and on behalf of the Village.

1. Resolution Consolidating as Single Improvement Sanitary Sewer Projects
Nos. 70 -2 and 71 -2.
a. Manager Miller requested Council pass a resolution consolidating

as a single improvement Sanitary Sewer Project 70 -2 (Gervais Avenue
From Kennard Street to White Bear Avenue)and Sanitary Sewer Project
71 -2 (Van Dyke Avenue from Kohlman Avenue to Gervais Avenue and on
Gervais Avenue from White Bear Avenue to 300 feet west of Southlawn
extended). The fiscal agents, Juran and Moody, Inc. have recommended
this be done for bonding purposes.
b. Councilman Haugan introduced the following resolution and moved
its adoption:

RESOLUTION CONSOLIDATING AS SINGLE
IMPROVEMENT SANITARY SEWER PROJECTS
NOS. 71 -2 AND 70 -2
WHEREAS:
A. Sanitary Sewer Project Nos. 70 -2 and 71 -2 were initially
intended to constitute a single project covering substantially
the same general area covered collectively by the two projects;
B. After a preliminary investigation into the matter, the
Village Council of the Village of Maplewood determined that said
improvements could be made more economically by dividing the
project into two separate projects;
C. From an engineering standpoint said projects should be
viewed as a single intergrated sanitary sewer improvement
program for the affected area;
D. Construction contracts for the two sanitary sewer projects
will have been let within the same year;
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Maplewood that said Sanitary Sewer Projects No. 70 -2
and 71 -2 are hereby consolidated as a single improvement for
purposes of financing the same.
Seconded by Councilman Greavu. Ayes - all.
F. STAFF PRESENTATIONS
1. Manager Miller stated he had requested the Village's fiscal agent appear
tonight to give a short explanation of the effects the past Village bonding
is going to have in the future.
Mr. Bob Sander, Juran and Moody explained about bonding and its procedures.
He further stated that there were three ways for the Village to repay money
it borrows, from revenues, assessments, General Obligation taxes or a
combination thereof.
Council stated they wished to have a "shirt 'sleeve" session with the bonding
consultant, attorney and engineer to discuss bonding and assessment procedures.
Staff will arrange the time schedule for this meeting.
2. Village Attorney Lais stated he had received a call from Assistant County

Attorney Gregg in regard to Beam Avenue ponding. The County Attorney is going
to submit a report to the Ramsey County Board of Commissioners on Monday at
their meeting.
Councilwoman Olson, Mr. Hite and Mr. Collier are going to attend the Ramsey
County Board meeting Monday morning.
3. Councilman Wiegert submitted a letter regarding Eldridge Avenue
Improvement.
Councilwoman Olson moved to reconsider the Au- arding of Bids for the Eldridge.
Avenue Improvement on September 2, 1971.
Seconded by Councilman Haugan. Ayes - all.
4. Mr. Miller stated the Gladstone Fire Department requested a beer and
set up license for Saturday night for their dance at Aldrich Arena.
Councilman Greavu moved to grant a 3.2 beer and set up permit to the
Gladstone Fire Department for Saturday, August 28, 1971 at Aldrich Arena.
Seconded by Councilman Haugan.
