Prosperity Road (E) ADJOURN;iENT MINUTES OF MAPLEWOOD VILLAGE COUNCIL 7:30 P.M., THURSDAY, AUGUST 12, 1971 COUNCIL CHAMBERS, MUNICIPAL BUILDING MEETING NO. 71 -30 A. CALL TO ORDER A special meeting of the Village Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:37 P.M. by Mayor Axdahl. B. ROLL CALL Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Arrived at 7:43 P.M. Harald L. Haugan, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present C. PUBLIC HEARINGS 1. Sanitary Sewer Improvement - Holloway Avenue (7:30 P.M.) a. Forest Green Development Area 1. Mayor Axdahl convened the meeting for a public hearing for con - struction of sanitary sewer mains on Holloway Avenue from Beebe Road extended to 100 feet East of McKnight Road. The Clerk read the notice of hearing with the publication dates. 2. Consulting Engineer Kuusisto explained the specifics of the pro- posed improvement. The estimated cost of said improvement is $55,200. The construction of the sanitary sewer would result in the elimination of the lift station. 3. Village Engineer Collier presented a report on various methods of assessing the proposed project and answered questions from the persons present. 4. Councilwoman Olson posed the following question to Council: "this lift station is being repaired and replaced, the fact that 20 years in the future the cost would be $103,000 and that we have;:ibeen paying into the sewer maintenance fund for the lift station in the area; I would like to ask Council if they will consider that this be under general obligation rather than assess the people an area systems charge, and asked if there is money in the sewer maintenance fund to offset this, because certainly the whole fund (sewer maintenance fund) will benefit from not having this kind of cost. 5. Manager Miller stated that rather than coming out of sewer funds, it would have to come out of general obligation. In the future the Council will have to look into increasing of the sewer rental bills, and at that time, projects such as this will have to be taken into account. - 1 - 8/12 6. Mayor Axdahl stated the public hearing on the Forest Green Area Improvements, which is in connection with the Holloway Avenue Sanitary Sewer Improvement, was held on July 8, 1971, and decision delayed un- til the meeting of August 12, 1971. 7. Councilwoman Olson now being served and will benefit. and that the nronerties that are now to inR of the lift station shall be borne by eeneral oblieation in addit- to Seconded by Councilman Haugan. Ayes - all. *see page 7 and 8 for further clarification of the motion. 8. Councilwoman Olson introduced the following resolution and moved its adoption: 71 - 8 - 168 WHEREAS, after due notice of public hearings pertaining to: 1. The construction of watermains and appurtenances on Ripley Avenue from Furness Street to Ruth Street and on Beebe Road ex- tended from Ripley Street to Holloway and on Holloway from Beebe Road to Furness Street. 2. Street construction on Beebe Road from Larpenteur to Holloway; 3. Sanitary sewer on Holloway from approximately 100 feet east on McKnight Road to the vicinity of North St. Paul Road and on North St. Paul Road from Holloway to VanDyke Street and on Beebe Road extended from Ripley Street to Holloway Avenue. . 4. Storm sewers to service the area between Holloway Avenue and Ripley Street from Furness Street to Beebe Road extended and along Beebe Road extended from Ripley to Holloway and along Holloway from Beebe Road to North St. Paul Road. a hearing on the above improvements in accordance with the notice duly given was duly held on July 8, 1971, and August 12, 1971, and the Council has heard all persons desiring to be heard on this matter and has fully considered the same; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. That it is advisable, expedient and necessary that the Village of Maplewood construct the above improvements as described on the notices of hearing thereon and orders the same to be made. 2. The Village Engineer is designated engineer for this improve- - 2 - 8/12 ment and is hereby directed to prepare final plans and specifications for the making of said improvement. 3. This improvement is hereby designated as Project #71 -17. Seconded by Councilman Haugan. Ayes - all. 2. Water Improvement - Londin Lane, Maplewood Drive a. Mayor Axdahl convened the meeting for a public hearing on the construct- ion of water mains in the following described area: Londin Lane from McKnight Road to Lower Afton Road thence southerly to Mailand Road extended thence easterly on Mailand Road and Mailand Road extended to McKnight Road. The Clerk read the notice of hearing along with the publication dates. b. Village Engineer Collier presented the specifics of the proposed im- provement and answered questions from the Council and the audience. Mr. Collier stated that any water mains constructed within the area proposed for Planned Unit Development will be constructed and cost borne by the developer. The estimated total cost of the improvement is $144,396. c. Mayor Axdahl called for proponents. None were heard. d. Mayor Axdahl called for formal objections. The following objector was heard: Mary Jane Miklos, 1229 W. Minnehaha e. Mayor Axdahl closed the public hearing. f. Councilman Wiegert moved to delay dec to allow for additional testimonv to Seconded by Councilman Greavu. Ayes - all. 3. Deferred Assessments: a. Sanitary Sewer No. I 1. Mayor Axdahl convened the meeting for a public hearing on deferred assessments of Sanitary Sewer No. 1. The Clerk read the notice of hearing along with the publication dates. 2. Village Engineer Collier explained the area covered by Sanitary Sewer Improvement 1. Notices have been sent out to all persons having deferments. He stated he has received two letters requesting contin- uation of their deferments. 3. Council stated they would consider the persons who were in the audience at this time and to hold the letters until later. - 3 - 8/12 4. Mayor Axdahl called for persons who wished to be heard. The following persons requested continuation of their deferments: Ben Belisle, 2237 German Street Mrs. Henry Olson, 1152 E. County Road B Harold Schmidt, 1745 E. Frost Avenue, representing Meister Land Development Mrs. Munson, 2135 E. Larpenteur Paul Yocum, representing Gethsemane Lutheran Church Lena Kunze, 2341 Stillwater Avenue Willard Arndt, 3030 Woodbridge Robert Steingraber, 2648 E. Minnehaha Mr. Cullifer, 2335 Stillwater Road Raymond Kaeder, 1085 Mary Mayor Axdahl stated persons wishing to request consideration of their defered assessments should fill out a Deferred Assessment Form and return it to the Village Office. Mayor Axdahl adjourned the public hearing. Councilman Wiegert moved assessments until August in writing. Seconded by Councilman Greavu. b. Sanitary Sewer No. 2 (8:45 P.M.) lic Ayes - all. 1. Mayor Axdahl convened the meeting for a public hearing on the Deferred Assessments for Sanitary Sewer Improvement No. 2. The Clerk read the notice of hearing along with the publication dates. 2. Village Engineer Collier explained the area this assessment involved. 3. Mayor Axdahl called for persons who wished to be heard. The follow- ing persons requested continuation of their assessments: Dick Lofgren, 2661 Mayer Lane 4. Mayor Axdahl stated persons desiring consideration of their defer- red assessments should fill out a Deferred Assessment form and return it to the Village Offices. 5. Mayor Axdahl adjourned the public hearing. 6. Councilman Greavu moved to adjourn the public hearing until the Meeting of August 26, 1971 to allow persons to file testimony in writing. Seconded by Councilman Wiegert. c. Sanitary Sewer No. 3 (9:15 P.M.) - 4 - 8/12 Ayes - all. 1. Mayor Axdahl convened the meeting for a public hearing on the Deferred Assessments for Sanitary Sewer Improvement No. 3. The Clerk read the notice of hearing along with the publication dates. 2. Village Engineer Collier explained the area this assessment in- volved. The amount of deferred assessments are approximately $46,000. 3. Mayor Axdahl called for persons who wished to be heard. The following persons requested continuation of their assessments: Ed Masloski, 1915 Desoto Street Val Knabe, 1760 Desoto Street John McMillan, representing Mrs. Mathilda Tschida, 1717 Edgerton St. J. S. Buelow, 2020 Arcade Albin Oscarson, 1775 DeSoto St. Herb Toenjes, 1966 McMenemy Road 4. Mayor Axdahl stated persons desiring consideration of their defer- red assessments should fill out a Deferred Assessment -form and return it to the Village Offices. 5. Mayor Axdahl adjourned the public hearing. 6. Councilman Haugan moved to writing. Seconded by Councilman Wiegert. Ayes - all. d. Sanitary Sewer No. 4 (9:45 P.M.) 1. Mayor Axdahl convened the meeting for a public hearing on the Deferred Assessments for Sanitary Sewer Improvement No. 4. The Clerk read the notice of hearing along with the publication dates. 2. Village Engineer Collier explained the area this assessment in- volved. The amount of deferred assessments are approximately $420.00; 3. Mayor Axdahl called for persons who wished to be heard. The follow- ing person requested continuation of their assessments: Bob Arrigoni, 2152 Prosperity Road 4. Mayor Axdahl stated persons desiring consideration of their defer- red assessments should fill out a Deferred Assessment form and return it to the Village Offices. 5. Mayor Axdahl adjourned the public hearing. 6. Councilman Greavu moved to adjourn the public hearing until the Meeting of August 26, 1971 to allow persons to file testimony in writing. Seconded by Councilman Wiegert. Ayes - all. - 5 - 8/12 e. Sanitary Sewer No. 5 (10:00 P.M.) 1. Mayor Axdahl convened the meeting for a public hearing on the Deferred Assessments for Sanitary Sewer Improvement No. 5. The Clerk read the notice of hearing along with the publication dates. 2. Village Engineer Collier explained the area this assessment in- volved. 3. Manager Miller stated the engineering office had forms that can be filled out if anyone wishes to have his deferment continued. Council has,tonite,been closing the hearings and continuing discussion until the meeting of August 26, 1971, and Council has requested persons re- turn the forms to Village Offices within one week for review by staff before being brought before the Council. 4. Mayor Axdahl called for persons who wished to be heard at this time. The following persons were heard: Dr. F. A. Bowman, 2550 E. Minnehaha Avenue Walter Sitko, 359 E. Lark D. G. Kimble, 679 Ferndale Bernard Mehr, 687 Ferndale 5. Mayor Axdahl adjourned the public hearing, 6. Councilman Wiegert moved to adjourn the public h Meeting of August 26, 1971 to allow persons to file writing. Seconded by Councilman Greavu. Ayes - all. D. UNFINISHED BUSINESS 1. Cope Avenue a. Manager Miller requested authority to proceed with a feasibility to continue Cope Avenue, east of White Bear Avenue to Ariel Street. North St. Paul is considering continuing Cope Avenue from Ariel Street to McKnight Road. b. Councilman Haugan introduced the following resolution and moved its adoption: 71 -8- 169 WHEREAS, the Village Council has determined that it is necessary and expedient that improvements be made to Cope Avenue from White Bear Avenue to Ariel Street, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA, that the above described improvement to Cope Avenue is hereby referred to the Village Engineer, and he is instructed to report to the Council will all convenient speed advising the Council in a preliminary - 6 - 8/12 way as to whether the proposed improvement is feasible and should best be made as proposed and the estimated cost of the improvement as recom- mended. Seconded by Councilman Greavu. Ayes - all. 2. Prosperity Road a. Village Engineer Collier stated Ramsey County has informed the Village that they are unable to provide signalization at County Road B and White Bear Avenue at this time because of lack of funds. Staff requests Council consider requesting Ramsey County to proceed with signalization, as soon as possible, and to close Prosperity Road at White Bear Avenue. b. Councilwoman Olson introduced the following resolution and moved its adoption* 9 71 -8 -170 WHEREAS, it is necessary to close Prosperity Avenue at White Bear Avenue, and WHEREAS, it is now necessary to redirect traffic, and WHEREAS, Ramsey County has indicated they are unable to provide immediate signalization at White Bear Avenue and County Road "B ", NOW, THEREFORE, BE IT RESOLVED THAT THE VILLAGE OF MAPLEWOOD, MINN- ESOTA requests Ramsey County to: (1) Close Prosperity Avenue at White Bear; allowing a right turn lane *amended by motion: Meeting No. 71 -31. (2) Take necessary and appropriate action to redirect traffic; (3) Install signalization at White Bear Avenue and County Road "B" as soon as possible; (4) Investigate the possibility of interim traffic control devices at White Bear Avenue and County Road "B ". Seconded by Councilman Greavu. Ayes - all. C. PUBLIC HEARINGS (continued) 1. Sanitary Sewer Improvement - Forest Green Area (continued) a. Staff requested clarification of the motion approving the Sanitary Sewer Improvement for the Forest Green area. Was it Council's intent to approve the Holloway Avenue Sewer Improvement plus the Forest Green Area improvements, the public hearing of which was held on July 8, 1971 and continued? b. Manager Miller read the notice of hearing for the Forest Green Area improvements held on July 8, 1971. - 7 - 8/12 c. Village Engineer Collier reviewed the proposed resolution approving the Forest Green Area Improvements and the Holloway Avenue Sanitary Sewei( Improvement. j d. Council stated it was their intent the entire project be approved. (As stated in resolution No. 71 -8 -168 under Item C -1) E. PRESENTATIONS Mayor Axdahl stated there will be a Ramsey County League meeting regarding the current tax bill, August 17, 1971, at 7:30 P.M. in the Council Chambers. Councilwoman Olson moved to appoint Councilman ;'iegert to represent the Village at the Ramsey County League Meeting, August 17,-1971. Seconded by Councilman Greavu. Ayes - all. F.
