CALL TO ORDER A special meeting of the Village Council of Maplewood, Minnesota was held in the Cafetorium of the Maplewood Junior High School and was called to order at 7:36 P.M. by Acting Mayor Haugan. ROLL CALL Lester G. Axdahl, Mayor Absent Harald L. Haugan, Acting Mayor Present John C. Greavu, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present PUBLIC HEARING 1. Forest Green Improvements - 7:30 P.M. Acting Mayor Haugan convened the meeting for a public hearing on the following utility improvements for the Forest Green Area: i 1. Water mains and necessary appurtenances on: Ripley Avenue, Furness to Ruth; West side of Forest Green Property, Ripley to Holloway; Holloway Avenue, Furness to 750 ft, westerly; Furness Street, Holloway Avenue to 320 ft. southerly; 2. Sewer main and necessary appurtenances on: North St. Paul Road and vicinity from Van Dyke Street to Holloway Avenue and on Holloway Avenue from North St. Paul Road to 700 feet west of Furness and along the west side of Forest Green Property from Holloway to Ripley. Also on Ripley Street alignment from southwest corner of Forest Green Property westerly to Ruth.. Also from the southwest corner of Forest Green Property southeasterly to Beebe Road and on Beebe Road southerly to a point 250 feet north of Larpenteur. 3. Storm Sewers and necessary appurtenances along the west side of Forest Green property thence northerly to Holloway Ave., thence westerly along Holloway extended to No. St. Paul Road. 4. Street improvement on Beebe Road from Larpenteur Avenue to North Property Line of Forest Green; and on Holloway Avenue from North St. Paul Road easterly to Beebe Road, thence southerly on Beebe Road to the north Forest Green Property line. - 1 - 7/8 The Clerk read the notice of hearing along with the publication dates. a. Sanitary Sewer 1. Constulting Engineer Kuusisto explained the specifics of the four alternate plans for the Forest Green improvements. 2. Village Engineer Collier explained the proposed imporvements and the assessing procedures. Mr. Collier further stated that if in a 5 to 10 year period if the lift station now in use need be replaced, an area assessment might be levied. The staff proposed that a sewer line on Holloway from the present lift station to Alternate Plan A could be constructed and eliminate the lift station. 3. Following further discussion, Councilwoman Olson moved to suspend the Rules to discuss the tentative proposal for this project. Seconded by Councilman Wiegert. 4. Councilman Wiegert to Beebe Road (where P at not Avenue. Seconded by Councilman Greavu. Councilman Greavu introduced the following resolution and moved its adoption: 71- 7- 133 WHEREAS, the Village Council has determined that it is necessary and expedient that the area described as: Holloway Avenue from Beebe Road extended to 100 feet east of McKnight Road be improved by construction of sanitary sewer. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA, that the improvement as hereinbefore described is hereby referred to Village Engineer, and he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and should best be made as proposed, and the estimated cost of the improvement as recommended. Seconded by Councilman Wiegert. Ayes - all. 6. Acting Mayor Haugan called for proponents. None were heard. - 2 - 7/8 7. Acting Mayor Haugan called for formal objections on the sanitary sewer improvement portion of the public hearing of the Forest Green improvements. The following were heard: Peter Fisher, 1812 Furness, stated he objects to any plan which would, in the future, encourage development of the triangle of land lying north of Ripley Avenue; South of North St. Paul Road; and Plan A with its offset 400 feet from North St. Paul Road would encourage development. b. Water Mains, Storm Sewer and Street Improvement. 1. Consulting Engineer Kuusisto explained the specifics of the pro- posed construction of water mains, storm sewer and street improvements. Mr. Kuusisto answered questions from the audience. 2. Acting Mayor Haugan called for formal objections apposing the water main improvement and the storm sewer improvement. None were heard. 3. Acting Mayor Haugan called for formal objections for the street improvement. The following were heard: Mr. and Mrs. Robert Gill, 1806 McKnight Road; Mr. Norse Swonburg, 1818 No. Howard Street; Mrs. Harold Munson, 2135 E. Larpenteur Avenue; Mrs. Anna Belanger, 5067 Otter Lake Road. 4. Acting Mayor Haugan closed the public hearing. 5. Councilwoman Olson moved to delay decision of the Forest Green Improvements until July 15, 1971 meeting to allow one week for ad- Seconded by Councilman Wiegert. Ayes all. 6. Councilwoman Olson moved that pending the outcome of the hearing, that the letting of bids be contingent on a building oeing drawn by the developers so that the Council would know, in fact that the development is oroceedine. Seconded by Councilman Wiegert. 7. Following further discussion, the motion and second were withdrawn. 8. Staff was instructed to prepare what estimated costs would be assessed against Hill High School and Forest Green if the improvements were feasible, and the attorney was directed to give Council advise on what procedure to follow. D. PRESENTATIONS 1. Mr. Nygren, representing International Dairy Queen, Inc., stated the Dairy Queen store on Century Avenue had received a letter listing certain conditions that must be corrected by July 9, 1971 or the occupancy permit would be lifted. Acting Mayor Haugan read the letter from Planning Director Bailey Sieda stating that Dairy Queen had until July 9, 1971 to shield the lights and to correct the drainage problem. - 3 - 7/8 Mr. Nygren informed the Council he had just learned of the items that needed to be corrected and had ordered the lighting shields and presented a plan that would correct the drainage problem. Village Engineer Collier explained that the drainage problem was not entirely caused by the Dairy Queen, other businesses were involved. Staff recommended that if an extension of time is granted to the Dairy Queen, a time limit should be given. Councilman Greavu moved to grant a one week time extension until July 16, 1971, at 8:00 A.M. to place the light shields and a 6-0—day-time extension for the drainage problem to be corrected. Seconded by Councilman Wiegert. Ayes - all. 2. Councilwoman. Olson stated that the developers of the Planned Unit Develop- ment at the northeast corner of Larpenteur Avenue and McKnight Road have stopped pumping the storm water directly into the culvert and off the Doro Project. They are now pumping water into the east ponding area from other parts of the project. Storm water is thus being forced off the site and effecting private property to the east. Have the developers been given permission to drain their lards in this matter? It was said that the staff would investigate. Staff will investigate. 3. Acting Manager Ashworth informed the Council that the resolution passed by the Ramsey County Board of Commissioners regarding ponding and treating of storm waters, has revised the cost of the Beam Avenue Improvements upward) in the amount of one -half million dollars. Council directed Staff to prepare a resolution or some format to advise them what can be done regarding the increased costs to Beam Avenue and present same to Council at the July 15th meeting. E.
