A. CALL TO ORDER
A special meeting of the Village Council of Maplewood, Minnesota was
held in the Council Chambers, Municipal Building and was called to
order at 7:33 P.M. by Mayor Axdahl.

C. PUBLIC HEARINGS
1. (7:30 P.M.) Martin Colon - Frank Bradac Rezoning
a. Mayor Axdahl convened the meeting for a public hearing on a
zone change request from Farm- Residence to Business and Commercial,
T legally described as Lots 1 and 2, Block 4, Smith and Taylor's
Addition to North St, Paul lying northwesterly of White Bear Ave-
nue except the north 20 feet thereof, The Clerk read the notice
of hearing,
b. Manager Miller presented the staff report.
C. Chairman Lyman Coombs, Maplewood Planning Commission, read the
following Commission's recommendation:
Commissioner Stolzman moved -
The Planning Commission recommendseto the Council that the pro-
posed zone change on the property described in Public Hearing
Item ZC 1 -71 from F.R., Farm Residential to B.C., Business and
Commercial, be denied.
The Planning Commission suggests to the Council that the rezoning
of this property should be considered, as stated in our earlier
recommendation, only at such a time as it is of optimum benefit
to the Village,
(The Commission suggests that the optimum time for
official zoning district change be at such time as
only when White Bear Avenue extended is physically

constructed and connected between Lark Street and
Cope Avenue abutting the west side of the site;

secondly, when Cope Avenue right -of -way is acquired
and a street therein is properly constructed between
White Bear Avenue and Hazelwood as it abuts the north
side of the subject site; and thirdly, when the White
Bear Frontage Road and right -of -way for such along the
west side of White Bear Avenue abutting this property
has been eliminated in total or part for public street
and reverted to the abutting private property subject
to Village Council approval as to form and method of
reversion.)
and at that time it should be considered as L.B.C., Limited
Business and Commercial as defined under Paragraph 4 of Chapter
907.010 of the Village Ordinances as stated in Ordinance No.
256.
The Planning Commission believes that the development of this
property should be closely monitored by the Council, as required
by this Paragraph, so as to conform with the intent of this Par-
agraph and provide an orderly transitional zone between com-
mercial and residential property.
Commissioner Disselkamp seconded. Ayes - all.
d. Mr. Mogren, attorney for Mr. Bradac, stated Mr. Bradac has no
objections to the rezoning but will not deed any of the property
for Cope Avenue extension.
e. Marvin Middendorf, 1745 E. Lark Avenue stated his opposition
for the zone change.
f. Martin Colon questioned what the assessments would be on the
property if Cope Avenue is extended. Staff stated the costs of
the improvement, at this time, are not known.
g. Mayor Axdahl called for formal objections. The following ob-
jections were heard:
Mrs. Patrick Molohan, 1750 Lark
George James, 1758 Lark
Mrs. Kenneth Murphy, 1764 Lark
John Franzen, 1765 Lark
Mrs. Vaun England, 1759 Lark
h. Mayor Axdahl closed the hearing. Written objections will be
accepted for one week. Decision on the zone change will be made
at the February 4th, 1971 Council meeting.
2. (7:45 P.M.) Gervais Avenue Improvement (Sanitary Sewer)
a. Mayor Axdahl convened the meeting for the public hearing on the
improvement of Gervais Avenue from Kennard Street to White Bear Ave-
nue by construction of sanitary sewer mains, service connections.
The Clerk read the notice of hearing along with the publication
dates.

b. Village Engineer Kuusisto explained the specifics of the pro-
posed improvement. The total estimated cost is $109,795.00.
c. Following further discussion, Mayor Axdahl called for formal
objections. The following objector was heard:
Stan Weston, Lecon Properties objected to the design of the
project and requested that a longer look be given to the whole
area.
d. Mayor Axdahl closed the hearing. Written objections will be
accepted for a one week period. Decision will be made at the Feb-
ruary 4, 1971 meeting. Staff was directed to prepare a study re-
lating to different routing alternatives of the sewer mains.
3. (8:30) Planned Unit Development - Special Use Permit (Sagstetter)
a. Mayor Axdahl convened the meeting for a public hearing on the
application of Mr. Richard E. Sagstetter for a Planned Unit Devel-
opment permit composed of 13 single dwellings, 2 double dwellings,
96 Apartment Units on 9.01 acres legally described as the Sz of the
NW4 of the NE 4 of the NW 4 and the NA, of the SW4 of the NE 4 of
the NW4 of Section 17, Township 29, Range 22 except the east 30 feet
thereof and except the West 33 feet thereof.
b. Manager Miller presented the staff report.
c. Chairman Lyman Coombs, Maplewood Planning Commission, read the
following Commission's recommendation:
Commissioner Stolzman moved -
The Planning Commission recommends that the requested special -
use permit be rejected. The proposed Planned Unit Development
Plan adds to an already existing problem of an over expanded apart-
ment development. The Commission believes that this land should
be planned and developed in a fashion which acts to scale the dwel-
ling units per acre to the degree that the total 9 acre tract does
not exceed a total of 45 dwelling units for the total site area and
suggestion is made that the density for the approximate southerly
one -third of the total site be considered with a maximum density
not to exceed 6 units per acre and the northerly two - thirds of the
total site not to exceed 3 dwelling units per acre.
Commissioner Howard seconded. Vote: 9 to 1 in favor of the motion.
d. Mr. Tom VanHeusen, archetect, representing Mr. Sagstetter, spoke
on behalf of the proposed project and explained the details.
e. Mayor Axdahl called for formal objections. The following object-
ions were heard:
Mr. Leo Elm, 1855 DeSoto; Mr. and Mrs. Thomas Nielson, 490 E.
County Road B; Mr. Mike Mandel, 500 E. County Road B; Mr. Arthur
Kaese, 506 E. County Road B.

f. Mayor Axdahl closed the hearing. Written objections will be
- accepted for a one week period. Decision will be made at the Feb-
ruary 4, 1971 meeting.
D. PRESENTATIONS
a. Mananger Miller requested authorization to request the firm, hir6d
to conduct the Village water study, to submit their bill and also
authorization to attempt to investigate hiring another firm.
Councilwoman Olson moved to authorize staff to request the firm
to submit a bill and also authorize staff to investigate h;r;na
Seconded by Councilman Haugan.
Ayes - all.
b. Manager Miller stated he had sent a letter to the manager of
North Saint Paul informing him of the action taken by the Council
regarding Eleventh Avenue.
