CALL TO ORDER A special meeting of the Village Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:07 P.M. by Mayor Axdahl. B. ROLL CALL Lester G. Axdahl, Mayor Present John C. Greavu, Councilman Present Harald L. Haugan, Councilman Present Patricia L. Olson, Councilwoman Present Donald J. Wiegert, Councilman Present Mayor Axdahl stated that the purpose of the meeting tonight was to discuss the requests for deferments to the assessments whose hearings were held two weeks ago. Mayor Axdahl asked for the staff present- ation. 1. Lydia Avenue and McKnight Road - Storm Sewer (69 -4) a. Village Engineer Kuusisto stated he would like to make a suggestion that would perhaps clear up some of the questions asked by the residents and also make it clearer as to what areas would be assessed. He suggested that a line extended northerly from right of way line of Frederick Street to County Road D and easterly to a point that would be approximately 120 feet east of McKnight Road would be included in this assessment. The property east of the stated 120 foot line would not be assessed at this time. In the future residents in that area, as trunks are added, would be assessed for trunks, and as lat- erals are added, they would be assessed for laterals. Mr. Kuusisto further stated the approximate amount raisgd'by assess- ment.to,;-be He answered questions from the audience. $80,000.00: Mr. Kenneth Tilsen, representing Tilsen Construction Com- pany had already paid $17,000 into this storm sewer project. The money was used for the benefit of the project by construct- ion of the laterals that are in the ground right now. Manager Miller stated that because you were assessed once that you cannot be assessed over again is not true. This is a misunderstanding that the staff is trying to point out so - 1 - 9 -18 that this misunderstanding will not happen again. A resident may be assessed again for a project if he is benefited by some future project. ! Councilman Wiegert moved the establishment of the district to I be assessed as recommended by the Staff. (Deletes the prop- erty a point 120 feet east of McKnight Road and the tier lots on north side of Beam Avenue.) Seconded by Councilman Haugan. Ayes - Mayor Axdahl, Councilmen Greavu, Haugan and Wiegert. Nay - Councilwoman Olson. Councilman Greavu moved to adopt the assessment roll pending corrections and introduced the following resolution and moved its adoption: 70- 9 -147.A WHEREAS, pursuant to proper notice duly given as required by law, the Village Council has met and heard rud passed upon all objections to the proposed assessment for t: • construction of Storm Sewer as described in the files' of the Village Clerk as Lydia Avenue and McKnight Road - Storm Sewer (69 -4) and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benfited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of nineteen (19) years, the first of the installments to be payable on or after the first Monday in Jan- uary, 1971 and shall bear interest at the rate of seven (7) per- cent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1971. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the reimburse itself in the future for the portion of the swim 9 -18 Council to cost of this i... improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the Village by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Haugan. Ayes - Mayor Axdahl, Councilmen Greavu, Haugan aitd Wiegert. Nay - C:)icncilwoman Olson, 2. Assessment Requests - Lydia Avenue and McKnight Road (69 -4) a. Manager Miller read a request from Mr. John Speak requesting cancellation of the storm sewer assessment. His property lies between Beam Avenue, Maple Lane on Furness Street and all of his water drains to Beam Avenue which flows to the North St. Paul area. He stated his assessment should be considered the same as those on Beam Avenue. Also, Tilsen advertised that all assessments were paid in this development. b. Manager Miller stated that this particular property does have a "cut -off" and 1/3 of the drainage goes to the north and 2/3 flows to the south. If the property were to deleted from this roll, it would be assessed if there is a development to the south. Following discussion, Councilman Wiegert moved to table this matter temporarily. Seconded by Councilman Greavu. Ayes - all. c. Manager Miller read the notice of hearing for filing ob- jections to the assessment roll for Improvement No. 69 -4. - 3 - 9 -18 d. The comment was made that everyone should be assessed at 2� per square foot and also credit be given for the funds es- crowed for the laterials ($27,000 estimated cost, $17,000 was escrowed leaving a balance of about $10,000). Councilman Haugan moved that the difference between the escrowed funds and the cost of 2G a square foot be levied. Seconded by Councilman Greavu. Ayes - all. e. Mr. John Speak, 2901 Furness Street, again asked for can- cellation of his assessment for Storm Sewer. Councilman Greavu moved to deny the reques his storm sewer assessment. (Code No. 57- t of Mr. Speak to cancel Seconded by Councilman Wiegert. Ayes - all. f. Mr. Albertus H. Ruiter, 2292 East County Road D, requests cancellation of his assessment because his property has three low spots where water drains and does not in any way return to the storm sewer. . This area has been deleted from the assessment roll. g. Carl G. Gustafson, 219'.% E. Lydia, stated approximately 2 of the property will not drain to Lydia Avenue due to the north- erly ^ind easterly slope of the land and requests adjustment to the storm sewer assessment as he feels it is unfair to be assessed on the enure 54,014 square feet. Councilman Greavu moved to deny Mr. Gustafson's request for adjust- ment. (Code No. 57- 00210- 330 -10) Seconded by Councilman Haugan. Ayes - all. h. The following list of residents objected to being assessed for storm sewer because they were under the impression that all assessments were paid when they purchased their homes from Mr. Tilsen; Raymond J. He also requests assessments be calculated on a per lot basis as per Netnorlin Plata Councilwoman Olson moved that portion of the assessment be can- celed. (Furness Court - 40 foot right of way on Lydia). Seconded by Councilman Wiegert. Ayes - all. Councilman Greavu moved that the assessment be levied on a per lot basis. Seconded by Councilman Haugan. Ayes - all. j. Jerrold Lindahl, 2233 Lydia, requests deferment of assess- ment since land is not buildable until Tower Road is completed, requests cancellation of assessments on 80 feet right of way.for Tower Road; requests cancellation of assessment on Northern States Power easement as land is not usable by property owners. Councilwoman Olson moved to cancel the assessment of the Tower Road portion of 80 feet. Seconded by Councilman Haugan. Ayes - all. Councilman Wiegert moved to deny the request to cancel the assess- ment on the Northern States Power easement property as this is a matter between the individual and the power company. Seconded by Councilman Greavu. Ayes - all. Councilwoman Olson moved that the deferment of the assessment on that land which is not buildable north on Tower Road be granted until such time as Tower Road is completed and the land is build- able. Seconded by Councilman Wiegert. Ayes - all. - 5 - 9 -18 II k. D. J. Nordgren, 2233 Lydia Avenue requests adjustment of the assessment as he stated the square footage was improperly cal- culated since 40 feet was acquired by the Village across the south end of his property for street right of way. Councilman Wiegert moved to cancel the assessment for the 40 foot street right of way acquired from Mr. Nordgren. Seconded by Councilman Greavu. Ayes - all. 1. Jerrold Lindahl, 2245 Lydia, requested cancellation of the assessments for the 33 feet of property acquired for street right of way on McKnight Road and 40 feet on Lydia. Councilwoman Olson moved to cancel the assessments on Mr. Lindahl's property for the 33 feet acquired for street right of way on Mc-. Knight Road and the 40 feet on Lydia Avenue. Seconded by Councilman Wiegert. Ayes - all. M. County Road D (No Change) Mr. Herbert Bruentrup, 2980 White Bear Avenue requested cancel= lation of the assessment on the property acquired by the Village for storm water ponding and recreation purposes. This land was acquired by the Village with the stipulation the Village would assume all assessments. Councilwoman Olson moved to cancel the assessment on the portion of land acquired by the Village and assess the matter to the Village. Seconded by Councilman Wiegert. Ayes - all. - 6 - 9 -18 Angelo J. Vruno, 2370 Gall, requested cancellation of storm sewer assessment as he is not benefited. No,. change. The following residents also requested cancellation of assess- ments since they felt Tilsen Construction had placed monies in escrow for the storm sewer: Don Morrison, 2222 Maple Lane Richard Herzog, 2236 E. Maple Lane Werner Hillstrom, 2244 Maple Lane Phillip Prokop, 2983 Howard Richard Benkusky, 2980 Howard Don Eastland, 2176 Maple Lane Mrs. Alex Kazdalwicz, 2917 Furness Council has passed a resolution to assess the residents in the Tilsen Area the difference between the escrowed funds and the cost of 2� per square foot. 3. Water Improvement - Lydia Avenue 69 -7 Council had at the previous assessment hearing deleted that portion between White Bear Avenue and westerly line of Tilsen's Addition. Manager Miller read the notice of hearing. Ma, -or Axdthl called for persons who wished to be heard regarding these assessments. a. Staff recommended assessing Lot 1, Block 2, Robert Tilsen's Maplewood Heights No. 4 only 10 feet as it is a corner lot and Mr. Tilsen paid an assessment on the Howard Street side of the property. Councilman Greavu moved to assess Lot 1, Block 2, Robert Tilsen's Maplewood Heights No. 4 by 10 feet. Councilman Greavu withdrew his motion. Councilman Wiegert moved to cancel the 10 foot assessment on Lot 1, Block 2, Robert Tilsen's Maplewood Heights No. 4. Seconded by Councilwoman Olson. - 7 - Ayes - all. Manager Miller recommended Council cancel the remainder of the listed objections. Councilman Greavu moved to cancel the Water Assessment on Lot 2, Block 3, Lots 1 and 3, 6 o 2; Lot 2, Block , Ro ert Tilsen's Maplewood Heiqhts No. 5. Seconded by Councilwoman Olson. Ayes - all. 4. White Bear Avenue Street and Storm Sewer (Imp. No. 69 -.5). a. Manager Miller recommended the Storm Sewer portion of this project he deleted. The cost of the project was relatively low and also this area will be included when major improvements are called for in the future. Councilman Wiegert moved that the storm sewer project of Imp: No. 69 -5 be deleted from this assessment roll until such a time in the future when major improvements will be required. Seconded by Councilman Greavu. Ayes - all. Mr. Herb Bruentrups questioned how can White Bear Avenue be improved so that the water will drain properly. Following discussion regarding the drainage along White Bear Avenue, Staff was instructed to contact the County about the drainage and also to discuss the County ditches along White Bear Avenue. b. Mr. Al Johnson requested deferment of his assessment as no paving improvement had been done in 1969 on White Bear Avenue. He paid an assessment of approximately $900.00. Staff stated the water improvement was assessed in 1969 but the street was not completed in time to assess, that is why the assessment is levied this year. Council denied the request. c. The following list of property owners filed for cancellation of the storm sewer assessment: Mr. Al Johnson 2869 White Bear Avenue. Mr. and Mrs. Ray Miller, 2778 White Bear Avenue. Mr. and Mrs. Milford Olson, 2740 White Bear Avenue. Mary E. Kiesling, 2866 White Bear Avenue. Nettie Schuette, 2750 White Bear Avenue. Maplewood Covenant Church, 2691 White Bear Avenue requested adjustment of the area calculations for their assessment. They stated there was an error in the calculations of square footage. Council had in a previous motion deleted the storm sewer improvement from the project. - 8 - 9 -18 d. Councilman Greavu moved to deny the request of Mary Kiesling, 2866 White Bear Avenue to defer the street assessment on her property. Code No. 57 00210 020 58. Seconded by Councilman Wiegert. Ayes - all. e. Councilman Greavu moved to deny the request of Nettie Schuette to defer or cancel the street assessment. Code No. 57 00210 020 60. Seconded by Councilman Haugan. Ayes - all. 5. Flandrau Street Water Improvement 69 - 3. a. Edward Rydeen, 1940 Flandrau stated the assessment per front footage shows more than the lot is. The lot is odd shaped and was assessed under the old formula for odd shaped lot policy. Staff recommended assessing under the new policy for odd shaped lots.. Councilman Greavu moved to assess Mr. R Been, 1940 Flandrau, Code No .57 25100 040 02 under the new policy for oddshaped lots. Seconded by Councilman Haugan. Ayes - all. b. Mrs. Harold Baldwin, 1950 Flandrau requests adjustment concerning the size of her lot. The lot is odd shaped. Staff recommends assessing under the new policy for odd shaped lots. Councilman Greavu moved to assess Mrs. Baldwin, 1950 Flandrau, Code No. 57 25100 020 G? under the poles for odd shaped lots. Seconded by Councilman Wiegert. Ayes - all. c. Alan F. Laidlaw, 1944 Flandrau, requested assessment be on actual front footage and not under the odd shaped lot concept. Councilman Greavu moved to deny the request of Mr. Laidlaw, 1944 Flandrau, Code No. 5725 100 030 02 and assess under The new policy for odd shaped lots. Seconded by Councilman Haugan. Ayes - all. d. Mr. and Mrs. Alfred Hassler, 1931 Flandrau, requested change should be based on actual front footage as they were told it would be. Councilman Greavu -moved to deny the request of the Hassler's 1931 Flandrau, Code No. 57 25100 120 01 and assess under the new policy for odd shape lots. Seconded by Councilman Haugan. Ayes - all. 0 - 9 - 9 -18 e. Harry Johnson, 1937 Flandrau requested assessment should be on actual front footage of his property. Councilman Greavu moved to deny the request of Mr. Johnson, 1937 Flandrau, Code No. 57 251.00 090 01 — and-establish 0 .97 feet as the assessment under the policy for odd shaped lots. Seconded by Councilman Wiegert. Ayes - all. f. Howard Unger, 1933 Flandrau, requested an assessment adjustment.. He feels the formula for his lot was unfair. Councilman Greavu moved to establish 101.17 feet as the Water Assessment for Mr. Unger, 1933 Flandrau Code No 57 25100 110 01. Seconded by Councilman Haugan. Ayes - all. g. G. Kenneth Nelson, 1725 Frost Avenue stated he paid a cash connection charge to the Village in 1964 to hook -up to the Frost Avenue water line. He requests cancellation of the water assessment. Councilman Wiegert moved to cancel all but the 10 feet of the water assessment for the side lot consideration for Mr. Nelson, 725 Frost - C.ode No. 57 25100 070 02. Seconded by Councilman Haugan. Ayes - all. h. 1 "*r Forrest Schoeller, 1935 Flandrau stated zA the original hear•i+l; on this water improvement it was said that the assessment woulH be based on front footage the same as the sewer assessment was basEG on. He feels it is not in good faith for a Council to change their reasoning or policy after a definite plan has been established. The lot is assessed at 101 feet. Also, he has a drainage easement on his property. Staff stated the drainage easement was not included in the assessment. Councilman Haugan moved to assess Mr. Schoeller, 1935 Flandrau, Code No. 57 25100 100 01 under theodd shaped lot policy ��econded by Councilman Wiegert. County Road B - German St. Water Improvement 69 - 9 Ayes - all. a. Tony Oswald, 1700 Roselawn requested that the stumps that were placed on his lot be removed. Council referred the matter to Staff for investigation. b. Ben Belisle, 2237 German St. would like deferment of the north end of his property which is unimproved. There is no access to the property that he is requesting a deferment. Councilman Wiegert moved to defer 185 feet of Mr. Belisle's assessment (Code No. 57 68800.E until an improvements are made Seconded by Councilwoman Olson. Ayes - all. - 10 - c. Orville C. Anderson, 2256 German, requested deferment for the north 112 of his property. Approximately 130 feet of the property inaccessable to -the street. Councilman Greavu moved to defer 124.7 feet of Mr. Anderson's property Code No. 57 68800010 01 subject to the standard policy for deferments. Seconded by Councilman Wiegert. Ayes - all. d. Ivar Wicklander, 1896 E. County Road B. requested adjustment or deferment on his property (Code No. 57 01410 070 29) for the following reason, if an easement for roadway purposes is open to the public benefit, a water assessment to a private citizen seems unfair. Councilman Wiegert moved to deny the request of Mr. Ivar Wicklander 1896 East County Road B, Code No 57 01410 070-2 for adjustment or deferment of his assessment. Seconded by Councilman'Haugan. Ayes - all. e. Anton Wicklander, 1884 E. County Road B. requested deferment on his property Code No. 57 01410 120 3a because the land is not filled and is 20 feet below level of the road. Councilman Greavu moved to defer Mr. Wicklander's water assessment for his property, Code No. 57 01410 120 30. Seconded by Councilman Wiegert. Ayes - all. 7. Linwood Avenue I -later Improvement 69 - 21. a. Mr. Budd Kolby, 2350 Linwood Avenue, requested deferment as a portion of his land is undeveloped and he has no plans to develop it at this time. Councilman Haugan moved to assess Mr. Kolb y, 2350 Linwood (Code No. 57 01300 010 27) 100 feet and defer the balance of t e property I Seconded by Councilwoman Olson. Ayes - all. b. Mr. V. George Oxford, Jr. 2305 Linwood Avenue requested deferment of approximately 350 feet of his assessment as the land is zoned Farm Residence. Councilwoman Olson moved to defer 350 feet of the Water Assessment of Mr. Oxford (Code No. 57 01200 010 56 ) and assess the balance. Approximately 140 feet . Seconded by Councilman Haugan. Ayes - all. - 11 - . 9 -18 ft.) V J 8. Maryland Avenue Water Improvement 69 - 11 a. Councilman Greavu moved that all of the Maryland Avenue Water :Improvement from McKnight Road to Lakewood Drive be deferred until such time as property chan es hands'or sold or t e property is hooked up to the water line, in which case they will pay a cash connection charge of $8.00 per front /Foot. Seconded by Councilman Haugan. Ayes - all. b. Arthur Tousignant, 2310 E. Maryland requested deferment on lots 57 14800 010 00, 57 14800 020 00, 57 14800 040 00, 57 14800 061 00; 57 14800 030 00 for the following reasons; water already on property, is on social security and is 73 years old and that the land is undeveloped. Council granted deferment. subject to all conditions listed in previous motion. c. Harry J. Solkowicz, 1240 No. McKnight Road requested an adjust- ment and deferment of his assessment as his home faces McKnight Road and he has a receipt for a quit. claim deed for easement across a 100 ft. triangle located at N.E. intersection of Maryland and McKnight so they feel they should not be assessed for 426 feet when our tax statement is 440 feet. They feel the street and curve should be deducted for the water assessment. Councilwoman Olson moved to assess and defer Mr. Solkowicz property (Code No. 57 02410 020 52 407 feet instead of 426 feet. Seconded by Councilman Haugan. Ayes - all. d. Mr. Manuel Sanchez, 2077 E. Orange requested deferment. (Code No. 57 1.4800 091 00) as the lots are vacant. Deferment granted. e. Amanda Yeager Anderson, 2354 E. Maryland Avenue requested all but one lot is undeveloped and she has a receipt for a quit claim deed for an easement across a 100 foot triangle located at Maryland Avenue and Lakewood Drive so she feels she should not be assessed for a full 330 feet. Councilman Haugan moved to establish the assessment of Mrs. Anderson's property (Code No. 57 14700 090 Ol ) at 280 feet taking the average of the front and rear feet. Seconded by Councilwoman Olson. Ayes - all. f. Mr. Paul Edmiston, 2345 Maryland Avcnue requested deferment. Code No. 57 02410 020 55. Deferment granted by Councilman Greavu's previous passed motion. - 12 - 9 -18 r g. Mr. A. J. Reiter, Ass t. Land Commissioner requested cancellation of water assessment of property No. 57 14800 210 00 as the described property is Ramsey County Land used exclusively for an open space area for the pleasure and comfort of the residents in the immediate area and will never require public utility service. Councilman Wiegert moved to deny the Ramsey County request to cancel the water assessment on property described as 57 14800 210 00. Seconded by Councilman Greavu. Ayes - all. h. Mr. Raymond A. Colosimo, 2323 Case Avenue requested deferment on the water assessment for lot 57 14700 100 01 on the basis that at the meeting of September 1, 1970 he understood that the assessment will be deferred until property is sold or water connected. Deferment granted by Councilman's Greavu's previously passed motion. Mayor Axdahl called for a five minute recess. Mayor Axdahl reconvened the meeting. 9. Lark Avenue Water Improvement 69 - 12 a. Harry Nordwall, 376 E. Viking Drive stated he was assessed unfairly for 95.97 front feet. He has an odd shaped lot but it is 75 feet from from front to back except that Viking Drive runs at a slight angle on both sides. Councilman Wiegert moved to establish 75 feet as the assement for the property of Mr. Nordwall, 376 E. Viking Drive Co a —No.-5-7--21-700- 072 20. Seconded by Councilman Greavu. Ayes - all. b. Walter Sitko, 368 E. Viking Drive requested an adjustment of his water assessment. He was assessed for 179.95 ft. while he feels it should be 150.5 feet under the new policy for odd shaped lots. Councilman Greavu moved to establish 150.5 feet as the assessment footage for Mr. Sitko, 368 E_. __Viking Drive Code No. 57 21700 060 20. Seconded by.Councilman Haugan. She requests an adjustment on Lot 6, Block 6, Brower Park. The actual front footage is 174.95 feet but 150 feet back it measures 122.64 feet. This would make 148.80 feet assessable according to resolution passed September 1, 1970. By its method of application, it has a built in 12,% penalty factor. In addition the method of measuring "Odd Lots" with a planimeter has introduced an additional penalty. The combination of these two factors has increased his footage, he feels, almost 24% on a lot that deviates only slightly from being rectangular. Reed Santa, 2495 Highwood Avenue requested the East 100 feet of his utilities assessment be deferred. His home sets on the West 100 feet and the East 100 feet is used for recreational purposes.
