Resolution 24-04-2308 PROCLAIMING ARBOR DAY 2024 WHEREAS, Arbor Day provides an opportunity to celebrate the importance of trees and forests to our economy, culture, history, and future of the state; and WHEREAS, Trees are of great value as they provide clean air and water, shade and energy savings,wildlife habitat, recreational opportunities, wood products, and jobs, while also capturing and storing carbon from the atmosphere, thereby offsetting greenhouse gas emissions; and WHEREAS, Properly planting and caring for a diverse mix of trees makes community forests more resilient by minimizing the impacts of diseases, insects, and other stressors such as climate change and providing long-term community and environmental benefits; and WHEREAS, Thoughtfully choosing, planting, and caring for a diverse mix of trees now supports resilient communities into the future. Resolution 24-04-2309 RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS WITH THE CITY OF MAPLEWOOD ON BEHALF OF ITS PROSECUTING ATTORNEY AND POLICE DEPARTMENT WHEREAS, the City of Maplewood, MNon behalf of its Prosecuting Attorney and Police Department desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State’s criminal justice data communications network for which the City is eligible. The Joint Powers Agreements further provide the City with the ability to add, modify and delete connectivity, systems and tools over the five-year life of the agreement and obligates the City to pay the costs for the network connection. NOW, THEREFORE, BE IT RESOLVED by the City Council of Maplewood, Minnesota as follows: 1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension and the City of Maplewood on behalf of its Prosecuting Attorney and Police Department, are hereby approved. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the City’s connection to the systems and tools offered by the State. 3.That the Prosecuting Attorney, Joseph Kelley,or his or her successor, is designated the Authorized Representative for the Prosecuting Attorney. The Authorized Representative is also authorized to sign any subsequent amendment or agreement that may be required by the State of Minnesota to maintain the City’s connection to the systems and tools offered by the State. 4.That Marylee Abrams, the Mayor for the City of Maplewood, and Andrea Sindt, the City Clerk, are authorized to sign the State of Minnesota Joint Powers Agreements. Resolution 24-04-2310 PUBLIC VACATION OF AN EASEMENT RESOLUTION BE IT RESOLVED by the City Council of the City of Maplewood, Minnesota, as follows: Section 1. Background. 1.01Steve/Stacy Poindexter and Lillian Magidow/Daniel Barthel, petitioned the Maplewood City Council to vacate an unused public utility easement that is entirely within the properties at 2786 and 2792 Keller Parkway. 1.02The utility easement was originally recorded within the Lake Gervais View Addition plat on January 2, 1963. 1.03The portion of the 10-foot-wide utility easement to be vacated bisects the parcels of Block 2, Lots 4 and 5, as shown on the Lake Gervais View Addition plat. 1.04A hearing notice on said petition was published twice in the City of Maplewood’s official newspaper, and a written notice was mailed to the affected property owners. 1.05On April 22, 2024, the City Council held a hearing on such petition, at which time all persons for and against the granting of said petition were heard. Section 2. Standards 2.01 Minnesota state statute requires that no vacation shall be made unless it appears inthe interest of the public to do so. Resolution 24-04-2311 APPROVAL OF GRANT AGREEMENT WITH THE MINNESOTADEPARTMENT OF NATURAL RESOURCES FORTHE SHADE TREE PROGRAM BONDING GRANTS, 2023-2027 WHEREAS, the City Council of Maplewood, Minnesota has approved the grant agreement between the City of Maplewood and the Minnesota Department of Natural Resources for the Shade Tree Program Bonding Grants, 2023-2027. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that: 1.The Mayor and City Manager are hereby authorized to enter into the grant agreement. This study is looking at the future needs of those who travel along and across I-35W. Work on the study began in January 2023 and is nearing completion. MnDOT will be providing an update to the City Council about the project and will be looking for feedback from the City Council on the alternatives for their final report. This study is looking at vehicle, pedestrian, and bicycle traffic needs. Background: MnDOT started their study of MN Highway 36 in January 2023. The project team provided an update on the study at the June 12, 2023 City Council meeting. The study area includes the section of MN Highway 36 from I-35W to English Street and includes all crossing points for vehicles, bicycles, and pedestrians. This segment of MN Highway 36 is a major east/west corridor for vehicle Packet Page Number 16 of 184 F4 traffic. It is approximately 8 miles long and lies in the cities of Roseville, Little Canada, and Maplewood. MN Highway 36 does pose challenges for north/south traffic looking to cross MN Highway 36, especially for pedestrians and bicycles. This study aims to take a big picture look at what the needs and wants are for people who travel on and across MN Highway 36. Representatives of MnDOT will provide an update on the MN 36 Corridor Study from I-35W to English St. The study has generated three alternatives that address the safety and mobility needs of people traveling along MN 36, as well as people walking and biking over it. MnDOT is seeking comments on the alternatives for its final report due in June. Background: Strategic planning is an organizational management activity that is used to set priorities, focus energy and resources, strengthen operations, ensure that employees and other stakeholders are working toward common goals, establish agreement around intended outcomes/results, and assess and adjust the organization's direction in response to a changing environment. The City of Maplewood's Strategic Plan consists of six strategic priorities which are established by the City Council. These priorities are supported by a series of Key Outcomes and underlying Performance Measures, which describe desired outcomes and are a metric in measuring success. Strategic planning is a continual journey and our plan is modified every year to ensure that it is up to date and reflects the changing dynamics of our community. The Finance Director has confirmed the fleet fund has sufficient funds to cover the buildout cost of Unit 546. The City has not yet received the fifth truck chassis or a revised estimated delivery date. The buildout of the fifth truck chassis will likely be in 2025 and the cost will be accounted for in the 2025-2029 CIP plan update. This unit is utilized by the street division to install and repair city signs throughout the city. The city of Maplewood owns approximately 5,800 signs. The old unit will be sent to state auction. For past purchases of vehicles, the agenda reports included both the cost for ordering the chassis and the cost for the vehicle body/equipment buildout. Supply chain issues have caused a long delay between when a truck is ordered and the when the chassis are delivered. In March of 2023, the City Council authorized the purchase of 5 truck chassis. To date we have received 4 of the 5 truck chassis that the City Council authorized for purchase. Supply chain issues have also resulted in delivery delays and large increases to buildout costs. Staff has received an accurate buildout quote for Unit 546 in the amount of $84,200.00 and is detailed as follows: ABM Equipment $84,200.00 Total Cost $84,200.00 The old unit will be sent to state auction once the new unit is ready. Maintaining native vegetation is also an important strategy for carbon sequestration, pollution mitigation and climate resilience. Packet Page Number 138 of 184 G4 Background: Prescribed burns are a best-practice to maintaining native plant communities and to prevent establishment of encroaching, non-native and invasive plant species. Prescribed burns release nutrients for existing native plants and allows more light to penetrate to soil level, increasing native plant vigor and food and flowering resources for wildlife including pollinators. A request for quotes to conduct prescribed burns at Prairie Farm, Beaver Creek, Gladstone Savanna, Maplewood Nature Center and YMCA/ White Bear Avenue prairie strip was released on April 16, 2024 and quotes were due April 26, 2024. Four quotes were received ranging from $15,603.50 to $27,999.70. Edge Ecosystems submitted the lowest quote and is experienced and well qualified for this project. Edge Ecosystems recently conducted a safe and successful burn at Fish Creek for the City of Maplewood in April of 2024 which was funded through our grant partner, Great River Greening. Based on their past work experience and their quote staff recommend entering into the agreement for 2024 Maplewood Open Space Prescribed Burns project. Packet Page Number 141 of 184 G4, Attachment 1 14.INJUNCTIVERELIEFFOR BREACH.TheContractor'sobligationsunder this Agreement areof a unique character that gives them particular value.As such, the Contractor's breach of any of such obligations will result in irreparable and continuing damage to the City or which there will be no adequate remedy at law.In the event of such breach,theCitywillbe entitled toinjunctivereliefand/oradecreeforspecific performance, and such other and further relief as may be proper, including monetary damages if appropriate. 15.INDEMNIFICATION.The Contractor hereby agrees to defend, indemnify, and hold harmless theCity,its officials, employees,andagentsfor any andallclaims arisingunder orin any wayrelatedtothis Agreement.TheContractor'sdutypursuantto this Section shall survive termination or expiration of thisAgreement.The Contractor further agrees to indemnify, defend, and hold harmless the City from any claimby a third-partywhich is based upon Contractor's alleged infringement of any intellectual property right.The Contractorexpressly acknowledgesthat it shall exercise reasonable care to ensure that it does not engage in any activities which may infringe upon third-party intellectual property rights in performance of the Contractor Services hereunder. 16.INSURANCE.The Contractor hereby agrees that,at all times during the term of this Agreement, the Contractor shallkeep in full force the followinginsurance policies,in no less than the limits herein specified: A single limit or combinedlimit or excessumbrella general liability insurance policy of an amount of not less than $500,000 for property damage arising from one occurrence, $2,000,000 for total bodily or personal injuries or death and/or damages arising from one occurrence. Asingle limit or combined limit or excess umbrella automobile liability insurance policy, if applicable, covering owned,non-ownedand hired vehicles used regularly in theprovisionofservicesunderthisAgreement,inanamountofnotlessthan $500,000 per accident for property damage, $1,000,000 for bodily injuries and/or damages to any one person, and $1,000,000 fortotal bodily injuries and /or damages arising from any one accident. A professional liability insurance policy covering personnel of the Contractor while performing services under this Agreement in the following amounts: Errors and omissions $500,000 per occurrence and $1,000,000 in total for any individual occurrence. Workers CompensationInsurance and employer's liability as required by lawincluding all states endorsementin an amount of $100,000 for each occurrence. Prior to the effective date of this Agreement, the Contractor will furnish the City with certificates of insurance as proof of insurance for general Liability and Auto Liability.Such certificates of insurance shall name the City as an additional insured under the Contractor's policies. The contractor shall prevent invasive species from entering into or spreading within a projectsite by cleaning equipment prior to arriving at the project site. If the equipment, vehicles, gear, or clothing arrives at the project site with soil, aggregate material, mulch, vegetation(including seeds) or animals, it shall be cleaned by contractor furnished tool or equipment (brush/broom, compressed air or pressure washer) at the staging area. Background The streets included in the 2024 Maplewood Street Improvements total approximately 4.3 miles in length and consist of streets in the following two areas: East Shore Drive Area: This area is generally bounded by Frost Avenue to the north, Lake Phalen to the west, Larpenteur Avenue to the south, and Birmingham Street to the east. This retaining wall replacement was originally proposed with the Woodlynn-Southlawn Street Improvements, City Project 22-17. The wall was not replaced during that project due to the contractor, T.A. The bids have been checked and tabulated for accuracy. The Engineer’s Estimate for project construction cost was $9,457,817.65. The lowest bid from Forest Lake Contracting of $8,636,221.30 is approximately $821,600 (9%) lower than the Engineer’s Estimate. Budget Impact: The currently approved funding plan (shown below), established at the feasibility stage of the project, is $10,878,200. The total estimated project cost based on the low bid (including 12% indirect costs and a 10% contingency) is $10,639,800, roughly $238,400 below the current funding plan.
