opinions can be heard and understood in a reasonable manner. We appreciate the fact that when
appearing at Council meetings, it is understood that everyone will follow these principles:
Speak only for yourself, not for other council members or citizens - unless specifically tasked by
your colleagues to speak for the group or for citizens in the form of a petition.
Show respect during comments and/or discussions, listen actively and do not interrupt or talk
amongst each other.
Be respectful of the process, keeping order and decorum. Do not be critical of council members,
staff or others in public.
Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive.

PROCLAIMING ARBOR DAY 2024
WHEREAS, Arbor Day provides an opportunity to celebrate the importance of trees
and forests to our economy, culture, history, and future of the state; and
WHEREAS, Trees are of great value as they provide clean air and water, shade and
energy savings,wildlife habitat, recreational opportunities, wood products, and jobs, while
also capturing and storing carbon from the atmosphere, thereby offsetting greenhouse gas
emissions; and
WHEREAS, Properly planting and caring for a diverse mix of trees makes community
forests more resilient by minimizing the impacts of diseases, insects, and other stressors
such as climate change and providing long-term community and environmental benefits; and
WHEREAS, Thoughtfully choosing, planting, and caring for a diverse mix of trees now
supports resilient communities into the future.
NOW, THEREFORE, BE IT RESOLVED THAT May 4, 2024, is hereby designated
Arbor Day in the City of Maplewood.

RESOLUTION APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS
WITH THE CITY OF MAPLEWOOD ON BEHALF OF ITS PROSECUTING ATTORNEY
AND POLICE DEPARTMENT
WHEREAS, the City of Maplewood, MNon behalf of its Prosecuting Attorney and
Police Department desires to enter into Joint Powers Agreements with the State of
Minnesota, Department of Public Safety, Bureau of Criminal Apprehension to use systems
and tools available over the State’s criminal justice data communications network for which
the City is eligible. The Joint Powers Agreements further provide the City with the ability to
add, modify and delete connectivity, systems and tools over the five-year life of the
agreement and obligates the City to pay the costs for the network connection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Maplewood,
Minnesota as follows:
1. That the State of Minnesota Joint Powers Agreements by and between the State
of Minnesota acting through its Department of Public Safety, Bureau of Criminal
Apprehension and the City of Maplewood on behalf of its Prosecuting Attorney
and Police Department, are hereby approved.

2.That the Director of Public Safety, Brian Bierdeman,or his or her successor, is
designated the Authorized Representative for the Police Department. The
Authorized Representative is also authorized to sign any subsequent amendment
or agreement that may be required by the State of Minnesota to maintain the
City’s connection to the systems and tools offered by the State.
3.That the Prosecuting Attorney, Joseph Kelley,or his or her successor, is
designated the Authorized Representative for the Prosecuting Attorney. The
Authorized Representative is also authorized to sign any subsequent amendment
or agreement that may be required by the State of Minnesota to maintain the
City’s connection to the systems and tools offered by the State.
4.That Marylee Abrams, the Mayor for the City of Maplewood, and Andrea Sindt, the
City Clerk, are authorized to sign the State of Minnesota Joint Powers
Agreements.

PUBLIC VACATION OF AN EASEMENT RESOLUTION
BE IT RESOLVED by the City Council of the City of Maplewood, Minnesota, as follows:
Section 1. Background.
1.01Steve/Stacy Poindexter and Lillian Magidow/Daniel Barthel, petitioned the
Maplewood City Council to vacate an unused public utility easement that is
entirely within the properties at 2786 and 2792 Keller Parkway.
1.02The utility easement was originally recorded within the Lake Gervais View
Addition plat on January 2, 1963.
1.03The portion of the 10-foot-wide utility easement to be vacated bisects the parcels
of Block 2, Lots 4 and 5, as shown on the Lake Gervais View Addition plat.
1.04A hearing notice on said petition was published twice in the City of Maplewood’s
official newspaper, and a written notice was mailed to the affected property
owners.
1.05On April 22, 2024, the City Council held a hearing on such petition, at which
time all persons for and against the granting of said petition were heard.
Section 2. Standards
2.01 Minnesota state statute requires that no vacation shall be made unless it appears
inthe interest of the public to do so.

3.01 The Maplewood City Council makes the following findings:
1.There is no anticipated public need for the described unused public
easement.
2.The vacation is not counter to the public interest.

BONDING GRANTS, 2023-2027
WHEREAS, the City Council of Maplewood, Minnesota has approved the grant
agreement between the City of Maplewood and the Minnesota Department of Natural
Resources for the Shade Tree Program Bonding Grants, 2023-2027.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, that:
1.The Mayor and City Manager are hereby authorized to enter into the grant
agreement.

viewing area at Maplewood Nature Center.
Recommended Action:
Motion to approve the resolution accepting a donation of patio pavers in the amount of $600.29
from The Friends of Maplewood Nature, to be installed at Maplewood Nature Center.

Background
The Friends of Maplewood Nature wishes to donate a circular patio paver kit to install around the
existing bird feeder at Maplewood Nature Center. The pavers will allow for easy sweeping and
removal of spent sunflower seed shells, which if left in place, act as an herbicide killing surrounding
plants. Pavers will also provide a hard surface for ladders used in filling the bird feeders and provide

an attractive focal point for visitors.The Friends of Maplewood Nature will purchase the paver kit,
with a value of $600.29 and donate it to the City.

MnDOT has been working on a multimodal corridor study of MN Highway 36 from Interstate 35W (I-
35W) to English Street. This study is looking at the future needs of those who travel along and
across I-35W. Work on the study began in January 2023 and is nearing completion. MnDOT will be
providing an update to the City Council about the project and will be looking for feedback from the
City Council on the alternatives for their final report.

MnDOT has been studying Highway 36 from I-35W to English Street to better understand the needs
of people who travel along Highway 36, as well as those who cross it. This study is looking at
vehicle, pedestrian, and bicycle traffic needs.
Background:
MnDOT started their study of MN Highway 36 in January 2023. The project team provided an
update on the study at the June 12, 2023 City Council meeting. The study area includes the section
of MN Highway 36 from I-35W to English Street and includes all crossing points for vehicles,
bicycles, and pedestrians. This segment of MN Highway 36 is a major east/west corridor for vehicle

traffic. It is approximately 8 miles long and lies in the cities of Roseville, Little Canada, and
Maplewood. MN Highway 36 does pose challenges for north/south traffic looking to cross MN
Highway 36, especially for pedestrians and bicycles. This study aims to take a big picture look at
what the needs and wants are for people who travel on and across MN Highway 36.
Representatives of MnDOT will provide an update on the MN 36 Corridor Study from I-35W to
English St. The study has generated three alternatives that address the safety and mobility needs
of people traveling along MN 36, as well as people walking and biking over it. MnDOT is seeking
comments on the alternatives for its final report due in June.

Background:
Strategic planning is an organizational management activity that is used to set priorities, focus
energy and resources, strengthen operations, ensure that employees and other stakeholders are
working toward common goals, establish agreement around intended outcomes/results, and assess
and adjust the organization's direction in response to a changing environment.
The City of Maplewood's Strategic Plan consists of six strategic priorities which are established by
the City Council. These priorities are supported by a series of Key Outcomes and underlying
Performance Measures, which describe desired outcomes and are a metric in measuring success.
Strategic planning is a continual journey and our plan is modified every year to ensure that it is up
to date and reflects the changing dynamics of our community. Staff met with all departments to
make modifications to the plan during the first quarter of 2024.

In 2023 the City Council authorized the purchase of 5 truck chassis. The City of Maplewood’s 2024-
2028 Capital Improvement Plan (CIP) identifies the buildout of the 5 replacement trucks. City
Council approval is needed to move forward with this purchase for the buildout of Unit 546.
Recommended Action:
Motion to approve the purchase of equipment to buildout one Public Works 1-ton truck and direct
the Mayor and City Manager to enter into a contract for the purchase under MN State Contract with
ABM Equipment for the total purchase cost of $84.200.00.

Use of Reserves Other: The 2024 CIP identifies $165,000.00 for
the buildouts of 5 Public Works trucks. The truck chassis for the fourth truck, Unit 546, has been
received. The cost of the buildout for this truck is $84,200.00. Overall, the total buildout costs for the
four vehicles received is approximately $1,600 under the approved CIP budget. The Finance
Director has confirmed the fleet fund has sufficient funds to cover the buildout cost of Unit 546. The
City has not yet received the fifth truck chassis or a revised estimated delivery date. The buildout of
the fifth truck chassis will likely be in 2025 and the cost will be accounted for in the 2025-2029 CIP
plan update.

Background:
The current 2007 utility sign truck is in need of replacement. This unit is utilized by the street
division to install and repair city signs throughout the city. The city of Maplewood owns
approximately 5,800 signs. The old unit will be sent to state auction.
For past purchases of vehicles, the agenda reports included both the cost for ordering the chassis
and the cost for the vehicle body/equipment buildout. Supply chain issues have caused a long delay
between when a truck is ordered and the when the chassis are delivered. In March of 2023, the
City Council authorized the purchase of 5 truck chassis. To date we have received 4 of the 5 truck
chassis that the City Council authorized for purchase. Supply chain issues have also resulted in
delivery delays and large increases to buildout costs.
Staff has received an accurate buildout quote for Unit 546 in the amount of $84,200.00 and is
detailed as follows:
ABM Equipment $84,200.00
Total Cost $84,200.00
The old unit will be sent to state auction once the new unit is ready. All proceeds from the auction
will be deposited in the Fleet Fund for future purchases.

Gladstone Savanna, Maplewood Nature Center and a YMCA strip along White Bear Avenue.
Funding is proposed through the Park Improvement Fund.
Recommended Action:
Motion to approve the attached Independent Contractor Services Agreement with Edge
Ecosystems for the 2024 Maplewood Open Space Prescribed Burns project and direct the Mayor
and City Manager to sign the agreement. Minor revisions as approved by the City Attorney, are
authorized as needed.

Maintaining Maplewood’s plant and wildlife communities and preventing the spread of invasive
species are important maintenance and fiscal strategies. Maintaining native vegetation is also an
important strategy for carbon sequestration, pollution mitigation and climate resilience.

Background:
Prescribed burns are a best-practice to maintaining native plant communities and to prevent
establishment of encroaching, non-native and invasive plant species. Prescribed burns release
nutrients for existing native plants and allows more light to penetrate to soil level, increasing native
plant vigor and food and flowering resources for wildlife including pollinators.
A request for quotes to conduct prescribed burns at Prairie Farm, Beaver Creek, Gladstone
Savanna, Maplewood Nature Center and YMCA/ White Bear Avenue prairie strip was released on
April 16, 2024 and quotes were due April 26, 2024.
Four quotes were received ranging from $15,603.50 to $27,999.70. Edge Ecosystems submitted
the lowest quote and is experienced and well qualified for this project. Edge Ecosystems recently
conducted a safe and successful burn at Fish Creek for the City of Maplewood in April of 2024
which was funded through our grant partner, Great River Greening. Based on their past work
experience and their quote staff recommend entering into the agreement for 2024 Maplewood Open
Space Prescribed Burns project.

SCOPEOFSERVICES.TheCityandtheContractorherebyagreethattheContractorshall

COMPENSATION.ThetotalamountofcompensationtobepaidbytheCitytothe
ContractorpursuanttothisAgreementshallnotexceed$Allpayments

INDEPENDENT CONTRACTOR RELATIONSHIP.The Contractor's relationship with the
Cityisthatofanindependentcontractor.NothinginthisAgreementisintendedtonor

relationship.TheContractorwillnotbeentitledtoanyofthebenefitsthattheCitymay

Contractorissolelyresponsibleforandmustmaintainadequaterecordsofexpenses
incurredin the courseofperformingservicesunderthisAgreement.TheCitywillreport
amountspaidtotheContractortotheextentand in the manner requiredbylaw.
RETURNOFTHECITY'SPROPERTY.Allmaterialsincluding,withoutlimitation,
contentarticles,documents,drawings, models, apparatus, sketches, andlists,furnishedtothe
ContractorbytheCity,whetherdeliveredtotheContractorbytheCityormadebythe
ContractorintheperformanceofservicesunderthisAgreement(collectively,"City
Property")arethesoleandexclusivepropertyoftheCity.TheContractoragreestokeepall
CitypropertyattheCity'spremisesunlessotherwisepermittedinwritingbytheCity.The
ContractoragreestopromptlydelivertheoriginalandanycopiesoftheCityPropertytothe
CityatanytimeupontheCity'srequest.UponterminationofthisAgreementbyeitherparty
foranyreason,theContractoragreestopromptlydelivertotheCityordestroy,attheCity's
option,theoriginalandanycopiesoftheCityProperty.Withinfivedaysafterthe
terminationofthisAgreement,theContractoragreestocertifyinwritingthattheContractor
hassoreturnedordestroyedallsuchCityProperty.
OBSERVANCE OF CITY RULES. At alltimeswhile on Citypremises,the Contractor will
observetheCity'srulesandregulationswithrespecttoconduct,healthandsafety,and
protection of personsandproperty.

6.NOCONFLICTOFINTEREST.During the termofthisAgreement, theContractor will
notacceptwork,enterintoacontract,oracceptanyobligationinconsistentorincompatible
with theContractor Services under this Agreement.TheContractor warrants that, to the
best of its knowledge, there is no other contract or duty on the Contractor's part which
conflictswithoris inconsistent withthisAgreement.TheContractoragrees toindemnify
the City from any and all loss or liability incurred by reason of the alleged breach by the
Contractorofany servicesagreementwithanythirdparty.
7.TERMANDTERMINATlON.
7.1.TERM.This Agreement is effective as of the Effective Dateand shall remain
effectiveuntilthedateuponwhichtheContractorcompletesallContractorServicestothe
satisfaction of the City.
7.2.TERMINATION.EitherpartymayterminatethisAgreement,withorwithout
cause, atanytimeuponfifteen(15)days' prior writtennoticetotheotherparty.
8.SUCCESSORANDASSIGNS.The Contractor may not assign or subcontract anyofits
responsibilities or duties under this Agreement without the City's prior written consent.
Subjecttotheforegoing,thisAgreementwillbeforthebenefitoftheCity'ssuccessorsand
assigns, and willbebindingon theContractor's assignees.
9.CONSEQUENTIAL DAMAGES.Neither party will be liable to the other for any
consequential,special,orincidentaldamagesarisingunderthetermsofthisAgreement.
10.NOTICES.Any notice required or permitted by this Agreement shall be in writing and
shall be delivered as follows with notice deemed given as indicated: (i) by personal delivery
when delivered personally; (ii) by overnight courier upon writtenverification of receipt;
(iii)by telecopy or facsimile transmission upon acknowledgment of receipt of electronic
transmission;or(iv) by certifiedor registeredUnitedStatesmail, returnreceipt requested,
uponverificationofreceipt.Noticeshallbesenttotheaddressessetforthabove or such
otheraddressaseitherpartymayspecifyinwriting.
11.GOVERNINGLAW.ThisAgreementshallhegovernedinallrespectsbythelawsofthe
UnitedStatesofAmericaandtheStateofMinnesota.Anydisputearisingundertheterms
of this Agreement shall be venued inRamsey County, Minnesota, and the parties hereto
expressly waive anyjurisdictionalchallenges hereunder.
12.SEVERABILITY.Should any provisions of this Agreement be held by a court of
competentjurisdiction to be illegal, invalid, or unenforceable, the legality, validity, and
enforceability of the remaining provisions of this Agreement shall not be affected or
impaired thereby.
13.WAIVER.ThefailureoftheCityto strictlyenforce anytermofthisAgreement shallnot
operateorbe construed asawaiver ofanyofthe City'srightshereunder.

14.INJUNCTIVERELIEFFOR BREACH.TheContractor'sobligationsunder this Agreement
areof a unique character that gives them particular value.As such, the Contractor's breach of
any of such obligations will result in irreparable and continuing damage to the City or which
there will be no adequate remedy at law.In the event of such breach,theCitywillbe entitled
toinjunctivereliefand/oradecreeforspecific performance, and such other and further
relief as may be proper, including monetary damages if appropriate.
15.INDEMNIFICATION.The Contractor hereby agrees to defend, indemnify, and hold harmless
theCity,its officials, employees,andagentsfor any andallclaims arisingunder orin any
wayrelatedtothis Agreement.TheContractor'sdutypursuantto this Section shall survive
termination or expiration of thisAgreement.The Contractor further agrees to indemnify,
defend, and hold harmless the City from any claimby a third-partywhich is based upon
Contractor's alleged infringement of any intellectual property right.The Contractorexpressly
acknowledgesthat it shall exercise reasonable care to ensure that it does not engage in any
activities which may infringe upon third-party intellectual property rights in performance of
the Contractor Services hereunder.
16.INSURANCE.The Contractor hereby agrees that,at all times during the term of this
Agreement, the Contractor shallkeep in full force the followinginsurance policies,in no less
than the limits herein specified:
A single limit or combinedlimit or excessumbrella general liability insurance policy
of an amount of not less than $500,000 for property damage arising from one occurrence,
$2,000,000 for total bodily or personal injuries or death and/or damages arising from
one occurrence.
Asingle limit or combined limit or excess umbrella automobile liability insurance
policy, if applicable, covering owned,non-ownedand hired vehicles used regularly in
theprovisionofservicesunderthisAgreement,inanamountofnotlessthan
$500,000 per accident for property damage, $1,000,000 for bodily injuries and/or
damages to any one person, and $1,000,000 fortotal bodily injuries and /or damages
arising from any one accident.
A professional liability insurance policy covering personnel of the Contractor while
performing services under this Agreement in the following amounts: Errors and
omissions $500,000 per occurrence and $1,000,000 in total for any individual
occurrence.

17.ENTIRE AGREEMENT.This Agreement constitutes the entire agreement between the
parties relating to the subject matter and supersedes all prior or contemporaneous oral or
written agreements concerning such subject matter.The terms of this Agreement will
governallprojectassignmentsandservicesundertakenbytheContractorfortheCity.This
Agreementmayonlybechangedbymutualagreementofauthorizedrepresentativesofthe
parties in writing.
18.RECORDS ACCESS.The Contractor shall provide the City access to any books,
documents, papers, and records which are directly pertinent to the Agreement, for the
purpose ofmaking audit, examination, excerpts, and transcriptions, for three years after
finalpaymentsandallotherpendingmattersrelatedtothisAgreementareclosed.
19.DATAPRIVACY.TheContractorshallcomplywithMinnesotaStatutes,Chapter 13,the
MinnesotaGovernmentDataPracticesAct("MGDPA").DatareceivedbytheContractor
from the City in connection with performance ofthe Contractor Services is government
data within the meaning ofthe MGDPA.
20.COMPLIANCE WITH LAWS.The Contractor hereby expressly acknowledges and agrees
that it will comply with all applicable laws, including but not limited toprevailing wage,
workers compensation, non-discrimination, and any other laws which may apply.The
Contractor shall be solely responsible for any violation of such laws arising out of the
Contractor's performance ofthe Contractor Serviceshereunder.
21.GOVERNMENTAPPROVALS.TheContractorshallbesolelyresponsibleforapplying
forandobtaininganynecessarygovernmentalapprovalswhichmayberequiredrelatedto
the Contractor's completion ofthe Contractor Services.

MN DNR Invasive Species Spread Prevention Activities
Maplewood requires adherance to the DNR requirements ofactive steps to prevent or limit the
introduction, establishment, and spread of invasive speciesduring contracted work. The
contractor shall prevent invasive species from entering into or spreading within a projectsite by
cleaning equipment prior to arriving at the project site. If the equipment, vehicles, gear, or clothing
arrives at the project site with soil, aggregate material, mulch, vegetation(including seeds) or
animals, it shall be cleaned by contractor furnished tool or equipment (brush/broom, compressed
air or pressure washer) at the staging area. Staging is to be done at paved entrances to each
preserve or burn area. The contractor shall dispose of material cleaned from equipment and
clothing at a location determined by the Project manager. If the material cannot be disposed of
onsite,secure material prior to transport (sealed container, covered truck, or wrap with tarp) and
legally dispose of offsite.

The issuance of bonds will provide for necessary street improvements without undue debt burden.
Background:
The street improvement projects are included in the City’s Capital Improvement Plan and were
previously approved as individual projects for construction in 2024. Principal and interest payments
will be financed over 15 years through a tax levy. Detailed financing plans are included in the
attached report from Ehler’s.
A rating conference with S&P will be scheduled prior to the sale of the bonds. The City Council will
consider the award of bids for the bond sale on Monday, June 10, 2024.

RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE
OF GENERAL OBLIGATION IMPROVEMENT BONDS,
SERIES 2024A, IN THE PROPOSED AGGREGATE PRINCIPAL
AMOUNT OF $4,880,000
BE IT RESOLVED By the City Council of the City of Maplewood, Minnesota (the “City”) as
follows:
Section 1. Authorization.
(a)The City is authorized by Minnesota Statutes, Chapters 429 and 475, as amended
(the “Act”), to issue obligations in an amount deemed necessary to defray in whole or in part the
expense incurred and estimated to be incurred in making improvements authorized by the Act.
(b)Certain assessable public improvements in the City (the “Improvements”) have
been made, duly ordered, or contracts let pursuant to the provisions of the Act.
(c)The City proposes to issue its General Obligation Improvement Bonds,
Series 2024A (the “Bonds”), in the proposed aggregate principal amount of $4,880,000, pursuant
to the Act, to provide financing for the Improvements.
(d)The City is authorized by Section 475.60, subdivision 2(9) of the Act to negotiate
the sale of the Bonds, it being determined that the City has retained an independent municipal
advisor in connection with such sale. The actions of the City staff and municipal advisor in
negotiating the sale of the Bonds are ratified and confirmed in all aspects.
Section 2. Sale of the Bond. The City Council finds it necessary and expedient to the sound
financial management of the affairs of the City to issue the Bonds in the proposed aggregate principal
amount of $4,880,000, pursuant to the Act, to provide financing for the Improvements. The Bonds will
be issued, sold, and delivered in accordance with the Terms of Proposal to be prepared in connection with
the offering and the sale of the Bonds.
Section 3. Authority of Municipal Advisor. Ehlers and Associates, Inc. (the “Municipal
Advisor”) is authorized and directed to negotiate the Bonds. The City Council will meet on Monday,
June 10, 2024 (or such other date as the City Council shall deem appropriate), to consider proposals for
the purchase of the Bonds and to take any other appropriate action with respect to the Bonds.
Section 4. Authority of Bond Counsel. The law firm of Kennedy & Graven, Chartered, as
bond counsel for the City (“Bond Counsel”), is authorized to act as bond counsel and to assist in the
preparation and review of necessary documents, certificates, and instruments relating to the Bond. The
officers, employees, and agents of the City are hereby authorized to assist Bond Counsel in the
preparation of such documents, certificates, and instruments.
Section 5. Covenants. In the resolution awarding the sale of the Bonds, the City Council
will set forth the covenants and undertakings required by the Act.
Section 6. Official Statement. In connection with the sale of the Bonds, the officers or
employees of the City are authorized and directed to cooperate with the Municipal Advisor and

participate in the preparation of an official statement for the Bonds and to deliver it on behalf of the City
upon its completion.

expenditures made for certain costs of the Improvements, from the proceeds of the Bonds in accordance
with Treasury Regulations, Section 1.150-2 (the “Reimbursement Regulations”). All reimbursed
expenditures will be capital expenditures, costs of issuance of the bonds, or other expenditures eligible for
reimbursement under Section 1.150-2(d)(3) of the Reimbursement Regulations. This Declaration has
been made not later than sixty (60) days after payment of any original expenditure to be subject to a
reimbursement allocation with respect to the proceeds of tax-exempt bonds, except for the following
expenditures: (a) costs of issuance of bonds; (b) costs in an amount not in excess of the lesser of
$100,000 or five percent (5%) of the proceeds of an issue; or (c) “preliminary expenditures” up to an
amount not in excess of twenty percent (20%) of the aggregate issue price of the issue or issues that
finance or are reasonably expected by the City to finance the project for which the preliminary
expenditures were incurred. The term “preliminary expenditures” includes architectural, engineering,
surveying, soil testing, bond issuance, and similar costs that are incurred prior to commencement of
acquisition, construction, or rehabilitation of a project, other than land acquisition, site preparation, and
similar costs incident to commencement of construction.

Policy Issue:
Plans and specifications for the 2024 Maplewood Street Improvements, City Project 23-08 were
approved by Council on March 25, 2024. The plans and specifications were subsequently
advertised for bids and a bid opening was held on April 24, 2024. These bids have been tabulated
and checked for accuracy, with Forest Lake Contracting submitting the lowest responsible bid. The
City Council will consider approving a resolution to receive bids and award a construction contract
to Forest Lake Contracting for the 2024 Maplewood Street Improvements, City Project 23-08.
Receiving bids and awarding a contract is one of the last steps in the public improvement process
prior to starting construction on a street improvement project.
Recommended Action:
Motion to approve the resolution receiving bids and awarding a construction contract for the 2024
Maplewood Street Improvements, City Project 23-08, to Forest Lake Contracting for the Base Bid
and Bid Alternate 1.

The street and utility improvements included in this project represent an investment into the City’s
infrastructure and considers the needs of area property owners. This project includes
environmentally sound construction methods, reusing materials onsite, utilizing recycled products
where possible, reducing runoff, and improving the quality of water reaching area waterbodies.
Background
The streets included in the 2024 Maplewood Street Improvements total approximately 4.3 miles in
length and consist of streets in the following two areas:
East Shore Drive Area: This area is generally bounded by Frost Avenue to the north, Lake
Phalen to the west, Larpenteur Avenue to the south, and Birmingham Street to the east.
Cypress-Maple
wood Drive Area: This area is generally bounded by Beam Avenue to the
north, Keller Parkway to the west, Gervais Avenue to the south, and Hazelwood Avenue to
the east.
This project is a part of the 2024 – 2028 Maplewood Capital Improvement Plan (CIP). The project
is a combination of a pavement rehabilitation (Maplewood Drive-Cypress Area) and full
reconstruction type improvements (East Shore Drive Area). The proposed improvements include
the following:
Pavement Rehabilitation Streets:
Full depth reclamation of existing pavement and underlying aggregate base.
Removal of excess reclaim material to accommodate new pavement section.

Offsite Improvements:
Sanitary sewer lining of deteriorating mains within the project area and throughout the
City.
Fog seal of past project streets.
Replacement of failing wooden timber retaining wall on Gervais Avenue, just east of
Maplewood Drive (Bid Alternate 1). This retaining wall replacement was originally
proposed with the Woodlynn-Southlawn Street Improvements, City Project 22-17. The wall
was not replaced during that project due to the contractor, T.A. Schifsky and Sons, Inc.
going out of business.
Four valid bids were received for this project. A summary of the bids, including Bid Alternate 1, are
shown below. The bids have been checked and tabulated for accuracy. The Engineer’s Estimate for
project construction cost was $9,457,817.65. The lowest bid from Forest Lake Contracting of
$8,636,221.30 is approximately $821,600 (9%) lower than the Engineer’s Estimate.

The City has worked successfully with Forest Lake Contracting as a prime-contractor in the past
during the Highway 36 & English Street Improvements in 2013, and during the Kenwood Area
Street Improvements in 2006. Staff finds the bids received competitive and responsible in nature
and are recommend awarding the Base Bid and Bid Alternate 1 to the low bidder, Forest Lake
Contracting.
Budget Impact:
The currently approved funding plan (shown below), established at the feasibility stage of the
project, is $10,878,200. The total estimated project cost based on the low bid (including 12%
indirect costs and a 10% contingency) is $10,639,800, roughly $238,400 below the current funding
plan.

RESOLUTION
RECEIVING BIDS AND AWARDING CONSTRUCTION CONTRACT
WHEREAS, pursuant to resolution passed by the City Council on March 25, 2024,
approving plans and specifications and advertising for bids for 2024 Maplewood Street
Improvements, City Project 23-08, and
WHEREAS, the plans and specifications were advertised for bids pursuant to Minnesota
Statutes, Chapter 429, and
WHEREAS, bids were received and opened on April 24, 2024 at 10:00 A.M.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA that the combined Base Bid and Bid Alternate No.1 of Forest lake Contracting in
the amount of $8,636,221.30 is the lowest responsible bid for the construction of 2024
Maplewood Street Improvements, City Project 23-08, and the Mayor and the City Manager are
hereby authorized and directed to enter into a contract for the combined Base Bid and Bid
Alternate 1 with said bidder for and on behalf of the City.
The previously approved financing plan for the 2024 Maplewood Street Improvements,
City Project 23-08 is shown below.
