Resolution 24-02-2291 REQUESTING RAMSEY COUNTY TO RESTRICT PARKING ON MCKNIGHT ROAD BETWEEN BEAM AVENUE AND INTERSTATE HIGHWAY 694 WHEREAS, McKnight Road (CSAH 68) is a Ramsey County State Aid Route, and WHEREAS, Ramsey County has proposed a mill an overlay project on McKnight th Road Between 11Avenue and Interstate Highway 694, and th WHEREAS, Ramsey County will be converting McKnight Road, between 13Avenue and Interstate Highway 694, from a 4-lane to 3-lane road, and WHEREAS, the existing road facilities for the section of McKnight Road between Beam Avenue and Interstate Highway 694 currently does not provide adequate width for parking on the street, and WHERAS, the section of McKnight Road between Beam Avenue and Interstate Highway 694 will have dedicated bike lanes, which require the section of McKnight Road between Beam Avenue and Interstate Highway 694 to be signed as a No Parking area. Seconded by CouncilmemberLeeAyes– All The motion passed. 6.Resolution Appointing Additional Election Judges for the 2024 Presidential Nomination Primary Election annmoved to approve the resolution listing additional election CouncilmemberJuenem judges for the 2024 Presidential Nomination Primary Election to be held on March 5, 2024. Chris Campbell, with CWP West LLC, addressed council, answered questionsand provided further information. Resolution 24-02-2293 CONDITIONAL USE PERMIT RESOLUTION BE IT RESOLVED by the City Council of the City of Maplewood, Minnesota, as follows: Section 1. PIN: 022922210025 Section 2. Standards. 2.01General Conditional Use Permit Standards. City Ordinance Section 44- 1097(a) states that the City Council must base approval of a Conditional Use Permit on the following nine standards for approval. 1.The use would be located, designed, maintained, constructed, and operated to be in conformity with the City’s Comprehensive Plan and Code of Ordinances. 2.The use would not change the existing or planned character of the surrounding area. 3.The use would not depreciate property values. 4.The use would not involve any activity, process, materials, equipment, or methods of operation that would be dangerous, hazardous, detrimental, disturbing, or cause a nuisance to any person or property because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water run-off, vibration, general unsightliness, electrical interference or other nuisances. 5.The use would not exceed the design standards of any affected street. 6.The use would be served by adequate public facilities and services, including streets, police and fire protection, drainage structures, water and sewer systems, schools and parks. 7.The use would not create excessive additional costs for public facilities or services. 8.The use would maximize the preservation of and incorporate the site’s natural and scenic features into the development design. 9.The use would cause minimal adverse environmental effects. Section 3. Findings. 3.01The proposal meets the specific conditional use permit standards. February 26, 2024 City Council Meeting Minutes Council Packet Page Number 7 of 92 7 E1 Section 4. City Review Process 4.01The City conducted the following review when considering this conditional use permit request. 1.On January 16, 2024, the planning commission held a public hearing. City staff published a hearing notice in the Pioneer Press and sent notices to the surrounding property owners. The planning commission gave everyone at the hearing a chance to speak and present written statements. The planning commission recommended that the city council approve this resolution. 2.On February 26, 2024, the city council discussed this resolution. They considered reports and recommendations from the planning commission and city staff. Section 5.City Council 5.01The city council hereby approvesthe resolution. Approval is based on the findings outlined in section 3 of this resolution. Approval is subject to the following conditions: 1.All construction shall follow the approved plans. The planning staff may approve minor changes. 2.The proposed construction must be substantially started within one year of council approval or the permit shall become null and void. 3.The city council shall review this permit in one year. 4.The applicant must meet all the conditions outlined in the design review resolution for this project. 5.This resolution approves the parking as proposed onsite: (3) off-street parking stalls in the southeast corner of the property, (9) vacuum stalls on the east side of the building, and (25) stacking stalls. 6.If a parking shortage develops on-site, the city council will require additional parking spaces to be installed. 7.Water from the motor vehicle wash shall not drain onto a public street or access. Site and Building Plan Standards and Findings. 2.01 City ordinance Sections 2-286(3) and 2-290(b) require the community design review board to hold a public meeting to review the application and make specific findings to approve design plans. The community design review board held a public meeting on January 16, 2024, and recommended that the city council make the following findings to approve the design plans: 1.That the design and location of the proposed development and its relationship to neighboring, existing or proposed developments and traffic is suchthat it will not impair the desirability of investment or occupation in the neighborhood; that it will not unreasonably interfere with the use and enjoyment of neighboring, existing or proposed developments; and that it will not create traffic hazards or congestion. 2.That the design and location of the proposed development are in keeping with the character of the surrounding neighborhood and are not detrimental to the harmonious, orderly and attractive development contemplated by this article and the city's comprehensive municipal plan. February 26, 2024 City Council Meeting Minutes Council Packet Page Number 9 of 92 9 E1 3.That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors, and that it is aesthetically of good composition, materials, textures and colors. Section 3. City Council Action. 3.01The above-described site and design plans are hereby approved based on the findings outlined in Section 2 of this resolution. Subject to staff approval, the site must be developed and maintained in substantial conformance with the design plans. Approval is subject to the applicant doing the following: 1.Repeat this review in two years if the city has not issued a building permit for this project. 2.Obtain approval of a conditional use permit for a motor vehicle wash. 3.All requirements of the fire marshal, city engineer, and building official must be met. 4.A drainage system shall be installed, subject to the approval of the city engineer. 5.Satisfy the requirements in the city engineering review authored by Jon Jarosch, dated January 4, 2024. 6.Satisfy the requirements in the city environmental review authored by Shann Finwall and Carole Gernes, dated January 4, 2024. 7.The applicant shall obtain all required permits from the Ramsey- Washington Metro Watershed District. 8.Rooftop vents and any mechanical equipment shall be located out of view from all sides of the property and screened as required by city ordinance. 9.This approval does not include signage. All signage must meet the city’s sign ordinance requirements. The applicant must apply for a sign permit before installation of any signs on the site. 10.Before the issuance of a building permit, the applicant shall submit for staff review and approval the following items: a.The applicant shall provide the city with a cash escrow or an irrevocable letter of credit for all required exterior improvements. Theamount shall be 150 percent of the cost of the work. b.The site has an oil pipeline and overhead transmission line easements. The applicant shall provide documentation from the easement holder authorizing the proposed project details and overall site design as shown on the applicant’s plans. The applicant must submit an updated landscape plan per the recommendations outlined in the environmental review dated January 4, 2024. 11.The applicant shall complete the following before occupying the building: a.Replace any property irons removed because of this construction. b.Provide continuous concrete curbs and gutters around the parking lot and driveways. c. Install all required landscaping and an in-ground lawn irrigation system for all landscaped areas. d.Install all required outdoor lighting. e.Install all required sidewalks and trails. 12.If any required work is not done, the city may allow temporary occupancy if: a.The city determines that the work is not essential to public health, safety or welfare. b.The above-required letter of credit or cash escrow is held by the City of Maplewood forall required exterior improvements. The owner or contractor shall complete any unfinished exterior improvements by June 1 of the following year if occupancy of the building is in the fall or winter or within six weeks of occupancy of the building if occupancy is in the spring or summer. 13.All work shall follow the approved plans. The owner shall maintain and repair the fence so that it remains in good condition and 100 percent opaque. 6. There shall be no noise-making business activity conducted on the property, or made by vehicles entering or leaving the lot, between 7 p.m. and 7 a.m., Monday through Saturday, and not on Sunday as required by city code. This condition shall not prohibit business activity on the property during these hours so long as the business activity does not otherwise violate the provisions of the city ordinance regulating noise. 7. The proposed construction and the outdoor storage on the property must be substantially started within one year of council approval or the permit shall become null and void. The council may extend this deadline for one year. 8. The city council shall review this permit in one year. 9. The property shall meet the hard surface parking and minimum space requirements as required by ordinance. 10. All construction shall follow the project plans as approved by the city. This shall include providing a driveway to the gate of the storage yard, subject to the requirements of the fire marshal. 11. The property owner shall keep the site clean of debris and shall cut or remove any noxious weeds. 12. City staff utilize the bituminous materials for pothole, curb, and shoulder repairs. Background: An allocation is made in the Public Works operating budget each year for the purchase of bituminous materials in order to maintain roads through patching, spot paving, shouldering and bituminous curb repairs. It is anticipated that the cost for the bituminous purchases will be $85,000 for the 2024 maintenance season. Council Packet Page Number 91 of 92 G9 The proposedsupplier of the bituminous materials is T.A. Schifsky and Sons due to their nearby location in North St. Paul and their competitive pricing. Staff has been informed that T.A Schifsky’s and Sons may be closing their bituminous plant business and marketing their property for sale sometime this spring. This closure would have an impact on where bituminous material is purchased from in 2024. In the past, one of the big reasons we have typically used T.A. Schifsky’s and Sons was their close proximity to our city. This allowed for quick and effective pavement repairs. The second closest asphalt plant is owned by the City of St. Paul, requiring an approximate 60-minute round trip. The extra travel time per load will have an impact on the efficiency of the City’s bituminous maintenance operations. There are additional options for purchasing of bituminous materials. These options include locations such as Minnesota Paving and Materials in Lakeland MN, Martin Marietta in St Paul MN, and Bituminous Roadways Columbus, MN. If T.A. Schifsky’s plant is shut down, staff will evaluate the available options to determine where the best location for purchasing bituminous will be based on travel time and cost of material.
