C~OMMUNITY DESIGN REVIEW BOARD
This outline has been prepared to explain the review process of this meeting. The
review of an item usually follows this format.
1. The chairperson of the meeting will announce the item to be reviewed.
The chairperson will ask the applicant or developer of the project up to the podium
to respond to the staffs recommendation regarding the proposal. The Community
Design Review Board will then discuss the proposed project with the applicant.
The chairperson will {hen ask the audience if there is anyone present who wishes
to comment on the proposal.
After everyone is the audience wishing to speak has given his or her comments,
the chairperson will close the public discussion portion of the meeting.
The Board will then discuss the proposal. No further public comments are allowed.
The Board will then make its recommendations or decision.
Most decisions by the Board are final, unless appealed to the City Council. You
must notify the City staff in writing within 15 days to register an appeal.

VI. DESIGN REVIEW
A. National Tire Warehouse---White Bear Avenue
Steve Johnston, president of Landform Engineering Company (civil engineers for the project),
was present representing National Tire Warehouse. Mr. Johnston explained the project and
answered questions from the board members. He said they are proposing to enhance and
improve the buffer area. Danny Smith of Embree Construction Group, Inc., the general
contractor, was also at the meeting. Mr. Smith described the building and how it functions.

Boardmember Robinson moved the Community Design Review Board recommend:
Approval of the plans, date-stamped January 30, 1997, for proposed National Tire
Warehouse on White Bear Avenue, based on the findings required by the code. Approval
is subject to the following conditions:
1. Repeat this review in two years if the city has not issued a building permit for this
project.
2. Before getting a building permit, the applicant shall:
Dedicate and record a wetland-buffer easement for that part of the wetland buffer
on the National Tire Warehouse site. This easement shall describe the boundary
of the wetland buffer and prohibit any building, mowing, cutting, filling or dumping
within the buffer.
b. Dedicating a drainage easement over that part of the entire property (including
the area on the abutting site to the south) below the elevation 919.5.
c. Revise the plans as follows for staff approval:
(1) Substitute the amur maple trees with another species, for example, a variety
of crab apple tree.
(2) Substitute the MnDOT seed mix #1200 with mix #250 as requested by the
watershed district.
(3)
Show sod on the north, south and west sides of the building. The only seed
allowed may be behind the building. The areas to be sodded include the
contiguous parts of the Mogren property to the north and the boulevard.
(4) Revise the site plan to show a 24-foot-wide driveway connection to the
Mogren Brothers Landscaping site.
d. Submit grading, drainage, utility and erosion control plans to the city engineer for
approval.
e. Dedicate and record cross easements for access between this site and the
abutting properties.
The color now indicated on the plans as black will be a shade of blue. Samples of
this blue color will be subject to staff review.
3. The applicant shall complete the following before occupying the building:
a. Install reflectorized stop signs at both exits, a handicap parking sign for each
handicap parking space and an address on the building.
b. Post a "no left turn" Sign at the southerly curb cut.

c. Provide continuous concrete curb and gutter on both sides of the southerly
driveway as shown on the site plan.
d. Paint the rooftop mechanical equipment to match the color of the upper part of
the building. (code requirement) The community design review board waives the
requirement for enclosures around this equipment.
e. Construct the trash dumpster enclosure of the same materials and color as the
building,
f. Install an in-ground lawn irrigation system for all landscaped areas. (code
requirement)
g. Install signs at the edge of the wetland-protection buffer which prohibit any
building, mowing, cutting, filling or dumping within the buffer.
4. If any required work is not done, the city may allow temporary occupancy if:
a. The city determines that the work is not essential to the public health, safety or
welfare.
b. The city receives a cash escrow or an irrevocable letter of credit for the required
work. The amount shall be 150% of the cost of the unfinished work.

This approval does not include the signs. Signage will be reviewed by staff through
the sign permit process.
All work shall follow the approved plans. The director of community development may
approve minor changes.

Cellular Telephone Tower Site for American Portable Telecom, Inc.--~SW Corner of English
Street and Gervais Avenue
Micheiie Johnson, representing American Portable Telecom, said she had reviewed the staff
report and concurred with the recommendations. Ms. Johnson explained that one electrical
cabinet would be 5 feet high, 3 feet wide and 3 feet deep. This single receptacle would be set
slightly apart from a row of three smaller cabinets. They are an off-white color and would be
surrounded by a barbed-wire fence. Ms. Johnson said the pole is hollow and constructed of
galvanized metal that weathers to a sky gray color.
According to Ms. Johnson, the grass inside the fenced area will be cut and any debris will also
be removed. The access road will be gravel.

Boardmember Vidyashankar moved the Community Design Review Board recommend:

Approval of the plans, date-stamped February 12, 1997, for a 165-foot-tall
telecommunications monopole and equipment on the vacant property on the southwest
corner of English Street and Gervais Avenue. Approval is based on the findings required
by code and subject to the applicant doing the following:
1. Repeat this review in two years if the city has not issued permits for this project.
Before getting a building permit, provide a grading, drainage, driveway and erosion
control plan to the city engineer for approval. The erosion control plan shall meet all
ordinance requirements.
3. Before getting a certificate of occupancy, the applicant shall remove and dispose of
any debris and ensure that the site is cleaned up.
4. If any required work is not done, the city may allow temporary occupancy if:
a. The city determines that the work is not essential to the public health, safety or
welfare.
b. The city receives a cash escrow or an irrevocable letter of credit for the required
work. The amount shall be 150% of the cost of the unfinished work.
5. All work shall follow the approved plans. The director of community development may
approve minor changes.
6. The color of the pole shall conform to the existing code. If there is any deviation, it
shall be subject to staff approval.

B. Rules of Procedure RevisionmMeeting Start Time
Secretary Ekstrand presented the staff report. He said either the 6 or 6:30 p.m. starting time
was optional. Boardmember Robinson had no objection to either time. Boardmember
Johnson would prefer 6 p.m. Boardmember Vidyashankar said he sometimes has a conflict
with his children's schedules but he wasn't certain how often. Mr. Ekstrand reported that Matt
Ledvina, the new board member, said he was okay with both times but occasionally the 6
p.m. time might be "a little tight."
Boardmember Johnson moved the Community Design Review Board recommend amending
the community design review board rules of procedure to change the meeting start time from
7 p.m. to 6 p.m. This starting time will be subject to review in six months.

Design Review - Lakes Orthodontic Clinic
Cope Avenue, east of undeveloped Kennard Street
March 17, 1997
INTRODUCTION
David Goehring Architects, is requesting approval to build a 3,657-square-foot medical office
building for Lakes Orthodontic Associates, P.A. This building would be on the south side of
Cope Avenue, east of the Maple Shores Townhomes. Refer to pages 6-8.
The proposed building would have an exterior of cedar board and batten siding stained green.
The roof would have asphalt shingles.
DISCUSSION
Building Materials and Design
The city strives for commercial buildings that have no-maintenance exteriors. Although the
proposed cedar siding would require a restaining at some point, it would be compatible with
other nearby buildings. For example, the Maple Shores Townhomes and the Sheet Metal
Workers Credit Union both have wood exteriors and have been kept in good condition. The
Maplewood Office Park and Cope Avenue Professional Building also have wood exteriors with
additional accent materials. The proposed building, with its gable-roof design, would also be
more compatible with the nearby homes than a typical flat-roofed building. Staff is in favor of the
proposed building based on these reasons.
Site Plan Considerations
The site plan shows a 13-foot parking lot setback from the north lot line. The grading and
erosion control plan shows 15 feet as code requires. The plans submitted for the building permit
should show a 15-foot setback to comply with the code.
The handicap-accessible parking requirements of the ADA (Americans with Disability Act)
requires that the striped loading aisle between the two handicap parking stalls be eight feet wide.
This area is shown at five feet. The applicant should revise the plan to provide eight feet.
Screening
The city code requires a six-foot-tall, 80% opaque visual screen along the south lot line. The
property at 1665 Lark Avenue, south of the proposed building, already has a wooden screening
fence in place. However, to meet code the applicant must provide a visual screen south of the
proposed parking lot in back of 1673 Lark Avenue. A continuation of the fence would be a
logical way to provide this screening.
Landscaping
On August 12, 1996, the city council directed staff to apply the Chanhassen Landscaping
Ordinance on a trial basis to landscaping proposals we review for the next year. This ordinance
bases the minimum amount of landscaping required on the cost of the proposed construction.
The Chanhassen code requires that the developer spend at least 2% of the project cost on
landscaping. (The code requires that the minimum landscape value include only expenditures
on trees and plant materials. It does not include sod, seed, labor and grading.)
The applicant told me that they do not yet have a project cost estimate. Staff will attempt to get
this data by the time of the meeting. In spite of not having this information. The proposed
landscaping looks attractive and acceptable, with the exception of extending the screening fence
as mentioned above.
Engineering Comments
Ken Haider, the Maplewood City Engineer, recommended that the applicant revise the
grading/drainage plan showing a catch basin near the rear property line. Runoff from the
parking lot and the back part of the site should be directed th.rough a grassy swale to this catch
basin. This catch basin should be connected to the existing one on the adjacent lot. The
applicant should also close off and curb over the existing curb cut along Cope Avenue.
RECOMMENDATION
Approve the plans (stamped March 4, 1997) for Lakes Orthodontic Associates, P.A., based on
the findings required by the code. The developer shall do the following: '
1. Repeat this review in two years if the city has not issued a building permit for this project.
2. Complete the following before the city issues a building permit:
a. Provide a grading, drainage, utility and erosion control plan to the city engineer for
approval. The erosion control plan shall be comply with ordinance requirements. The
grading and drainage plan shall show a catch basin near the rear property line. Runoff
from the parking lot and the back part of the site should be directed through a grassy
swale to this catch basin. This catch basin should be connected to the existing one on
the adjacent lot.
Revise the site plan with the following details for staff approval:
(1) Show the closing of the existing curb cut along Cope Avenue. The applicant shall
sod the boulevard and extend the street curb in this area.
(2) Provide a 15-foot parking lot setback from the Cope Avenue right-of-way line.
(3) Provide an eight-foot-wide loading space between the handicap stalls.
(4) Show a six-foot-wide, 80% opaque decorative wood screening fence adjacent to
1673 Lark Avenue. This fence shall be in addition to the proposed landscaping and
shall match the existing fence behind 1665 Lark Avenue in design.

Revise the landscape plan as follows for staff approval:
(1) Substitute the Amur Maples with a native and comparable species.
(2) Show all overstory deciduous trees to be at least 2 1/2 inches in caliper, balled and
burlapped, all coniferous trees to be at least six feet tall, balled and burlapped and all
ornamental trees to be at least 1 1/2 inches in caliper, balled and burlapped.
(3) Show sod in all turf areas.
3. Complete the following before occupying the building:
a. Replace property irons that are removed because of this construction.
b. Restore and sod-damaged boulevards.
c. Install a reflectorized stop sign at the exit, a handicap-parking sign for each handicap-
parking space and an address on the building.
d. Construct the trash dumpster enclosure with materials to match the building. The
enclosure must have a 100% opaque closeable gate.
e. Install and maintain an in-ground sprinkler system for all landscaped areas.
f. Install site security lights. Site lights must be designed and installed so that they do not
cause any nuisance for abutting neighbors or drivers.
4. If any required work is not done, the city may allow temporary occupancy if:
a. The city determines that the work is not essential to the public health, safety or welfare.
b. The city receives a cash escrow or an irrevocable letter of credit for the required work.
The amount shall be 150% of the cost ofthe unfinished work.
5. This approval does not include the signs.
6. All work shall follow the approved plans. The director of community development may
approve minor changes.
Appeals
Anyone may appeal the community design review board's (CDRB) decision.' Appeals must be
received within 15 days of the CDRB's action. Appeals are reviewed by the city council.

PAST ACTION

Kennard Street right-of-way to the proposed clinic site. This section of vacated right-of-way had
been part of the Maple Shores Townhomes property.

interfere with the use and enjoyment of neighboring, existing or proposed developments; and
that it will not create traffic hazards or congestion.-
That the design and location of the proposed development is in keeping with the character of
the surrounding neighborhood and is not detrimental to the harmonious, orderly and
attractive development contemplated by this article and the city's comprehensive municipal
plan.
That the design and location of the proposed development would provide a desirable
environment for its occupants, as well as for its neighbors, and that it is aesthetically of good
composition, materials, textures and colors.

Design Review - 3-Plex
South of townhomes at 1994 Clark Street
March 20, 1997
INTRODUCTION
Richard Schreier is requesting approval of plans to build a 3-plex at the northeast corner of Clark
Street and Vernon Avenue. Refer to the maps on pages 4-6. This 3-plex would have horizontal
lap siding with an accent of vertical aluminum siding. Colors would be earth tones. Each unit
would have a two-car, tuck-under garage facing Clark Street. The decks shown would not be
built right away according to Mr. Schreier.
DISCUSSION
Building Materials and Design
Section 25-70(2) of the city code requires that the design of the proposed development be in
keeping with the character of the surrounding neighborhood... Section 36-28(c)(11) requires
that the applicant use building materials that are compatible in quality with similar development
in the area. Brick is the prominent material on the adjacent townhomes. The applicant should
put brick on the front elevation beneath the lower roof projection as well as on the sides of the
building. The brick on the side elevations would replace the proposed vertical siding. The
addition of brick would be attractive and would meet code for compatibility.
In addition to the brick, the applicant should revise the building elevations as follows to enhance
the building appearance:
1. Add a small roof over the side doors. This would also provide cover from the rain.
2. Add another window on the side elevations toward th® front of the building to give a
balanced appearance with the proposed upper side windows.
3. Add window shutters on the side elevations.
4. Provide metal, raised-panel garage doors painted the same color as the trim. (The applicant
is proposing raised-panel doors, though the plans show fiat door sections.)
5. Install a decorative shingle such as Timberline shingles rather than a solid-color material.
The shingles should be a color to compliment the brick.
Landscaping
The applicant proposes to sod the entire yard and plant six soft maples. Section 36-28(c)(9)
requires that the applicant install an underground lawn irrigation system.
The applicant should add foundation plantings along the south side of the building to soften the
view from the street.
Chanhassen Landscaping Code
On August 12, 1995, the city council directed staff to apply the Chanhassen Landscaping
Ordinance, on a trial basis, to landscaping proposals we review for the next year. This
ordinance bases the minimum amount of landscaping required on the cost of the proposed
construction. It requires that a developer spend 2 percent of the cost of the project on
landscaping. (The code requires that the minimum landscape value include only expenditures
on trees and plant materials. It does not include sod, seed, labor and grading.)
At a conservative construction estimate of $150,000 for this building, the applicant would have to
spend $3000 on trees. At an estimated cost of $300 per tree, the applicant would have to plant
ten trees-six are proposed.
The applicant would not meet the Chanhassen ordinance. The number of trees and shrubs
should be increased to meet this requirement.
RECOMMENDATION
Approve the plans (stamped March 19, 1997) for the proposed 3-plex on the northeast corner of
Clark Street and Vernon Avenue. The applicant shall do the following:
1. Repeat this review in two years if the city has not issued a building permit for this project.
2. Provide the following for staff approval before the city issues a building permit:
a. A certificate of survey showing the proposed building placement. (code requirement)
b. Revised building elevations for staff approval showing:
(1) Brick on the front elevation below the lower roof. The brick shall wrap around onto
the side elevations in the areas shown as vertical siding.
(2) A small roof over the doors on the side elevations.
(3) Another window on the side elevations toward the front of the building as a balance
to the one already proposed.
(4) Window shutters on the side elevations as well as the front.
(5) Metal, raised-panel garage doors painted the same color as the trim.
(6) Decorative shingles, such as Timberline, rather than a solid-color material. The
shingles shall be a color compatible with the brick.
3. Revise the landscape plan for staff approval showing:
Sod on all parts of the yard and boulevard.
Foundation plantings on the south side of the building.
Ten overstory trees that are at least 2 1/2 inches in caliper, balled and burlapped, or
propose a landscape plan that meets the Chanhassen 2 percent-cost-of-the-project
landscape requirement.
Install and maintain an in-ground sprinkler system for all landscaped areas. (code
requirement)

INTRODUCTION
On April 25, 1995, the community design review board (CDRB) approved plans for a Batteries
Plus store at the northeast corner of Radatz and White Bear Avenues. Condition One requires
that the applicant 'repeat this review in two years if the city has not issued a building permit for
this project."
The applicant, Cliff Snyder of CMD Properties Inc., is requesting that the CDRB grant a one-year
time extension since he has not obtained a building permit within the two-year deadline. Refer to
Mr. Snyder's letter on page 2 and the memorandum on pages 5-11.
BACKGROUND
· June 14, 1996: Staff approVed a revised site plan to add a one-way driveway along the south
side of the building. Refer to pages 12-13.
DISCUSSION
Nothing has changed in the way of code changes or neighborhood conditions to warrant denial
of this time extension.
RECOMMENDATION
Approve a one-year time extension for a Batteries Plus store at the northeast comer of Radatz
and White Bear Avenues, subject to the April 25, 1995 community design review board
conditions and the June 14, 1996 staff-approval conditions.

INTRODUCTION
Cliff Snyder, of CMD Prope. rties, Inc., is requesting approval of architectural, site and
landscape plans for Batteries Plus. Refer to the maps on pages 5-7. Batteries Plus is
a battery retail store. They sell every conceivable type of battery, including car
batteries. They would have car battery testing equipment on a hand cart for testing
batteries in the parking lot. They could also replace a car's battery if the customer
needed one. The proposed building would have an exterior of rock-face concrete block
with a metal-panel fascia.
DISCUSSION
Building Materials
The code requires that commercial buildings be compatible with other commercial
buildings in the neighborhood. The existing buildings vary in their exterior materials.
Premier Bank is brick, Rapid Oil is rock-face block and Burger King is painted brick.
To be compatible with the assortment of materials in this area, staff is suggesting that
the applicant include brick into the building design as an accent material. The city
should strive for improved building materials and design whenever possible.
Building Design
The building elevations show · metal shed on the back of the building. This shed
would be used for storage. The site plan does not show this shed. At the time of this
writing, the applicant and the architect were unavailable for comment. If this metal shed
is proposed, it should be allowed only on the north side of the .building on the part of the
site zoned BC(M), (business commercial modified). This is required since the east part
of the site (the area behind the proposed building) is zoned LBC (limited business
commercial) which would not allow a storage building. This storage building should
also be constructed of the same materials as the building.

Approve the plans (stamped April 3, 1995) for Batteries Plus, subject to the findings required by
the code. The developer shall do the following:
1. Repeat this review in two years if the city has not issued a building permit for this
