This letter transmits for your review the summary report detailing work undertaken pursuant to the terms of the MOA for the reporting period of October 1, 2022, through December 31, 2022. In accordance with MOA Stipulation XV.A, the report includes an itemized listing of all actions required to be taken to implement the terms of the MOA and identifies what activities the Council has taken during the reporting period to implement those actions. If any occurred during the reporting period, the report also identifies any problems or unexpected issues encountered, any scheduling changes proposed, and any disputes and objections submitted or resolved in FTA's efforts to carry out the terms of the MOA. It also includes any changes recommended in implementation of the MOA, the name and contact information for the Council's Preservation Lead, a timetable of activities proposed for implementation within the following reporting period, and notice of the initiation of construction for individual construction bid packages, when applicable. As required by Stipulation XV.B, the Council is also notifying the public via the Project website, or other means as appropriate, about the publication of the quarterly reports to obtain public input. Per the terms of MOA Stipulation IILB.ii, signatories and concurring parties to the MOA have thirty (30) calendar days from receipt of the report to review the report and provide comments, if any, to FTA and the Council. If FTA and the Council receive any comments from the public, the Council, in accordance with Stipulation XV.B, will share the comments with the signatories and concurring parties to the MOA. In accordance with Stipulation XV.C, FTA, at its own discretion or at the request of any signatory to the MOA, may convene a meeting to facilitate review and comment on the reports, and to resolve any questions about its content and/or to resolve objections or concerns. and WHEREAS, the SPRWS is proposing to finance the Project, in part, with loans provided by the Drinking Water State Revolving Fund (DWSRF), which utilizes federal funds provided by the U.S. Environmental Protection Agency (EPA); and WHEREAS, in accordance with the letter dated December 3, 2015, the EPA has authorized the Minnesota Department of Health (MDH) to act on the federal agency's behalf when initiating Section 106 consultation in connection with DWSRF financial assistance; and WHEREAS, the MDH, acting on behalf of the EPA, has determined that the Project is a federal undertaking subject to the requirements of Section 106 of the National Historic Preservation Act (54 U.S.C. § 306108), and its implementing regulations, 36 CFR § 800; and WHEREAS, the MDH, in consultation with the Minnesota State Historic Preservation Office (SHPO), has defined the Area of Potential Effects (APE) for the Project as shown in Attachment A; and WHEREAS, the MDH, in consultation with the SHPO, has identified one historic property within the APE for the Project, the St. Paul Water Works (McCarron's Water Treatment Plant) (McCarron's WTP), which has been determined eligible for listing in the National Register of Historic Places (NRHP); and WHEREAS, the MDH, in consultation with the SHPO, has determined that there are no additional historic properties located within the APE for the Project; and WHEREAS, the Project includes the demolition of various portions of the Purification and Filtration Plant at the McCarron's WTP (including two Secondary Settling Basins, five Clarifiers, one Recarbonation Chamber, and one Flocculation Chamber) and the repurposing of other portions of the Purification and Filtration Plant at the McCarron's WTP (including another Flocculation Chamber); and WHEREAS, the MDH has determined, and the SHPO has concurred, that the Project will have an adverse effect on the McCarron's WTP and that the adverse effect cannot be avoided; and WHEREAS, the MDH invited the following federally -recognized Indigenous tribes to consult on this Project: Bois Forte Band of Chippewa, Fond du Lac Band of the Minnesota Chippewa Tribe, Grand Portage Band of Lake Superior Chippewa, Leech Lake Band of Ojibwe, Lower Sioux Indian Community, Mille Lacs Band of Ojibwe, Prairie Island Indian Community, Red Lake Nation, Shakopee Mdewakanton Sioux (Dakota) Community, Upper Sioux Community, and White Earth Nation and none of the tribal nations have expressed concerns; and WHEREAS, the SPRWS, on behalf of the MDH, has engaged with the public through City Council meetings, newspaper articles, mailers to neighbors, open houses for neighboring homeowners, collaboration with the City of Maplewood, website updates, and multiple project updates included with customer bills, and neither the public nor the engaged parties have expressed concerns about the historical impacts of the Project; and WHEREAS, the MDH and the SPRWS have consulted with the Ramsey County Historical Society, the Maplewood Historical Society, and the Maplewood Heritage Preservation Commission regarding the identification of historic properties and the effects of the Project on historic properties, and have invited them to sign this Memorandum of Agreement (Agreement) as concurring parties; and WHEREAS, the MDH and the SPRWS have also invited Historic St. Paul and the St. Paul Heritage Preservation Commission to participate in consultation but both parties declined to participate; and WHEREAS, the SPRWS has responsibilities under this Agreement and is therefore an invited signatory to this Agreement; and WHEREAS, the MDH has notified the Advisory Council on Historic Preservation (ACHP) of the Project's Adverse Effect in accordance with 36 CFR § 800.6(a)(1), and has provided the documentation specified in 36 CFR § 800.11(e) and the ACHP has chosen not to participate in the consultation; and NOW, THEREFORE, the MDH and the SHPO agree that the undertaking shall be implemented in accordance with the following stipulations in order to take into account the effect of the undertaking on historic properties. STIPULATIONS The MDH shall ensure that the following measures are carried out: History of St. Paul Water Works (McCarron's Water Treatment Plant) Book A. The SPRWS will create and publish a "coffee table" book that will include a narrative history of the McCarron's Water Treatment Plant as well as photos, illustrations, drawings, and maps. The SPRWS may hire a professional historical consultant, corporate historian, or other such firm to assist with refining the contents and preparing the book for publication. Any firm hired shall have satisfactory experience assembling deliverables of a similar nature. B. The goal of the book is to provide an engaging and comprehensive overview of the history of the McCarron's WTP. The publication is intended to capture the history of the McCarron's WTP facility, not the history of the entire SPRWS utility. The book will be written such that the content is generally understandable for members of the public who do not have a detailed knowledge of drinking water treatment and should be targeted for a junior high reading level audience. C. The SPRWS will develop an outline of the proposed book, including narrative and graphic contents (illustrations, photographs, maps), within twenty-four (24) months of the execution of this Agreement. The SPRWS will distribute a copy of the draft outline of the book to the MDH and the SHPO to ensure that the proposed content aligns with expectations and meets the intent of this stipulation. The MDH and the SHPO will have thirty (30) days to review and provide comments to the SPRWS on the outline. The SPRWS will consider and incorporate, as feasible, into the final outline any comments and recommendations made by the MDH and the SHPO. D. The SPRWS will distribute a pdf of the first draft of the book, to the MDH and the SHPO for review and comment within twelve (12) months following completion of Project construction. The completion of Project construction will be considered the date on which the last construction invoice for the Project is approved for payment by the SPRWS. The MDH and the SHPO will have thirty (30) days to provide comments on the draft. The SPRWS will incorporate, as feasible, into the final book any comments and recommendations made by the MDH and the SHPO. E. Production of the final book will be completed within eighteen (18) months following completion of Project construction. The completion of Project construction will be considered the date on which the last construction invoice is approved for payment by the SPRWS. F. The SPRWS will offer a copy of the final book to each St. Paul and Ramsey County Library Branch that is located within the SPRWS service area. G. The SPRWS will offer a copy of the final book to each consulting party that participated in consultation, including the Ramsey County Historical Society, the Maplewood Historical Society, the Maplewood Heritage Preservation Commission, the Minnesota Department of Health, and the State Historic Preservation Office. H. If feasible, the SPRWS will also make the book available for purchase by the general public. II. Video Introduction to the History of the St. Paul Water Works (McCarron's Water Treatment Plant) A. The SPRWS will create and publish a video history of the McCarron's WTP. The video history contents will be based upon the same information collected while writing and producing the coffee table book under Stipulation I of this Agreement. B. The goal of this video will be to briefly overview the history of the McCarron's WTP facility in a way that is engaging and is accessible to members of the general public who do not have a detailed knowledge of drinking water treatment. The video will seek to generate interest in the history of the facility but will not provide an in-depth facility overview. Those who are interested in a detailed overview of the history of the facility will be pointed towards the coffee table book that is being prepared under Stipulation I of this Agreement. The video is anticipated to be between five (5) and ten (10) minutes in length. C. The SPRWS will develop a draft outline of the proposed video contents and provide the draft outline to the MDH and the SHPO within twenty -our (24) months of the execution of this Agreement. The MDH and the SHPO will have thirty (30) days to provide comments on the draft outline. The SPRWS will consider and incorporate, as feasible, into the final outline for the video any comments and recommendations made by the MDH and the SHPO. D. The SPRWS will develop and share a first draft of the video within twelve (12) months following completion of Project construction. The SPRWS will distribute the draft video to the MDH and, the SHPO for review and comment. The MDH and the SHPO will have thirty (30) days to provide comments on the draft. The SPRWS will consider and incorporate, as feasible, into the final video any comments and recommendations made by the MDH and the SHPO. E. Final production of the video history will be completed by the SPRWS within eighteen (18) months following completion of Project construction. The completion of Project construction will be considered the date on which the last construction invoice for the Project is approved for payment by the SPRWS. F. The video history will be made available to the public for at least three years via a link on the SPRWS's website. III. Updated Historic Property Inventory Forms for the State Historic Preservation Office A. The SPRWS will update the following Minnesota Multiple/Individual Property Inventory Forms for properties that will be demolished or significantly modified as part of the Project, per the requirements of the Historic and Architectural Survey Manual (Revised 08/2017): o Purification and Filtration Plant, RA-MWC-0036 o St. Paul Water Works / McCarron's Water Treatment Plant, RA-MWC-0275 o Shed, RA-MWC-0279 o Shed, RA-MWC-0280 B. The updated inventory forms will be provided to the SHPO within twelve (12) months following completion of Project construction. The completion of Project construction will be considered the date on which the last construction invoice for the Project is approved for payment by the SPRWS. IV. Public Display of St. Paul Water Works (McCarron's Water Treatment Plant) Historic Photographs A. Many historic photographs of the water treatment plant are currently displayed on the McCarron's campus. The SPRWS staff will add to this historic photograph display by printing and displaying additional historic images of the water treatment plant. The goal of this effort will be to ensure that future staffers and visitors to the facility can obtain a fairly comprehensive view of the changes that have been made to the water treatment plant and facilities to make water treatment possible for the last 100 years. The SPRWS will make an effort to include these photos in spaces that are available to the public during tours of the facility such as the lobby and along the route that tour groups will travel. C. Within twelve (12) months following completion of Project construction, the SPRWS will review the photographs currently located in public areas, add additional historic photographs of the water treatment plant in appropriate locations, and provide email documentation of implementation to the MDH and the SHPO. V. Post Review Discoveries A. If previously unidentified significant historic properties (including archaeological sites) are discovered during Project activities, the SPRWS will immediately halt all Project activities within a one hundred (100) foot radius of the discovery, notify the MDH and the SHPO of the discovery, and implement interim measures to protect the discovery from looting and vandalism. B. Immediately upon receipt of this notification, the MDH and SPRWS will inspect the Project site to determine the extent of the discovery and ensure that construction activities have halted, clearly mark the area of discovery, implement additional measures, as appropriate, to protect the discovery and notify the SHPO of the discovery and measures taken to protect the site. C. The MDH, in consultation with the SPRWS and the SHPO, will follow procedures to evaluate the property per 36 CFR § 800.4, or assume National Register eligibility for the purposes of Section 106 consultation only, and either determine that "no additional historic properties are affected" or, if a newly discovered historic property is potentially affected, assess adverse effects and make a finding of effect per 36 CFR § 800.5 prior to resuming Project activities in the area of discovery. D. Treatment of Human Remains: If the inadvertent discovery contains human remains, the SPRWS shall immediately halt all Project activities within a one hundred (100) foot radius of the discovery and immediately notify the Minnesota Office of the State Archaeologist (OSA) and the county sheriff. The remains shall be secured as found and protected by the SPRWS. The SPRWS will subsequently notify the MDH and the SHPO. The suspected remains will not be further disturbed or removed until disposition has been determined by the OSA consistent with the Procedures for Implementing Minnesota's Private Cemeteries Act (Anfinson 2008). At all times, the human remains will be treated with the utmost dignity and respect, and in a manner consistent with the ACHP's Policy Statement on the Treatment of Human Remains, Burial Sites, and Funerary Objects (February 23, 2007). VI. Dispute Resolution A. Should any party to this Agreement object, in writing, at any time to the manner in which the terms of this Agreement are implemented, the MDH will consult with such party to resolve the objection. If the MDH determines that such objection cannot be resolved, the MDH will forward all documentation relevant to the dispute, to the ACHP. The ACHP will provide the MDH with its advice on the resolution of the objection within thirty (30) days of receiving adequate documentation. Prior to reaching a final decision on the dispute, the MDH will prepare a written response that takes into account any timely advice or comments regarding the dispute from the ACHP, and signatories and consulting parties to the Agreement, and provide them with a copy of this written response. The MDH will then proceed according to its final decision. B. If the ACHP does not provide its advice regarding the dispute within the thirty (30) daytime period, the MDH may make a final decision on the dispute and proceed accordingly. Prior to reaching such a final decision, the MDH will prepare a written response that takes into account any timely comments regarding the dispute from the signatories and concurring parties to the Agreement and provide them and the ACHP with a copy of such written response. C. The responsibility of the parties to this Agreement to carry out all actions under this Agreement that are not the subjects of the dispute will remain unchanged. D. If, at any time during the implementation of the measures stipulated in this Agreement, an objection should be raised by the public, the MDH will notify the signatories to this MOA of the objection and consult with the objecting party to resolve the objection. If the MDH determines that the objection cannot be resolved, the MDH will seek the recommendations or comments of the ACHP in accordance with Stipulation VI.A-B of this MOA. VII. Amendments This Agreement may be amended when such an amendment is agreed to in writing by all signatories. The amendment will be effective on the date a copy signed by all signatories is filed with the ACHP. Vill. Termination Any signatory to this Agreement may terminate this Agreement by providing thirty (30) calendar days written notice to the other signatories. The signatories must consult during the period prior to termination to attempt to agree on amendments or other actions that would avoid termination. If the Agreement is terminated and the MDH elects to continue with the undertaking, then the MDH will reinitiate review of the undertaking in accordance with 36 CFR § 800. IX. Duration This Agreement will remain in effect from the date of execution for a period not to exceed six (6) years. If the MDH anticipates that the terms of this Agreement will not be completed within this timeframe, the MDH will notify the parties to this Agreement in writing at least thirty (30) calendar days prior to the Agreement's expiration date. This Agreement may be extended by written concurrence of the signatories. If this Agreement expires and the MDH elects to continue with the undertaking, then the MDH will reinitiate Section 106 consultation of the undertaking in accordance with 36 CFR § 800. The MDH will notify the SHPO when Project construction has been completed. The completion of Project construction will be considered the date on which the last construction invoice is approved for payment by the SPRWS. X. Implementation of this Agreement A. This Agreement maybe executed in counterparts, with a separate page for each signature. This Agreement will become effective on the date of the final signature of a signatory or invited signatory. The MDH will ensure each party is provided with a complete copy and that the final Agreement, updates to appendices, and any amendments are filed with the ACHP. B. Execution of this Agreement by the MDH and the SHPO and implementation of its terms is evidence that the MDH has taken into account the effects of its undertaking on historic properties and has afforded the ACHP opportunity to comment pursuant to Section 106 of the National Historic Preservation Act.
