ADJOURNMENT Chairperson Arbuckle adjourned the meeting at 7:48 p.m. April 20, 2021 2 Planning Commission Meeting Minutes PC Packet Page Number2 of 16 F1 PLANNING COMMISSION STAFF REPORT Meeting Date June 15, 2021 REPORT TO: Melinda Coleman, City Manager REPORT FROM: Elizabeth Hammond, Planner PRESENTER: Elizabeth Hammond, Planner AGENDA ITEM: Development (PUD) parcels to PUD-Fixed District Action Requested: Motion Discussion Public Hearing Form of Action: Resolution Ordinance Contract/Agreement Proclamation Policy Issue: In September 2020, as part of the implementation efforts related to the 2040 Comprehensive Plan, recommended for approval by the Planning Commission and subsequently approved by the City Council on September 14, 2020. In relation to the ordinance, the existing PUD parcels throughout the City need to be rezoned to PUD-Fixed District. Recommended Action: Development (PUD) parcels to PUD-Fixed District. Fiscal Impact: Is There a Fiscal Impact? No Yes, the true or estimated cost is $0. Financing source(s): Adopted Budget Budget Modification New Revenue Source Use of Reserves Other: N/A Strategic Plan Relevance: Financial Sustainability Integrated Communication Targeted Redevelopment Operational Effectiveness Community Inclusiveness Infrastructure & Asset Mgmt. This ordinance will identify all existing PUD parcels throughout the City and update our zoning map accordingly. This ordinance is necessary for keeping our records relating to previous PUDs up to date and identifying new PUDs in the future. Background: The City previously modified the PUD adoption and amendment process. All existing PUD properties in the City are to be rezoned to PUD-Fixed District. The rezoning process will not change PC Packet Page Number3 of 16 F1 the specific regulations within existing PUDs but will establish the new process for creating future PUDs and amending existing PUDs. The most significant change that resulted from the PUD amendment last fall is that planned unit developments (PUD) will now be processed as a rezoning rather than as a conditional use permit. Through the rezoning, the PUD will be considered its own zoning district, have its own section in the zoning ordinance where standards are listed, and labeled on the map as PUD with a number. This will make it easier for staff and property owners to find the standards that regulate uses and structures. All existing PUDs need to be rezoned to a fixed planned unit development district and represented in this manner on the zoning map. The existing conditional use permits shall continue to govern any development. If a major amendment is needed, the conditional use permit would be replaced with a new PUD district. Staff sent a letter to all property owners that are in existing PUDs throughout the City, providing on the City website with additional information on the rezoning. Following the initial letter, staff sent out a formal public hearing notice to the same property owners. Over the past month, staff has received approximately (20) twenty calls regarding the notices. Property owners reached out to further understand how this would potentially affect their property and get their general questions answered. Staff also hosted an open house where property owners were invited to meet with staff to ask questions regarding this project. There were no major concerns or opposition to the rezoning ordinance. criteria the City Council must consider when considering a zoning map amendment. This ordinance is based on the following findings: 1. Assure itself that the proposed change is consistent with the spirit, purpose and intent of city code. 2. Determine that the proposed change will not substantially injure or detract from the use of neighboring properties or from the character of the neighborhood and that the use of the property adjacent to the area included in the proposed change or plan is adequately safeguarded. 3. Determine that the proposed change will serve the best interests and conveniences of the community, where applicable, and the public welfare. 4. Consider the effect of the proposed change upon the logical, efficient, and economical extension of public services and facilities, such as public water, sewers, police and fire protection and schools. 5.
