Maple Pond Homes which sits on a 12-acre lot was originally approved as a Planned Unit Development in 1968but has never had a comprehensive sign plan. The site has been regulated for signs based on its existing use, which is residential. The site qualifies for a comprehensive sign planbased on its size andzoningas a PUD. Recommended Action: Motion to approve a comprehensive sign plan for the Maple Pond Homes at 1854 Beebe Road Northwith the following conditions: 1.Monument Sign: One monument sign not exceeding 45 square feet is allowed along Beebe Road. The sign shall observe a 10-foot minimum setback from the property line. 2.Wall Sign: One wall sign not exceeding 24 square feet is allowed. 3.Directional Signs: Directional signs not exceeding 14 square feet and 6feet in height are allowed. 4.All signs with the exception of directional signs that meet the size and height restrictions shall be individually permitted by the city. 5.Staff may approve minor changes. The city deemed the applicant’s application complete on February 6, 2019. The initial 60-day review deadline for a decision is April 7, 2019. As stated in Minnesota State Statute 15.99, the city is allowed to take an additional 60 days if necessary to complete the review. Background On May 16, 1968, the city council approved a ConditionalUse Permit for a Planned Unit Development (PUD) allowingtheapartmentbuildings to be builtat 1854 Beebe Road. On November 15, 1999, staff approved a sign permit for a new 32 square foot monument sign for Maple Pond Homes. On January 7, 2019, staff sent ImaginalityDesignsa letter denying a sign permit request for a new 45 square foot sign because it exceededthe maximum allowed sign area for this property. On January 28, 2019, the city council denied the appeal of a sign permit for a 45 square foot monument sign at 1854 Beebe Road North. Discussion The applicant is requesting city approval for a 45 square foot monument sign at the Maple Pond Homes located at 1854 Beebe Road. This sign replaces an old 32 square foot sign at the same location. Staff received a sign permit application from Imaginality Designs proposing to install a new 45 square foot monument sign on November 29, 2018. Staff denied the permit because the sign exceeded the 32 square foot allowable sign size and suggested to the applicant to apply for a comprehensive sign plan, reduce the sign size to meet the city’s sign code,or appeal thestaff decision.The applicant appealedthestaff decision to the city council but was denied at the January 28, 2019,city council meeting.Theapplicant is now requesting city approvalfor a comprehensive sign plan for the site that will allow a 45 square foot monument sign on the property. It should be noted that duringthe process of working with the applicant on how to move forward, the applicantmovedforward and installed the sign without a permitasshown in theimage on the next page. Architectural The sign is a 45 square footmonument sign that combines two colors –white and brown with the name of the apartment home written in individual letters as shown in the image and plans on subsequent pages. Maple Pond Homes qualifies for consideration of a Comprehensive Sign Plan because it exceeds 10 acres in size and was originally approved as a PUD. Staff feels that a comprehensive sign plan for this site is not out of place and would allow the 45 square foot monument to be approved. Councilmember Juenemann movedto deny the appeal of a sign permit denial for a sign proposed at 1854 Beebe Road Northwith conditions that the sign permit and sign variance be paid and not the penalty. Your application was received by staff on November 29, 2018 and reviewed against the city’s sign ordinance. City stafffound that the monument sign you are proposingexceeds the allowable size of 32 square feet in area for signs in residential districts as stated in section 44-742 of the city code. As with all permit applicationsthat do not meet city code, city staff contacted you by phone and through email toassist you in meeting the city’s sign ordinance. Unfortunately, all efforts were unsuccessful. As such, the sign permit application you submittedfor the Maple Ponds Homes located at 1854 Beebe Road has been denied. The reason for denial is that the sign exceedsthe allowable size for signs in residential districts. You havethree options to obtain a sign permit: 1.Modify the sign to meet the City’s sign code. 2.Apply for a Comprehensive Sign Planwhich would allow flexibility from the sign code. Comprehensive Sign Plans are reviewed and approved by the City’s Community Design Review Board. I am enclosing the Comprehensive Sign Plan application. 3.Appeal staff’sdecision for denial to the City Council.Appeals can be submitted to my attention, at which time I will schedule a review of the sign permit appeal with the City Council.
