Policy Issue:
The November 6, 2018 General Election included two councilmember positions. An equal number
of votes were received by Marylee Abrams and Nikki Villavicencio for the second council seat.
Chosen by lot, Nikki Villavicencio called the coin toss and prevailed. Within the designated period,
Marylee Abrams requested a recount. The recount was held at Ramsey County Elections on
Tuesday, November 27, 2018. The city council shall act as the canvassing board, canvass the
results, determine the four challenged ballots and one found ballot, and declare the results of the
recount.
Recommended Action:
The city attorney recommends the following motions for the four challenged ballots, one found ballot
and resolution:
1. Motion to count a vote on challenged ballot #1 for Villavicencio and that a vote be counted for the
candidates other than Villavicencio or Abrams in Precinct 13.
2. Motion to count a vote on challenged ballot #2 for Villavicencio and that a vote be counted for the
candidates other than Villavicencio or Abrams in Precinct 7.
3. Motion to count votes on challenged ballot #3 for both Villavicencio and Abrams in Precinct 12.
4. Motion to not count a vote on challenged ballot #4 for Villavicencio and that the vote for Abrams
on this ballot be counted in Precinct 12.
5. Motion to count a vote on found ballot for Abrams and that a vote be counted for the candidates
other than Villavicencio or Abrams in Precinct 10.
6. Motion to approve the resolution canvassing results of recount for councilmember from the
November 27, 2018 recount.

Minn. Stat. 205.185 requires the governing body of a city conducting an election to act as the
canvassing board, canvass results and declare the results of an election.
Background
The tie in the number of votes cast for Marylee Abrams and Nikki Villavicencio in the November 6
General Election was determined by the toss of a coin in the manner provided by Minn. Stat.
204C.34 on November 13 during the canvassing of the General Election results. By selecting a
number between one and ten which was closest without going over to a number drawn at random,
Councilmember Candidate Villavicencio called the coin toss and prevailed. A written request for a
recount from Candidate Abrams was received on November 13.
The requested recount on November 27, 2018 was open to the public. The focus of the recount
was the votes cast for the two candidates, Marylee Abrams and Nikki Villavicencio. Four counting
teams sorted and counted the 17,840 ballots per the Secretary of State 2018 Recount Guide.
There were four challenged ballots which will be presented to the canvassing board for final
determination. Voter intent should be decided per Minn. Stat. 204C.22 and the abstract will be
modified to reflect the determinations.
Upon counting Precinct 10, one ballot and one vote for Marylee Abrams was unavailable for
examination. An exhaustive search was conducted on November 27 at Ramsey County and an
additional search at city hall on November 28 led staff to the election night's Precinct 10 spoiled
ballot envelope. In the precinct's spoiled ballot envelope were several defective ballots and one
non -defective ballot which also had a vote for Abrams and another candidate. The collective
agreement between county and city staff is that this is the ballot which was searched for extensively
on November 27.
Ramsey County has provided an Abstract of Votes Cast — Recount for Councilmember detailing the
results from the November 27, 2018 recount. Upon determination of the challenged and found
ballots by the canvassing board, the abstract and resolution will be modified to show the final
declaration of results.
Pursuant to Minn. Stat. 205.185, the issuance of the certificate of election to the successful
candidate will occur after the contest time has expired and the required certificate of filing per Minn.
Stat. 211A.05 has been submitted. The four-year term will begin January 7, 2019.

Ramsey County Elections
Process for Recount for Council Member in City of Maplewood
The following is a description of the process to be used to conduct the recount for Council
Member for the City of Maplewood.
1. There will be four counting teams to sort and count the ballots. Each team will count
one precinct at a time. Each candidate or a candidates' representative may observe the
ballots as they are sorted. After they have been sorted, one additional representative
per candidate may observe the ballots while they are being counted. If other election
materials are handled or examined by the recount officials, the candidates and their
representatives may observe them. The observers must not interfere with the counting
of the ballots or the preparation of the summary of the recount vote by precinct.
Candidates may have additional representatives in the public viewing area of the room.
2. The focus of the recount will be the votes cast for the candidates with the second and
third highest number of votes received. The ballots will be separated into piles, in the
following manner.
a. Ballots with a vote for the Marylee Abrams
b. Ballots with a vote for the candidate Nikki Villavicencio
C. Ballots with votes for both candidates
d. All other ballots
3. The ballots in each pile will then be counted into groups of 25.
4. Election judges will determine the intent of the voter in the manner provided
in Minn. Stat. § 204C.22.
5. Challenges of the election judges' determination of a vote cast may be made by stating
the challenge to the recount official. The basis for the challenge must be written by the
recount official on the header of the ballot and initialed. Challenges must not be either
automatic or frivolous. Challenged ballots will be presented to the city canvassing board
for a final determination.

6. Results for each precinct will be recorded for the categories listed in 2a — 2d on a
summary statement for that precinct.
7. When counting has been completed, the ballots for that precinct will be resealed into
the transfer case.
8. This process will be repeated until the ballots for each precinct have been recounted.
9. The results of the recount will be reported to the Maplewood city council.

204C.22 DETERMINING VOTER'S INTENT.
Subdivision 1. Ballot valid if intent determinable. A ballot shall not be rejected for a technical error
that does not make it impossible to determine the voter's intent. In determining intent the principles contained
in this section apply.
Subd. 2. From face of ballot only. Intent shall be ascertained only from the face of the ballot.
Subd. 3. Votes for too many candidates. If a voter places a mark beside the names of more candidates
for an office than are to be elected or nominated, the ballot is defective with respect only to that office. No
vote shall be counted for any candidate for that office, but the rest of the ballot shall be counted if possible.
At a primary, if a voter has not indicated a parry preference and places a mark beside the names of candidates
of more than one party on the partisan ballot, the ballot is totally defective and no votes on it shall be counted.
If a voter has indicated a party preference at a primary, only votes cast for candidates of that party shall be
counted.
Subd. 3a. Votes yes and no. If a voter votes both yes and no on a question, no vote may be counted for
that question, but the rest of the ballot must be counted if possible.
Subd. 4. Name written in proper place. If a voter has written the name of an individual in the proper
place on a general or special election ballot a vote shall be counted for that individual whether or not the
voter makes a mark in the oval or other target shape opposite the blank.
Subd. 4a. Write-in vote for candidate team. A write-in vote cast for a candidate for governor without
a write-in vote for a candidate for lieutenant governor must be counted as a vote for the candidate team
including the lieutenant governor candidate selected by that candidate for governor.
Subd. 5. Name written on primary ballot. If a voter has written the name of an individual on a primary
or special primary ballot, a vote shall not be counted for that office.
Subd. 6. Mark out of place. If a mark (X) is made out of its proper place, but so near a name or space
as to indicate clearly the voter's intent, the vote shall be counted.
Subd. 7. All written names or marks counted up to limit. If a number of individuals are to be elected
to the same office, the election judges shall count all names written in and all printed names with marks in
oval or other target shape opposite them, not exceeding the whole number to be elected. When fewer names
than the number to be elected are marked or written in, only the marked or written in names shall be counted.
When more names than the number to be elected are marked or written in, the ballot is defective with respect
to that office and no vote shall be counted for that office.
Subd. 8. Misspelling; abbreviations. Misspelling or abbreviations of the names of write-in candidates
shall be disregarded if the individual for whom the vote was intended can be clearly ascertained from the
ballot.
Subd. 9. Votes for only some offices or questions determined. If the voter's choice for only some of
the offices or questions can be determined from a ballot, the ballot shall be counted for those offices or
questions only.
Subd. 10. Different marks. If a voter uniformly uses a mark that clearly indicates an intent to mark a
name or to mark yes or no on a question, and the voter does not use the more standard mark anywhere else
on the ballot, a vote shall be counted for each candidate or response to a question marked. If a voter uses
two or more distinct marks, such as (X) and some other mark, a vote shall be counted for each candidate or

response to a question marked, unless the ballot is marked by distinguishing characteristics that make the
entire ballot defective as provided in subdivision 13.
Subd. 11. Attempted erasures. If the names of two candidates have been marked, and an attempt has
been made to erase or obliterate one of the marks, a vote shall be counted for the remaining marked candidate.
If an attempt has been made to obliterate a write-in name a vote shall be counted for the remaining write-in
name or marked candidate.
Subd. 12. Soil; defacement. A ballot shall not be rejected merely because it is slightly soiled or defaced.
Subd. 13. Identifying ballot. If a ballot is marked by distinguishing characteristics in a manner making
it evident that the voter intended to identify the ballot, the entire ballot is defective.
Subd. 14. No votes for certain offices. If the number of candidates for an office is equal to the number
of individuals to be elected to that office, and the voter has not marked any name, no vote shall be counted
for any candidate for that office.
Subd. 15. Blank ballot for one or more offices valid. If no name or response to a question is marked
and no name is written in, the ballot is blank with respect to that office or question. A ballot that is blank
with respect to one or more offices or questions is not defective.

13.0 DETERMINING VOTER INTENT
Minnesota law requires that every effort be made to accurately count all votes on a ballot.
This means that a ballot or vote must not be rejected for a technicality if it is possible to
decide what the voter intended, even though the voter may have made a mistake or the
ballot is damaged. Intent is determined only from the face of the ballot. Use the following
rules to decide what a voter intended:

14.0 CANVASSING BOARD
The recount official presents the recount worksheet and any challenged ballots to the
canvassing board. The candidate or candidate representative who made the challenge may
present the basis for the challenge to the canvassing board. The canvassing board rules on
the challenged ballots and incorporates the rulings into the canvassing report. The
canvassing board certifies the results of the recount. Challenged ballots must be returned to
the election official who has custody of the ballots. For general elections, the certificate of
election is issued to the winning candidate after the seven days have passed after the
canvassing board declared the candidate elected. (M.R. 8235.1100)

Canvassing Results of Recount for Councilmember
WHEREAS, a State General Election was held on November 6, 2018; and
WHEREAS, the ballot included four candidates for two Maplewood councilmember positions; and
WHEREAS, the number of votes cast for the second councilmember position was a tie between
candidates Marylee Abrams and Nikki Villavicencio; and
WHEREAS, a winner for this office was determined by the canvassing board in the manner
provided by Minn. Stat. 204C.34; and
WHEREAS, the losing candidate then requested a recount for the second councilmember position
as provided in Minn. Stat. 204C.36;
WHEREAS, a recount was conducted on November 27, 2018;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of Maplewood, Ramsey County,
Minnesota, acting as a canvassing board on December 3, 2018, hereby declares as follows:
1. The following are the results from the recount conducted on November 27, 2018, as specified by
the Abstract of Votes Cast — Recount for Councilmember:
Votes Cast for Marylee Abrams 5,757
Votes Cast for Nikki Villavicencio 5,752
2. That votes from the four ballots challenged in the recount are resolved as approved by the
canvassing board on this date and the city clerk is hereby directed to amend the abstract of votes from
the recount to reflect these changes.
3. That the city clerk is hereby further directed to amend the abstract of votes from the recount to add
one vote for candidate Marylee Abrams and one vote for the group of candidates other than Marylee
Abrams and Nikki Villavicencio from the ballot that was not examined during the recount.
4. That following are the results of the recount as amended by the canvassing board:

5. The candidate for the second councilmember position who received the highest number of votes
as determined by the recount conducted on November 27, 2018 and the decisions of the canvassing
