Use Permit Revision for the Laundromat at 1690 McKnight Road North and answered

Commissioner Donofrio requested the addition of the recommendation to limit the business to be
open no later than 10 p.m.
Commissioner Donofrio moved to approve the conditional use permit revision for a planned unit
development resolution allowing a laundromat to operate within the building located at 1690
McKnight Road North. Approval is subject to the following conditions (additions are underlined
and deletions are crossed out):
1. Adherence to the site plan and conditions approved by the Community Design Review Board,
future changes to the site plan may be approved by the board.
2. All uses shall conform with the BC(M), business commercial (modified) zoning district
requirements.
3. External speakers shall be directed away from the dwelling units and the sound shall not
exceed fifty decibels (normal conversation level) at the residential property line.
4. The maximum building height shall be one story.
5. There shall be no exterior storage or sale of goods or merchandise.
6.
The proposed used of a laundromat is approved
with this permit and the laundry use must receive a certificate of occupancy within one year or
this approval shall become null and void. A one year time extension may be approved by the
city council.
7. There shall be no vents for the underground fuel tanks within 200 feet of an existing residence
8. The type and anchoring of underground storage tanks must be approved by the City Fire
Marshal. The tanks shall be strapped to a concrete slab.
9. Before the laundry use receives a certificate of occupancy the applicant must either construct
trash enclosures for all trash receptacles on site or submit to staff a letter of credit for 150
percent of the cost of construction.
10. Before the laundry use receives a certificate of occupancy the applicant must remove all
banner and temporary signs that do not confirm to city ordinance requirements.
11. The laundry use at this site must be closed to the public by 10 p.m. daily.

Policy Issue:
The applicant is requesting approval of a conditional use permit (CUP) to operate a community
center which includes the uses of a banquet hall, a sports bar and restaurant, a fitness gym, and
office space at 1800 White Bear Avenue.
Recommended Action:
Motion to approve the conditional use permit resolution attached for a community center to be
located at 1800 White Bear Avenue North.

The city deemed the applicant's application complete on September 24, 2018. The initial 60-day
review deadline for a decision is November 30, 2018. As stated in Minnesota State Statute 15.99,
the city is allowed to take an additional 60 days if necessary to complete the review.
Background
On July 25, 1989, the city approved remodeling plans for Mid America Bank.
On November 3, 2000, the city approved plans for Junior Achievement to make minor exterior
improvements to the building.
On October 10, 2003, the city council approved a 5-foot parking lot setback variance for the Junior
Achievement building.
Discussion
Zoning
The site is currently zoned as mixed use (MU). This zoning district allows a number of uses including
restaurants, indoor recreation, health/sports club and offices. Community centers are allowed in any
zoning district in the city with an approved conditional use permit. Because this project is proposing
a banquet hall in addition to a sports bar and restaurant, fitness gym, and office space, staff felt a
conditional use permit for the combination of all the uses would be the most appropriate pathway for
the city's review. While the banquet hall is a conditional use, all other proposed uses would be
permitted by right of the zoning code.
Proposed Use
The applicant is proposing to reconfigure the internal space of the Junior Achievement building at
1800 White Bear Avenue North into a community center with uses of a banquet hall, a sports bar and
restaurant, fitness gym, and office space. The banquet hall will operate mainly on Friday and
Saturday, with seasonal weekday functions consisting of theatrical Southeast Asia story telling
dances. The sports bar and restaurant will be open seven days a week. A prospective tenant
proposal is for a fitness gym in 3,800 square feet of the building and future office space.
Parking
There are currently 235 regular parking spaces and 6 accessible parking spaces on site. Section
44-17(a) calls for the following parking spaces for the intended uses:
1. Banquet hall: One parking space for every four seats for theater, auditorium, church, or
other place of public assemblage. The banquet hall would have 300 seats which means 75
parking spaces are required.
2. Bar and restaurant: One parking space for each 50 square feet of floor space devoted to
patron use for restaurant, cafe or tearoom. The restaurant would have a floor space of 4,300
square feet which means 86 parking spaces are required.
3. Office space and fitness gym: One parking space for each 200 square feet of floor space
for commercial, office space, or other recreational building use other than those specified.
The 1,700 square feet of office space will require 9 parking spaces and the 3,800 square
feet of fitness gym will require 20 parking spaces.
The proposed uses would require a minimum of 188 parking spaces. There are 241 parking spaces
on site, leaving an excess of 53 parking spaces. The mixed use zoning district sets the maximum
parking spaces within the district to not exceed the specified minimum in city code by ten percent, or
two spaces, whichever is greater. There is a parking lot lease agreement between Gruber's Power
Equipment at 1762 White Bear Avenue and Junior Achievement that allows Gruber's Power
Equipment to use 46 parking spaces on the Junior Achievement property. The applicant intends to
continue this lease agreement. This creates an excess of only seven parking spaces on site, which
meets city code. The 46 parking spaces leased to Gruber's Power Equipment are however not
intensively used throughout the day and would serve as additional parking for the community center
when Gruber's is closed. The dimensions of the existing parking spaces meet city code requirements.
Exterior Improvements
There are no exterior changes proposed for the building or site. However, an inspection of the site
found that the trash and recycling dumpsters are not screened, there is rubbish on the site, and
there is a lack of landscaping along White Bear Avenue. Staff is recommending the applicants
address these issues prior to the applicant being granted a certificate of occupancy for the building.
Conditional Use Permit Standards
City code requires that the City finds that all nine standards outlined in the conditional use permit
ordinance are met prior to approval. The standards are outlined in the reference information
attached. Staff finds that the proposed conditional use permit for a banquet hall meets the
conditional use permit standards.
Department Comments
Engineering
Tyler Strong, Staff Engineer, reviewed this project and had these comments regarding the site.
1. Should the project include exterior site improvements a plan review request shall be
submitted to the City of Maplewood Engineering Department for approval prior to
construction.
2. The applicant shall be responsible for SAC, WAC, and PAC charges related to this change
of use.
3. The applicant shall verify that the existing sanitary sewer service has adequate capacity to
service the proposed change in use.
4. The Owner shall satisfy the requirements of all permitting and reviewing agencies including
(but not limited to) the MPCA and SPRWS.
Building Official, Jason Brash
Build per 2012 IBC, 2012 IMC, 2012 IFGC, 2014 NEC, 2012 Minnesota State Plumbing Code, 2015
Minnesota State Fire Code, MN 2015 Accessibility Code, and 2015 Minnesota Building Code.
Demonstrate compliance with all the requirements of the 2012 Minnesota Energy Code Chapter
1323 Section C401.2. Mixing 2012 IECC provisions and ASHRAE Standard 90.1 to obtain
compliance is not an option. The following forms must be completed as submittals.

Special inspections required as per 2012 IBC Chapter 17. Complete supporting special inspection
schedule document and submit with application.
All kitchen equipment and plans must be NSF listed and meet all State of Minnesota Environmental
Health requirements. If you have any questions contact Environmental Health Officer Molly Wellens
at 651-249-2308. Provide documents and submit plans to review before building permit can be
issued.
Submit plans to the Metropolitan Council 651-602-1113 for SAC determination. Confirm all plans
with John DuCharme, City of Maplewood Engineering Department 651-249-2411.

Plumbing plans shall be submitted to the State Health Department for approval prior to the issuance
of a plumbing permit, (651-284-5063). Approval shall be submitted to Maplewood. Maplewood will
issue the permit for DWV. Water Service is owned by St. Paul Regional Water Services who will
issue the permit for the potable water connections (651-266-6270).
Provide two sets of signed stamped rolled plans and a digital PDF with permit application.
All commercial building contractors doing work in Maplewood must be licensed by the City of
Maplewood. Also, all plumbing, heating, gas, excavating, sewer, masonry contractors must be
licensed by the City of Maplewood. For specific licensing questions please call 651-249-2300.
Separate permits are required for building, plumbing, mechanical, electrical, Health, fire alarm, and
sprinklers.
Environmental Health Officer, Molly Wellens
1. The applicant must go through the plan review process and pay all associated fees.
2. The applicant must obtain a food license to open, and must maintain the license annually.

October 16, 2018: The planning commission will hold a public hearing and make a
recommendation on this project.
Citizen Comments
Staff surveyed the 53 surrounding property owners within 500 feet of the site for their opinion about
this proposal. The applicant also held a neighborhood meeting and notified property owners within
500 feet. Staff received eleven responses:
1. 1769 White Bear Avenue North, Jennifer and Jeff LaPointe: My name is Jennifer LaPointe,
and my husband, Jeff, daughter and myself reside at 1769 White Bear Avenue North. I am e-
mailing you in regards to the letter we received in the mail concerning the Junior Achievement
Building, and possible new uses for the space. I would like to share a few comments,
questions, and concerns I have regarding the proposal. First of all, we are concerned about
noise. Banquet halls bars/restaurants can have business going late at night. Is there, or are
there, plans to be put in place to help reduce noise from music and larger crowds? There are
many children who either are permanent residents on the block, or who rent where an increase
in loud noises during the night can impact families with young children. Secondly, another
concern I have is traffic control. The Junior Achievement building shares parking lots with
Gruber's and Perkins. There are very few barriers separately the three businesses. What will
be done to ensure that the other business' spaces will not be interfered with? In the letter it
states that premier performances will be happening inside of the space. This can draw a large
number of guests and performers. Is there going to be a plan in place to help with the traffic
control on White Bear Avenue. Historically, when events are taking place at Aldrich Arena
(Sporting Events, Shows/Concerts/Graduations) traffic can be backed up all the way to the
community center. If there are going to be large crowds and an uptick in traffic congestion
how will this be addressed by the city and business owner? If nothing is done proactively it
will negatively impact the residents who live on the block who are going to be "stuck in traffic"
to get in and out of their driveway. Furthermore, how will the addition of a banquet hall impact
the use of the Maplewood Community Center's service in terms of renting out their banquet
area?The community center has already had a history of financial trouble- how will this impact
the business it gets when another banquet hall will open up less than half a mile away. Last,
and most importantly, I do have some strong concerns in terms of safety. White Bear Avenue
has a lot of foot traffic as is. During events such as the Ramsey County Fair, Freight Farm
etc. there is an uptick in cars revving engines late and night, yelling between patrons, walking
through yards and rifling through vehicles. I am concerned that all of the above things listed
will exponentially increase as it is directly across the street from homes. Additionally, I know
it is protocol to have security guards working events in banquet halls. However, these are
usually private companies and not Maplewood P.D., and are only patrolling the situation inside
of the building. Who will be watching once people leave the building from the banquet or the
bar/restaurant? The potential to have drunk drivers leaving across the street of our home is
dangerous. I am skeptical that saying security personal will stop all of this. Bamboo Hut, which
is down the street- not far just past Larpenteur has a banquet hall. There have been incidents
where people have been shot and guns have been fired. THIS MUST BE PREVENTED.
Gunfire is never good but Bamboo Hut is not across the street from residential homes. The
Junior Achievement Building is. I understand that having a building occupied is better than a
large facility being left abandoned and unused. I agree. However, I am not confident that
having a Bar/Restaurant and large events in a banquet type setting is the best for the residents
who call White Bear Avenue home. Thank you for taking the time to read the comments about
this project.
2. 1834 Flandrau Street, Barb Schlink: I am responding to your letter about the proposal on the
Junior Achievements building on 1800 White Bear Avenue. I live sort of behind Henji's rental
on 1834 Flandrau St. It's good to add all of the things in your letter but I am concerned about
the problem of gangs and like what happened at the Asian bar/dance hall on Rice St. Will
there be police presence at these functions? We certainly need more restaurants in this area
of Maplewood. Also how late will these functions go on during the week? The way it is there
is a lot of noise when there is activities with bands during the summer months in the Aldrich
Arena parking lot at the Asian market on the weekends.
3. 1829 North St. Paul Road (DLP Foods Inc.), Debra Pedro: I am not sure this would be the
right fit for this area.Also I think parking is going to be an issue and the sports bar with drinking
will most likely create a problem. There is a lot of residential and I don't feel it will be an
advantage to the area. Am concerned banquets are not going to be limited to just Friday and
Saturday and am most concerned about the sports bar.
4. 1800 White Bear Avenue, Junior Achievement of the Upper Midwest, Inc.: We fully support
this proposal as it will revitalize this property and utilize the benefits of the space in new ways.
5. 1773 White Bear Avenue, Torin Gustafson: I live at 1773 White Bear Ave N, directly across
the street from the proposed banquet facility. When I bought a home on such a busy street,
it was my hope that we would see improvements to pedestrian facilities and more vibrant
businesses. Having met with the new owners, reviewing their plans, and asking some further
questions, I have to say that I am in support of the proposed development. This area is in
need of some activation with higher quality businesses and a decent sit-down restaurant —
and the proposed plans fit that bill! As it stands, I have to drive to get to many places in
Maplewood, so to have something that I can walk to will be really nice. The new owners seem
to be committed to being a part of the neighborhood and are enthusiastic about their plans. I
am too! In fact, I find this to be a far superior plan than the Hardee's that was proposed a
year ago just to the south of this location. White Bear Ave has enough drive-through and
convenience businesses as it is. I would love to see more businesses integrating into
neighborhoods instead of the current land use pattern which seems to separate them
drastically and then forces people into cars to accomplish the simplest of errands. It is my
opinion that the permit for the banquet facility should be granted. I look forward to being able
to enjoy a real meal (and cocktail!) at a nice sit down restaurant within walking distance (other
than Perkin's)! Best regards.
6. 1799 White Bear Avenue North, Sue Allhiser: I live across the street from the Junior
Achievement building and would be directly affected by the type of business that is allowed to
operate there. People forget that the whole west side of White Bear Avenue is residential
housing. I am STRONGLY OPPOSED to this becoming a banquet, bar, and restaurant
facility. Would you think of putting a bar or banquet facility in a tree lined cul-de-sac? Did we
not learn anything from the STARGATE LOUNGE? THE MYTH? Garrity's? This is a problem
waiting to explode.
a) Has there been a PUBLIC SAFETY STUDY done?
b) Is there even adequate parking? There was already a recent pedestrian death on Frost
and White Bear Ave. You are talking about adding hundreds more vehicles and people
with alcohol in their systems on any given day or evening if this place opens. Are you
prepared for the public safety calls? More deaths and injuries?
c) When Aldrich has an event there are traffic control officers out will that happen here?
d) What is to stop them from having events other than on weekends, more concerts and
large events, possible gang situations again?
e) As you know the STARGATE said they would not have Teen Nights and Rap nights
but once they needed the money anything went. The MYTH continues to be a problem
with numerous police and paramedic calls. There have been gang issues. Garrity's
back in the day caused many police and paramedic calls. Do we really want to bring
that into a residential neighborhood?
f) If you feel this type of business is needed why not keep this type of activity down by
Maplewood Mall where it is a commercial area without single family homes right across
the street.
g) How will you ensure they have security? As they are fighting expenses vs. income we
all know things originally committed to can fall by the wayside in favor of more income.
h) There is a banquet hall approximately 2 blocks south at 1660-C called the White
Dragon. Why is another banquet hall needed within 2 blocks?
i) This is a residential area. This will destroy property values and public safety. OVER
300 people could be at this one location. That's a lot of people in a neighborhood. That
is inviting trouble.
j) Would you want your child or grandchild playing in the yard across from a place like the
MYTH or STARGATE Lounge? Would you want to hear and see all of the drunks,
fights, sirens, ambulances, as they are called out for problems? If you wouldn't want
this across the street from your home please don't force me to have it across the street

k) Miranowski will also have to meet with Maplewood's police chief to discuss crime. The old
Myth had its share of problems, including a shooting on the night of a Lit Wayne concert.
7. 1804 Flandrau Street, Lisa Horn: I don't mind the idea of this Naocha Sees LLC place if it
was for Maplewood Community Center like family oriented/community events, but if that's
what it would be like, instead of Myth type events, I wonder why the community center is not
adequate. I wouldn't even mind a grown up restaurant where families would come and adults
could get alcoholic beverages with their dinner. I live behind the house next to Hejny rental,
and I would be very concerned if this residential area was going to provide anything that would
be attractive to gangs at any time they use the building at first or in the future. My street,
Flandrau is a peaceful street that has 93 houses that attract first time home buyers with little
children (which is what we were 28 years ago and raise our 6 children here)as do the following
streets moving farther west of WBA. Thank you
8. 1740 Van Dyke Street (Woodland Hills Church), Jodi Cremers: Woodland Hills doesn't see
any conflicts with this project moving forward. Thanks.
9. 1750 White Bear Avenue North (Super America), Steve Morris: I've received the opinion
feedback form for the proposed use of the site. We support the continued expansion of
business and welcome additional options for our shared customers and residents for food,
recreation and entertainment. My only comment would be that with a wide range of facilities
and planned activities, particularly the restaurant lounge & bar, that I have seen in the past,
due to our business being open 24/7, patrons from one facility head to another on their way
home, or wherever it may take them. This has at times caused both operational and safety
concerns for our customers and employees, and when we need to place a call for service
(Police/EMS), that activity gets tagged to our businesses and can negatively impact the
perception and operational functions of our business. Again, we support continued and
needed redevelopment and repurpose, my only concern is this activity& security potentials at
bar close/activity close impacting our operations.
10. 1795 White Bear Avenue North, Jesse Potter: I am opposed to this facility. A bar being put in
across the street.

Standards for a Conditional Use Permit
Section 44-1097 of the conditional use permit ordinance states that a conditional use permit may be
approved, or amended by satisfying all of the following standards for approval:
1. The use would be located, designed, maintained, constructed and operated to be in
conformity with the City's Comprehensive Plan and Code of Ordinances.
2. The use would not change the existing or planned character of the surrounding area.
3. The use would not depreciate property values.
4. The use would not involve any activity, process, materials, equipment or methods of
operation that would be dangerous, hazardous, detrimental, disturbing or cause a nuisance
to any person or property, because of excessive noise, glare, smoke, dust, odor, fumes,
water or air pollution, drainage, water run-off, vibration, general unsightliness, electrical
interference or other nuisances.
5. The use would generate only minimal vehicular traffic on local streets and would not create
traffic congestion or unsafe access on existing or proposed streets.
6. The use would be served by adequate public facilities and services, including streets, police
and fire protection, drainage structures, water and sewer systems, schools and parks.
7. The use would not create excessive additional costs for public facilities or services.
8. The use would maximize the preservation of and incorporate the site's natural and scenic
features into the development design.
9. The use would cause minimal adverse environmental effects.

CONDITIONAL USE PERMIT RESOLUTION
WHEREAS, Touyer Moua, on behalf of Naocha Sees LLC., has applied for a conditional use
permit for a community center which includes the uses of a banquet hall, sports bar, restaurant,
fitness gym and office space at 1800 White Bear Avenue North.
WHEREAS, conditional use permits are required for a community center within the City of
Maplewood according to section 44-1092.
WHEREAS, this permit applies to the site at 1800 White Bear Avenue North. The legal
description is:
Tract B, Registered Land Survey Number 587, Ramsey County, Minnesota.
PID 14-29-22-33-0026
WHEREAS, the history of this conditional use permit revision is as follows:
1. On October 16, 2018, the planning commission held a public hearing. The city staff
published a hearing notice in the Maplewood Review and sent notices to the
surrounding property owners. The planning commission gave everyone at the
hearing a chance to speak and present written statements. The planning
commission recommended that the city council the conditional use permit
revision.
2. On November 13, 2018, the city council discussed the conditional use permit. They
considered reports and recommendations from the planning commission and city
staff.
NOW, THEREFORE, BE IT RESOLVED that the city council the above-
described conditional use permit because:
1. The use would be located, designed, maintained, constructed and operated to be in
conformity with the City's Comprehensive Plan and Code of Ordinances.
2. The use would not change the existing or planned character of the surrounding area.
3. The use would not depreciate property values.
4. The use would not involve any activity, process, materials, equipment or methods of
operation that would be dangerous, hazardous, detrimental, disturbing or cause a
nuisance to any person or property, because of excessive noise, glare, smoke, dust,
odor, fumes, water or air pollution, drainage, water run-off, vibration, general
unsightliness, electrical interference or other nuisances.
5. The use would not exceed the design standards of any affected street.
6. The use would be served by adequate public facilities and services, including streets,
police and fire protection, drainage structures, water and sewer systems, schools
and parks.
7. The use would not create excessive additional costs for public facilities or services.

8. The use would maximize the preservation of and incorporate the site's natural and
scenic features into the development design.
9. The use would cause minimal adverse environmental effects.
Approval is subject to the following conditions:
1. The applicant must submit for staff approval a plan for traffic control during large
banquet events.
2. The applicant must submit to staff a copy of the executed parking lease agreement
between 1800 White Bear Avenue and 1762 White Bear Avenue.
3. Prior to issuance of a building permit the applicant must:
a. Submit a landscape plan which shows three additional trees and a shrub
planting bed on the intersection of White Bear Avenue and Ripley Avenue.
b. Submit trash and recycling dumpster screening plan.
C. The applicant shall comply with all the requirements set forth in the
engineering report dated September 18, 2018 by Tyler Strong, Civil Engineer

d. The applicant shall comply with all requirements set forth in the building
report dated September 19, 2018 by Jason Brash, Building Official.
e. The applicant must comply with conditions outlined by Molly Wellens,
Environmental Health Officer as follows:
1) The applicant must go through the plan review process and pay all
associated fees.
2) The applicant must obtain a food license to open, and must maintain
the license annually.
f. Prior to issuance of a certificate of occupancy the applicant must:
1) Restripe the parking lot.
2) Clear the site of all debris.
3) Construct trash and dumpster enclosure
i. The applicant is required to obtain all applicable licenses for alcohol and food
from the city.
4. Any exterior site improvements in the future would be subject to the city's design
review process. This site is regulated under the mixed use zoning district which has
specific design standards and landscaping requirements.
5. This permit only allows for a banquet hall, sports bar, restaurant, fitness gym and
office space at the site. Any additional uses would require city review and approval.

6. All signs require a separate sign permit and must meet city code requirements.
7. The city council shall review this permit in one year.

Intended Use of Property at:

The intended use is a Banquet hall with an adjoining Sports lounge Restaurant serving fine Asian cuisine
dishes and finger food. The Banquet hall will function mainly Friday and Saturday, while the Sports Bar
Lounge and Restaurant will be open seven days a week. Seasonal weekday functions in the banquet hall
will consist of Theatric Southeast Asia story telling dances from premier dance groups within the Twin
Cities for public entertaining! The restaurant will creatively be themed to match seasonal professional
sports leagues! The dining areas will consist of open dining, private group dining and bar eatery(including
a sushi bar)! Moreover, a prospective tenant proposal is for a Fitness Gym in one of the quarters! This
gym would save nearby neighbors time and money due to its location and low membership fee!
Benefits of the Proposed Use:
1) There is a high demand for Banquet halls. Existing Halls are pre-booked up to six months which
has made securing a venue a challenge. Many residents in the surrounding area currently cannot
afford the high cost and limited food selection offered by places like the Prom Center in Oakdale.
Therefore, more than often, Maplewood, North/South and East Saint Paul residents would have
to resort to Banquet halls located on the west side of the twin cities such as the Buansavanh Hall
in Brooklyn Park. Having this Banquet Hall near local residents who need it most will ease all
aspects of planning, decorations and guest participation.
2) There is a high demand for Larger foot print halls. Most existing affordable halls are less than
5,000 sq ft. These smaller halls (although similar in capacity) limits the venue from having a
photobooth, necessary desert and food tables, rituals setup areas, and larger scale decorations
such as those needed for Weddings. With up to 8,000 square feet, this hall will meet the needs
of the customer and fulfil their"size matters" concerns.
3) The popularity in Minority Dance Theatric groups has spiked dramatically in the last decade.
Unfortunately, these Dance group and their Managers are often left without an affordable
descent place to show their talent. Freeing up the weekdays in the Banquet Hall for the dance
group to put on shows for the public will aid their growth further as well as fund their programs
from the proceeds coming from the public audience.
4) There is a lack of Sports Bar lounges in Maplewood. Especially for larger groups (10 to 12) who
wants some privacy with friends to come cheer for their favorite teams. This Sports Bar lounge
will offer both private booths and open dining for all customers. Like the four seasons, the decor
will change according to the sports season, creating a one of a kind sports lounge atmosphere not
found anywhere else! Moreover,the lounge will also feature Karaoke capability for customers to
bring joy to their friends and family alike!
5) Prospective Fitness Gym Tenant—A prospective Tenant has requested up to 4000 square feet of
space for a Fitness Gym that would include showers and Sauna for its customers. The gym would
consist of trainers that would be able to assist language barrier customers in Lao/Hmong/Karen
that would require Fitness Education and training on machines and Fitness classes.
6) Office Space —There is no better place to lease an office near or inside a restaurant! Leftover
offices will be leased to small businesses!

The neighborhood meet and greet was very exciting! We met the neighboring business owners along
with a few residential owners. Everyone was excited that the area has not had an Event Center for a
while. Moreover,they love the food we brought and can't wait to enjoy more when the kitchen opens!
There was one neighbor name Sue that was concerned about the hours of operation. We re-assured her
we will have Security guards as a requirement for night events along with surveillance cameras.

After 16 months of planning and multiple phases of community engagement, a draft of the 2040
Comprehensive Plan has been prepared for your consideration to submit to the Metropolitan
Council for its official review. The draft 2040 Comprehensive Plan has 15 chapters, comprising the
traditional elements of land use, parks, transportation, and infrastructure, as well as the specialized
areas of historic resources and sustainability. The planning process identified four guiding principles
that are woven throughout the document— resilience, equity, health, and age-friendliness.
Recommended Action:
Motion to approve the resolution authorizing submittal of Maplewood's Draft 2040 Comprehensive
Plan to the Metropolitan Council for its formal review.

Every 10 years, all Twin Cities metro communities are required to update their comprehensive
plans to ensure compatibility with the plans adopted by the Metropolitan Council. Chapters and
areas of focus include land use, housing, sustainability, parks, natural resources, transportation,
historical resources, surface water and sanitary sewer.
Background
In April of 2018 the City Council approved the distribution of the 2040 Comprehensive Plan to
adjacent and affected jurisdictions for six months of review that ends on October 12, 2018. The City
of Maplewood has received comments from a number of adjacent communities, counties, state
agencies, local advocacy groups, and the Metropolitan Council.
The 2040 Comprehensive Plan has been revised to respond to the comments received. To facilitate
review of the changes made, the attached table has been created to identify the entity who made
the comment, the comment itself, and the proposed response to said comment. The draft of the
revised 2040 Comprehensive Plan has been posted on the City's website.
In general, there has not been substantive change to the 2040 Comprehensive Plan. In responding
to comments received there were no changes to land use guidance. Most of the changes were
focused on Land Use, Housing, Transportation and Utilities. Comments received from the
Metropolitan Council and local advocacy organizations did result in some revisions to policies,
actions, and implementation tools.
The next step in the planning process is the holding of a public hearing on the revised draft at the
October 16, 2018 meeting. After holding the public hearing, the Planning Commission will be asked
to consider whether the draft 2040 Comprehensive Plan needs to be modified and/or if it can move
forward to the City Council for authorization of its submission to the Metropolitan Council. The
deadline for submission to the Metropolitan Council is December 31, 2018.

RESOLUTION AUTHORIZING SUBMITTAL OF
MAPLEWOOD'S DRAFT 2040 COMPREHENSIVE PLAN
TO THE METROPOLITAN COUNCIL
WHEREAS, Minnesota Statutes section 473.864 requires each local governmental unit to
review and, if necessary, amend its entire comprehensive plan and its fiscal devices and official
controls at least once every ten years to ensure its comprehensive plan conforms to metropolitan
system plans and ensure its fiscal devices and official controls do not conflict with the
comprehensive plan or permit activities that conflict with metropolitan system plans; and
WHEREAS, Minnesota Statutes sections 473.858 and 473.864 require local governmental
units to complete their "decennial" reviews by December 31, 2018; and
WHEREAS, the City Council, Planning Commission, and the City Staff have prepared a
proposed Comprehensive Plan intended to meet the requirements of the Metropolitan Land
Planning Act and Metropolitan Council guidelines and procedures; and
WHEREAS, pursuant to Minnesota Statutes section 473.858, the proposed Comprehensive
Plan was submitted to adjacent governmental units and affected special districts and school
districts for review and comment on April 13, 2018, and the statutory six-month review and
comment period has elapsed; and
WHEREAS, the Planning Commission has considered the proposed Comprehensive Plan
and all public comments, and thereafter submitted its recommendations to this Council; and
WHEREAS, the City of Maplewood conducted public hearings on March 20, 2018 and
October 16, 2018 relative to the adoption of the proposed Comprehensive Plan; and
WHEREAS, the City Council has reviewed the proposed Comprehensive Plan and those
recommendations, public comments, and comments from adjacent jurisdictions and affected
districts; and
WHEREAS, Minnesota Statutes section 473.858 requires a local governmental unit to
submit its proposed comprehensive plan to the Metropolitan Council following recommendation by
the planning commission and after consideration but before final approval by the governing body of
the local governmental unit.
WHEREAS, based on its review of the proposed Comprehensive Plan and Planning
Commission and staff recommendations, the City Council is ready to submit its proposed plan to
the Metropolitan Council for review pursuant to Minnesota Statutes section 473.864; and
