Following are rules of civility the City of Maplewood expects of everyone appearing at Council
Meetings - elected officials, staff and citizens. It is hoped that by following these simple rules, everyone’s
opinions can be heard and understood in a reasonable manner. We appreciate the fact that when
appearing at Council meetings, it is understood that everyone will follow these principles:
Speak only for yourself, not for other councilmembers or citizens - unless specifically tasked by
your colleagues to speak for the group or for citizens in the form of a petition.
Show respect during comments and/or discussions, listen actively and do not interrupt or talk
amongst each other.
Be respectful of the process, keeping order and decorum. Do not be critical of councilmembers,
staff or others in public.
Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive.

A.CALL TO ORDER
A meeting of the City Council was held atthe Maplewood City Hall – Council Chambers
and was called to order at7:16 p.m. byMayor Slawik.
Mayor Slawik reported on a fire truck parked outside an elementary school with a banner
stating Drive Slowly and people going around the bus even with the stop arm extended.
She warned residents to watch out for the kids. Chief Nadeau gave additional
information.
Councilmember Juenemann noted that Governor Dayton was at Carver Elementary
welcoming the kids back on their first day of school.

Councilmember Juenemann reminded residents there is a medicine drop off outside City
Hall atthenight police entrance.
Ash Tree Education
Councilmember Juenemann reported there will be an Ash Tree Education Program
through theNature Center.
Business Retention and Expansion Visit
Mayor Slawikreported on the visit with 3M that took place earlier in the day. City
Manager Coleman and PublicSafety Director Nadeau gave additional information about
the visit.
Candidate Forum
Councilmember Smith congratulated all the candidates that participated in the City
Council and MayoralCandidate Forum sponsored by the League of Women Voters.

or interest requested by councilmembers and gave an overview of upcoming events in

existing construction contract, Change Order No. 1, City Project PR 17-01.

RESOLUTION
DIRECTING MODIFICATION OF EXISTING CONSTRUCTION CONTRACT,
CITY PROJECT PR 17-01, CHANGE ORDER NO. 1
WHEREAS, the City Council of Maplewood, Minnesota has heretofore ordered the
Wakefield Park Improvements Project, PR 17-01, and has let a construction contract,
and
WHEREAS, it is now necessary and expedient that said contract be modified and
designated as Wakefield Park Improvements Project, PR 17-01, Change Order No. 1.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
MAPLEWOOD, Minnesota, that
1.The Mayor and Parks & Recreation Director are hereby authorized and
directed to modify the existing contract by executing said Change Order No. 1
which is an increase of $12,269.39
The revised contract amount is $2,087,166.97.

1.Resolution Providing Approval of the 2019 Preliminary Property Tax Levy
and Setting the 2019 Budget Public Hearing Date and Time
City Manager Coleman introduced the staff report. Finance Director Paulseth gave the
presentation.
CouncilmemberSmith moved to approvethe resolution setting a preliminary tax levy for
taxes payable in 2019 in the amount of $22,109,600and setting the budget hearing for
December 10, 2018 at 7:00 p.m.

RESOLUTION PROVIDING APPROVAL OF THE 2019 PROPOSED TAX LEVY
And
SETTING 2019 BUDGET PUBLIC HEARING DATE
WHEREAS, State law requires that the City Council adopt a proposed tax levy
for taxes payable in 2019 by September 30, 2018; and
WHEREAS, the City Council has reviewed the proposed 2019 Budget and has
determined the amount of the proposed tax levy payable in 2019, which is the maximum
amount that will be levied.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MAPLEWOOD, MINNESOTA THAT:
1.The proposed tax levy for taxes payable in 2019, in the amount of
$22,109,600 is hereby adopted and shall be certified to the Ramsey County
Auditor as follows:
General Fund $16,138,910
Debt Service Funds $ 4,676,601
Market Value Debt Service$ 269,089
Recreation Fund $ 200,000
EDA Fund $ 100,000
Capital Improvement Fund$ 280,000

2.Debt levies have been reduced by other revenue sources to a total of
$4,676,601 for tax capacity levies and $269,089 for market value levies.

budget shall be Monday, December 10, 2018 at 7:00 pm in the Maplewood
City Council Chambers.

SECTION I. Chapter 2, Article IV, Division 3 of the city code is amended by repealing

Background
The agencies, working together and coordinating efforts under the Human Trafficking Task Force,
wish to investigate and prosecute human trafficking and sexual exploitation of children.The

JOINT POWERS AGREEMENT
Commissioner of Public Safety on behalf of the Bureau of Criminal Apprehension (orthe
City of Maplewood on behalf of its Police Department located at 1830 County Road B East, Maplewood,
MN 55109,
Recitals
Under Minnesota Statutes, § 471.59, the BCA and the Governmental Unit are empowered to engage in
agreements that are necessary to exercise their powers. The parties wish to work together to investigate
and prosecute human trafficking and sexual exploitation of children. The parties, along with other law
enforcement agencies have formed the Minnesota Human Trafficking Investigators Task Force
I to coordinate their efforts.
Agreement
1. Term of Agreement
1.1 Effective Date. This Agreement is effective on the date BCA obtains all required signatures
pursuant to Minnesota Statutes § 16C.05, subdivision 2.
1.2 Expiration Date. This Agreement expires five (5) years from the Effective Date unless
terminated earlier pursuant to clause 12.
2. Purpose
The Governmental Unit and BCA enter into this Agreement to implement the Minnesota Human
Trafficking Investigators Task Force that will use a three-pronged approach to combat human
trafficking and the sexual exploitation of children:prevention, education and enforcement. The
BCA will provide a Senior Special Agent who will serve as the Commander of the task force.
3.Standards
The Governmental Unit will adhere to the MNHITF Standards identified below:
3.1Investigate human trafficking crimes committed by organized groups or individuals related to
child sexual exploitation, sex trafficking with a focus on minors being trafficked, and labor
trafficking.
3.2Investigators will follow appropriate state and/or federal laws in obtaining arrest warrants,
search warrants and civil and criminal forfeitures. Investigators will follow proper legal
procedures in securing evidence, including electronic devices.
3.3Investigators will understand and use appropriate legal procedures in the use of informants
including documentation of identity, monitoring of activities, use and recordation of payments.
3.4Investigators will use, as appropriate, a broad array of investigative technologies and
techniques.
3.5Investigators will interview and prepare reports of victim rescues and be able to direct those
victims to appropriate public and private resources to help ensure their safety and integration
back into society.
3.6Full-time Task Force members will dedicate their primary reporting duties to the MNHITF
physical location, currently the BCA Headquarters for the duration of the term of this Agreement.

3.7Affiliate Task Force members must be able to dedicate sufficient time to the task force to
complete their assigned duties for the duration of the term of this Agreement.
3.8Investigators must be licensed peace officers.
3.9Assigned investigators will investigate cases involving cross-jurisdictional, high impact
and/or organized groups involving human trafficking. The assignment may require investigators
to travel to Greater Minnesota and throughout the seven county metro area as investigations
expand or as assigned by the task force commander.
3.10Assigned investigators will be asked to participate in pro-active operations deterring sexual
exploitation of children and rescuing victims of human trafficking primarily focused on minors
with the goal of identifying their traffickers.
3.11Full-time Task Force members will prepare an operational briefing sheet for each active
operation, to be approved by the task force commander.
3.12Full-time Task Force members will prepare investigative reports for review and approval by
the task force commander.
3.13Full-time Investigators will be assigned to and report to the task force commander or a
designee.

4. Responsibilities of the Governmental Unit and the BCA
4.1The Governmental Unit will:
4.1.1 Conduct investigations in accordance with provisions of the MNHITF Standards,
identified in clause 3 above, and conclude such investigations in a timely manner.
4.1.2Maintain accurate records of prevention, education, and enforcement activities, to be
collected and forwarded quarterly to the BCA for statistical reporting purposes.
4.1.3Assign one or more employees of the Governmental Unit as members to the MNHITF.
All employees of the Governmental Unit assigned as members, and while performing
MNHITF assignments, shall continue to be employed and directly supervised by the
same Governmental Unit currently employing that member. All services, duties, acts
or omissions performed by the MNHITF member will be within the course and duty of
loyment and therefore covered by the Workers Compensation and
other compensation programs of the Governmental Unit including fringe benefits.
4.1.4Make a reasonable good faith attempt to be represented at all scheduled MNHITF
meetings in order to share information and resources among theMNHITF members.
4.1.5Participate fully in any audits required by the Minnesota Human Trafficking Task
Force.
4.2Nothing in this Agreement shall otherwise limit the jurisdiction, powers, and responsibilities
normally possessed by a memberas an employee of the Governmental Unit.
5.Payment
There are no payments associated with this Agreement.

7. Assignment, Amendments, Waiver, and Agreement Complete
7.1 Assignment. The Governmental Unit may neither assign nor transfer any rights or obligations
under this Agreement.
7.2Amendments. Any amendment to this Agreement must be in writing and will not be effective
until it has been executed and approved by the same parties who executed and approved the
original Agreement, or their successors in office.
7.3Waiver. If the State fails to enforce any provision of this Agreement, that failure does not
waive the provision or its right to enforce it.
7.4Agreement Complete. This Agreement contains all negotiations and agreements between
theBCA and the Governmental Unit. No other understanding regarding this Agreement,
whether written or oral, may be used to bind either party.
8. Liability
TheBCA and the Governmental Unit agree each party will be responsible for its own acts and the
results thereof to the extent authorized by law and shall not be responsible for the acts of any others
and the results thereof. The liability shall be governed by provisions of the Minnesota Tort
Claims Act, Minnesota Statutes, § 3.736, and other applicable law. The liability
shall be governed by provisions of the Municipal Tort Claims Act, Minnesota Statutes, §§ 466.01-
466.15, and other applicable law.
9. Audits
Under Minnesota Statutes, § 16C.05, subdivision 5, the books, records,
documents, and accounting procedures and practices relevant to this Agreement are subject to
examination by the BCA and/or the State Auditor and/or Legislative Auditor, as appropriate, for a
minimum of six (6) years from the end of this Agreement.
10. Government Data Practices
The Governmental Unit and the BCA must comply with the Minnesota Government Data Practices
Act, Minnesota Statutes Chapter 13 and other applicable law, as it applies to all data provided by
theBCA under this Agreement and as it applies to all data created, collected, received, stored,
used, maintained, or disseminated by the Governmental Unit under this Agreement. The civil
remedies of Minnesota Statutes § 13.08 apply to the release of the data referred to in this clause by
either the Governmental Unit or the BCA.
If the Governmental Unit receives a request to release the data referred to in this clause, the
Governmental Unit must immediately notify the BCA. The BCA will give the Governmental Unit
instructions concerning the release of the data to the requesting party before the data is released.
11. Venue
The venue for all legal proceedings out of this Agreement, or its breach, must be in the appropriate
state or federal court with competent jurisdiction in Ramsey County, Minnesota.
12. Expiration and Termination
12.1Either party may terminate this Agreement at any time, with or without cause, upon 30 days
written notice to the other party. To the extent funds are available, the Governmental Unit
shall receive reimbursement in accordance with the terms of this Agreement through the date
of termination.
12.2Upon expiration or earlier termination of this Agreement, the Governmental Unit shall provide
theMNHITF Commander all investigative equipment that was acquired under this Agreement.

13. Continuing Obligations
The following clauses survive the expiration or cancellation of this Agreement: 8, Liability; 9, Audits;

The City of Maplewood utilized fiber optics to connect all remote sites back to our data centers.
The City also leverages our partnership with the City of Roseville and Metro-Inet group of cities to
cost share much of our IT infrastructure. The approval of this segment of fiber means the Citywill
have access to fiber optics that will connect three city buildings along with providing a backbone
from Maplewood to Roseville.

As stated above, fiber optics is the preferred infrastructure for all remote sites to communicate back
to City Hall. Fiber optics are scalable which means they are future proof and can essentially
accommodate any data needs the City may need for the future. If approved, this item will also
provide the City a backbone connection with the City of Roseville to ensure that we may continue to
leverage economies of scale via a shared phone system, storage, network infrastructure, etc.
Background
There are twoprimary goals that will be accomplished by ascertaining this segment of fiber optics:
Connectivity to remote sites and dedicated connectivity to the City of Roseville.

Staff has built our systems around the connectivity and capacity that is provided via fiber optic
infrastructure and wherever possible look to connect remote site back to city hall via fiber optics.
Thesecurity systems, video surveillance systems and phones all operate over thenetwork and with
the bandwidth provided by fiber optics the sky is the limit as to what the Citycan utilize them for.
Fiber optics at remote sites allow anyone working at those sites the same abilities as if they were
located at themain campus. With fiber optic connectivity we have the most reliable, scalable
solution available. The fiber approved with this agreement will run directly past three city buildings,
the new Wakefield Park building, Fire Station 2 and Edgerton School.
The second benefit to this connection is that it locks down a means of connecting Maplewood City
Hall to Roseville City Hall. Maplewood and Roseville IT staff has had a wonderful working
relationship for many years. We’ve partnered on many purchases over the years, shared data
center space to provide for offsite backups, shared applications/data between our networks, cost
shared our phone system, cost sharedour storage and virtual server infrastructure, etc. This lease
will ensure that Maplewood will continue to have the connectivity required for years to come.
The cost of installing fiber optics is not cheap. That is why staff has been working with North St.
Paul to explore the possibility of entering into a 20 year lease that would allow Maplewood use of
some of their existing fiber optics. North St. Paul installed a substantial fiber optic network
throughout much of their City and extended it west into Maplewood. This segment still has some
available capacity. This agreement allows Maplewood use of said fiber optics for 20 years. The
North St. Paul proposal includes 12 strands of fiber optics that run from Maplewood to Roseville as
shown in the attached diagram.The attached agreementwas approved by the North St. Paul City
Council on Tuesday, September 18, 2018.

OPTICAL FIBER USE AGREEMENT
This agreement is between the City of North St. Paul ("City") and the City
of Maplewood ("Grantee"), collectively referred to as ("Parties"). The Parties are statutory
cities and municipal corporations of the State of Minnesota.
Recitals
A.Under Minn. Stat. §471.59, subd. 10, the Parties are empowered to enter into
agreements for the joint exercise of powers with other governmental units for public
purposes.
B.The Parties have the right to own telecommunications equipment for their own
municipal use and to enter into agreements with other cities conveying title to or
otherwise granting rights to use telecommunications facilities.
C.The City owns and operates optical fiber and cable linking facilities as depicted in
Diagram 1, attached and made a part of this Agreement, and Grantee is in need of
optical fiber for its own uses.
NOW THEREFORE, for valuable consideration, the parties agree as follows:
SECTION ONE - JOINT AND COOPERATIVE AGREEMENT
1.1 The Effective Date of this Agreement shall be January 1, 2019.
1.2 The Parties hereby form this Agreement pursuant to Minn. Stat. § 471.59, which
allows two or more governmental units to jointly and cooperatively exercise any power
common to the contracting parties or any similar powers. The purpose of the
Agreement is to facilitate the cooperative use of optical fiber owned by the City at the
time of this Agreement in accordance with the terms of this Agreement. The Parties
are governed by Subd. l (a) of Section 471.59 and do not hereby assume responsibility
for the acts or omissions of the other party.
1.3 This Agreement shall terminate twenty (20) years from the Effective Date, unless
terminated earlier by a material breach by either party' or extended for an additional
period(s).
SECTION TWO - GRANT OF INDEFEASIBLE RIGHT TO USE
2.1For purposes of this Agreement, an "Indefeasible Right to Use" ("IRU") shall mean
an irrevocable grant to fully possess, use and utilize the described facility granted, for
all municipal purposes of the Grantee, but not for commercial profit purposes.
2.2The City hereby grants to the Grantee an IRU of 12 strands of optical fiber
cable within approximately thirty-thousand (30,000) feet of optical fiber
pathway of the City's fiber optic cable system ("Optical Fiber") connecting
the access points ("AP") as described in Diagram 1 Fiber Optic Pathway
and Access Points as shared backbone, attached to and made a part of this
Agreement.

2.3The Grantee will be allocated fiber strands
2.4Notwithstanding the grant of an IRU to Grantee, the City will continue to own and
maintain the Optical Fiber to ensure continuous functionality. City response for repairs
on the Optical Fiber segments will be with an intended goal of four hours of any
reported trouble. Trouble or outages should be reportedto the City's Emergency Service
Line at (651) 747-2417.
2.5City shall maintain responsibility for any maintenance, repair or relocation costs of the
Optical Fiber. Grantee will reimburse City for a share of the maintenance costs
referenced in paragraph 3.2 below. Grantee is responsible for their prorated share of
relocation costs of the Optical Fiber. The Prorate share is determined by the percentage
of Optical Fiber controlled by Grantee multiplied by the cost of relocation.
2.6The City's guarantee to Grantee of access to the Network is unconditional and shall
not be affected by Grantee's use of the Metro I-net as a provider of information
technology services or the Grantee's use of any other provider for equivalent services.
SECTION THREE - PAYMENT
3.1Grantee shall pay the City $50,000 for the IRU for the twenty-year term of this
Agreement. Both parties in a single lump sum will pay this cost upon approval of this
Agreement. If this Agreement is terminated prior to the full twenty (20) years; and said
termination is not due to a material breach of City, the City shall be entitled to retain
the entire lump sum payment. If said termination is due to a material breach of City,
Grantee shall be entitled to an equitable, pro rata recovery of this payment as
appropriate.
3.2Following pre-installation written notice from the City and satisfactory City
installment, Grantee shall pay the reasonable one-time cost of future additional
connections to the Optical Fiber. There will be no additional recurring cost to Grantee.
3.3Grantee shall pay the City an annual recurring cost of $2,400 as Grantee's share of
maintenance costs for the Optical Fiber. The City shall perform all maintenance on the
Optical Fiber, which shall consist of Clearing of Locate Tickets, Locates and Fiber
Repair. Maintenance costs are subject to an increase of up to 3% each year over the
term of the Agreement, at the City's discretion and based on costs. These costs will be
paid upon invoice from City and within Grantee standard payment policies. Grantee
agrees to pay its share of federal or state taxes, if any, which may be imposed on the
Optical Fiber during the term of this Agreement in accordance with the appropriate tax
allocation between the City's ownership of the Optical Fiber and the Grantee's IRU.
SECTION FOUR- PARTY REPRESENTATIVES - NOTICE
4.1To assist the Parties in the day-to-day performance of this Agreement, to ensure
compliance with the specifications and to provide ongoing consultation,
representatives shall be designated by the Parties. The Parties shall inform each other,
in writing, of any change in the designated representatives. At the time of execution of
this Agreement the following persons are the designated representatives.

4.2No representative established pursuant to this Section shall have authority to bind the
City or Grantee, which may only be bound pursuant to action of the respective City
Councils or by their express, written delegation of authority to a representative of the
party.
SECTION FIVE - REPRESENTATIONS AND WARRANTIES
5.1The Parties have authority to enter into this Agreement upon approval by the respective
City Councils and execution by the authorized representatives.
5.2The City warrants that, pursuant to the requirements of this Agreement, and upon
written notice of the City, it will promptly remedy any delays, omissions, or
interruptions to the Network. The City further warrants that it has and shall maintain in
full force and effect during this Agreement, and any extension to this Agreement, all
necessary federal, state and local authorizations, permits and licenses to construct,
operate and maintain the Network and provide access to the Network to the Grantee
through the IRU.
5.3The City shall not create, or allow to be created, any lien on the Optical Fiber, the rights
or title relating to the Optical Fiber, or any interest therein. If any third party to create
such a lien, the City will promptly, at its own expense, take all necessary action to
discharge any such lien and shall hold Grantee harmless from all costs resulting from
such lien or action related to a lien.
5.4The Parties represent that this Agreement does not conflict with any laws, including the
cable franchises held by each Party.
SECTION SIX ASSIGNMENT AMENDMENTS, WAIVER, AND CONTRACT
COMPLETE
6.1Neither the City nor the Grantee may assign or transfer any rights or obligations under
this Agreement without the prior written consent of the other Party.
6.2Any amendment to this Agreement must be in writing and will not be effective until
approved and executed by the City Council of each Party.
6.3If either Party fails to enforce any provision of this Agreement, such failure does not
waive the provision or the Party's right to enforce it or other provisions later.
6.4This Agreement contains all negotiations and agreements between the Grantee and the
City. No other understanding regarding this Agreement, whether written or oral, may
alter the express terms of this Agreement.
6.5This Agreement is governed by an express covenant of good faith and fair dealing
between the Parties.
SECTION SEVEN - LIABILITY, INSURANCE AND INDEMNIFICATION
7.1Each Party to this Agreement shall be liable for its own acts or omissions and those of
its own employees. Neither Party shall be responsible for the acts of the other Party, its
agents or employees.
7.2The provisions of the Municipal Tort Claims Act, Minnesota Statutes, Chapter 466, the
Minnesota Tort Claims Act, Section 471.59, and other applicable law govern liability

. Each Party warrants thatitis
able to comply with the aforementioned liability requirements through an insurance or
self-insurance program and that each has coverage consistent with the liability limits
contained in Chapter 466.
7.3This Agreement does not constitute a waiver by either Party of limitations on liability,
provided by Chapter 466, or other applicable law. This clause will not be construed to
bar any legal remedies that each Party may have for the other Party's failure to fulfill its
obligations under this Agreement.
7.4Each Party shall defend, indemnify and hold the other Party harmless from any and all
liability, on account of injury to persons or damage to property occasioned by the
alleged negligent or intentional acts of the indemnifying Party. Neither Party, shall be
indemnified for losses or claims occasioned by its own negligence or intentional acts.
7.5In the event a suit isbrought against a Party under circumstances where this agreement
to indemnify applies, the indemnifying Party at its sole cost and expense shall defend
the other Party in such suit if written notice thereof is promptly given to the
indemnifying Party within a period wherein it is not prejudiced by lack of such notice.
If a Party is required to indemnify and defend, it will thereafter have control of such
litigation, but may not settle without the consent of the indemnified Party, which
consent shall not be unreasonably withheld. This section is not, as to third parties, a
waiver of any defense or immunity otherwise available to the indemnifying Party.
SECTION EIGHT - GRANTEE AUDITS
Grantee shall have the right to review the City's books, records, documents and accounting
procedures relevant to this Agreement. These rights shall be exercised upon request of the
Grantee at any time, for review at a mutually convenient time and location. The costs of such
review shall be borne by Grantee if no material irregularities are found. If Grantee discovers
material irregularities, the City shall bear the cost of Grantee's audit.
SECTION NINE - GOVERNMENT DATA PRACTICES ACT
This Agreement is subject to the Minnesota Government Data Practices Act, Minnesota Statutes,
Chapter 13.Ifeither Party receives a request for a Data request affecting data or property of the
other Party, the Party receiving th e request shall immediately notify the other Party of the request and
of the scope of intended disclosure. Each Party retains its full rights under the Act.
SECTION TEN - DISPUTE RESOLUTION
If the Parties are unable to resolve any dispute arising out of or relating to this Agreement,
they agree to binding arbitration as the exclusive remedy for such disputes. Claims submitted
to arbitration shall be brought within Minnesota's applicable statutes of limitations periods for
such claim or cause of action. The parties shall mutually select a neutral, qualified arbitrator
and shall share the costs and fees of the arbitrator equally. Minnesota Statutes, Sections
572.08 to 572.30, the Uniform Arbitration Act, shall govern the arbitration.

CITY OF MAPLEWOOD
CITY COUNCIL POLICIES ON AWARDOF
CHARITABLE GAMBLING TAX FUNDS
1.All licensed charitable gambling organizations within the City are required to contribute 10
percent (10%) of net profits derived from lawful gambling activity in the City to the
Charitable Gambling Tax Fund. These funds are dispersed by the City Council for lawful
expenditures.
2.All applications must be complete and submitted by the application deadline established by
the City Manager.
3.The City of Maplewood grants funds from the Charitable Gambling Tax Fund to support
activities and services that benefit Maplewood residents. The first priority in the granting of
funds will be given to the City of Maplewood domiciled organizations. The second priority
or consideration will be given to funding requests from other organizations which are used
primarily for the benefit of Maplewood residents. Funds shall be distributed for projects,
equipment, or activities that are based in the community and which primarily benefit
Maplewood residentsand will be looked upon more favorably than requests for salaries or
general operating costs.
4.In general, requests from organized athletic groups will not be funded. Funding for these
programs should be from participating families or community auxiliary groups. There are so
many athletic organizations within the community that the City of Maplewood is not capable
of funding their financial requests or fairly determining appropriate recipients.
5.The amount of Charitable Gambling Tax Funds awarded to any requestisdetermined by a
City Council vote. A requestmust receive 3 or more votes for funding in order to receive
Charitable Gambling Tax Funds.
6.All funds granted are required to be expended for the requested project within one year of the
date ofthe award letter. However, payment will not be made until after January 1 of the
award year. Grant recipientsshall submit a letter to the Senior Administrative Assistant
requesting payment of the grant award as well as provide specific information on how the
funds were used (receipts or other proof of expenditure) for the proposed purpose.
7.No employee or department of the City of Maplewood shall solicit a donation from a
licensed charitable organization without City Manager approval. If there is a financial need
for a specific program that was not funded in the City budget, staff may submit a request to
the City Manager for the use of Charitable Gambling Tax Funds.
8.The allocation of Charitable Gambling Tax Funds is an annual award. A previous receipt of
funds in no way guarantees or commits the City of Maplewood to funding in any subsequent
year. Each year’s funding requires a new, separate application.

The city deemed the applicant’s application complete on August 28, 2018. The initial 60-day review
deadline for a decision is October 27, 2018. As stated in Minnesota State Statute 15.99, the city is
allowed to take an additional 60 days if necessary to complete the review.
Background
On July 27, 1987, the city council approved a CUP for a planned unit development (PUD) allowinga
neighborhood shopping center, which includedmotor fuel sales, to be built. One of the conditions of
approvalfor this PUD stated “alluses shall conform with the BC(M), business commercial
(modified) zoning district requirements.” Within the BC(M) zoning district, “laundry” is a conditional
use.

Discussion
Conditional Use Permit
The applicant is proposing to build a new laundromat within the shopping center located at 1690
McKnightRoad North. No exterior changes are proposed to the building or site. This project would
convertexisting interior commercial space into the laundry facility.
In reviewing the applicant’s request staff did visit the site and found that the trash receptacles
behind the building were not screened as required by code. In addition, two of the existing tenants
are using banners in lieu of a permanent sign onthe building and there were multiple temporary
signs near the road. Staff is recommending conditions in the conditional use permit that would
require these issues be addressed prior to a certificate of occupancy being granted for the
laundromat use.

Staff engineer Jon Jarosch reviewed this project and stated since there are no exterior
improvements he would have no comments regarding the site.

All commercial building contractors doing work in Maplewood must be licensed by the City of
Maplewood. Also, all plumbing, heating, gas, excavating, sewer, masonry, contractors must be
licensed by the City of Maplewood. For specific licensing questions please call 651-249-2300.
Separate permits are required for building, plumbing, mechanical, electrical, fire alarm, and
sprinklers.

Planning Commission
September 18, 2018: The planning commission held a public hearingand recommended approval
ofthisproject. The commission recommend a condition of approval be added to the CUP which
requires the laundromat to be closed by 10 p.m. daily.
Citizen Comments
Staff surveyed the 97surrounding property owners within 500 feet of the proposed site for their
opinion about this proposal. Staff received nineresponses – all shown below.
1.No comments (Robert and Nancy Jackson, 2340 Larpenteur Avenue East)
2.While it is true that the Strip Mall at 1690 North McKnight Road has difficulty attracting
businesses, did the developers ever question which business would be a good fit? The area
here includes townhomes, apartments,single family homes \[all with on site laundry facilities\],
two private schools and a sprawling 3M campus a few miles away. Strip Malls in Woodbury and
other suburbs have popular restaurants catering to all ages. Judging from the dense traffic on
McKnight Road, something similar could work here – a casual, cut-above type eatery open for
breakfast and dinner, beer and wine available, and above all, excellent cuisine. The Twin
Citians love to eat and there is a no shortage of good cooks around.
On the other hand, there are already Laundromats in close proximity to the one proposed here.
The latter is literally in our backyard and, when the trees and bushes lose their leaves it’s not an
attractive view. Laundromats are noisy, open very late, usually understaffed and easy targets for
unsavory types. A quiet place to call homewould be a thing of the past.
Thank you for the opportunity to provide comments on the proposal, and I hope you will give us
ample notice of the public hearings in time to make plans to attend. (Diana Luciani, 1724

3.First, there is another laundromat only 1 mile away and another 2 miles away so it is not really
needed. The hours of 6 AM to 11 PM will also increase the traffic and the noise for nearby
residents during what should be quieter hours. The lack of supervision with only partial staffing
would also be detrimental to nearby residents. We are opposed to the extra traffic and people in
our neighborhood that this business could bring. (Roy and Julie Reichow, 1650 Myrtle Street)
4.Thank you for including the Maple Woods Townhouses input for future plans with the strip mall
south of our townhouse property.
After studying the information and charts regarding this request, I've concluded the two suites in
question are the mosteast and close to the wooded area of the site. Generally I agree with the
owner that occupied, viable businesses are preferable to the overall health of that corner vs.
dark store fronts. Laundromats do tend to attract "hanging out". Also, customers will come and
go frequently and repeatedly as they drop off and pick up. That is also a characteristic of the
market and fuel areas at the west end.
I'm a little confused where the proposed rezoning of the site on the long range city
comprehensive plan might fit with this. The site is 5 acres, so expansion of the existing building

is still possible. The property lines of that western edge, where the mall and apartments and
townhouses meet, are very confusing. Natural water shed and wooded areas are also affected,
but not involved with this request that I can see. All involve the overall character of this
neighborhood as the occupants of both malls on that intersection, as well as whatever St. Paul
does with the golf course property.
I've worked with mall owner,Anwar, this year. Primarily on removing fallen trees and wood from
the woods to the townhouse south property line. He and his mall site manager have been
prompt and considerate. However, at some point, the wooded areas on the south border of
Maplewood Estates are going to need natural maintenance. I do see some city workers
seasonally clearing brush, etc. along Larpenteur. The trees are old and huge on our side of the
wooded buffer, as well as the strip mall side. Buckthorn is certainly an issue. There's bound to
be ash trees in Anwar's buffer woods. The city has already been inspecting our property. I
received a call from S&S Trees recently, they have the city inspection contract. As of this week,
our property is healthy.
Aside from not wanting that wooded buffer between our properties be affected by anything the
mall owner proposes, what I'm hearing and concur with, is traffic concerns. ALL traffic on
Larpenteur/Lakewood Drive and McKnight Rd. exit and entrance to the child care center and the
townhouse front drive on McKnight is getting extremely dangerous, if not impossible at times. It
would help if the west wooded border of the mall property could regularly be trimmed back to
improve our sight lines looking south when exiting the townhouse property front drive.I hope

5.I would think people in this area all have their own machines – even in the apartments. Might be

6.No, no, no!! No! We have high traffic volume now!! Adding this will make it worse. Houses in
Larpenteur facing this mall have a hard time getting out of their yards, it is dangerous! Chose a
lower traffic business. Hill Murray High School traffic is terrible at our corner of Larpenteur and
McKnight. Who is going to monitor speeding, loud music in cars, screeching tires?? City council
should sit here and see reality. Must be the almighty $$ driving this stupid decision. Please how
would you make the decision if you lived here? Dangerous getting out of my driveway now
without adding more traffic.
7.Doesn't bother me; would rather keep the site as a shopping centerand occupied -so that it

CONDITIONAL USE PERMIT REVISION FOR A
PLANNED UNIT DEVELOPMENTRESOLUTION
WHEREAS, Anwar Bhimani, theproperty owner, has applied for a conditional use permit
revisionfor a planned unit developmentto build a new laundromat within the shopping center
located at 1690 McKnightRoad North.
WHEREAS, conditional use permits are required for planned unit developments and laundry
facilities located within the business commercial modified zoning district.
WHEREAS, this conditional use permit fora planned unit development was originally
approved for the purposes of office, commercial and service uses, including convenience motor fuel
sales.
WHEREAS, this permit applies to the site at 1690 McKnight Road North. The legal
description is:
Lot Three, Block One, Maple Woods Estates
WHEREAS, the history of this conditional use permitrevisionis as follows:
1.On September 18, 2018, the planning commission held a public hearing. The city
staff published a hearing notice in the Maplewood Review and sent notices to the
surrounding property owners. The planning commission gave everyone at the
hearing a chance to speak and present written statements. The planning
commission recommended that the city council approvethe conditional use permit
revision.
2.On September 24, 2018, the city council discussed the conditional use permit. They
considered reports and recommendations from the planning commission and city
staff.
NOW, THEREFORE, BE IT RESOLVED that the city council __________ the above-
described conditional use permit because:
1.The use would be located, designed, maintained, constructed and operated to be in
conformity withthe City’s Comprehensive Plan and Code of Ordinances.
2.The use would not change the existing or planned character of the surrounding area.
3.The use would not depreciate property values.
4.The use would not involve any activity, process, materials, equipment or methods of
operation that would be dangerous, hazardous, detrimental, disturbing or cause a
nuisance to any person or property, because of excessive noise, glare, smoke, dust,
odor, fumes, water or air pollution, drainage, water run-off, vibration, general
unsightliness, electrical interference or other nuisances.
5.The use would not exceed the design standards of any affected street.

6.The use would be served by adequate public facilities and services, including streets,
police and fire protection, drainage structures, water and sewer systems, schools
and parks.
7.The use would not create excessive additional costs for public facilities or services.

9.The use would cause minimal adverse environmental effects.
Approval is subject to the following conditions (additions are underlined and deletions are crossed
out):
1.Adherence to the site plan and conditions approved by the Community Design Review
Board, Future changes to the site plan may be approved by the Board.
2.All uses shall conform with the BC(M), business commercial (modified) zoning district
requirements.
3. External speakers shall be directed away from the dwelling units and the sound shall not
exceed fifty decibels (normal conversation level) at the residential property line.
4.The maximum building height shall be one story.
5.There shall be no exterior storage or sale of goods or merchandise.
6.The proposed construction must be substantially started within one year of Council
approval or the permit shall become null and void. A six-month time extension may be
requested as allowed in Section 36-442(d) of City code. Theproposed use of a
laundromat is approved with this permit and the laundry use must receive a certificate of
occupancy within one year or this approval shall become null and void. A one year time
extension may be approved by the city council.
7.There shall be no vents for the underground fuel tanks within 200 feet of an existing
residence or the buildable area of the planned undeveloped lots in the Currie Street
Addition, south of Larpenteur Avenue.
8.The type and anchoring of underground storage tanks must be approved by the City Fire
Marshal. The tanks shall be strapped to a concrete slab.
9.Before the laundry use receives a certificate of occupancy the applicant must either
construct trash enclosures for all trash receptacles on site or submit to staff a letter of
credit for 150 percent of the cost of construction.
10.Before the laundry use receivesa certificate of occupancy the applicant must remove all
banner and temporary signs that do not confirm to city ordinance requirements.
11.The laundry use at this site must be closed to the public by 10 p.m. daily.

Helen Zian, the property owner at 1475 Belmont LaneEast, has struggled to maintain her property
to the standards set in City Code. After a recent investigation by code and building staff, it was
determined that her home was no longer fit for human habitation and was a hazard. Staff is working
with the home owner to develop a plan to address the issues at the site. This includes entering into
a restoration agreementwith the owner of the property.
Recommended Action:
Motion to enter into a Restoration Agreement with Helen Zianfor 1475 Belmont Lane. The City
Attorney is authorized to approve minor modifications and the final format of the agreement.

Background
Helen Zian, the owner of 1475 BelmontLane, has lived in Maplewood for many years. Her home
has had a number of code violations over the years. More often they were small violations like long
grass or exterior storage.In fall of 2018, city staff received information that showed the home had
not had water for a number of years. Based on that knowledge, and some other issues at the
property, staff appliedforand received a warrant to enter the property. On further investigationof
the inside of the home, it was found that there were a number ofserious violations, and that the
house was no longer fit for human habitation.
Discussion
Diana Longrie,Ms. Zian’s attorney,reached out to the city with an interest in entering into a
restoration agreement for the property. This agreement isin place of the city bringing formal court
action against the owner to abate thehazardous conditions at theproperty. This agreement givesa
set period of time for which the ownercan bring her property into compliance. If the property is not
in compliance by the agreed upondate, the agreement allows the city to enter the property, and
abate the hazardous conditions.The real cost of the abatementwill be placed as a lien against the
property. The cost for the abatement is not expected toexceed $60,000.
The attached Restoration Agreementis a draft, but staff recommends the council authorize the City
Attorney to approve minor modificationsand the final format of the agreement. The substance and
standards of the agreement will be the same, just some minor items may be changed.

RESTORATIONAGREEMENT
ThisRestorationAgreement (the “Agreement”) is entered into as of this ___ day of
_________________, 2018, by and between the city of Maplewood, a Minnesota municipal
corporation (the “City”),and Helen K. Zian, a single person (the “Owner”).The City andthe
Ownershall be referred to collectively herein as the “Parties.”
RECITALS
WHEREAS,the Ownerisfee ownerof certain realproperty located at 1475 Belmont Lane
Eastin the city of Maplewood, Ramsey County, Minnesota andlegally described on the attached
Exhibit A (the “Property”); and
WHEREAS,the Property contains, in part, a single-family residentialdwellingwith an
attached garage (collectively, the “Dwelling”); and
WHEREAS,onSeptember 11, 2018, pursuant to an administrative search warrant,a
physical inspection of the Dwelling’s interiorwas conducted by the City’s code enforcement
officer and the City’s building officialand the following conditions were observed: an
overwhelming stench of rotting food, mold, feces and urine, animal feces and urine throughout the
Dwelling, human feces throughout the Dwelling, bins containing urine, plastic bags containing
feces, an accumulation of rotting vegetables, damaged walls and collapsed ceilings, an
accumulation of junk and other debris, no running water or operable toilets, no working electricity,
no operable heating or cooling, mold growth, an infestation of flying insects, and the basement
floor was covered with brown liquid; and
WHEREAS,during the aforementioned inspection, the City’s code enforcement officer
also observed that the Property’s exterior had an overgrowth of quack grass and other long weeds
exceeding 8 inches, as well as an accumulation of junk and debris, including felt, plastic containers,
wood piles, and chicken wire; and
WHEREAS,based on the conditions discovered duringthe aforementioned inspections,
the City has determined that(1) the Dwellingis “hazardous,”as defined byMinnesota Statutes,
section 463.15, (2) the Dwelling is “unsafe,” as defined by Minnesota Administrative Rules

1300.0180,and (3) both the exterior and interior portions of the Propertyarein violation of
numerous provisions of the Maplewood City Code (the “City Code”); and
WHEREAS,pursuant to both Minnesota Statutes, chapter 463and chapter 12 of the City
Code, the City is authorized to initiate formal legal proceedings to require thatthe Owner abate
the Property’s hazardous and unsafe conditions and, in the event that the Owner fails to do so, the
City is further provided with the statutory authority to facilitatesaid abatement on its ownand
assess the Property for the costthereof; and
WHEREAS,by entering into this Agreement, the Parties wish tojointlyfacilitate the
abatement ofthe Property’s hazardous conditions and avoid formal legal proceedings, as
authorized by Minnesota Statutes, section 463.151.
, THEREFORE,in consideration of the mutual covenants and promises set forthin
NOW
this Agreement, and other good and valuable consideration, the receipt and sufficiency of which
are acknowledged by the Parties, the Partieshereby agree as follows:
AGREEMENT
1.Recitals.The Partiesagree that the foregoing Recitals are true and correct and are fully
incorporated into this Agreement.
2.The Property. The Parties agreeand acknowledge that based on the present condition of
the Property, which includes numerous violations of the City Code, the Propertyis hazardous, as
that term is defined by Minnesota Statutes Section 463.15, andthe Dwelling isunsafe, as that term
is defined by Minnesota Administrative Rules 1300.0180.The Owner represents that she hasa
valid interest in the Property, including the Dwelling located thereon, and that shehasthe full legal
power and authority to enter into this Agreement.
3.Abatement of Exterior Violations. The Owner, at her own cost and expense,agrees to
undertake allwork necessary to abate the violations related to the Property’s exterior (the “Exterior
Work”) on or before October 10, 2018.The Exterior Work is described and itemized in the attached
Exhibit B. The Owner hereby authorizesthe City to inspect the Property’s exterioron or before
October 10, 2018to ensure that all Exterior Workhas been completed. If the Ownerfails to comply
with this section 3,the Parties agree that the City may immediatelyenter onto the Property, perform
the ExteriorWorkor hire a third-party contractor to do so in its sole discretion,and assess all of
its costs pursuant to section 7 of this Agreement without the need for any further action or approval.
4.Abatement of Interior Violations.The Owner, at her own cost and expense, agrees to
undertake all work necessary to abate the violations related to the Property’s interior (the “Interior
Work”) on or before October 24, 2018. The Interior Work is described and itemized in the attached
Exhibit C. The Owner hereby authorizesthe City to inspect the Property’s interioron or before
October 24, 2018to ensure that all Interior Work has been completed. If the Owner fails to comply
withthis section 4, the Parties agree that the City may immediately enter onto the Property, hire a
contractor to perform the Interior Work or raze the Dwelling, in its sole discretion,and assess all

of its costs pursuant to section 7of this Agreement without the need for any further action or
approval.
The Parties understand and acknowledge thatrazing the Dwelling might be the most practical and
cost-efficient method for abatingthe hazardous conditions of the Dwelling.The parties are also
mindful that razing the Dwelling might take some additional time to accomplish. Therefore, the
Owner shall have the option to provide the City with written notice of her intent to raze the
Dwelling on or before October 10, 2018. In the event that the Owner provides the City with said
written notice, the aforementioned deadline for the Interior Work shall be replaced with the
following two requirements:
(a)On or before October 19, 2018, the Ownershall obtain at least one quotefrom duly licensed
contractors for the razing of the Dwelling and shall provide copies of said quotes to the
City; and
(b)Onor before November 23, 2018,the Dwelling shall be razed in its entirety by the Owner.
Following the razing of the Dwelling on or before that date, the City agrees to provide the
Ownerwith a reasonable amount of time to clear the Property of any debris or materials
left behind before initiating any enforcement action related thereto.
Providing written notice to the City of an intent to raze and, thus, triggering the requirements in
(a) and (b) above shall act as an affirmative acknowledgment by the Owner that razing the
Dwelling is the most efficient and cost-effective manner in which to abate the hazardous
conditions. Should the Owner fail to strictly adhere to eitherof the requirements in (a) and (b)
above after providing said written notice,the City may immediately enter onto the Property, hire
a contractor to perform the Interior Work orraze the Dwelling, in its sole discretion,and assess all
of its costs pursuant to section 7of this Agreement without the need for any further action or
approval.
5.Hazardous Building Action.By entering into this Agreement, the City agrees that it will
not initiate formal legal proceedingsin civil courtagainst the Owner regarding the Property’s
hazardous conditions, except as otherwise expressly authorized in section 10 of this Agreement,
unless the Owner breaches any of the terms of this Agreement.
6. Cost Estimate.The estimated maximum cost to complete the Exterior Workis $400.00.
The estimated maximum cost to complete the Interior Work, which may includeclearing out and
razingthe Dwelling, is $40,000.00. The Partiesunderstand and agree thatactual costs might amount
toup to 150 percentof thoseestimated figures, or $600.00and $60,000.00, respectively. The Parties
agreethatif the Ownerfails tocomplete either the Exterior Workin accordance withthe timeline
contemplated in section 3 of this Agreement, orthe Interior Work in accordance with the timeline
contemplated in section 4 of this Agreement, or both, and the Citysubsequentlyperforms any of said
work, asexpresslyauthorized herein, 100 percent of the actual cost of the workperformed by the City
shall be assessed against the Propertyin accordance with section 7 below.
7. Special Assessment of City Expenses; Waivers. The City shall beauthorized, pursuant to
Minnesota Statutes, Section 463.21, the City Code,and this Agreement,to assess the expenses that it

incurs to undertake the Exterior Workand Interior Work, which may include razing the Dwelling,in
an amountnot to exceed 120 percent of the estimated figures contained in section 6 of this Agreement.
If the Owner fails to comply with sections 3 or 4 ofthis Agreementand the City subsequently takes
abatement action,then the Owner, for herself andhersuccessors and assigns,waives theright to
object to the City’s assessment of 100 percent of the cost thereof. The Owner, for herself and her
successors or assigns, further waives theright to appeal the levy of the special assessment pursuant to
Minnesota Statutes, Section 429.081, or reapportionment thereof upon land division pursuant to
Minnesota Statutes, Section 429.071, subdivision 3, or otherwise, and further specifically agrees with
respect to such special assessment against the Property that:
(a)Any requirements of Minnesota Statutes, Chapter 429 with which the City does not
comply are hereby waived;
(b)The increase in fair market value of the Property as a whole resulting from the work
will be in an amount at least equal to the total cost assessed to the Property, and that
such increase in fair market value is a special benefit resulting from said work; and
(c)Assessment of the actual cost ofthe work against the Property as outlined above is
reasonable, fair, and equitable and there are no other properties against which such
costs should be assessed.
The City shallprovide for the payment of such special assessment infive equalannual installments
commencing with taxes payable in 2020, with interest at the annual rate of fivepercent (5%)
accruing from the date of adoption of the assessment.The City shall provide a written notice of
the amount of the assessmentprior to certification to the county for placement on the taxes of the
Property to the then-current fee owner of the Property.
8.Right of Entry.
(a)The Owner hereby grants to theCity, and itsagents, employees, contractors, and
invitees,the right to immediately enter upon the Property and the Dwelling contained
thereonfor the purpose of conducting all activities on the Property necessary to
accomplish the Exterior Work and the Interior Work, which may include razing the
Dwelling,in accordance with this Agreement, forthe further purpose of storing
materials, equipment, and other items thereon which are needed in connection with the
said work, and for the purpose of inspecting the Propertyand the Dwellingto determine
compliance with this Agreement.
(b)The right of entry outlined hereinshall expire upon completion of theExterior Work,
the Interior Work,razing of the Dwelling, if applicable,and final inspection by the City
of both the exterior portions of the Property and the Dwelling’s interior.
(c)In consideration for such right of entry, the City agrees to use the Property only for the
purposes described herein and will do no unnecessary damage to the land.
9.Indemnification; Waiver of Claims. The Owneragrees toindemnify, hold harmless, and
defend the City, its officials, employees, contractors, and agents from and against any and all

liability, loss, costs, damages, expenses, claims, actions, or judgments, including reasonable
attorneys’ fees which they, or their agents or contractors may hereinafter sustain, incur, or be
required to pay, arising out of or by reason of this Agreement. Nothing in this Agreement shall be
construed as a waiver by the City of any immunities, defenses, or other limitations on liability to
which the City is entitled by law, including but not limited to the maximum monetary limits on
liability established by Minnesota Statutes Chapter 466 or otherwise.
Should the City complete any of the Exterior Workor Interior Work, which may include razing
the Dwelling,in accordance with this Agreement, the Ownerwaives any and all claimsagainst the
City for the removal or destruction of any and all personal items. As part of this waiver, the Owner
knowingly acknowledges and agreesthat none of the itemsthat remain at the Propertyhave value,
nor are they salvageable and, accordingly, the City may dispose of said items and neednot make
any attempt to salvage or sellsaid items.
10.Cost Exceeds Estimate.In the event that the Cityis permitted hereunder to complete the
any of the work on the Propertyanddetermines that the actual cost of the work will exceed 150
percent of the estimated costs contained herein, it will notify the Ownerof such determination in
writing. The Owner will then have five days to determine whether to consent to an increase in the
amount of the assessment to include the increased costs. If the Owner notifies the City in writing
within such period that she will accept the increase, then the City will proceed with the work.If
such notice is not givenby the Owner, the City may,in its sole discretion,proceed with undertaking
the work knowing that it will be limited to specially assessing the Property for only 120 percent of
the estimated costs contained herein or, alternatively, proceed witha hazardous building action
pursuant to Minnesota Statutes, Chapter 463.
11. General Provisions.This Agreement represents the entire agreement between the Parties
and supersedes in all respects all prior agreements of the Parties, whether written or otherwise,
with respect to the Propertyand the Dwelling. No change, modification or waiver of any
provisions of this Agreementwill be binding unless it isin writing and signed by both Parties.
This Agreement shall be construed according to the laws of the state of Minnesota.
12.Execution in Counterparts.This Agreement may be executed and delivered in multiple
counterparts, each of which, when so delivered, shall be an original, but such counterparts shall
together constitute but one and the same instrument and agreement.
13.Run with the Land.The provisions of this Agreement shall run with the land and be
binding upon the Parties and theirrespective heirs, successors, and assigns.
14.Recording.The City mayrecord this Agreement against the Property in the land records
of Ramsey County. It is the intent of the Parties that this Agreement isin a form which is recordable
among the land records and the Partiesagree to make any changes to this Agreement as may be
necessary to effectuatethe recording and filing of this Agreement against theProperty.
15.No Occupancy.The Property is presentlyunoccupied and the Owner agrees not tooccupy
the Property or otherwise allow occupancyuntil thisAgreementis terminated.

16.Severability. If any term, provision, or condition contained in this Agreement shall, to
any extent, be invalid or unenforceable, the remainder of this Agreement (or the application of
such term, provision, or condition to persons or circumstances other than those in respect to which
it is invalid or unenforceable) shall not be affected, and each term, provision, or condition of this
Agreement shall be valid and enforceable to the fullest extent permitted by law.
17.Compliance with Laws and Regulations. In performing all obligations contained herein,
the Partiesmust abide by all applicable federal, state, and local statutes, ordinances, rules, and
regulations. The Owner shallapply for all necessary permits from the City, if required, for any of
the work. This Agreement is neither a substitute for, nor a waiverof, the City’s permitting and
inspection requirements.
18.Termination of Agreement. This Agreement shall terminate upon theOwner’s
satisfactory completion of both the Exterior Work and the Interior Work, which may include razing
the Dwelling,in the City’s sole discretion, or, if the City undertakesany ofthe work, uponfinal
payment of the special assessment levied against the Property regarding said work. Upon
termination of this Agreement,the City shall thereafter execute and deliver suchdocuments, in
recordable form, thatare necessary to extinguish the rights hereunder.
19.Attorney Representation.The Parties acknowledge that they have been represented by
counsel in connection with the execution of this Agreementand intend that no rules construing
provisions of this Agreementagainst the position of the drafter shall be applied. The Parties further
represent and declare that in executing this document they have relied solely upon their own
judgment, belief and knowledge, or the advice and recommendation of their own independently
selected counsel, and that they have not been influenced to any extent whatsoever in executing this
document by any representations or statements except those expressly contained or referred to in
this Agreement.

The Interior Work shall consist of either razing the Dwelling or completing all of the following:
1.Remove all feces and urine from the Dwelling;
2.Remove all rotting food from the Dwelling;
3.Remove all garbage, debris, and unsanitary clothing (soaked in urine, feces, or other
substances) from the Dwelling;
4.Declutter the Dwelling to ensure adequate ingress and egress to all exterior doors
and windows;
5.Replace or adequately clean and sanitizeany surfaces that are saturated with feces
or urine, including any walls, baseboards, flooring, carpeting, and tile;
6.Obtain a plumbing assessment from a licensed plumbing professionaland repair
the Dwelling’s plumbing system in accordance with said assessment and in
accordance with the Minnesota State Building Code;
7.Provide adequate running water to the Dwelling and ensure that restrooms contain
flushable toilets;
8.Obtain an electrical assessment from a licensed electrician and repair and make safe
all electrical components in accordance with the Minnesota State Building Code;
9.Provide an operable, code-compliant heat source for the Dwelling;
10.Repair open walls and damaged ceilings within the Dwelling in accordance with
the Minnesota State Building Code;
11.Repair the Dwelling’s leaking roof in accordance with the Minnesota State Building
Code;
12.Mitigate further water damage by removing any standing water from the Dwelling;
and
13.Determine the existence of mold due to excess moistureand mitigate saidmoisture

RESTORATIONAGREEMENT
This RestorationAgreement (the “Agreement”) is entered into as of this ___ day of
_________________, 2018, by and between the city of Maplewood, a Minnesota municipal
corporation (the “City”),and Helen K. Zian, a single person (the “Owner”).The City andthe
Ownershall be referred to collectively herein as the “Parties.”
RECITALS
WHEREAS,the Ownerisfee ownerof certain realproperty located at 1475 Belmont Lane
Eastin the city of Maplewood, Ramsey County, Minnesota andlegally described on the attached
Exhibit A (the “Property”); and
WHEREAS,the Property contains, in part, a single-family residentialdwellingwith an
attached garage (collectively, the “Dwelling”); and
WHEREAS,onSeptember 11, 2018, pursuant to an administrative search warrant,a
physical inspection of the Dwelling’s interiorwas conducted by the City’s code enforcement
officer and the City’s building officialand the following conditions were observed: an
overwhelming stench of rotting food, mold, feces and urine, animal feces and urine throughout the
Dwelling, human feces throughout the Dwelling, bins containing urine, plastic bags containing
feces, an accumulation of rotting vegetables, damaged walls and collapsed ceilings, an
accumulation of junk and other debris, no running water or operable toilets, no working electricity,
no operable heating or cooling, mold growth, an infestation of flying insects, and the basement
floor was covered with brown liquid; and
WHEREAS,during the aforementioned inspection, the City’s code enforcement officer
also observed that the Property’s exterior had an overgrowth of quack grass and other long weeds
exceeding 8 inches, as well as an accumulation of junk and debris, including felt, plastic containers,
wood piles, and chicken wire; and
WHEREAS,based on the conditions discovered duringthe aforementioned inspections,
the City has determined that(1) the Dwellingis “hazardous,”as defined byMinnesota Statutes,
section 463.15, (2) the Dwelling is “unsafe,” as defined by Minnesota Administrative Rules

1300.0180,and (3) both the exterior and interior portions of the Propertyarein violation of
numerous provisions of the Maplewood City Code (the “City Code”); and
WHEREAS,pursuant to both Minnesota Statutes, chapter 463and chapter 12 of the City
Code, the City is authorized to initiate formal legal proceedings to require thatthe Owner abate
the Property’s hazardous and unsafe conditions and, in the event that the Owner fails to do so, the
City is further provided with the statutory authority to facilitatesaid abatement on its ownand
assess the Property for the costthereof; and
WHEREAS,by entering into this Agreement, the Parties wish tojointlyfacilitate the
abatement ofthe Property’s hazardous conditions and avoid formal legal proceedings, as
authorized by Minnesota Statutes, section 463.151.
NOW, THEREFORE,in consideration of the mutual covenants and promises set forthin
this Agreement, and other good and valuable consideration, the receipt and sufficiency of which
are acknowledged by the Parties, the Partieshereby agree as follows:
AGREEMENT
1.Recitals.The Partiesagree that the foregoing Recitals are true and correct and are fully
incorporated into this Agreement.
2.The Property. The Parties agreeand acknowledge that based on the present condition of
the Property, which includes numerous violations of the City Code, the Propertyis hazardous, as
that term is defined by Minnesota Statutes Section 463.15, andthe Dwelling isunsafe, as that term
is defined by Minnesota Administrative Rules 1300.0180.The Owner represents that she hasa
valid interest in the Property, including the Dwelling located thereon, and that shehasthe full legal
power and authority to enter into this Agreement.
3.Abatement of Exterior Violations. The Owner, at her own cost and expense,agrees to
undertake allwork necessary to abate the violations related to the Property’s exterior (the “Exterior
Work”) on or before October 10, 2018.The Exterior Work is described and itemized in the attached

may mutually agree to a reasonable adjustment to the aforementioned timelinein writing;
provided, however, that the City, in its sole discretion, first determines that said notice was
provided by the Owner in good faithand due to a delay that was entirely out of the Owner’s
control.
(c)Following the Owner’s razing of the Dwelling in accordance with this Agreement, the City
agrees to provide the Ownerwith a reasonable amount of time to clear the Property of any
debris or materials left behind before initiating any enforcement action related thereto.

Dwelling,in accordance with this Agreement, for the further purpose of storing
materials, equipment, and other items thereon which are needed in connection with the
said work, and for the purpose of inspecting the Propertyand the Dwellingto determine
compliance with this Agreement.

(b)The right of entryoutlined hereinshall expire upon completion of the Exterior Work,
the Interior Work,razing of the Dwelling, if applicable,and final inspection by the City
of both the exterior portions of the Property and the Dwelling’s interior.
(c)In consideration for such right of entry, the City agrees to use the Property only for the
purposes described herein and will do no unnecessary damage to the land.
9.Indemnification; Waiver of Claims. The Owneragrees toindemnify, hold harmless, and
defend the City, its officials, employees, contractors, and agents from and against any and all
liability, loss, costs, damages, expenses, claims, actions, or judgments, including reasonable
attorneys’ fees which they, or their agents or contractors may hereinafter sustain, incur, or be
required to pay, arising out of or by reason of this Agreement. Nothing in this Agreement shall be
construed as a waiver by the City of any immunities, defenses, or other limitations on liability to
which the City is entitled by law, including but not limited to the maximum monetary limits on
liability established by Minnesota Statutes Chapter 466 or otherwise.
Should the City complete any of the Exterior Workor Interior Work, which may include razing
the Dwelling,in accordance with this Agreement, the Ownerwaives any and all claimsagainst the
City for the removal or destruction of any and all personal items. As part of this waiver, the Owner
knowingly acknowledges and agreesthat noneof the itemsthat remain inside of the Dwelling on
or after November 21, 2018 have value, norare they salvageable and, accordingly, the City may
dispose of said items and need not make any attempt to salvage or sellsaid items.
10.Cost Exceeds Estimate.In the event that the Cityis permitted hereunder to complete the
any of the work on the Propertyanddetermines that the actual cost of the work will exceed 150
percent of the estimated costs contained herein, it will notify the Ownerof such determination in
writing. The Ownerwill then have five days to determine whether to consent to an increase in the
amount of the assessment to include the increased costs. If the Owner notifies the City in writing
within such period that she willaccept the increase, then the City will proceed with the work.If
such notice is not givenby the Owner, the City may,in its sole discretion,proceed with undertaking
the work knowing that it will be limited to specially assessing the Property for only 150percent of
the estimated costs contained herein or, alternatively, proceed witha hazardous building action
pursuant to Minnesota Statutes, Chapter 463.
11.Accessory Structure. The accessory shed located on the Property is not considered a
hazardous building and, accordingly, is not subject to the provisions contained herein regarding
the Exterior Work and Interior Work, including the razing of the Dwelling.
12. General Provisions.This Agreement represents the entire agreement between the Parties
and supersedes in all respects all prior agreements of the Parties, whether written or otherwise,
with respect to the Propertyand the Dwelling. No change, modification or waiver of any
provisions of this Agreementwill be binding unless it isin writing and signed by both Parties.
This Agreement shall be construed according to the laws of the state of Minnesota.

13.Execution in Counterparts.This Agreement may be executed and delivered in multiple
counterparts, each of which, when so delivered, shall be an original, but such counterparts shall
together constitute but one and the same instrument and agreement.
14.Run with the Land.The provisions of this Agreement shall run with the land and be
binding upon the Parties and theirrespective heirs, successors, and assigns.
15.Recording.The City mayrecord this Agreement against the Property in the land records
of Ramsey County. It is the intent of the Parties that this Agreement isin a form which is recordable
among the land records and the Partiesagree to make any changes to this Agreement as may be
necessary to effectuate the recording and filing of this Agreement against the Property.
16.No Occupancy.The Property is presentlyunoccupied and the Owner agrees not tooccupy
the Property or otherwise allow occupancyuntil thisAgreementis terminated.
17.Severability. If any term, provision, or condition contained in this Agreement shall, to
any extent, be invalid or unenforceable, the remainder of this Agreement (or the application of
such term, provision, or condition to persons or circumstances other than those in respect to which
it is invalid or unenforceable) shall not be affected, and each term, provision, or condition of this
Agreement shall be valid and enforceable to the fullest extent permitted by law.
18.Compliance with Laws and Regulations. In performing all obligations contained herein,
the Partiesmust abide by all applicable federal, state, and local statutes,ordinances, rules, and
regulations. The Owner shallapply for all necessary permits from the City, if required, for any of
the work. This Agreement is neither a substitute for, nor a waiver of, the City’s permitting and
inspection requirements.
19.Termination of Agreement. This Agreement shall terminate upon theOwner’s
satisfactory completion of both the Exterior Work and the Interior Work, which may include razing
the Dwelling,in the City’s sole discretion, or, if the City undertakesany ofthe work, uponfinal
payment of the special assessment levied against the Property regarding said work. Upon
termination of this Agreement,the City shall thereafter execute and deliver such documents, in
recordable form, thatare necessary to extinguish the rights hereunder.
20.Attorney Representation.The Parties acknowledge that they have been represented by
counsel in connection with the execution of this Agreementand intend that no rules construing
provisions of this Agreementagainst the position of the drafter shall be applied. The Parties further
represent and declare that in executing this document they have relied solely upon their own
judgment, belief and knowledge, or the advice and recommendation of their own independently
selected counsel, and that they have not been influenced to any extent whatsoever in executing this
document by any representations or statements except those expressly contained or referred to in
this Agreement.

The Interior Work shall consist of either razing the Dwelling or completing all of the following:
1.Remove all feces and urine from the Dwelling;
2.Remove all rotting food from the Dwelling;
3.Remove all garbage, debris, and unsanitary clothing (soaked in urine, feces, or other
substances) from the Dwelling;
4.Declutter the Dwelling to ensure adequate ingress and egress to all exterior doors
and windows;
5.Replace or adequately clean and sanitize any surfaces that are saturated with feces
or urine, including any walls, baseboards, flooring, carpeting, and tile;
6.Obtain a plumbing assessment from a licensed plumbing professionaland repair
the Dwelling’s plumbing system in accordance with said assessment and in
accordance with the Minnesota State Building Code;
7.Provide adequate running water to the Dwelling and ensure that restrooms contain
flushable toilets;
8.Obtain an electrical assessment from a licensed electrician and repair and make safe
all electrical components in accordance with the Minnesota State Building Code;
9.Provide an operable, code-compliant heat source for the Dwelling;
10.Repair open walls and damaged ceilings within the Dwelling in accordance with
the Minnesota State Building Code;
11.Repair the Dwelling’s leaking roof in accordance with the Minnesota State Building
Code;
12.Mitigate further water damage by removing any standing water from the Dwelling;
and
13.Determine the existence of mold due to excess moistureand mitigate saidmoisture

The City has approved agreements to purchase properties in the vicinity of Frost Avenueand English
Street. Closing on the first property is expected soon. The City anticipates these properties to be
redeveloped and included in a future tax increment financing district. The City is using money from
its sewer and water funds to acquire theproperties. If a TIF district is established in this area and
future development(s) generate sufficient tax increment, the City will be able to reimburse itself for
the costs of this land out of tax increment. However, state law requires that to be eligible for
reimbursement the City must first adopt an interfund loan resolution which specifies theterms of the
loan and repayment.

State law prohibits the use of increment to reimburse expenditures made prior to collection of tax
increment unless the City has first adopted an interfund loan resolution. The City has previously
authorized purchase of the Moose Lodge property ($900,000) and Gladstone House ($275,000), plus
associated expenses. The proposed resolution identifies the City’s utility funds as the source of
revenue for these purchases. This resolution does not authorize additional expenditures above the
amounts the city council has previously approved.

Background
It is very important to adopt an interfund loan resolution when theCity incurs costs which it hopes to
recoup through a tax increment district. The resolution must be adopted before expenditureof the
funds. If the City subsequently establishes a TIF district and there is sufficient increment, the City
may be able to reimburse itself for some or all of the costs of these properties. If no district is created
or increment is insufficient, the City will end up payingfor this land from another source. The
resolution authorizes up to $2,000,000, which is the amount included in the 2019 budget for land
acquisition in the Gladstone area. However, the City is not required to expend the full amount
authorized.

RESOLUTION AUTHORIZING INTERFUNDLOAN FOR
ADVANCE OF CERTAIN COSTS IN CONNECTION WITH
A PROPOSED TAX INCREMENT FINANCING DISTRICT
BE IT RESOLVED by the City Council of the City ofMaplewood, Minnesota (the “City”) as
follows:
Section 1.Background.
1.01. The City intends to establish aTax Increment Financing District (the “TIF District”) in
the general vicinity of Frost Avenue and EnglishStreet, pursuant toMinnesota Statutes, Sections 469.174
through 469.1794, as amended (the “TIF Act”).
1.02.The Citymay incur certain costs related to the TIF Districtprior to such timeastax
increment may be available to pay for such costs.
1.03. The Cityhas determined to pay for certain land acquisition,demolition and administrative
costs related to the proposed TIF District (the “Qualified Costs”), which costs may be financed on a
temporary basis from City funds available for such purposesin order to finance expenditures that are
eligible to be paid with tax increments under the TIF Act.
1.04. Under Section 469.178, subdivision 7 of the TIF Act, the City is authorized to advance or
loan money from the City’s general fund or any other fund from which such advances may be legally
authorized in order to finance the Qualified Costs.
1.05. The City will loan funds from its water fund and sewer fund (the “Utility Funds”), or any
other fund designated by the City, to finance the Qualified Costs (the “Interfund Loan”) in accordance with
the terms of this resolution.
Section 2.Interfund Loan Authorized.
2.01. The Cityhereby authorizes the advance of up to $2,000,000.00 from the Utility Funds or
other funds or so much thereof as may be paid as Qualified Costs. The Cityshall reimburse itself for such
advances together with interest at the rate stated below. Interest accrues on the principal amount from the
date of each advance. The maximum rate of interest permitted to be charged is limited to the greater of
the rates specified under Minnesota Statutes, Section 270C.40 andSection 549.09 as of the date the loan
or advance is authorized, unless the written agreement states that the maximum interest rate will fluctuate
as the interest rates specified under Minnesota Statutes, Section 270C.40 or Section 549.09 are from time
to time adjusted. The interest rate shall be 4.0% and will not fluctuate.
2.02.Principal and interest (the “Payments”) on the Interfund Loan shall be paid semiannually
on each February1 and August 1 (each a “Payment Date”), commencing on the first Payment Date on
which the Cityhas Available Tax Increment (defined below), or on any other dates determined by the
City Managerof the City, through the date of last receipt of tax increment from the TIF District.

2.03. Payments on this Interfund Loan are payable solely from “Available Tax Increment,”
which shall mean, on each Payment Date, tax increment available after other obligations have been paid,
or as determined by the City Managerof the City, generatedin the preceding six (6) months with respect
to the property within the TIF District and remitted to the Cityby Ramsey County, Minnesota, all in
accordance with the TIF Act. Payments shall be applied first to accrued interest, and then to unpaid
principal. Payments on this Interfund Loan may be subordinated to any outstanding or future bonds or
notes issued by the City and secured in whole or in part with Available Tax Increment.
2.04.The principal sum and all accrued interest payable under this Interfund Loan are
prepayable in whole or in part at any time by the City without premium or penalty. No partial
prepayment shall affect the amount or timing of any other regular payment otherwise required to be made
under this Interfund Loan.
2.05.This Interfund Loan is evidence of an internal borrowing by the City in accordance with
Section 469.178, subdivision 7 of the TIF Act, and is a limited obligation payable solely from Available
Tax Increment pledged to the payment hereof under this resolution. This Interfund Loan and the interest
hereon shall not be deemed to constitute a general obligation of the State of Minnesota or any political
subdivision thereof, including, without limitation, the City. Neither the State of Minnesota nor any
political subdivision thereof shall be obligated to pay the principal of or interest on this Interfund Loan or
other costs incident hereto except out of Available Tax Increment, and neither the full faith and credit nor
the taxing power of the State of Minnesota or any political subdivision thereof is pledged to the payment
of the principal of or interest on this Interfund Loan or other costs incident hereto. The City shall have no
obligation to pay any principal amount of the Interfund Loan or accrued interest thereon, which may
remain unpaid after the final Payment Date.
2.06.The Citymay at any time make a determination to forgive the outstanding principal
amount and accrued interest on the Interfund Loan to the extent permissible under law.
2.07. The Citymay from time to time amend the terms of this resolution to the extent permitted
by law, including without limitation amendment to the payment schedule and the interest rate; provided,
however, that the interest rate may not be increased above the maximum specified in Section 469.178,
subdivision 7 of the TIF Act.
2.08.City officials and consultants are hereby authorized and directed to execute any
documents or take any actions necessary or convenient to carry out the intent of this resolution.
Section 3. Effective Date. This resolution is effective upon approval.
