Following are rules of civility the City of Maplewood expects of everyone appearing at Council
Meetings -elected officials, staff and citizens. It is hoped that by following these simple rules, everyone’s
opinions can be heard and understood in a reasonable manner. We appreciate the fact that when
appearing at Council meetings, it is understood that everyone will follow these principles:
Speak only for yourself, not for other councilmembers or citizens -unless specifically tasked by
your colleagues to speak for the group or for citizens in the form of a petition.
Show respect during comments and/or discussions, listen actively and do not interrupt or talk
amongst each other.
Be respectful of the process, keepingorder and decorum. Do not be critical of councilmembers,
staff or others in public.
Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive.

WHEREAS ,the Ramsey County Agricultural Society/Fair Board has presented to
the Maplewood Police Department a donation in the amount of $400; and
WHEREAS, this donation is intended for the purpose of Maplewood Police
Reserve Unit equipment and/or needs; and
WHEREAS, the Maplewood City Council is appreciative of the donation and
commends the Ramsey County Agricultural Society/Fair Board for their civic efforts,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Maplewood, Minnesota, that:
1.The donation is accepted and acknowledged with gratitude; and
2.The donation will be appropriated for the Police Department as designated;

authorize the city manager to execute the agreement between the City of Maplewood
and Perkins+Will to develop the North End Vision Plan.

2.Purchase Agreement to Sell City Owned Property at 3xxx Hazelwood
a.Intent to Close Meeting (§13D.05 subd. 3c)

Request to Increase Maplewood Area Historical Society Annual

Policy Issue:
The Maplewood Area Historical Society (MAHS) is requesting an increase in its annual City
appropriation for 2018 from $2,000 to $5,000. The budgeted appropriation for 2018 is $2,000 with
an offer to apply for the remainder from charitable gambling funds. The MAHS is also requesting
an increase in future annual appropriations, beginning in budget year 2019 to approximately
$15,000 - $20,000. The budgeted annual appropriation has not been increased since 2001,
although funds have occasionally been granted from charitable gambling proceeds.
Recommended Action:
Staff recommends a motion to increase the annual appropriation for the MAHS from $2,000 to
$5,000, beginning in budget year 2019, and further increases in budget year 2020 and after, with
additional opportunities from charitable gambling funds.

The MAHS believes that the historic archive and research center for Maplewood history will expand
to become an arts and cultural event center for Maplewood and the region. The MAHS provides
historic research to organizations such as the Maplewood Heritage Preservation Commission and
MnDOT on the Rush Line BRT corridor project.

Background
On September 11, 2001, the City Council approved a motion to include a $2,000 appropriation to
the Maplewood Historical Society in the city’s budget each year.
In budget year 2017, the appropriation amount was increased to $5,000, with $3,000 coming from
Charitable Gambling Funds.
During 2014 the City Council requested that the Historical Society provide financial reports to the
City each year. The 2017 annual financial report is attached. The $5,000 City appropriation for
2017 is reflected in Miscellaneous Income and it was utilized for general operating expenses.
In budget year 2018, an appropriation of $2,000 was granted, with an invitation to apply for the
remaining $3,000 from charitable gambling funds.

This project is consistent with the asset management report completed in 2015 which identified
needed improvements, updates, and replacements within City Hall, Park Maintenance, and Public
Works.
Background
The City Council awarded a construction contract to American Liberty Construction for City Hall,
Park Maintenance, and Public Works building improvements, City Project 17-01, in the amount of
$587,700.00.
Throughout the course of the project, several items were identified during construction that resulted
in either an increase or deductto the project contract. These items are summarized and included in
Change Order No. 1 (see attached Change Order No. 1).The net increase for Change Order No. 1
will increase the final project construction contract amount by $28,607.52 from $587,700.00 to
$616,307.52. No adjustments to the approved budget are needed.
The contractor, American Liberty Construction, has completed the project improvements. City staff
has reviewed the work and deemed it acceptable. The contractor has submitted all final project
documents required for final acceptance of the project.

November 28, 1994: The City Council made several approvals for the Maplewood Retail Addition

March 24, 1997: Staffapproved a permit request by Home Depot to have two temporary seasonal
outdoor storage and sales areas in the parking lot.
May 5, 2005: The City Council approved a CUP revision to add additional exterior storage to the
site.
August 28, 2017: The City Council approved a CUP revision to add additional exterior storage to
the site and to allow short term truck rentals from the property.
Discussion
The council approved a revision of the CUP for Home Depot, located at 2360 White Bear Avenue.
The store had a preexistingCUP for exterior storageand saleof merchandiseon the site.The
revision of the existing CUP addedareas for storage and sales on the northand west sides of the
buildingand to allowedshort term rental of trucks at the site.
The site was tidy and clean during the site inspection. There seemed to be ample parking and there
was not an excessive amount of exterior storage at the site. The rental vehicles were parked in their
approvedlocation. Staff recommends reviewing the CUP for this project again only if a problem arises
or a major change is proposed.

Economic Development Coordinator Martin gave the staff report. Todd Waldo with
Greenberg Farrow representing Home Depot answered questions of the council.
Councilmember Abrams moved to approve the conditional use permit resolution for
revisions for the property located at 2360 White Bear Avenue (Home Depot) based on
the findings required by ordinance and is subject to the following conditions:
1.All construction, uses and outside storage areas shall follow the site plan dated
August 17, 2017, in the staff report as approved by the city council. This includes the
location and size of the approved outside storage areas. The city will allow the
outside sales and storage of sheds and landscaping materials with this revision. City
staff shall approve the final layout for all outdoor sales and storage areas. Outdoor
storage and sales shall be limited to the dates indicated by the site plan dated
August 17, 2017. The director of community development may approve minor
changes to theseplans.
2.The store shall use the new outside storage and display areas within one year of the
Council's approval or the permit shall end. The city council may extend this deadline
for oneyear.
3.The city council shall review this permit revision in oneyear.
4.This permit allows a waiver of the parking code to allow 154 fewer parking spaces
than the code allows since there is adequate parking available for the existing and
proposed uses. Thecity may require Home Depot to add more parking spaces orto
reduce the amount of area used for outdoor sales and storage if the citydetermines
that a parking shortage hasdeveloped.
5.The rental of moving trucks is allowed for this site. All trucks must be located in the

Discussion
The council approveda CUPto allow a food truck to be located on the property at 2520 White
Bear Avenue. A CUP is required for the exterior sales of goods – including food trucks – for more
than four months a year. The applicant,Mr. Sanchez-Osorio, is not allowed tostore the truck
overnight on this site but is allowed to sellfood from the propertyall year.
The approved exterior sale of goods is limited to only afood truck. The existing liquor store and
any other tenants of this property are not allowed to store or sell any additional goods outside of
thebuilding.
Additionally, this permitdoes not move with the food truck. The CUP only applies to 2520 White
Bear Avenue. If the applicantdecidedto move his truck to another location in the city he will have
to abide by ordinance requirements for that property. This CUP is not transferable to another
property.

State law allows cities to create storm sewer improvement tax districts within specific areas of the
community. The ordinance allows the city to acquire, construct, reconstruct, extend, maintain and
otherwise improvestorm sewer systems and related facilities within the district. City policy is that
the property owners within a subdivision are responsible for maintaining stormwaterponds and
similar facilities. It is not the city’s obligation to do so. In the event the homeowners fail to maintain
the facilities, the city has the right but not the obligation to do the necessary work and recover the
cost through atax levied only on the propertieswithin the district. This avoids a tax on other
properties in the city or the need to show special benefit under Minn. Stat., Chapter 429.

Infiltration basins are required to be constructed as part of the stormwater infrastructure of the
Beebe Meadows plat. Property owners within the plat are required to maintain the infiltration basin
infrastructure. Creating a stormsewer tax district will ensure operational effectiveness and financial
stability by creating a mechanism in which to assess the property owners for the work if not
complete.
Background
The goal is to establish a stormsewer tax district for the Beebe Meadows plat, and introduce a
mechanism for creating such a district over other plats if needed in the future. If the stormwater
facilities are maintained by the homeowners as required, the city will never have to take actionon
the district.It is an insurance policy in the event the city needs to intervene against private parties
not maintainingthe stormwater facilities.If this happens the district is a mechanism that will allow
the city to recover the cost of maintaining the facilities by levying a tax against the properties within
the district. Taxpayers outside the district would bear no cost and the city would not be requiredto
demonstrate special benefit as it would if the work were done under Minn. Stat., Chapter 429.

1.01. The City is authorized by Minnesota Statutes, Sections 444.16 – 444.21 (the “Act”) to
establish a storm sewer improvement tax district in connection with the Beebe Meadows
subdivision (the “District”) to acquire, construct, reconstruct, extend, maintain and otherwise
improve storm sewer systems and related facilities within the District and to acquire, construct,
maintain and improve stormwater holding areas and ponds outside of the District which are for the
benefit of the District in accordance with the Act and to levy a tax on all taxable property within the
District to finance such activities.
1.02. It is found and determined that it is in the best interests of Maplewood and its storm
water management program that the District be established. The District shall be comprised of the
land legally described in Exhibit A, attached hereto.
Section II. Establishment: Authorizations.
2.01. The Beebe Meadows Storm Sewer Improvement Tax District is hereby established.
The City shall have all powers and authority conferred by the Act in the operation and financing of
the activities of the District.
2.02. The boundaries of the District include all property described in Exhibit A, attached
hereto and are depicted in the map on Exhibit B, attached hereto.
2.03. The city clerk is authorized and directed to file a certified copy of this ordinance with
the Auditor, Recorder, and Registrar of Titles of Ramsey County.
Section III. This ordinance shall become effective upon its adoption and publication and the
recording of the plat of Beebe Meadows, Ramsey County, Minnesota.

DISTRICTORDINANCEBY TITLE AND SUMMARY
WHEREAS, the city council of the city of Maplewood has adopted an ordinance
establishing the Beebe Meadows storm sewer improvement tax district pursuant to Minnesota
Statutes, sections 444.16-444.21; and
WHEREAS, MinnesotaStatutes, section412.191, subd. 4, allows publication by title and
summary in the case of lengthy ordinances or those containing charts or maps; and
WHEREAS, the ordinanceis 2pages in length; and
WHEREAS, the city council believes that the following summary would clearly inform the
public of the intent and effect of the ordinance.
NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Maplewood that
the city clerk shall cause the following summary to be published in the official newspaper in lieu of
the entire ordinances:
Public Notice
The Maplewood city council has adopted an ordinancewhich establishes the Beebe
Meadows storm sewer improvement tax district. Beebe Meadows is a new seven-lot residential
subdivision which will treat stormwater onsite. Maintenance of the stormwater facilitieswill be the
responsibility of the subdivision homeowners. If the homeowners fail to maintain the storm water
facilities, the storm sewer improvement tax district allows the city to perform the maintenance and
levy a tax against theseven lots to recover the costof that work.No cost would be borne by the
other taxpayers in the city. A full copyof the Beebe Meadows Storm Sewer Improvement Tax
District Ordinance is available in the office of the city clerk.

construct three rain gardens at City Hall –one in a parking lot island and two near the main

40T This project will treat storm water runoff at City Hall campus and enhance aesthetics. A grant will
cover the cost of this project so there will be no cost to the City.
Background
40T Storm water runoff from City Hall campus eventually makes it way to Wakefield Lake, which is an
impaired body of water. City staff met with staff from RWMWD to look at projects that could be done
at City Hall campus to improve storm water management. RWMWD identified two areas for rain

gardens that best fit their goals and cost-share program – the front entrance of City Hall and the
main parking lot.RWMWD’s consultant prepared designsfor three rain gardens (Attachment 1).If
the project is approved, construction will occur this year.
40T Parking lot raingarden.With the existing configuration of the parking lot, the best place for a
parking lot raingarden is in the vegetated island north of the City Hall entry walkway. Threepine
trees will be removed to create this garden. The garden will take runoff from the parking lotand
should remove the existing problemofstanding water and ice forming in this part of the parking lot.
40T Tworain gardens along the entry walkway. These gardens will be anextension of the existing
landscaped beds and much of the existing planting will remain intact. The gardens will take roof
runoff from City Hall.
40T Maplewood has received a grant from RWMWD that will cover 100% of the cost of the gardens.

40T Staff recommends that City Council awards the project to Outdoor Lab Landscape Design, Inc. at a

financial costs to the City.
40T In addition to the rain garden grant, the City has received a 50% cost-share grant from RWMWD for
a public art piece to be placed in one of therain gardens. Artist Lisa Elias has prepared a design
(Attachment 3) for a metal sculpture that wouldbe located on theeastside of the entry walkway.
The cost for the sculpture is $9300; RWMWD will cover 50% of that and the City will cover the
remainderthrough the Environmental Utility Fund. The art piece is less than $10,000 so does not
require Council approval, but it ispart of the rain garden project.

The Feasibility Study is an essential element ofthe proposed Ferndale/Ivy Area Street
Improvements project. The studyis the first step towards making infrastructure improvements in the
project area.
Background
The Ferndale-Ivy area streets are generally bounded by Union Pacific Railroad (UPR) tracks to the
north, McKnight Road to the west, Maryland Avenue to the south, Century Avenue to the east (see

attached project location map). This project is a part of the approved 2018 – 2022Capital
improvement Plan (CIP).
The proposed project includes approximately 1.2 miles of streets which have an average pavement
condition index (PCI) rating of 34 (on a scale of 1 to 100) according to the most recent street rating
survey. The pavement on these streets has continued to deteriorate over the years and is in need
of replacement. These streets have concrete curb and gutter which for most areas will remain.
However, there are known areas with poor drainage and settlement issues where thecurb and
gutter will need to be replaced. The proposed project will also include sidewalks, trails, pedestrian
improvements, expansion of storm water facilities,andstorm water quality features.
On October 9, 2017, the City Council approveda regional drainage/hydraulic studyin response to
the July 11, 2011 floodthat affected this area. The identified flood remediation work from this study
will then be incorporated into the feasibility study and the street improvement projectfor a
comprehensive approach to improvements needed in this specific area.
As a part of this project it is anticipated the cast iron water mains will need to be replaced due to
past break history and susceptibility to future breaks. Repairs to the sanitary sewer system are also
anticipated. The proposed project will also include a fog seal preventative maintenance treatment to
a past neighborhood improvement area and sanitary sewer main reliningboth on and off the project
site. The location for both of these items will be determined during the feasibility study.Staff will
commence with soil borings, preliminary surveying, appraisal analysis, neighborhood meetings, and
all other tasks associated with preparing the feasibility study.

survey. These streets have continued to deteriorate over the years and are in need of rehabilitation.
There is existing concrete curb and gutter, water main, sanitary sewer and storm sewer throughout
the majority of the project area. Similar to the past pavement rehabilitation projects, this project will
focus on the replacement of the deteriorated pavement section with replacement of concrete curb
and gutter only as necessary to properly support the new pavement.Staff will commence with soil
borings, preliminary surveying, appraisal analysis, neighborhood meetings, and all other tasks
associated with preparing the feasibility study.
