PAUL CITY ORDI- NANCE NO. 13061, AN ORDINANCE AMENDING ST. PAUL CITY ORDI- NANCE NO. 11061. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DOES HEREBY OR- DAIN AS FOLLOWS: Section 1. That Ordinance No. 13061 of the City of Saint Paul, amending St. Paul Ordinance No. 11061, is hereby ap- proved and the terms and provisions thereof are hereby accepted by the Council of the Village of Maplewood for and on behalf of the said Village of Maplewood. Section 2. That a copy of this ordi- nance, after publication, shall be for- warded to the Clerk of the City of Saint Paul. Section 3. This ordinance shall take effect and be in force upon its passage and publication. Passed by the Council of the Village of Maplewood this 21 day of October, 1965. Byron H. LllllE?------------------- being duly sworn, on oath says; that he is, and during all the times herein stated has been_____________________________________________ a` publisher of the newspaper known as Maplewood Review, and has full knowledge of the facts hereinafter stated; that for more than one year prior to the publica- tion therein of the ----- — ordinance -------------------------------------------------------------------------- ----------------------------------------------------------------------------------hereinafter described, said newspaper was printed and published in the Village of North St. Paul, in the County of Ramsey, State of Minnesota, on Tuesday each week; that during all said time said newspaper has been print- ed in the English language from its known office of publication within the Village from which it pur- ports to be issued as above stated and in newspaper format and in column and sheet form equivalent in space to at least 450 running inches of single column, two inches wide; has been issued once each week from a known office established in said place of publication and employing skilled workmen and equipped with the necessary material for preparing and printing the same, and the presswork on that part of the newspaper devoted to local news of interest to the community which it purports to serve has been done in its known office of publication; that during all said time in its makeup not less than twenty- five per cent of its news columns have been devoted to local news of interest to the community it pur- ports to serve; that during all said time it has not wholly duplicated any other publication, and has not been entirely made up of patents, plate matter and advertisements; has been circulated in and near its said place of publication to the extent of at least two hundred and forty (240) copies regularly delivered to paying subscribers and has entry as second class matter in its local post office; and that a copy of each issue has been filed with the State Historical Society, St. Paul; and that there has been on file in the office of the County Auditor of Ramsey County, Minnesota, the affidavit of a person having knowledge of the facts, showing the name and location of said newspaper and the existence of the conditions constituting its qualifications as a legal newspaper. PAUL DEPARTMENT OF RECORDS—CITY CLERK PUBLICATION NOTICE Date Oct. 11, , 19-L5L The attention of the Village Clerk, Village of Mnlearood is respectfully called to the following resolution, or ordinance which has been adopted by the City Council and approved by the Mayor. FORM G Council File No. 225171—Ordinance No. 13061—By Milton Rosen— An ordinance amending Ordinance No. 11061, entitled: "An ordinance granting permission and authority to the Village of Maple- wood to connect the public sewer sys- tem of said Village of Maplewood to the public sewer system of the City of Saint Paul and thereafter maintain and operate the same as an outlet for said public sewer system of said Village for public sewage conveyance and disposal purposes, and providing applicable terms and conditions", approved July 26, 1957, as amended. This is an emergency ordinance rend- ered necessary for the preservation of the public peace, health, and safety. The Council of the City of Saint Paul Does Ordain: SECTION 1 That Ordinance No. 11061, approved July 26, 1957, as amended, be and the same hereby is further amended in the following particulars, to -wit: That the first paragraph of Section 3 of said ordinance shall be and hereby is amended so that the same shall read as follows: "That said Village of Maplewood shall not permit any connections to be made to its said public sewer system in respect to any property lying beyond the limits of said Vil- lage, and that no connection other than that hereinabove expressly per- mitted and authorized shall be made between said Village public sewer system and said City public sewer system without further express au- thorization therefor by the, Council of the City of Saint Paul, except that said Village of Maplewood may per- mit the temporary installation, main- tenance, and operation of a sewer service connection between its said public sewer system and the follow- ing described real property lying be- yond its corporate limits and situate in the City of Saint Paul, County of Ramsey, State of Minnesota, to -wit: Subject to Larpenteur Avenue, the North 187 feet of the West 74.3 feet of the East 584.3 feet of E. iz of the Northeast 1,y of the Northwest is of Section 23, Town- ship 29, Range 22, except the East 410 feet thereof, Ramsey County, Minnesota, according to the United States Government Survey there- of; identified as 1970 E. Larpenteur Avenue, upon the express condition applic- able to such temporary sewer con- nection, that the same shall be discon- tinued and removed upgn the con= struction by or for the City of Saint Paul of a public sanitary sewer abut- ting the subject parcel of real estate, and that thereupon the then owner of the subject parcel of real estate shall cause the same to be connected by proper sanitary sewer connection with such public sanitary sewer here- after constructed by or for the City of Saint Paul, abutting the same." SECTION 2 That this amendatory ordinance shall be deemed dependent for its operative effect upon the acceptance of the same and the concurrence therein by said Village of Maplewood, evidenced by an ordinance passed by its ilia e Council or governing body, and the f a certified copy of the same with the City Clerk not later than 60 days next after the official publication of this amendatory ordinance. SECTION 3 This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety.
