Resolution 18-06-1584 Resolution to Maintain the Statutory Tort Limits for Liability Insurance Proposed June 25, 20183 City Council Meeting Minutes Packet Page Number 4 of 169 E2 WHEREAS,the League of Minnesota Cities Insurance Trust annually requests member cities to make an election to waive or not waive the tort liability limit established by Minnesota Statutes 466.04; and WHEREAS,the City has three choices: to not waive the statutory limit, to waive the limit but to keep insurance coverage at the statutory limit, and to waive the limit and to add insurance to a new level; NOW, THEREFORE, BE IT RESOLVED,that the City Council of the City of Maplewood hereby elects to not waive the statutory tort liability limit established by Minnesota Statutes 466.04. Resolution18-06-1579 Urban Agriculture Ordinance SummaryAuthorizing Publication of Ordinance Nos. 978 through 985 by Title and Summary WHEREAS, the City of Maplewood (the “City”) is a municipal corporation organized and existing under the laws of Minnesota; and WHEREAS, the City Council of the City of Maplewood has adopted Ordinance Nos. 978 through 985, ordinances which create or amend city code to allow for urban agriculture uses; and WHEREAS,MinnesotaStatutes, § 412.191, subd. 4, allows publication by title and summary in the case of lengthy ordinances or those containing charts or maps; and WHEREAS, the ordinances are 21 pages in length; and WHEREAS, the City Council believes that the following summary would clearly inform the public of the intent and effect of the ordinances. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Maplewood that the City Clerk shall cause the following summary of Ordinance Nos. 978 through 985 to be published in the official newspaper in lieu of the entire ordinance: Public Notice The City Council of the City of Maplewood has adopted Ordinance Nos. 978 through 985, ordinances which create or amend city code to allow for urban agriculture uses. A summary of the ordinances follows: Ordinance No. 978 June 25, 20184 City Council Meeting Minutes Packet Page Number 5 of 169 E2 An Ordinance Allowing the Keeping of Bees 1.Allow beekeeping in any zoning district as a permitted use. 2.Hive placement requirements as follows: a.Located at least five feet from any property line with the front of the hive facing in toward the property. b.Located at least ten feet from a public sidewalk with the front of the hive facing in toward the property. c. Located at least 25 feet from a principal building on an adjoining lot. Ordinance No. 979 An Ordinance Allowing the Keeping of Poultry in All Zoning Districts 1.Allowing other types of poultry in addition to chickens (i.e., quail and pheasants) 2.Changing the neighborhood consent requirements from 100 percent to 60 percent consent for approval of a poultry permit. 3.Allowing the keeping of poultry on property that is not zoned single family residential with a permit. Ordinance No. 980 An Ordinance Allowing the Temporary Keeping of Goats and Sheep 1.Allow the temporary keeping of goats and sheep (up to 60 days) for vegetative management with a permit. 2.Require 60 percent neighborhood consent for the temporary keeping of goats and sheep. 3.Allow up to 75 goats or sheep, depending on size of lot. Ordinance No. 981 An Ordinance Allowing Aquaponics and Aquaculture in the Light and Heavy Manufacturing Zoning Districts 1.Amend the M-1 and M-2 Zoning Districts to allow for these uses. Ordinance 982 An Ordinance Allowing Community and Market Gardens 1.Allow community gardens one acre or under as a permitted use in any zoning district with standards such as setbacks, time limits for sale of produce, etc. 2.Allow community gardens over one acre in any zoning district with a conditional use permit. Ordinance 983 An Ordinance Allowing Front Yard Gardening and Permaculture 1.Adding text that make it clear that front yard gardening is a permitted use in all residential zoning districts. Ordinance 984 An Ordinance Allowing Urban Farms June 25, 20185 City Council Meeting Minutes Packet Page Number 6 of 169 E2 1.Allow urban farms on park land if it meets the City’s Park Master Plan. 2. Allow urban farms on all other zoning districts with a conditional use permit. Ordinance 985 An Ordinance Allowing Direct to Consumer Sales in all Commercial Zoning Districts 1.Define direct to consumer sales as the exterior sale of agricultural products or prepared foods directly from farmers or venders to consumers. 2.Allow direct to consumer sales in all commercial zoning districts for up to four months with permit. BE IT FURTHER RESOLVED by the City Council of the City of Maplewood that the City Clerk keep a copy of the ordinance in her office at city hall for public inspection and that she post a full copy of the ordinance in a public place within the city. th The resolution was adopted by the City Council of the City of Maplewood this 25 day of June, 2018, by a vote of five Ayes and zero Nays. Resolution18-06-1580 City Approval to Conduct Off-Site Gambling Within City Limits White Bear Avenue Business Association WHEREAS, White Bear Avenue Business Association has submitted an Application to Conduct Off-Site Gambling at the Ramsey County Fair Grounds, 2020 White Bear Avenue in Maplewood, MN 55109; and WHEREAS, the off-site gambling will take place during the Ramsey County Fair on Tuesday, July 11, 2018 through Saturday, July 15, 2018. Seconded by Councilmember JuenemannAyes – All The motion passed. 6.Amended 2018 Pay Rates Resolution for Temporary/Seasonal and Casual Part-Time Employees Councilmember Abrams moved to approve an amendment to the 2018 Pay Rates Resolution for Temporary/Seasonal and Casual Part-Time Employees. Resolution 18-06-1581 2018Pay RatesResolution Temporary/Seasonal&CasualP/TEmployees WHEREAS, according to the Minnesota Public Employees Labor Relations act, part-time employees who do not work more than 14 hour per week and temporary/seasonal employees who work in positions that do not exceed 67 days in a calendar year, or 100 days for full-time students, are not public employees and are therefore not eligible for membership in a public employee union. Recitals. 1.01.By Resolution No. 18-05-1563 adopted on May 14, 2018 (the “Award Resolution”), the City Council awarded the sale of the City’s General Obligation Bonds, Series 2018A (the “Bonds”), issued in the original aggregate principal amount of $6,940,000. The City issued the Bonds on June 14, 2018. 1.02.Section 2.02 and the form of Bonds attached as Exhibit B of the Award Resolution provide that interest on the Bonds is payable to the registered owners of record thereof as of the close of business on the first day of the month of such interest payment date. 1.03.Subsequent to the issuance of the Bonds, U.S. Bank National Association, Saint Paul, Minnesota, the initial Registrar appointed by the City under the Award Resolution (the “Registrar”), requested a change to the provisions in Award Resolution providing for the method of determining the registered owners of record of the Bonds to whom interest will be payable. The Registrar requests that Section 2.02 and the form of Bonds attached as Exhibit B of the Award Resolution (and correspondingly, the Bonds), be amended to provide that interest on the Bonds is payable to the registered owners of record thereof as of the close of business on the fifteenth day of the month preceding such interest payment date. 1.04.The proposed amendment to the Award Resolution does not change the interest or principal payment dates of the Bonds, or any other aspect of the Bonds including the principal amounts, interest rates or redemption provisions, but merely changes the method of determining the registered owner of the Bonds for purposes of making payments on the Bonds. Section 2. Award Resolution Amended. 2.01.Section 2.02 of the Award Resolution hereby is amended to read as follows (strikethrough denotes deleted text; underline denotes inserted text): 2.02. The Parks System Master Plan states taking care of the existing parks system was found to be highest community priority. This means reinvesting in and upgrading parks and facilities. Packet Page Number 34 of 169 G3 Background Maplewood currently has two Certified Playground Inspectors on staff. In the spring of 2017, all of was developed to address the concerns that were found. For 2018, staff proposed the Maplecrest Park Playground replacement. The selection of Maplecrest Park was made through the inspections process and based on safety and maintenance concerns. This playground has spent several years on the replace or fix list based on safety and the fact that it is not conducive to maintenance and repair. Staff believes that the selection of Maplecrest Park aligns with the goal of funding to be geographically distributed throughout the City. A community process will be followed for the selection of the Maplecrest Park Playground replacement. Residents will be invited to a neighborhood meeting to decide which of the proposals they like best and the proposal that receives the most votes will be installed at the park. Background Neighborhood Meeting The applicant held a neighborhood meeting on June 5, 2018 in the Community Room at Cardinal Pointe and all property owners with 500 feet were invited. The applicant stated approximately 60 people attendedthis meeting and the general takeaway was positive. A copy of the invitation the developer sent out is attached to this report. Planned Unit Development This site was part of the former Country View Golf Course which ceased operations in 2004. In 2007, a planned unit development (PUD) was approved to divide the golf course into four separate development areas – this project was called Mogren Retail Addition. Two of the parcels have been developed – Costco and Carmax. The project outlined within this report is the first project proposed for either of the two remaining development parcels. The original PUD approved for the Mogren Retail Additionstated that itdid not approve any future projects and that each project would have to be reviewed on its own. Packet Page Number 67 of 169 J2 The original vision for this site had been a retail or commercial use. In fact, when County Road D East and Country View Drive were constructed in their current form they were designed to handle commercial volumes. Commercial and retail uses typically generate a much higher traffic count than an apartment building would. However, a PUD was used to approve this redevelopment area as to be flexible with potential uses and other zoning requirements. The city’s zoning ordinance allows the city council to grantflexibility from strict ordinance compliance in the internal and external design requirements of a proposed PUD and may consider deviations from those requirements. Deviations may be granted for planned unit developments provided that: 1.The proposed development and the surrounding neighborhood can be better served by relaxing the code requirements that regulate the physical development or layout of the project because of its unique nature. 2.The PUD would be consistent with the spirit, intent and purposes of this chapter. 3.The planned unit development would produce a development of equal or superior quality to that which would result from strictadherence tothis chapter. 4.The deviations would not constitute a significant threat to the property values, safety, health or general welfare of the owners or occupants of nearbyland or to the environment. 5.The deviations are required for the reasonable and practical physical development of the project Comprehensive Plan In development of the Draft 2040 Comprehensive Plan, the property owner requested this site be guided for High Density Residential. The city council approved the Draft 2040 Comprehensive Plan on April 9, 2018 which included this site being guided for housing. The existing 2030 Comprehensive Plan guides this site as commercial which does allow for multi-familyhousing. In both the 2030 and 2040 plans, High Density Residential allows up to 25 units per acre. Section 44-300(1) of the city’s zoning ordinance provides density creditsfor underground parking. The net acreage for calculating density is allowed to be increased by300 square feet for each parking space that is provided under the principal use structure. With153 underground spaces being provided, 45,900 square feet can be added to the site’s netacreage.Adding the density bonus of 1.1 acres (45,900 square feet) to the site’s 5.6 acres of land equates to 6.7 acres being used to determine the maximum density for this site. In using both the city’s comprehensive plan and zoning code, the maximum amount of units allowed on this site would be 167. The applicant is requesting approval for a building containing 152 units. Building Height City ordinance requires the city council approve residential buildings that exceed a height of 35 feet or three stories. The applicant is proposing a four-story building with a typical height of 46 feet, 4 inches. The building’s bump out areas will be 49 feet, 8 inches and the main entry will have a height of 54 feet, 7 inches. As a comparison, the multi-familybuildings approved as part of the Frost- English Village redevelopment project are 51 feet in height. The city’s fire department has reviewed the proposed project and has stated it has no issues with the proposed height. In addition, there is a Packet Page Number 68 of 169 J2 significant grade change between this project and the existing Cardinal Pointe building which is located east of the Bruce Vento Trail. Cardinal Pointe is positioned several feet higher than this proposed building. Exhibit submitted by applicant showing building heights and grading in project area. Parking Section 44-1093(b)states “the city council may consider flexibility from strict code compliance in the internal and external design requirements of a proposed PUD and may consider deviations from those requirements.”The city’s zoning ordinance states multi-familybuildings must provide two parking spaces for each unit – with one of the parking spaces being covered. This project would provide 152 units of housing, thus requiring 304 parking spaces with 152 being covered. The applicant is proposing 153 underground parking spaces and 144 surface spaces for a total of 297 spaces. The covered spaces ordinance requirement is being met but the overall count is seven spaces short of city standards. The parking ratio (spaces to units) for this project is 1.9. The applicant provided data from its other projects showing ratios ranging from 1.66 to 1.98. Staff reviewedparking requirements from other metro cities and recent projects and have determinedthe proposed parking count for this project isacceptable. Cities vary vastly in how parking requirements are determined. For example in Roseville, parking is determined by requiring one space for each bedroom plus 0.25 spaces for each unit for visitor parking. This proposed project would have 210 bedrooms thus requiring 210 spaces under Roseville’s rules plus an additional38 spaces for visitor parking (.25 x 152 units) – for a total of 248 parking spaces. Staff is not stating Roseville’s rules are preferred just using it to illustrate parking rules can vary greatly from city to city. Under the PUD the city can always require the applicant to add additional spaces if parking becomes an issue. Attached to this report is a spreadsheet detailing the cities and projects staff reviewed while analyzing parking for this project. Floor Area City ordinance requires a minimum of 580 square feet for both efficiencies and one-bedroom units. The applicant is proposing 78 one-bedroom units ranging from 775-1,297 square feet in size – well exceeding the city’s minimum requirement. The applicant is proposing 16 “studio” or efficiency units each being 570 square feet in site – 10 square feet short of the city’s minimum. The size of the efficiencies exceedsminimum size requirements as defined by the state’s building and fire codes and staff does not have any issues providing zoning flexibility in this area. All of the project’s 2- bedroom units are well above the city’s minimum requirements. Packet Page Number 69 of 169 J2 Public Vacation and Lot Combination The applicant is seeking city approval to combine the two lots that comprise the site into a single parcel. Staff has no issues with the proposed lot combination. Asa result of thelot combination, an existing easement vacation is being requested. This existing utility easement runs along the shared property linebut is fully contained within the south parcel. With the combination of the two lots, this easement is no longer necessary. Because the applicant owns both pieces of property being affected there was not a requirement to submit a petition and the council is permitted to approve this request with a simple majority vote. A requirement ofthe lot combination request is that the proposednew singlelot shall include 10-foot public drainage and utility easements along all property lines of the combined lot. Design Review Site Plan The site has been designed with two access points – one accessing Country View Drive and the other accessing County Road DEast. The building is nestled toward the southeast portion of the site. All building and parking lot setbacks are being met. Much of the vegetation near the Bruce Vento Trail is being preserved. A “dog run” area is being proposed north of the building. A chain link fence is being proposed to contain this area for dogs. Staff recommends additional landscaping elements be added along the west and north sides of the chain link fence to enhance the view from County Road D East. Building Elevations Exhibit submitted by applicant showing proposed site plan in project area. The building will be clad with siding in two different colors with a brick base. Dark panels will be located on the ends of the building. Columns are placed through each of the building’s elevations providing articulation and breaking up the building into sections. The building is attractively designed and will be unifiedin designwith the other projects in the Mogren Retail Addition PUD. Costco is located directly to the south of this project. Costco’s loading docks are located on the north side of its building – nearby this project. The developer shall consider using sound dampening building materials and windows for the south elevation to ensure future residents are protected from existing sound generation on the Costco site. Packet Page Number 70 of 169 J2 Landscaping The applicant’s landscaping plan proposes to add 40 trees to the site and numerous shrubs and perennials. Most of the existing vegetation near the east side of the site will remain in place. New plantings are primarily focused near the front entrance of the buildingand along the south and west property lines. The applicant shall be required to add landscaping elements along the west and north sides of the proposed dog run fence and have the proposed tree species plantings approved by the city’s naturalist. Lighting The applicant’s submitted photometric plan meets all city requirements. Commission Review Planning Commission June 19, 2018: The Planning Commission helda public hearing and reviewedthis project.No one spoke during the public hearing. The Planning Commission recommended approval of the project – including the parking waiver request. My name is John A.Olson and Iive in Unit333 Hazelwood Street, Cardinal Pointe rd Cooperative. My wife and I live on the 3floor, our windows, sliding door and patio all face the south west. When the trees have no leaves we see the Bruce Vento Trail and Costco very well. Our concern is this new apartment being 4 floors. Will we be looking at their roof or into their 4th floor windows. We also wonder how close to the trail will their building be and will there be a lot of trees on the west side of the trail cut down. Do the builders need a variance even to have a 4 story building in Maplewood? From the trail, it looks like the lay of the land is much lower than ours so this may not be a problem. My other concern is the 3 way stop sign at County Road D and Hazelwood. Several of us at Cardinal Pointe have observed cars on County Road D not stopping for these signs. Will the City consider signal lights at this intersection? Please do so as it appears to be a very dangerous intersection. Again, thank you for your time and patients with us. The applicant is also seeking the vacation of an existing public utility easement between the two properties and design review. Theamount of disturbance on this site is greater than ½acre. As such,the applicantis required to meet the City’s stormwater quality, rate control, and other stormwater management requirements.The applicant is proposing to meet these requirements via the use of a filtration basin and a water reuse system.From the information submitted, it appears that the proposed design meets the Cityand Watershed Districtstormwater management requirements. Thisreview does not constitute a final review of the plans, as the applicant will need to submit construction documentsand calculationsfor final review.Thefollowing are engineeringreview comments on the design and act as conditions prior to issuing permits. Drainage and Stormwater Management 1)The project shall be submitted to the Ramsey-Washington Metro Watershed District (RWMWD) for review. All conditions of RWMWD shall be met. 2)A joint storm water maintenance agreement shall be prepared and signed by the owner for the proposed filtration basin, pretreatment devices,and water reuse system.The Owner shall submit a signedcopy of the joint storm-water maintenance agreementwith theRWMWDto theCity. 3)One of the methods being proposed to meet volume reduction requirements is water reuse. As the City’s stormwatermanagement standards don’t currently address water reuse, the City will defer to the RWMWD methodology for calculating volume reduction credits generated through water reuse. 4)The water reuse system being proposed for this site shall meet all state and local regulations as it pertains to water reuse. Packet Page Number 96 of 169 J, Attachment 14 5)The water reuse system is proposed to be constructed from corrugated metal pipe. The soil borings indicate that groundwater is present onsite above the bottom of the water reuse system. As the system will be in contact with groundwater on the exterior, along with a permanent pool of water on the interior, corrosion and degradation of the pipe is of concern. The applicant should investigate the potential for pipe degradation and consider alternative materials for this system. 6)Filtration Basin Planting: It is difficult to establish filtration or infiltration basins by seed since the seed is washed away when stormwater flows into the basin. The city requires that at least 5000 square feet of the basin is plantedrather than seeded to ensure successful establishment of the bottom and slopes. In addition, if native seeding is a component of the project, the city requires there be a management agreement for three years to ensure establishment. This type of agreement is not required when plants are used instead of seed. Requirements: 1.A minimum of 5000 sq ft of the basin shall be planted, not seeded. 2.Provide a landscape drawing for the infiltration basin, including list of species, container size, spacing, and quantities. It is typically easier to establish shrubs in the basin bottom but perennials, shrubs, or a combination of the two may be used. 3.If proposing seeding as well as planting the bottom of the basins, provide explanation of measures that will be taken to ensure seed does not wash away. 4.For any area using a native seed mix (ex: pond slopes), provide information on maintenance for planting year, Year 2 and Year 3, addressing what maintenance activities will be required and what entity (developer, owner,etc.) will take on this responsibility. Preliminary Plat Beebe Meadows preliminary plat will have seven 10,000 square foot in area and 62.5 foot wide single family lots with a density of 4.4 units per net acre. Infiltration basins are proposed to be constructed in the back yards of Lots 2, 3, 4, and 6. The applicant must ensure that the lots meet the minimum net buildable lot area of 7,500 square feet excluding the storm waterponds(infiltration basins). Adjustments to the locations of the infiltration basins may be necessary to achieve this requirement. Wetlands There is a Manage A and a Manage B wetland located on the east side of the property. City code requires a 75-foot minimum and 100-foot average wetland buffer around a Manage A wetland and a 50-foot minimum and a 75-foot average wetland buffer around a Manage B wetland. Details on the wetland ordinance requires are outlined in the June 12, 2018, Environmental Review attached. Additionally, the applicants must submit a revised plat that shows that the wetland buffers which are located within Lots 3, 4, 5, and 7 are protected with a wetland buffer easement. The easement will specify that no building, mowing, or grading is allowed. Outlot The wetland and wetland buffers will be located within an Outlot on the preliminary plat. The City’s subdivision ordinance specifies that no building is allowed on an Outlot which will allow protection of the wetlands and buffers. A homeowner’s association will have to be established to ensure that the Outlot is owned and managed by the seven single family homeowners in the Beebe Meadows plat. The association will also be responsible for the maintenance of the infiltration basins as outlined in the Engineering Review attached. Landscaping and Screening The landscape plan shows the addition of 17 trees, turf seed, and BWSR approved seed mix in the infiltration basins. While the R-1S district does not have landscaping standards, the city may require screening between differing types of land use, such as between single dwellings and multiple dwellings. Lot 1 is located adjacent the Southwind Townhomes to the north. The house on Lot 1 will be constructed 8 feet higher than 2124 and 2126 Southwind Road. To ensure adequate screening between the differing types of land uses, the applicant must submit a revised landscape plan that shows a fence or landscaped screening on the north side of the house on Lot 1. Additionally, the revised landscape plan must comply with the recommendations outlined in the June 12, 2018, Environmental Review which requires additional trees and infiltration basin planting details. Citizen Comments 1.Dan Brinkman, 2117 Southwind Drive (e-mail response): My name is Dan Brinkman. I'm president of the Southwinds of Maplewood Townhome Association. The purpose of this communication is to determine some details of the proposed housing development on the property at 2135 Larpenteur Avenue. This acreage abuts our association property to the south. The decision to rezone the property to a low density level seems to make sense, given the size and makeup of the property, taking into account the wetland area. Our assumption is that there would be no construction of the east side of the development property line, what with elevation challenges and the wetland area to deal with. Is this correct? The home construction close to our association's southern propertyline is of greater concern. We would assume that any development of the northern lot of the plat would include buffer plantings along the property line to maintain viewing privacy for our association townhomes on Southwind Road. Would this be a correct assumption? It would also be our hope that, should these lots sell, and homes end up being constructed, that as many trees and plantings as possible that exist now could be left in place upon completion of this project. 2.Sharon and Bob Boyden, 1724 Southwind Lane (e-mail response): We received the proposal for rezoning for this property. We have many concerns. The building of 7 single family homes would greatly impact the following: a.Animals, currently we see deer, ducks, geese, owls, eagles, turkeys and even coyotes use this land. b.Foliage, many trees would be destroyed to make it possible to build so many homes. c.Pond life, the smaller animals who depend on this pond would be greatly reduced. Please keep us informed of this matter. Also let us know what else we can do to not let this rezoning occur. 3.Diane M. Mencke, 2135 Margaret Street (e-mail response): I am one of the owners of the property at 2135 Larpenteur Avenue East in Maplewood. I actually grew up in the farmhouse on this property and lived there from 1946 until 1969. This property has been in my family for at least four generations. My mother passed away in 2004, and I have owned 1/2 interest in the property since that time. My niece and nephew each own 1/4 interest in the property. This property has been for sale for over two years. We have had a number of offers on the property, but none ofthem were acceptable for various reasons. I am very impressed with this proposal for the use of this land. I feel that this proposal will be consistent with the surrounding area and will be a good fit due to the wetland constraints of this property. In my opinion, this proposal uses the wetlandsto create very desirable lots. Single family homes will definitely fit with the character of the neighborhood. I feel that they will be a very attractive addition to the area and will contribute to the property value of surrounding properties. Beebe Road was recently redone and will not need upgrades for the additional lots accessing the road. I am in favor of this proposal. 4.William Meyer, 2155 Larpenteur Avenue East (via e-mail): This neighborhood has been my home for the past 40 years. My grandfather built this house in 1950 and I just recently acquired it after his passing. We have a beautiful view of the pond and all the wildlife that it brings. We have a family of deer, owls, ducks, geese and the occasional turkey or two that have inhabited the wetland areas for many years and become quite fond of us. We are able to feed the deer daily and they have almost become like pets to us and would hate to lose this part of nature that I see every day in my backyard. If this proposed area is developed, I am afraid that all of the wildlife will disappear with it, as the deer use this area for grazing and a place to bed down. This would ultimately take away one of the last few wooded areas in the neighborhood. I’m not ready to lose that and with thepossible development of the golf course across the street, this would cause a lot more traffic and commotion then is needed. I moved here because of the feeling of being outside of the city while still in the city. It is very quiet and peaceful where I live and if seven homes were built in this location, it would take away from the tranquility of the neighborhood. I am sure there are many other neighbors who feel the same way that I do, we do not want to see our area be overdeveloped by more homes or townhouses. The area in question is too small for seven houses to be crammed in to. The traffic is bad enough already living on Larpenteur, but then adding more houses equals more traffic. 5.Tim and Julie Nyberg, 1732 Southwind Lane (via e-mail): My wife and I reside at 1732 Southwind Lane, Maplewood, and have several concerns about the proposed rezoning and development of lots on Beebe Street: Packet Page Number 112 of 169 J3 As we read it, there will be seven (7) single family detached homes on this small footprint. This proposed development seems very crowded due to the surrounding wet lands/nature areas. Will these REALLY be detached, single family homes? Might three side-by side townhomes be more appropriate on this size parcel? Will they be for purchase or rentals? Rentals, as you know come with a certain set of problems that would not be welcomed by anyone in the adjoining Southwind Townhomes. We feel that more rentals in the area would further decrease our property values. What will be the square footage and price point of the proposed homes? What is the reputation of this builder as it relates to quality builds? Are there any similar developments of the proposed density that the builder can point to as an example of how this proposed development would look? Too many builders now are jumping on parcels like this and creating an insensitive dense-pack eyesore for the sake of a quick buck. Finally, seven more driveways entering Beebe in that short frontage seems ridiculous. Might the developer propose the option of two or three shared driveways to minimize the concrete/pavement and the subsequent loss of green space? Thank you for addressing these questions and suggestions at the public hearing on May 15th. We will not be able to attend, but will look to our neighbors for answers to these concerns. 6.: We received your letter John and Betty Nierengarten, 1771 Southwind Lane (via e-mail) last week regarding the rezoning and comprehensive plan change for a single family home development proposal at 2135 Larpenteur Avenue. Given that this land will eventually be redeveloped one way or another, this appears to be one of the better scenarios as regards to compatibility with our residential neighborhood. As it stands, we have no reason to oppose it, but we would like to express a few concerns. I believe our opinion is similar to that of most other homeowners in the Southwind Townhomes development. The end product displayed in the plan is OK, but many of our neighbors are concerned about traffic, especially big trucks on Beebe Road during the construction period. That may be unavoidable, but there is more concern about potential damage done to Beebe during construction and whose responsibility it is to repair it. As mentioned in the proposal, Beebe was just recently redone to address past deterioration and enhance the ascetics of this roadway. All properties adjoining it had to pay an assessment for this. Building seven single family homes, in addition to noise and potential damage from construction traffic, will probably meanexcavation of the roadway to install water, sewer and electrical utilities. Current homeowners on Beebe have a right to have the road restored to the same condition it is now once the project is complete. Another question is whether the walkway that was added as part of the Beebe improvement will be extended all the way down to Larpenteur, or at least the end of the new development area. At face value, that would seem to be preferred. The subdivision will help the City increase the availability of new small lot single family housing that is currently underrepresented in the housing stock, by providing move-up single-family homes. Preliminary Plat The preliminary plat would allow the development of one vacant parcel that will be subdivided into 7 buildable lots that meet the standards of the Zoning and Subdivision Ordinances. Setbacks Section 44.196 – 44.198 of the City Code requires all buildings in the R-1S District to be setback 30-35 feet from the front lot line, 20% of the total lot depth (32 feet) from the rear lot line and setback 10 feet from the side lot line. The proposed lots will comply with these requirements. Lot Standards Section 44.195 of the Zoning Ordinance establishes a minimum lot area of 7,500 square feet, a minimum width of 60 feet and no minimum lot depth. The proposed lot widths are 62.5 feet wide. The lot sizes are 10,000 square feet. Lot standards for the proposed subdivision comply with the lot standards as defined in Chapter 44 of the Zoning Ordinance. Natural Features The existing 3.82-acre parcel contains two separate wetlands. Section 18.221(d)(5) of the City Code establishes the standards for wetland buffers. The site contains one manage A wetland which requires a minimum wetland buffer of 75 feet and an average buffer width of 100 feet. The site also contains one Manage B wetland which requires a minimum wetland buffer of 50 feet and an average buffer width of 75 feet. The proposed development is consistent with these standards. The proposed development will require the removal of 19 of the 100 trees (19%) on the site. Therefore, one tree, at a minimum of two caliper inches, will be provided for each tree removed. We will be planting five sugar maples, five common hackberries, five redmond lindens and four swamp white oaks to replace the trees being removed. The proposed locations for these trees are shown on Sheet L2.1. Stormwater management The proposed subdivision will provide 2 infiltration basins for Stormwater management. One of the basins is in the rear yard of lots 2 and 3, the other is located in the rear yard of lot 6. The infiltration basins will provide a location for a majority of the Stormwater to be collected and treated. Stormwater calculations are provided. The City’s wetland ordinance requires a 75-foot minimum and 100-foot average wetland buffer adjacent a Manage A wetlandand a 50-foot minimum and a 75-foot average wetland buffer adjacent a Manage B wetland.The wetland ordinance allows flexibility in instances where, because of the unique physical characteristics of a specific parcel of land, the averaging of buffer width for the entire parcel may be necessary to allow for the reasonable use of the land during a development or construction project. In such cases decreasing the minimum buffer width will be compensated for by increased buffer widths elsewhere in the same parcel to achieve the required average buffer width. Averaging is allowed based on an assessment of the following: a.Undue hardship would arise from not allowing the average buffer, or would otherwise not be in the public interest. b.Size of parcel. c. Configuration of existing roads and utilities. d.Percentage of parcel covered by wetland. e.Configuration of wetlands on the parcel. f.Averaging will not cause degradation of the wetland or stream. g.Averaging will ensure the protection or enhancement of portions of the buffer which are found to be the most ecologically beneficial to the wetland or stream. In reviewing the mitigation plan, the city may require one or more of the following actions: 1)Reducing or avoiding the impact by limiting the degree or amount of the action, such as by using appropriate technology. 2) Rectifying the impact by repairing, rehabilitating, or restoring the buffer. 3)Reducing or eliminating the impact over time by prevention and maintenance operations during the life of the actions. 4) Compensating for the impact by replacing, enhancing, or providing substitute buffer land at a two-to-one ratio. 5) Monitoring the impact and taking appropriate corrective measures. 6) Where the city requires restoration or replacement of a buffer, the owner or contractor shall replant the buffer with native vegetation. A restoration plan must be approved by the city before planting. 7) Any additional conditions required by the applicable watershed district and/or the soil and water conservation district shall apply. 8)A wetland or buffer mitigation surety, such as a cash deposit or letter of credit, of 150 percent of estimated cost for mitigation. The surety will be required based on the size of the project as deemed necessary by the administrator. Funds will be held by the city until successful completion of restoration as determined by the city after a final inspection. Wetland or buffer mitigation surety does not include other sureties required pursuant to any other provision of city ordinance or city directive. 2.Wetland Impacts: The development will have grading to within 75 feet of the Manage A and 50 feet to the ManageB wetland at its closest points. The remaining buffers will be increased to ensure the average 75-foot and 100-foot buffers are maintained. The applicant’s rationale for the wetland buffer averaging is as follows: The wetland buffer averaging is being requested due to the fact that there is more wetland and wetland buffer located on the property than land suitable for development. The wetland averaging allows the developer to maximize the wetland buffers in areas that are receiving direct impervious untreated areas (near the roadways,snowpiles,etc.) while providing usable upland areas to construct stormwatertreatment basins that collect rear roof drainage prior to discharge to wetlands where otherwise would be difficult to construct. Wetland bufferaveraging will also allow an increase in the wetland buffer and screening to the adjacent homes to the north and east of the development. The City will retain the surety for up to three years asoutlined in the maintenance agreement to ensure the wetland buffer mitigation is established and maintained. Infiltration Basins: 1.Infiltration Basins Proposed: There are two infiltration basins proposed in the rear yards of Lots 2, 3, 4, and 6. The basins may need to be redesigned to ensure that all seven lots are at least 7,500 square feet in net buildable area, which excludes stormwater drainage easements. 2.City Infiltration Basin Planting Requirements: Large infiltration basins will ideally be planted with deep-rooted native plants. The City requires a portion of the basin to be plantedrather than seeded. Using plants rather than seeds hastens establishment and provides a better chance of successful establishment. Acquiring this piece of property will enable the city to implement its vision for this part of the neighborhood on a more immediate basis than would a property owner seeking interim uses for the site. The sale of the property is contingent upon satisfaction of all contingencies included in Section #6 of the Purchase Agreement. Gladstone Neighborhood Redevelopment As the redevelopment of the former Maplewood Bowl site continues, staff is looking for ways to continue this effort in other areas of the neighborhood. One of the repeated themes staff has heard from developers is the site prep costs in this neighborhood are prohibitive and create difficulties in continuing the revitalization of this important neighborhood. As a response to this barrier, in the existing capital improvement plan (CIP) the city council tagged $4.75 million to be used for the acquisition of property for redevelopment. Specific properties will be identified and the City may act as developer or in agreement with a private developer to acquire and demolish existing buildings and property for development in accordance with the approved Gladstone Master Plan and the City's Comprehensive Plan. There is also a provision in the PA to allow the City to assign this property to another entity. Moose Lodge Relocation Update Discussion Item Only th City Manager Coleman and staffto discuss the PA. At the meeting, the realtor mentioned that the Moose Lodge would like to build a new lodge with a smaller footprint and would prefer to stay in the City. Staff mentioned the 1.98- acre parcel the City owns at the corner of Hazelwood and County Road D as a possible location in which to build a new lodge (survey and location map are attached for the subject property for your review). The property was acquired in June of 2013 as part of the condemnation process for the realignment of County Road D. The property consists of 1.98 acres (vacant property) and is encumbered by numerous easement restrictions. In total 66% of the 1.98 acres is encumbered by electrical powerline easements, pipeline easements, and drainage and utility easements making this a very challenging parcel for development. The parcel would support the construction of a new building up to approximately 12,000 square feet. The parcel appraised for $227,500 in July of 2014. To date, the City hasNOTreceived any offers for this property. The Moose Lodge Board is very lodge at this location with a smaller footprint. The lodge would like to enter into a Letter of Intent Packet Page Number 149 of 169 J4J4 (LOI) with the City to acquire this parcel to work with a builder and determine if this site would be suitable for a new building. The LOI would have a sunset of approximately 90 days out from date of signatures. Before we proceed with the LOI to sell the 1.98-acre parcel for $100,000, staff wants to ensure that we have council support. Monies from the sale of this property, pending council approval, would be deposited back into the EDA Fund which was used to acquire the parcel. Staff supports the sale of the property to the Moose Lodge for two compelling reasons: one, it facilitates the City to acquire the Moose Lodge and continue implementing the assembly of properties in the Gladstone Neighborhood and two, the Moose Lodge would remain in the Cityof Maplewood (thisinformation ndth was included in the City Manager/Council FYI on June 22and 29).
