HomeMy WebLinkAbout2017-09-19 PC Minutes MINUTES OF THE MAPLEWOOD PLANNING COMMISSION 1830 COUNTY ROAD B EAST, MAPLEWOOD, MINNESOTA TUESDAY, SEPTEMBER 19, 2017 7:00 P.M. 1. CALL TO ORDER A meeting of the Commission was held in the City Hall Council Chambers and was called to order at 7:00 p.m. by Chairperson Arbuckle. 2. ROLL CALL Paul Arbuckle, Chairperson Present Frederick Dahm, Commissioner Present Tushar Desai, Commissioner Present John Donofrio, Commissioner Present John Eads, Commissioner Present Allan Ige, Commissioner Present Bill Kempe, Commissioner Absent Staff Present: Michael Martin, Economic Development Coordinator 3. APPROVAL OF AGENDA Staff requested the addition of 10 a. October 17, 2017 PC meeting. Commissioner Desai moved to approve the agenda as amended. Seconded by Commissioner Ige. Ayes – All The motion passed. 4. APPROVAL OF MINUTES Commissioner Dahm had a correction to the minutes on page 3, item #6 the word trainer should be trailer. Commissioner Dahm moved to approve the August 15, 2017, PC minutes as amended. Seconded by Commissioner Donofrio. Ayes – Chairperson Arbuckle, Commissioner’s Dahm, Desai, Eads & Ige Abstention – Commissioner Donofrio The motion passed. 5. PUBLIC HEARING a. 7:00 p.m. or later: Consider Approval of Conditional Use Permit Revision, Academy for Sciences and Agriculture, 1194 County Road C East i. Economic Development Coordinator, Michael Martin gave the report to Consider Approval of Conditional Use Permit Revision, Academy for Sciences and Agriculture, 1194 County Road C East and answered questions of the commission. Becky Meyer, Representative from Academy for Sciences and Agriculture (AFSA), 1194 County Road C East, addressed and answered questions of the commission. iii. Nancy Schmidt, Business Manager from AFSA, addressed and answered questions of the commission. Chairperson Arbuckle opened the public hearing. 1. A member of the church from North St. Paul addressed the commission in favor of the school. Chairperson Arbuckle closed the public hearing. Commissioner Donofrio moved to approve the conditional use permit revision resolution. This conditional use permit allows a public charter school to operate within the building located at 1194 County Road C East. This approval shall be subject to the following conditions (additions are underlined and deletions are crossed out): 1. This permit shall be subject to review after one year from the date of approval, based on the procedures in City Code. 2. The owner/operator acquiring all necessary approvals and licenses from the state of Minnesota to operate the day care facility or school facility. 3. The day care center or school facility be maintained and operated in such a manner as to not create any nuisances for nearby properties. 4. A building permit shall be submitted for review and approval by the Building Official, prior to any construction activities on the subject property. 5. Any change of use to the building shall be submitted to the City Planner and Building Official for approval. Seconded by Commissioner Ige. Ayes - All The motion passed. This item goes to the city council on September 25, 2017. b. 7:00 p.m. or later: Consider Approval of Side-Yard Setback Variance, 425 Laurie Road East i. Economic Development Coordinator, Michael Martin gave the report to Consider Approval of Side-Yard Setback Variance, 425 Laurie Road and answered questions of the commission. ii. Applicant, Lola Sykes, 425 Laurie Road, addressed and answered questions of the commission. Chairperson Arbuckle opened the public hearing. 1. Gary Pundsak, 415 Laurie Road East, Maplewood, spoke against the proposal. 2. Jessica Lund, 426 Lark, Maplewood, spoke for the proposal. 3. Laverne Brilla, 433 Laurie Road East, Maplewood, spoke against the proposal. 4. Mike Savard, 2202 Clark Street N., Maplewood, spoke against the proposal. Chairperson Arbuckle closed the public hearing. September 19, 2017 2 Planning Commission Meeting Minutes Commissioner Desai moved to approve the resolution authorizing a four-foot side yard setback variance for 425 Laurie Road East for a portion of the proposed expansion of the ground floor living area of the house to allow for an accessible bathroom. Approval is based on the following reasons: (the addition to the motion is underlined and in bold): 1. Strict enforcement of the ordinance would reduce the proposed addition by four feet reducing the size of the new living space and eliminating the ability to provide for an accessible bathroom. 2. Approval would meet the spirit and intent of the ordinance with the construction of a new single family house on a vacant lot that is zoned and guided in the city’s comprehensive plan as residential. Approval of the variance shall be subject to the following: 1. The house at 425 Laurie Road East is to be used as single family dwelling only. The new living space shall not be rented or used as a second dwelling. 2. The approved variance space is for the accessible bathroom only. No other side yard setback variances have been approved. 3. Building plans that are submitted for the building permit shall reflect how the new addition will be accessible to the existing home. Seconded by Commissioner Dahm. Ayes - All The motion passed. This item goes to the city council on September 25, 2017. 6. NEW BUSINESS a. 2040 Comprehensive Plan Update Discussion i. Economic Development Coordinator, Michael Martin introduced the discussion to the 2040 Comprehensive Plan Update. ii. Planning Consultant, Britt Palmberg, Hoisington Koegler Group, Inc. gave the presentation for the 2040 Comprehensive Plan to discuss the first draft of the future land use plan map and the draft land use category. The steering committee meeting will be September 21, 2017 at 5 p.m. No action was required. 7. UNFINISHED BUSINESS None. 8. VISITOR PRESENTATIONS Kevin Berglund, Citizens Reporter News, addressed the commission. 9. COMMISSION PRESENTATIONS September 19, 2017 3 Planning Commission Meeting Minutes a. August 28, 2017 city council meeting (Staff represented Commissioner Arbuckle) ● Conditional Use Permit, Food Truck, 2520 White Bear Avenue, was passed by the city council. ● Conditional Use Permit Revision, Home Depot, 2360 White Bear Avenue, was passed by the city council. b. September 25, 2017, city council meeting (Commissioner Donofrio) ● Conditional Use Permit, Academy for Sciences and Agriculture, 1194 County Road C East ● Side-Yard Setback Variance, 425 Laurie Road East 10. STAFF PRESENTATIONS a. The start time for the Planning Commission meeting of October 17, 2017 will be at 6 p.m. for a joint meeting with the CDRB and the PC.
