Business Meeting - December 2 , 1980

Background: In November the Chair was approached by Mr .
Piletich, asking for Commission involvement
on the issue of special residential zoning for the property
west of Keller Lake and East of Arcade Street. A committee of
concerned citizens had been formed, which Messrs Piletich and
Hughes represent. A letter was also directed to the Chair;
attaching copy to be read into record.
Since all "complaints" must be formally acted upon by the
Commission, an invitation was issued to members of the
Committee to meet with us on December 2 , 1980 .
Also, reading into the record "Memo on Amendment to
Zoning Code" dated October 1 , 1980 and "Memo on Rezoning
West of Keller Lake, East of Arcade Street" , dated July 30 ,
1980. Good, comprehensive history.
Presentation : Piletich and Hughes explained their positions.
Some of the comments
. Taxes and expenses to the land are increasing and it may be
impossible to keep the property if some of the acreage
cannot be subdivided and sold off .
. This prohibition infringes on their rights as land owners .
. There is a prejudice shown by those with nothing to lose .
. Nice way to keep "parks" for the neighbors so the City would
be aligning itself with the affluent .
. A mix of incomes would not be likely in the future if the
lots cannot be subdivided.
. The RE zoning could be applied to other areas of the City once
it gets on the books discriminatorily.

Comments from resource guest, staff and commissioners
. The Village of Maplewood grew hodge-podge; then in the late
60s became aware that growth should be within certain parameters;
a Comprehensive Plan was formed. The RE zoning would fit into
that plan. There is only one other area of Maplewood to which
the RE designation could apply.
. It should be understood that there are two distinct items of
contention; an enabling ordinance would have to be passed
creating an Residential Estate classification. After the
passage of such an ordinance, the question of application to
any specific area of the City could be entertained.
. This seems to be a "political"issue and as such should be
dealt with at the City Council level . Every citizen has the
right to be heard by the Council .
There is always recourse to the courts .
If it is not an acknowledged "political" issue , can be
brought to the attention of the Maplewood Housing and
Redevelopment Authority or the Planning Commission .
. The City Manager can be approached by a private citizen as
can all administrative heads (e.g. Director of Public Works) .
Level headed talk can lead to compromises which would be
satisfactory to both sides and all interested parties .
Suggested Mr. Piletich and Mr. Hughes explore such avenues .
(There could be a special variance, for instance) .
. The Maplewood Human Relations Commission is empowered to
act only under the specifics contained in the Minnesota
State Act Against Discrimination.
Motion: Peter Fischer. Second Joe Banks
Complaint be dismissed.
Motion tabled until we find out if Commission would have
jurisdiction. Only concern would be possible application
of RE designation to the detriment of low and moderate income
families wishing to settle in Maplewood. Larsen will call
' Attorney General ' s office to see how our interest should be
directed. Will report at next meeting .
General : Insert request for information about Indochinese
families in Maplewood in Motion. No activity yet
within school district .
