I am a single male who has been employed by the above-named Respondent
since July 19, 1977, as a security officer. My worksite location is 3M
Center Building 236-1W-02, Maplewood, Minnesota.
My girlfriend, Deborah Piedmont and I, are both employed by the Respondent
as security officers. We are presently living together along with Ms.
Piedmont's two children. Deborah and I both work rotating shifts
. consequently we work the same shift about once every five to six months. I
contacted my supervisor, Lt. John Schoen, on November 9, 1988 to discuss
working on the same shift as Deborah. Lt. Schoen told me to let him know
the wedding date and he would "start the ball rolling" two weeks prior.
I told him we need a move as soon as possible and a wedding date was of no
consequence. Deborah and I met with Bernard Baumann, Mr. Schoen's
supervisor, who told us he would accommodate us after he heard "wedding
bells." We told Mr. Baumann that we needed a switch by December 12, with a
wedding date being of no consequence. We have had numerous meetings and
gone up the chain of command yet to date nothing has been accomplished. In
December, 1988, I asked Marty Hanson, Human Resource Manager, if I could
take ten days without pay. My request was later rescinded and I was told
that there was no such policy.
I believe my marital status and reprisal were factors in the Respondent's
actions. The Respondent has failed to do anything about my transfer
request thereby denying me full and equal benefits of employment because of
my marital status. I am aware of other employees who have requested time
off without pay and have been granted their requests.
I, therefore, allege that the Respondent has discriminated against me in
the area of employment on the bases of marital status and reprisal in
violation of Minnesota Statutes 363.03, subd. 1(2)(c) .
