The land herein referred to is
situated in the County of Ramsey,
State of Minnesota and is described

the Northwest 1/4 of Section 24,
Township 28, Range 22, described as
follows: Commencing on the South
line of said Quarter -Quarter section,
654 feet East of the Southwest
corner thereof; thence North at right
angles 396.3 feet; thence West and

The purpose of this action is to
obtain an order from the Court for the
following relief:
1. Declaring that a photocopy of the
Bank of America Mortgage, a copy of
which is attached to the Complaint
in this action as Exhibit A, may be
recorded with the Ramsey County
Recorder against the Property so
that the Bank of America Mortgage
can be recorded against the Property
as intended, and declaring that such
recorded copy shall be a valid and
enforceable mortgage against the
Property according to the terms of
the Bank of America Mortgage.
2. In the event that there is a
determination that the Bank of
America Mortgage cannot be
recorded, an order that can be
recorded against the Property
declaring that Bank of America
has an equitable lien against the
Property with the same terms and
for the same amount as the Bank of
America Mortgage.
3. Declaring that pursuant to Minn.
Stat. § 507.02 the PIP Mortgage,
document number A04547508, is
void for failure to be signed by Mary
Larson.
4. Determining whether Defendants
Alexander Larson and Property
Investment Partners were good faith
purchasers for value without notice
of the Bank of America Mortgage
and whether their interests in the
Property are subject to the Bank of
America Mortgage.
5. Determining the relative priority of
the interests of Bank of America and
of the Defendants in the Property.
6. Declaring that the interests of
Defendants Kirk Larson, Alexander
Larson, and Property Investment
Partners in the Property are subject
to the Bank of America Mortgage so
as to prevent the unjust enrichment
of said Defendants at the expense of
Bank of America.
7. Declaring that the Judgments,
as set forth in the Complaint in this
action, have not attached as liens
against the Property pursuant to the
homestead exemption under Minn.
Stat. ch. 510.
