felt that because of the court order
regarding the plat, they would be
required to provide that land with -

not feel the improvements were required,
even if the plat approval was.
However,an opinion from Maplewood
City Attorney Lais,presented to council _
members Thursday,June 17, indicated
that providing such services would be
necessary.He advised that council delay
of service to the area might be considered
"arbitrary and capricious"by the courts,
unless they could find strong grounds to
deny those services.
Council opposition to the development
has been based on the idea that such
development is premature in that area.
Residents of the vicinity have also
complained about assessments they will
be charged for projects they contend will
benefit only the Crestwood and Crestview
developers.
Jack Dilenthus of Dawn Development,
developers of the Crestwood plat said at
the recent Thursday session he was
"disappointed inthe council decision to •
reconsider"improvements to the road.
Fred Hawes of Mary Anderson Con- -
struction, developers of the Crestview
plat,said his firm had spent$100,000 in
grading on the site.He indicated that if -
improvements were delayed"it's enough
to make a company go down."
Several residents of the area spoke in
favor of a moratorium on the develop-
ment. Mayor Robert Bruton had com-
mented at an earlier session that such a
moratorium would help residents,giving •
them time to prepare for the assessments.
