ORDINANCE NO.417 AN ORDINANCE AMENDING CHAPTER 912 OF THE MUNICIPAL CODE RELATING TO FENCE HEIGHT THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS: Section 1.Section 912.130 is hereby amended to read as follows: 912.130—MAXIMUM HEIGHT OF FENCES.Fences bordering a property for purpose of enclosing the 10t or tract shall be limited t0 a maximum height ofd feet for residential usesand 10 feet for non-residential us Such fences sll be subject to determination by me building inspector as to whether the portion of fence which is on the frond yard 30 foot setback area of the site constitutes an impairment to clear vision for traffic purposes or impairs the view from neighboring :properties in such a manner asto constitute a so-celled i "spite fence.^In any case,obstruction to vision af. testing traffic in the public street or from neighboring properties,the height shall be only sock as is deter- mined by the building inspector to be acceptable.In making such determination,the building inspector may request advice and information from both the City Engineer the Police Chief,or persons representing these Officials,and their opinion shall be given In writing to the building inspector to be retained by him as part of his permanent record. Section 2.This Ordinance shall take effect end be in force from and after its passage and publication.
