A. CALL TO ORDER
A special meeting of the City Council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building and was called to order at 7:52 P.M. by Mayor Greavu.

C. COUNCIL PRESENTATIONS
1. Beam Avenue Grading West of Highway 61
a. Manager Evans stated the City Council -requested a report be prepared for
consideration at the special meeting meld this evening. Three items are addressed:
Mining permit vs. Grading permit;
Evaluation of Present Conditions and
Recommendations for future action.
Manager Evans presented the staff report with the recommendation that the follow-
ing steps be followed to resolve this issue:
1. Require the permitee to guarantee that a15 foot wide by 330 foot long
strip be paved at his expense;
2. Allow the permitee and only the permitee fifteen working days to finish
the site grading and excavation as shown on the approved plan;
3. Material removed from the Piletich Property shall only be used as fill on
the Toyota site;
4. Hauling on Beam Avenue will be permitted if vehicle speed is minimized and
an aggressive dust control program is implemented;
5. Restoration of topsoil and turf establishment be completed as soon as pos-
sible but under no circumstance later than August 1, 1981;
6. Any future excavation on the Piletich site shall require a permit as des-
cribed in Oridnance 415.
C. Mr. Mike Ryan, Ryan Construction, the firm doing the hauling to the Toyota
site, explained his firm's position.
d. The following residents presented their views:
Mrs. Marilyn Vars, 1140 Beam Avenue;
Mr. Jeff Blomquist, 1174 Beam Avenue;
Mr. Harvey Zuercher, 2911 Highway 61;
Mr. Michael Roy, 1200 Beam Avenue.

e. Mr. Voya Piletich, 2130 Arcade Street, owner of the property where the fill
is being hauled from, spoke on his plans for the property.
f. Councilman. Bastian moved to approve the grading permit for Mr. Voya Piletich
for his property on the north side of Beam Avenue west of Highway 61, subject
to the conditions presented in the staff report.
Seconded by Councilman Anderson. Ayes — all.
2. Assessment Reduction: Countryview Golf Course
a. Manager Evans stated it was necessary for Council to adopt two resolutions
reducing the assessments on the Countryview Golf Course property as ordered
by Ramsey County District Court.
b. Councilman Bastian introduced the following resolution and moved its adoption:

WHEREAS, pursuant to Resolution No. 76 -8 -162, the City Council of Maplewood,
Minnesota, adopted August 24, 1976, the special assessments for the construction
of Street Improvement 71 -15 were levied against property described by County
Auditor's Code No. 57 92100 011 05; and
WHEREAS, a court settlement was made to cancel the assessment in the amount
of $4,841.65; and
AV NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD that the
balance of the assessment for Street Improvement 71 -15 against the property
described by County Auditor's Code No. 57 92100 011 05 be cancelled in the amount
of $4,841.65.
Seconded by Councilman Nelson. Ayes — all.
c. Councilman Bastian introduced the following resolution and moved its adoption:

WHEREAS, pursuant to Resolution No. 76 -8 -162, the City Council of Maplewood,
Minnesota, adopted August 24, 1976, the special assessments for the construction
of Street Improvement 71 -15 were levied against property described by County
Auditor's Code No. 57 92100 011 09; and
WHEREAS, a court settlement was made to cancel the assessment in the amount
of $38,593.25 from balance of assessments; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CCUNICL OF MPALEWOOD that the
assessment for Street Improvement 71 -15 against the property described by
Council Auditor's Code No. 57 92100 011 09 be cancelled in the the amount of
$38,593.25.
