CALL TO ORDER A meeting of the Board of Adjustments and Appeals of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:41 P.M. by Chairman Bastian. B. ROLL CALL Gary W. Bastian, Chairman Present Norman G. Anderson Present John C. Greavu Present Frances L. Juker Present Earl L. Nelson Present C. APPROVAL OF MINUTES Minutes of Meeting No. 80 -6 (December 18, 1980) Mayor Greavu moved that the Minutes of Meeting No. 80 - -6 (December 18, 1980) be approved as submitted. Seconded by Councilman Anderson. Ayes — all. D. PUBLIC HEARINGS 1. Variance: Brooks Avenue and Germain Street — Cardinal 7:30 P.M. a. Chairman Bastian convened the meeting for a public hearing regarding the request of Christopher Cardinal for a variance to construct a garage larger than allowed by Code. The Clerk stated the hearing notice was in order and noted the dates of publication. b. Manager Evans presented the staff report. C. Vice Chairman Duane Prew presented the following Planning Commission recom- mendation: "Commissioner Prew moved that the planning Commission recommend to the Board of Appeals and Adjustments approval of the requested variance as the Commission I as recommended an amendment to the Code to change the maximum garage size, and recognizing there could be delays in the formalization of this amendment. Commissioner Barrett seconded. - Ayes all." d. Mr. Chris Cardinal, the applicant, spoke on behalf of the request. e. Chairman Bastian called for proponents. None were heard. f. Chairman Bastian called for opponents. None were heard. g. Chairman Bastian closed the public hearing. — a — 4/2 h. Councilman Anderson moved to approve the request of Mr. Christopher Cardinal for a variance to construct a garage (840 square feet) which exceeds the maximum allowable garage size of 750 square feet. Seconded by Councilman Nelson. Ayes — all. 2. Variance — 1389 Kohlman Avenue — Behrens — 7:30 P.M. a. Chairman Bastian convened the meeting for a public hearing regarding the request_ of James Behrens for a variance to construct a single family dwelling on a lot with substandard frontage. The Clerk stated the Searing notice was in order and noted the dates of publication. b. Manager Evans presented the staff report. C. Vice Chairman Duane Prew presented the following Planning Commission recommend- ation: "Commissioner Fischer moved that the Planning Commission recommend that the Board of Adjustments and Appeals approve the requested lot width variance to develop lot 59, Gardena Addition. Approval recommended on the basis that: 1. There are houses on 66 foot wide lots at 1417 and 1423 Kohlman Avenue and a variance granted at 1429 Kohlman Avenue. 2. The intent of the Zoning Code would be satisified. 3. The allowable density would not be exceeded. 4. The lot excess the 10,000 square foot minimum lot size. Commissioner Prew seconded. d. .Mayor Greavu called for proponents e. Mayor Greavu called for opponents Ayes 10, Abstained 1 (Commissioner Sletten)'! None were heard. None were heard. f. Mavor Greavu closed the public hearing. g. Councilman Nelson moved to approve the variance as requested by Mr. James Behrens for Lot 59, Gardena Addition, to construct a single family dwelling on a lot with substandard frontage, based on the recommendations given in the staff report and Planning Commission report.
