APPROVAL OF MINUTES a. February 20, 1990 • These minutes were amended on the bottom of page 3, item (2), changing "of" to "for ". Commissioner Fischer moved approval of the minutes of February 20, 1990, as amended. APPROVAL OF AGENDA Commissioner Sigmundik moved approval of the agenda as submitted. Commissioner Cardinal seconded Ayes -- Axdahl, Barrett, Cardinal, Fischer, Gerke, Larson, Rossbach, Sigmundik 110 Maplewood Planning Commission -2 Minutes 3 -5 -90 5. NEW BUSINESS a. Conditional Use Permit: Beam Ave. (Chili's) Secretary Olson presented the staff report for this requested conditional use permit for a 5,995- square foot, 217 -seat Chili's Restaurant on a property zoned business commercial (modified). There is also a 26,180- square -foot commercial strip center proposed on- site which would abut Chili's on the south and the developer is requesting approval for 19 fewer parking spaces than code requires. Commissioner Rossbach asked staff whether in the past any barricades have been installed on any public property to control traffic flow. Secretary Olson responded that the only instances he was aware of were cases where a chain or knock -down barricade was positioned for access by emergency vehicles only. 411 Dick Schreier, 2125 Desoto Street, developer for this project, commented on the history of a frontage road on this property. Mr. Schreier said he has received verbal approval from Ramsey County for two curb cuts on Beam Avenue. Mr. Schreier said there would be adequate parking with approval of the requested parking variance. Bill Potts, representing Chili's Restaurants of Dallas, Texas, gave a presentation. Randy Engel, representing the architect for this project, discussed changes made in the site plan, building design, and parking and traffic concerns. Boardmember Rossbach said since the zoning district to the south is single dwelling residential, he felt this requested proposal would change the character of the surrounding area. Randy Engel responded that many of the neighboring lots to the south are much larger than the minimum lot size and would allow considerable distances from this development. In addition, Mr. Engel pointed to the increased tax benefit to the community from this development. Commissioner Fischer moved the Planning Commission 410 Commissioner approval of the resolution approving a conditional use permit for a restaurant, subject to the following conditions: IIM Maplewood Planning Commission - 3 - Minutes 3 -5 -90 (1) Adherence to the approved site plan and related conditions. (2) This permit shall be subject to review after one year from the date of approval, based on the procedures in City code. (3) There shall be no excessive noise from the parking lot, especially after 10 p.m. If any complaints about late night noise from the parking lot are received, City staff may require that the rear parking lot be closed and barricaded after 10 p.m. The owner may appeal this decision to the City Council. In this case, a public hearing shall be held on the CUP. If the barricades do not work, the City Council may amend the CUP to limit hours of operation. (4) All cooking odors must be controlled so as not to be noticeable to adjacent residences. Commissioner Cardinal seconded Commissioner Larson moved to amend Item (3) of this motion to read: (3) There shall be no excessive noise from the parking lot. If any complaints about late night noise from the parking lot are received, the City Council may amend the CUP to limit hours of operation. Commissioner Sigmundik seconded This motion passed Ayes -- Axdahl, Barrett, Gerke, Larson, Rossbach, Sigmundik Nays -- Cardinal, Fischer The Commission then voted on the amended motion. This motion passed. Ayes -- Barrett, Cardinal, Fischer, Larson, Sigmundik Nays -- Axdahl, Gerke, Rossbach Commissioner Rossbach moved the Planning Commission direct the Community Design Review Board to consider the following option on the site plan: k Maplewood Planning Commission -4 Minutes 3 -5 -90 Take the retail space and move it as far back on the property as possible, making only an emergency vehicle and service lane behind the retail space, in that way pushing all of the parking into the front of the building creating a larger buffer for the property owners in the rear. Commissioner Gerke seconded This motion passed. Ayes -- Axdahl, Barrett, Cardinal, Fischer, Gerke, Larson, Rossbach, Sigmundik Commissioner Axdahl moved the Planning Commission direct the Community Design Review Board to consider the adequacy of the parking spaces if reduced by the amount requested in the variance, also reviewing the ratio of employees to patrons which are indicated by the location of the parking lots. Commissioner Cardinal seconded This motion passed. Ayes -- Axdahl, Barrett, Cardinal, Fischer, Gerke, Larson, Rossbach, Sigmundik 6. VISITOR PRESENTATIONS 7. COMMISSION PRESENTATIONS a. Council Meeting: February 26, 1990 Commissioner Rossbach reported on this meeting. b. Representative for the March 12 and 15 Council Meeting: William Rossbach 8. STAFF PRESENTATIONS a. Secretary Olson said he did not know at this time if there would be another Planning Commission meeting in March and asked commissioners to keep that Monday evening open, if possible. b. Secretary Olson informed the commissioners that seven people have applied for the Planning Commission vacancies and interviews will be scheduled for the first meeting in April. 9. ADJOURNMENT Meeting adjourned at 9:35 p.m. 411 MEMORANDUM TO: Planning Commission FROM: Shawn Bernier - Planning Intern SUBJECT: Easement Vacation LOCATION: 2983 Howard Street North APPLICANT: James A. & Kelly R. Sauer DATE: March 12, 1990 SUMMARY INTRODUCTION The applicant is requesting the vacation of part of the utility easement that is under their house, located at 2983 Howard Street North. (See the map on page 6.) CRITERIA FOR APPROVAL Chapter 412.851 of state law states that "Council may, by resolution, vacate any public easement . �� if it appears to be in the public interest to do so. DISCUSSION The Engineering Department has indicated that there are no City • utility or drainage facilities in the public easement right -of -way. There are no other utilities that need this easement. The balance of the easement should be maintained for the possibility of a future use. RECOMMENDATION Approve the resolution on page 5 to vacate a portion of the public utility easement between Lots 1 and 2, of Block 2, of Robert Tilsen's Maplewood Heights No. 4. My resignation does not come without some regrets. However, my current professional responsibilities require considerable travel and I am unable to dedicate the time and resources necessary to adequately address the issues put before the commission. Mr. Sletten's position expires on December 31, 1992. Mr. Ayers' position expires on December 31, 1991. Applications for the seven applicants are attached, along with a map showing the candidates' and commissioners' homes. The Planning Commission's "Rules of Procedure" state that "Appointments to the Planning Commission shall be made by the City Council, after a recommendation from the Planning Commission. The Planning Commission shall interview all candidates after a vacancy is advertised in the official newspaper and recommend three candidates to the City Council. Selection of the candidates shall be done by a written ballot. Each commissioner shall vote for not more than three candidates, listing them in order of preference, and sign his or her ballot. The chairman shall announce the vote of each member and tally the votes, giving three points to a first choice, two points to a second choice, and one point to a third choice. The names of the three candidates with the highest total votes shall be submitted to the Council, in order of total votes. The Commission shall make its recommendation based on qualifications and a representative geographical distribution of members."
