County Road C, said he was opposed to amending the residential single dwelling zoning to farm zoning, but he was in agreement with the rest of the proposal. Mike Hogan, 1116 E. County Road C, said he wanted the residential single dwelling zoning north of the Town and Country Manufactured Home Park to remain. James Nygard, 1110 E. County Road C, said he wanted residential low density land use designation with Ilk residential single dwelling zoning. Bill Keefer, 2408 Central Avenue Northeast, Minneapolis, owner of the Town and Country Manufactured Home Park, said he is in agreement with this proposal. Commissioner Rossbach moved the Planning Commission recommend approval of the resolution which amends the land use plan for the existing M -1 zone, southwest of County Road C and Highway 61 from RM, medium density residential to BW, business warehouse on the basis that: • (1) This area has been zoned for M -1 uses since the 1950s. (2) This area has excellent visibility and access for commercial use. (3) Commercial traffic on the frontage road would make this site better suited for commercial use. Commissioner Cardinal seconded Ayes--Barrett, Cardinal, Gerke, Larson, Rossbach, Sletten Commissioner Rossbach moved the Planning Commission take no action on the proposal to rezone the westerly half of the property north of the Town and Country Manufactured Home Park. (2) The BW designation is consistent with the long standing M -1 and BC zoning in the area. (2) The F zoned property is owned by the same owner as the drive -in property to the south and can be more easily developed commercially with that site. (3) The drive -in property has been zoned and used commercially for many years. The applicant is requesting approval of a conditional use permit (CUP) to add onto the Church of St. Jerome. The proposed addition /renovation plans consist of removing square feet of the existing church and replacing 4,800 square feet of new structure. The net the incre page amounts to 2,300 square feet. (Refer 6 for an explanation.) 2. Code requires that churches in F, farm residence districts be allowed only by CUP. There is no CUP for the church. Since the church is expanding, a CUP is now required. • 3. Staff is requesting ince code alsoarequiresuaeCUP•forrthiss day -care facility operation for three years use. The day care has been in op without a CUP. CRITERIA FOR CUP APPROVAL Subsection 36 -442 requires that in order to approve a CUP, the nine findings listed in the resolution on page 7 must be met. DISCUSSION It appears that all of the criteria for a conditional use permit would be met. RECOMMENDATION Adoption of the resolution on page 7, granting a conditional use permit, for an indefinite length of time, to expand the church and for a day -care facility based on the findings required by ordinance. Dear Sirs, The Church of St. Jerome located at 380 East Roselawn Avenue in Maplewood, `:innesota, is applying for a Conditional Use Permit this date. Account the shortage of priests and the assignment of one parish priest with no assistant, and with membership increasing, it has become mandatory to renovate the rectory in the church to secure 250 more seating capacity to accomodate attendance for Masses, funerals, weddings, and other religious liturgies all on one level. Use will be for church purposes only. We have contacted all property owners within the radius of 350 feet in accordance with Ramsey County Official Abstract of Title, and we are pleased to inform you that there are no objections to our building project. After our review of the criteria necessary for approval of CUP, we find that we will be in compliance with all standards as outlined by the City of Maplewood's CUP Permit application. The building project will in no way be in conflict with the city's standards or policies. Please refer to particularly Item 3 — the use would not depreciate property values, and in reality, would enhance and improve the present site due to the beautiful architecture and improved landscaping. As previously stated, we will be in compliance and abide by all policies set down by the City of Maplewood. We trust you will find everything in order along with the checks in payment for CUP and Design and Review Board applications. But, most of all, your approval and to proceed without any delay. BACKGROUND On January 23, 1990, the Community Design Review Board approved Ill the building and site plans and recommended approval of the CUP. DISCUSSION The building appears to meet all the findings for a conditional use permit. A four to six -foot berm is proposed along Cope Avenue to screen the site from the townhouses to the south. (See the map on page 4.) BACKGROUND July 20, 1961: The Maplewood Village Council approved the vacation of the north -south alley between Kingston Avenue and Effingham Street, approximately 113 feet west of Payne Avenue. This is shown on the map on page 4. November 20, 1989: The Maplewood Planning Commission recommended approval of the vacation of the alley north of Kingston Avenue. At this meeting, the Planning Commission requested that staff investigate the vacation of Effingham Street and the remaining north -south alley in this block. December 11, 1989: The Maplewood City Council approved the vacation of the east -west alley. CRITERIA FOR APPROVAL Chapter 412.851 of state law states that "Council may, by resolution, vacate any street . . . if it appears to be in the public interest to do so. . ." DISCUSSION The Effingham Street right -of -way, west of 1771 Payne Avenue, should be vacated. It is undeveloped and is not needed for street or utility purposes. The right -of -way should not be vacated in front of 1771 Payne Avenue, as the entire right -of -way section would go to the property owner to the south. This would cause two problems: 1. 1771 Payne Avenue uses this section of the right -of -way for a driveway turn - around. 110 2. The house at 1771 Payne Avenue appears to be very close, if not on, the right -of -way. If the right -of -way were vacated, the property owner to the south could construct an accessory building within 5 -10 feet of the house at 1771 Payne Avenue. The north -south alley between Kingston and Effingham should not be vacated. It is being used for access and utility purposes. RECOMMENDATIONS I. Approve the resolution on page 5 to vacate the unimproved Effingham street right -of -way, west of 1771 Payne Avenue to the DNR Trail. Approval is in the public interest because: 1. The adjoining property owners have no interest in having a street constructed. 2. The adjoining properties have adequate street access. 3. This street right -of -way is not needed for area traffic circulation or emergency vehicle access. 4. Maplewood's policy has been to vacate unneeded rights -of -way whenever possible. II. Drop the request for the alley vacation. 110 CITIZEN COMMENTS Staff sent surveys to 15 property owners within 350 feet of this request.
