Rooming House. Should read, "...the owner or • operator to three or more persons..." Item 4 -z. Workmanlike. Omit the word "reasonably." Section 241.060 EXTERIOR PROPERTY AREAS Item 1. Sanitation. Change the word "rubbish" to "refuse." Item 2. Grading and Drainage. Would like it to include man-made and not natural. Item 5. Would like it to have heading. Section 214.070 EXTERIOR OF STRUCTURES Item 1 -b. The words "substantial" and "peeling" are misspelled. Section 214.080 INTERIOR STRUCTURES Item 5. Sanitation. Change the word "rubbish" to "refuse." It was indicated that two applicants, Nettie Sherman and Grace Olson, who were previously rejected, although income eligible, would benefit from this proposal. Member Nemitz moved that in view of the availability of additional funds which must be allocated before the end of April, 1980, funding is hereby authorized for all income eligible applicants received to date for which points have previously been assigned. Randy Johnson Acting Secretary MEMORANDUM TO: Housing and Redevelopment Authority FROM: Randy Johnson SUBJECT: Special Meeting- April 24, 6:45 P.M., Jury Room DATE: April 15, 1980 The HRA has recently (February and April meetings) chosen to deny two MHFA Home Improvement Grant applicants, Nettie Sherman and Grace Olson, on the basis that they did not meet the required point threshold, although income eligible. The point system has a great deal of validity when a limited amount of grant money is available. The 1979 - 1980 grant cycle, however, is very untypical, as Maplewood has been given the "green light" to fund as many income eligible applicants as can be processed by April 30. In light of this unusual situation, the HRA may wish to reconsider its decision to deny funding for the two applicants mentioned above. March 17, 1980 • This letter was sent to the persons listed on the attached list. • RE: Capital Improvements Plan File No: 698.01 We are in the process of preparing a Capital Improvements Plan for the City of Maplewood through 1985. We would appreciate it if you could forward to Geoff Olson a list of capital items your department may undertake between now and 1985. The capital improvements list should be an estimaie of what the department may need in the next five years to meet the service demands of the City. In determining what capital improvements may be needed in the next five years, the City depart- ment heads should evaluate the present level of services and determine what improve- ments are necessary to keep pace with future service demands. The following provisions should be examined in determining what projects may be necessary: 1. Maplewood's response, to be in the form of a resolution (enclosed), is to be received by Metro Council no later than May 23, 1980. Background Since July 1977, the Maplewood H.R.A. has been working with the Metro H.R.A. and Minnesota Housing Finance Agency to offer home improvement grants to Maplewood's low income residents. The primary objective of the Home Improvement Grant Program is to provide monies to correct energy, health, and safety deficiencies. During the past three years, the Maplewood H.R.A. has distributed about $90,000 for new roofs, insulation, furnaces, weather stripping, electrical and plumbinc upgrading, window replacement, etc. Grants awarded to date have averaged about $2,800 per recipient, with a maximum allowable of $5,000. Maplewood has tentatively received an allocation of $27,374 for FY81. Of this amount $1506.00 (5.5 %) may be used for local administration, $684.00 for Metro H.R.A. administration, and $'.5,184 for grant funds. INTRODUCTION The Federal regulations which govern the administration of the Department of Housing and Urban Development's (HUD) CDBG Program, vest locally elected officials with responsibility for program design and implementation. These regulations also mandate that citizens be given an opportunity, and encouraged to serve in a key advisory role throughout the decision making process. To achieve these goals, the regulations require that all applicants for CDBG funds, must prepare and follow a written Citizen Participation Plan. The following paragraphs outline the City of Maplewood's strategy for complying with these requirements. II. DISSEMINATION OF INFORMATION The City will undertake several public information related efforts to promote citizen participation. These efforts will include, but not be limited to, the following: A. Public notification for all public hearings will be published in a non -legal section of the St. Paul Dispatch and Maplewood Review. Public notices will be . published at least 10 days prior to scheduled hearinc dates and will indicate the date, time, location, and a summary of the agenda. Hearings will be held at City Hall in the evening to encourage citizen involvement. If a location other than the City Hall is determined to be more convenient for the public, an announcement of the change will be posted at the City Hall at least 10 • days in advance and made mention of in each published public notice. B. The Community's quarterly newsletter, Maplewood in Motion, will be utilized, as deadlines permit, for program progress reports, up coming hearing notification, etc. C. CDBG Program Orientation will be the primary topic of the first of two pre - application public hearings (refer to Section III Al). City officials will inform citizens of: 1. the total amount of funds available for community development and housing activities, 2. the range of activities that may be undertaken with CDBG funds, 3. the kinds of activities previously funded in the City, 4. progress made with previously funded projects, 5. the competitive nature of the program, as a result of more pre - applications being submitted than can be funded, 6. the role of citizens in each stage of the process, and 7. A summary of other major requirements, such as, environmental policies, fair - sharing housing provisions, contracting procedures, etc. 2 • • D. All documents and the Citizen Participatio1 File (see Attachment A), which relate to the CDBG Program will be available for public review during normal working hours (8 A.M. to 5 P.M.) at the Office of Community Development, 1902 East County Road B. To assure that a staff person will be available to answer any questions, individuals will be encouraged to make appointments. E. Public notice of the City's submission of a CDBG Application to HUD will be published in both official news papers. This notification will cite a contact person for assistance in filing a statement in opposition to HUD's approval of the application. (Refer to Section III D2). F. Maplewood, presently does not have any concentrations of minority individuals, If the need arises, however, bilingual opportunities will be provided. The St. Paul International Institute will serve as a resource in providing the City with bilingual expertise. III. SCOPE OF PARTICIPATION The City will encourage citizens to participate in a wide range of CDBG related activities. In specific, the City will be seeking citizen input toward: the determination of community development priorities, the development of a strategy to pursue priori ':y needs, review and comment on the draft application prior to submission to HUD, assessment of the City's program performance, and comments on any proposed changes or amendments to the application (budget revisions or program strategy) or Housing Assistance Plan. • The following general mechanisms will be utilized to encourage citizen input as outlined above: public hearings, neighborhood attitude surveys, press releases, and articles in the City's quarterly newsletter, Maplewood in Motion. In all cases, citizens will be informed who to contact for comment or further information. A. Pre - Application Stage Citizen participation in the development of a CDBG Pre - Application will be encouraged as follows: 1. Two public hearings, open to the entire community, will be held on separate nights. The purpose of the first hearing will be to orient the public to the CDBG Program (refer to Section IIC) and to obtain input on the community's priority needs. The second hearing will be held to obtain input on the formulation of a strategy(s) to address specified priority needs. 2. Citizens will be invited to submit written project proposals to the Director of Community Development. To be assured of consideration, such proposals should be submitted to City staff prior to the second "Application Public Hearing" (refer to Section IIIB1). A written response will be provided within 15 working days. 3. Neighborhood Attitude Survey (NAP) a. Resident property owners directly affected (within 350 feet) by a proposed CDBG project, will be surveyed, door -to -door by City Staff S b. Non- resident property owners directly affected (within 350 feet) by a proposed CDBG Project will be mailed a survey. 3 • In either case, the purpose of the NAP is to provide directly affected citizens an opportunity for input regarding the type and scope of a . proposed CDBG Project. B. Application Siage If the City is invited to submit a full application, the City Council • will hold two public hearings, on separate nights, to receive comment on the proposed application. Both of these hearings will be held prior to Council consideration to approve submittal of the application to HUD. Additionally, these hearings shall serve as required public hearings for any public improvement projects associated with the application. Public notice will be mailed to all property owners directly affected. Citizens will be given an opportunity to respond to the scope and type of the proposed project, estimated costs and assessments, and the time schedule for development. In preparation for these public hearings, a public information session will be held in the general vicinity of a proposed CDBG Project. The purpose of the session will be to inform affected residents of proposed improvements so that they can have a realistic basis to form opinions. The sessions will be informal and intended to be on a one -to -one basis. • City Staff will be available to advise citizens on procedures for filing an objection to approval by HUD of a locally approved project application. C. Post - Application Stage 1. Program Amendment Citizen participation during program implementation will occur primarily through consultation with the Planning Commission or Housing and Redevelopment Authority, as appropriate. These bodies will be asked to review and comment on specific guidelines for approved projects. They will also meet to review any program amendments, budget revisions, and program /housing assistance plan modifications. All such changes will be discussed with either or both of these bodies and their comments con - sidered prior to the City Council taking final action. These meetings will be held on an as- needed basis. Any modifications proposed for the Community Development Program or Housing Assistance Plan, which require prior HUD approval, will be subject to public hearing prior to City Council consideration. 2. Program Implementation Performance A public hearing will be held to receive citizen comment regarding the City's performance in carrying out an approved Community Development Program. This hearing will be held within three months following the end 4 of each program year. Citizen commentary presented at this meeting as • well as volunteer comments offered throughout the program year will be used to develop the Grantee Performance Report as required by HUD. At the time of the initial program orientation meeting, citizens will be invited to volunteer comments throughout the year relative to any aspect of program performance. Every reasonable effort will be made to provide written responses within 15 days to complaints regarding program performance. Program staff will also be available during normal working hours (8 A.M. to 5 P.M.) to respond to citizens' inquiries. 3. The Citizen Participation Plan will be subject to public comment by way of a public hearing to be held the first pre - application public hearing for a subsequent CDBG Application. D. Complaint Handling Procedures • These procedures apply when a complaintant objects, in writing, to an application or alleges that the City of Maplewood has failed to comply with the requirements of the CDBG Program (24CFR Part 579.303). 1. Within 5 working days program staff will acknowledge, in writing, receipt of a complaint. • 2. If an application has been approved by the City Council and submitted to HUD, program staff will provide informational assistance to citizens • wishing to file an objection to approval by HUD. Staff will provide the complaintant with the information outlined in Attachment B, as well as any other desired program documentation. 3. If an application has not been approved by the City Council, Program Staff will make every effort to resolve the complaint within 30 days, and provide the complaintant with a written response. 4. In all cases, the Citizen Participation File shall contain records of all complaint related correspondence, both verbal and written. E. Persons wishing to object to approval of an application by HUD may make such objection known to the appropriate HIJD Area Office. HUD will consider objections made only on the following grounds: The applicant's description of needs and objectives is plainly inconsistent with available facts and data; or the activities to be undertaken are plainly inappropriate to meeting the needs and objectives identified by the applicant; or the application does not comply with the requirements of this Part or other applicable law; or the application pro- poses activities which are otherwise ineligible under this Part. Such objections should include both an identification of the requirements not met and in the case of objections made on the grounds that the description of needs and objectives is plainly inconsistent with significant, generally available facts and data, the data upon which the persons rely. Although HUD will consider objections submitted at any time, such objections should be submitted within 30 days of the publication of the notice that the application has been submitted to HUD, as described in paragraph (i)(3) below. In order to ensure that objections submitted will be considered during the review process, HUD will not approve an application until at least 45 days after receipt of an 411 application. Staff intends to notify the public of the availability of this program via the newspaper, Maplewood in Motion, churches, and sewer billing enclosures. However, before staff can advertise, the rating criteria must be revised regarding income (Item #1). As outlined below, Staff suggests that other criteria should also be considered for revision. Our 1981 allocation is slightly larger than our previous allocations but as you are aware, income eligibility and the grant ceiling have increased greatly In essense, a situation exists where the City could likely serve fewer persons than in the past but be faced with many more applications. Given this background, staff suggests that the existing priority criteria be reviewed relative to the following items. 1. Target Groups Does the existing system give priority to all target groups wished to be reached. For example: a. Handicapped /disabled applicant b. Elderly (62 and over) c. Single head of household with dependent children d. Household with four or more dependent children 2. Housing Assistance Plan Goals for Substantial Rehabilitation a. Presently the City has a committment to substantially rehabilitate 10 homes. Substantial rehabilitation is defined as bringing a home up to at least Section 8 standards. 3. Grant Impact Guidelines 6 and 7 are presently quite subjective. The following criteria are suggested to deal with these items more objectively and also to tie into the HAP: a. Bring home to Section 8 existing housing quality standards b. Bring home to City Code (Housing maintenance and /or Building Code c. Eliminate hazardous conditions d. Substantial weatherization and energy conservation improvements e. Eliminate housing overcrowding f. Maintain neighborhood stability (eliminate isolated incidence of deteriorated housing 4. Other Factors a. Demonstrated efforts toward maintenance or rehabilitation b. Applicant will provide labor 5. Existing Guidelines a. Income ranking has to be changed to reflect a $6,000 ceiling. It is suggested that a percentage concept be used to eliminate the necessity of again revising these points in the future. For example: 1. 100% or less than the maximum income level 2. 80% or less than the maximum income level 3. 60% or less than the maximum income level 4. 40% or less than the maximum income level 5. 20% or less than the maximum income level b. Item 2 does not appear to be applicable any longer c. Item 3, see Target Groups Points should be assigned to each criteria as in the past, possibly adding up to a total of 100 points. A threshold may be a good idea, particularly for the area of Grant Impact. Such a threshold would be a means of rejecting an other- wise qualified applicant if the improvements were not thought to be a priority of the HRA, PRIORITY GUIDELIUES Applications will be reviewed in order of date and time received. Eligible applicants as defined by Statute, meeting one or more of the following Guidelines, will be awarded points. Those applicants with the highest point totals will be given first considerations for grant monies, provided that priority is to be given to elderly applicants, and energy related improvements, not withstanding point totals. 1. MHFA GRANT APPLICATIONS - STATUS REPORT This was closed in May. There were 21 total applicants; 8 in progress; 5 closed out; and 8 withdrew or rejected. Our total dollars were $42,150, and the average grant was $2,810. We received $28,000 for 1981, and advertisements went out last week. We will continue the past practice of considering the first applicants for this year as those that are carried over, submitted before the notice, or in the process of coming in. It was indicate that thatseligible,Home Improvement Grant applicants receive preference ca Staff requested that a policy be established forreferral ofd Grant Applicants to the RAP Program, Two points of view a. All applicants should be referred, no matter how extensive the estimated cost of eligible improvements. This policy would maximize the use of available grant monies. Little, if any, insulation related work would be done by private contractors; b, Refer to RAP, only those applicants whose eligible improvements are estimated to exceed $6,000. Would reduce the competition between the public and private sector regarding energy related improvements. Larsen motioned and Fischer seconded to table this issue until the September meeting. Motion carried unanimously. The implications of the Privacy Act regarding HRA review and ranking of grant applicants were discussed. It was decided that all application data will be available to the HRA for ranking purposes but that all references to applicants will be by case number. B. HOUSING PLAN REIVIEW Juker moved to eliminate from the House Plan, the policy requiring the place- ment of all utilities underground, Fischer seconded. Motion carried unanimously. Staff provided an overview of proposed 3 and 10 year housing allocation schedules with the accompanying text. This material was originally pre- sented as pages 60 and 61 of the "yellow housing plan ". The membership accepted the proposal as submitted C. MHFA GRANT APPLICATIONS Of the 21 applications received for the 1980 funding cycle, 13 were funded. Eight either withdrew or were ineligible. Seven of the funded applicants have work remaining to be completed. To date, seven applicants have been declared income eligible for the 1981 cycle. The City Building Official is presently contacting these persons. Applications will be taken until early October, at such time the HRA will begin the ranking process. D. BONUS FUND APPLICATION - MAPLE KNOLL The Maple Knoll project did not make the cut off for funding. There is a possibility that the project will be eligible for additional bonus funds later this fall. Staff will check into the possibility of using previously committed funds for another project. E. SECTION 8 - MODERATE REHABILITATION Two duplex rental units qualified for the program in Maplewood. Inspection of the units is scheduled for August 19 to determine what improvements need to be made. F. TRAILS It was suggested that the City consider developing the trail easement at Archer Heights PUD, Staff will investigate the possibility of including the trail in the next budget proposal. 8. NEW BUSINESS A. SECTION 8 BONUS FUNDS /MOBILITY In July the Metropolitan Council advertised for _proposals for developers, The deadline for submittal just passed, as such, no information was available regarding proposals for Maplewood. Each developer is to set aside up to 2 l 20% of the proposed units for minorities from concentrated minority areas. B. 1981 SMALL CITIES BLOCK GRANT A workshop will be held on August 26, for prospective applicants. C. HOUSING DISCRIMINATION The Human Rights Act has been Amended to prohibit discrimination against families with children. The Human Relations Commission is considering a program that would test for this type of discrimination in Maplewood's rental housing complexes. (A copy of the Amendment is attached.) 9. MHFA HOME IMPROVEMENT GRANT RANKING CRITERIA Staff presented a ranking criteria proposal based upon comments received at the August meeting. Following additional revisions and assignment of points, Larsen motioned and Juker seconded to adopt the criteria as amended. (A copy of the adopted criteria as attached). These ranking criteria are subject to approval by the MHFA. The membership requested Staff to pursue the feasibility of the City purchasing smoke detectors and installing them in each home as an alternative to expensive contractor installation. B. REFERRAL OF MHFA GRANT APPLICANTS TO RAP Fischer motioned and Larsen seconded to automatically refer all applicants, at the time of application, to the RAP Program. Motion carried unanimously. The rationale being that the RAP Program should be used to the greatest extent possible in order to make the most cost - effective use of available MHFA Grant funds. C. SECTION 8 MODERATE REHABILITATION PROGRAM Two duplexes in Maplewood will be funded under the program. These structures are located at 1800 English and 943 Century. The duplex at 1800 English will be the first structure funded under this program. As such, the HRA membership requested that some media coverage be given to this project. Monies for an additional 100 units of rehabilitation have been allocated to the Metro HRA Advertisement for prospective landlords will be in the near future. D. TRAIL EASEMENT - ARCHER HEIGHTS PUD Staff will continue to pursue the possibility of including the pavement of this easement in the upcoming budget proposal. E. SECTION 8 BONUS FUNDS 1. The Parkway Townhouse proposal (Larpenteur and Parkway Drive) containing 30 family units ranked as the first alternate for funding. Metro Council staff indicated that the outlook is good for funding. A decision should be made by late October. 2. The Manle Knoll proposal (Radatz and White Bear Avenues) containing 57 units of family housing has been approved for funding. The details of site and building plans will be discussed in the very near future. 8. NEW BUSINESS A. 1980 MHFA HOME IMPROVEMENT GRANT APPLICANTS Juker motioned and Larsen seconded to approve applications 80 -1 and 80 -4 for grant funds. Motion carried unanimously. The following improvements were approved: Case 80 -1: All items contained in the building inspector's report up to the maximum of $6,000.00 Case 80 -4: a. Residing, provided the Applicant qualifies to provide his own labor b. Insulation of attic to R44 and ventilate d. Re tful A bm'A ted, % Ranly Johns 1Acting Secretary M E M O R A N D U M TO: HRA FROM: Associate Planner - HRA Laision SUBJECT: MHFA Grant Reconsiderations DATE: November 14, 1980 CASE 80 -10 Request Fund labor as well as materials for a driveway Background Approval was granted on October 14, 1980 to fund the construction of an accessibility ramp (wheel chair) and a driveway, if: a. the MHFA Accessibility Program could not fund prior to next spring and b. labor to install the driveway would be provided by the Applicant. Section 6.4b4 of the MHFA Guidelines states "reconstruction of sidewalks and driveways is allowed only on private property and only if existing conditions are a clear and imminent health hazard ". In this case, an imminent health hazard was found to exist due to the age of the Applicant (71) and the lack of easy passage between the house and car by wheel chair. The Applicant has made application to the MHFA Accessibility Program. Also, since that time it has been brought to Staff's attention that the Applicant had understood that his labor would be voluntary, but that approximately $500 in labor costs for assistance to him would be paid. Partial labor costs cannot be funded. If labor costs are to be paid in any manner, a contractor must be employed who is licensed by the City. The Applicant has requested that the HRA revise its conditions for approval to allow labor costs for the installation of a driveway. Materials were approved and estimated at $500. The cost of labor would be approximately $700- 1,000 in addition to present grant amount estimate of $3,000. Recommendation Fund the labor costs in addition to material costs for the installation of a driveway, subject to: p 1. Maplewood receiving an allocation of Bonus funds in excess of the requested labor costs 2. The driveway is not funded by the MHFA accessibility program. Approval is based upon the following findings: 1. Approval would be consistent with the spirit and intent of the program guidelines 2. Due to accessibility considerations, a unique situation is established in which there is a demonstrated hardship. 3. Approval does not obligate the funding of additional driveway improvements unless similar circumstances can be proven. Case #80 -14 Request Appeal Staff's determination of income ineligibility Background On October 14, 1980, conditional approval of the applicant's application was granted. Staff was instructed to determine whether or not the applicant was employed in addition to receiving County Assistance. Recommendation Denial of the appeal on the basis that MHFA program guidelines have been adhered to. EVIDENCE OF SUCH VERIFICATION MUST BE INCLUDED -IN THE GRANT SUBMISSION PACK- AGE. The Inspection Report provided by MHFA shall be included with all Grant Submission Packages. Oth- er Inspection Reports may be substituted, but only upon receipt of written approval by MHFA. Such report forms must include at least the following items: (a) General condition of the structure. (b) Structural soundness. - (c) Plumbing systems, including: water supply, waste disposal, fixtures, and piping system. (d) Heating systems. (e) Electrical systems. (f) Roof. (g) Energy efficiency, including: insulation, infiltration, windows, doors, and ventilation. (h) General exterior conditions. (i) General interior conditions. An explanation should be provided for any deficiency which ap- pears on the inspection report but does not appear on the Im- provements Certificate for correction. (a) Income Formula Worksheet: The income formula determines the "ADJUSTED GROSS INCOME" of an applying household. The Administering Entity is responsible for the correct use of this formula in determining the eligibility of the appli- cant. EXTRAORDINARY MEDICAL EXPENSES - an amount equal to the total of those medical and other expenses which MHFA determines to be extraordinary.
