Rejected. Date - -- , John Prey resigned from the Housing and Redevelopment Authority (HRA) in October. His appointment expires in March 1989. HRA commissioners are appointed to five year terms. To avoid the need to reappoint Mr. Prey's replacement in March, Council should appoint the new commissioner to fill out the two months remaining in Mr. Preys term, as wel I as, appoint this person to their own f ive—year term that would expire in March 1994 a A notice was pub ished in four issues of the Maplewood Review to advertise this vacancy. One individual , Gary Pearson, submitted an application. On November 15, 1988, the HRA .interviewed Mr. Pearson. RECOMMENDATION The HRA recommends that Council appoint Gary Pearson to the HRA to fill the vacancy that resulted from the resignation of Commissioner Frey . BACKGROUND Wages for vacation and sick 1 eave are financed by the Payroll Benefits Fund. Wages for hours worked are financed by the General Fund. During 1988, vacation and sick leave hours used in the Finance Department was less than anticipated in the 1988 Budget. Consequently, the wages for hours worked was higher than anticipated in the Finance Department budget. A budget transfer is needed to finance these costs. INTRODUCTION ., The applicant is requesting a six-month time extension for the � Cottages of Maplewood lanned Unit Development (PUD) . This PUD ° consists of sixty townhouse-style residential units for older adults. (Refer to the site ' plan on page 5.) ° BACKGR8LIND Council approved this PUD and tax-exempt financing for this pnmject on December 149 1987. On January 11, 1988, Council approved this project for tax-exempt financing. In July 1988, Ramsey County authorized a Community Development Block Grant for this development. In November 19881 the applicant received a tax-exempt bonding commitment from the Minnesota Housing Finance Agency. DISCUSSION The present applicant has made a good-faith effort to proceed in a timely manner with this development. The initial applicant, Arkell Development, had to withdraw. The search for the present applicant resulted in an unavoidable delay of about four months. A closing for the financing is scheduled for January 23, 1989. There have been no changes to City code or in the surrounding property that warrant revision of the original conditions of approval. RECOMMENDATION Approve a six-month time extension for the Cottages of Maplewood PUD, subject to the original conditions of approval dated December 14, 1987. REFERENCE City Code: Section 36-442(d) states "The proposed construction must be substantially started or the proposed use utilized within one year of Council approval or the permit shall become null and void. The Council may grant one six-month extension of the permit if just cause is shown. This rq?quirement shall not apply to PULP'.-:.-. with an approved phasing plan. Such extension shall be requested in writing and filed with the Director of Community Development at least thirty (30) days before the expiration of the original conditional use permit. There shall be no charge for filing such petition. The objective is to have the pay rates for all temporary and part -time employees set at one time in one resolution. BACKGROUND Past policy has set the minimum pay rate for each position to be the amount specified under minimum wage law. It is proposed that this pol. i cy be continued. The current minimum wage rates are $3.85 per hour for those age 18 and . of der and $3.47 per hour for those under age 18. It is proposed that the maximum pay rates for each position be increased by 4/0 and a minimum of $.25 per hour effective January 1, 1989 with the following exce-pti ons. For the Secretary, Accounting Clerk and Clerk-Typist positions, the maximum is equivalent to the starting pay rate for a full-time permanent employee. For the Administrative Assistant position, the maximum pay rate is increased from $7.60 to $10.50 per hour to facilitate hiring for certain specialized or professional positions such as interns, election judge coordinator, etc. It should also be noted that the last time these pay rates were increased was two years ago. RECOMMENDATION Adoption of the attached resolution is recommended. Currently, the CITY's Utility Billing function is performed on the TI mini - computer system. The new EDEN SYSTEMS Utility Billing application is being maintained 0 concurrently. However, the information on this system is accurate only, to approximately July 1988, because of the double -entry of account information, on the two systems. EDEN SYSTEMS' marginal implementation support to.the CITY and general software "bugs" .have. caused a significant delay in bringing the new Utility Billing system on -line. EDEN SYSTEMS will be at the CITY, January 17, 18 and 19, to make a final software installation and verification. At that time, they will also perform a parallel run Of the two systems. The CITY will incur a cost of $3,900.00 to bring the EDEN SYSTEM Utility Billing application on -line. Without the requested transfer, manual data input, at a higher cost, would be needed. These cabs are parked at the drivers' homes. The nonresident cab drivers would travel to the applicant's property an average of ten times each week to drop off receipts. b. More than one light commercial vehicle is associated with this home occupation request. Light commercial vehicle is defined as a vehicle with a 3/4 ton or less payload on which is attached a snowplow, glass carrier, crane or similar commercial attachment. Each of the applicant's vehicles has a roof-mounted taxi-light. He has found another location to do the repair work and has agreed to discontinue repair work on the cabs at his home" REQUIRED FINDINGS Section 17-21(a) of city code lists twelve conditions that must be adhered to for home occupations. Refer to Page 7. DISCUSSION Since the applicant has agreed to discontinue repair work on the cabs at his home, the main concern is the cabs coming to his home to drop off receipts. Ten trips each week is similar to other home occupations, such as beauty shops, but is at the upper end of an acceptable amount of traffic. Approval should be +or six months to evaluate whether removing the repair work has made this an acceptable home occupation. The running of dispatcher radios up to III hours at a time, which can be clearly heard on our property. 2. We have encountered language from persons involved in the occupation which is not only vulgar to us, but to our child and guests in our home. 3. The constant shif Ling of personal vehicles and taxis that continues all day long up and down the neighborhood streets, along with the unnecessary revving of engines that goes along with this. 4. They work on other persons vehicles which are not their personal vehicles or taxis , 5. There has been traffic and work connected to the home occupation until at least 11:30 p.m. 6. The constant working on and storage of the taxis has greatly affected the use and enjoyment of our property, which is our right as a residential homeowner. 7. We question the use of the term "minor repairs ", as many of the repairs we have observed to date have not been minor. We have understood that this is a strictly residential neighborhood and strongly feel that a home occupation such as this is contrary to the residential zoning. If we had in ended to live near a business such as this, we would have purchased property in area that held this type of business. There still remains a question of whether or not Mr. Catlin charges for the repairs on the various vehicles. Apparently on September 19, 1987, the staff attempted on -site investigation findings. At that time they found two taxis in the garage and evidence of painting of the vehicle. Staff should specifically make a determination with respect to the following: Light commercial vehicle: A vehicle with a payload rating of. three - quarter ton or less on which is attached a snow plow, glass carrier, crane or similar commercial attachment. A determination should be made whether or not taxis fall within this definition commercial attachments. Under Section 17 -21 License Requirements, your attention should be drawn to: 1. Customers visiting the premises 2. More than one vehicle associated with the home occupation which is classified as light commercial vehicle. Staff should investigate the following: 1) Exactly the type of business Mr. Catlin is undertaking - leasing with repairs; 2) A check should be made concerning the state requirements and licensing of taxi cabs; 3) An inspection of the garage area and a determination of the type of activities undertaken, such as internal combustion enginer repairs, painting, body work, and whether other vehicles are prepared at the premises. Initial research indicates Town Taxi may be a franchise operation. Staff should research the requirements for franchise, such as a repair and storage garage and a contract distribution point. He said that Mr. Catlin purchases his radio dispatching and cab insurance through Town Taxi. Town Taxi requires its own mechanics to frequently inspect each of the cars that uses its radio dispatching service. Town Taxi's mechanics also perform the inspection required by MN/DOT to use a cab to transport packages. The cars must comply with Town Taxi's operating and appearance requirements. If a problem is found dm°ing an inspection, the problem must be corrected before the cab can receive any further dispatches from Town Taxi. Any cited repairs can be made by Town Taxi or some other qualified garage. Mr. Catlin's drivers bring their leased cars to Town Taxi for inspection but Mr. Catlin pays for any repairs. There may be cases where it is unreasonable to require the costs of licensing and insurance where a vehicle would not cause a nuisance. MEETINGS Regular: The City Council shall hold regular meetings on the second and fourth Mondays of each month at 7 :00 P.M., provided that when the day fixed for any regular meeting falls on a day designated by law as a legal holiday, such meeting shall be held at the same hour on the next succeeding Thursday not a holiday. _Special : The Mayor or any two members of the Council by writing filed with the City Clerk at least twenty -four hours before such meeting may call a special meeting. Notice of such meeting shall state the purpose or purposes thereof and shall be personally delivered to each member or be left at the members usual place of residence with a person of suitable age and discretion then residing therein, or written notice thereof shall be left in a conspicuous place at the residence if no such person can be found there. The notice shall be delivered twelve hours before the meeting time.
