Chairperson Desai opened the public hearing. 1.Bryan Derhim, 2431 Cypress Street, Maplewood,addressed the commission. Concerns of the commission and the resident that spoke werethe condition of the building, parking, and theimpact on the neighborhood frompeople test driving cars.The loading or unloading of cars on nearby streets or surrounding properties and the hours of operation. Chairperson Desai closed the public hearing. Commissioner Tripplermoved to approvethe conditional use permit resolution to allow used-car sales at 1081 Highway 36. Approval is based on the findings required by ordinance and subject (additions or deletions to the conditions are underlined or in to the following conditions: bold). 1.All construction shall follow the plans date-stamped June 11, 2014, approved by the city. Staff may approve minor changes. 2.The proposed use must be substantially started within one year of council approval or the permit shall become null and void. The council may extend this deadline for one year after review and good-cause is shown. 3.The city council shall review this permit in oneyear. 4.This permit requires that cars for sale be kept indoors as proposed. 5.Any signs shall be installed in accordance with the Maplewood Sign Ordinance. 6.The applicant shall pave the area behind the building to eliminate the graveled parking and driveway surfaces. The property owner shall also do the same in the area behind Hirshfield’s at the same time to clean up the site. 7.The applicant shall direct his staff to avoid the residential neighborhood for test drives. 8.Cars should be unloaded on site not on the streets or nearby properties. 9.Hours of operation shall be Monday –Thursday 9:00 a.m. –8:00 p.m., Friday and Saturday 9:00 a.m. –6:00 p.m. Commissioner Tripplermoved to approvethe variance resolution for the proposed Whitaker used car sales business to be less than 350 feet from a residential district. The proposed use would be 190 feet away. This variance approval is based on the following findings: 1.The proposed variance would be in harmony with the intent of the ordinance. With a 350 foot separation from a residential property, the code attempts to buffer auto sales activities from residents. In this case, there would be no outdoor car sales or displays, to eliminate any neighborhood impact. July 1, 2014 2 Planning CommissionMeetingMinutes 2.The use would be consistent with the comprehensive plan since it is classified commercial and auto sales are a commercial activity. 3.There are practical difficulties in complying with the ordinance. The existing building is closer than 350 feet to the nearest residentially zoned property. This proximity is nothing the applicant can control. This “practical difficulty” is being addressed by the applicant by operating his used car sales business inside the building. Other than test drives, there would be no impact on the neighborhood. The residential district to the north, furthermore, is almost fully screened by mature trees from this commercial property. Seconded by Commissioner Kempe.Ayes -All The motion passed. Introduction Project Description The citycouncilhas approved apurchase agreement for the former Maplewood Fire Station No. 1, at 1177 Century Avenue North. LCS Lawn Serviceis proposing to move itslandscaping maintenance business to this location. This use is permitted by the current business commercial (BC) zoning, but to change it from a government use, the comprehensive planclassification would need to be changed to C (commercial) to match the existing BC zoning. LCS Lawn Servicealso proposes to use a portion the parking lot to store equipment. This would require a conditional use permit (CUP) for any equipment or materials thatwould be stored outdoors. Requests The City of Maplewood is requesting that the city council approve: 1.A comprehensive land use plan amendment from G (government)to C (commercial). 2.A CUP to be allowed to store equipment and materials outdoors. Background This property is the site of Maplewood Fire Station No. 1.Itwas placedfor sale due to its replacement with the new fire station under construction on McKnight Road near Minnehaha Avenue.The city council approved a purchase agreement from LCS Lawn Serviceto purchase this property from the city.LCS Lawn Service is not proposing anychanges to the exterior of the building and will be utilizing the parking lot as it is currently configured. In the future, any changes to the exterior part of the building or the parking lot would trigger a design review process by the city. The site currently meets minimum parking requirements for the building. Discussion Comprehensive Plan Amendment The city council must approve the proposed land use plan change to C (commercial)if they wish to approve the CUP. Staff recommends approval of this change since the proposed use complies with the general development policies in the comprehensive plan. The site is already zoned business commercial and would be consistent with the C (commercial) land use designation. The other non-residential properties along Century Avenue, south of this site, are also zoned BC and guided C. Conditional Use Permit The applicant is proposing to store trailers and vehicles in an area directly west, orbehind, the building. The city requires a conditional use permit to allow exterior storage. The applicant is proposing to mitigate the exterior storage by installing a 100 percent opaque screening fence on the three exposed sides of the storage area. The applicant did not indicate how tall of a fence would be built but staff would recommend requiring the fence be at least six feet tall. The applicant is also proposing to restore the overflow parking area to the north ofthe building with grass seed. Committee Review August 19, 2014: The planning commission will reviewthis project and make a recommendation regarding the comprehensive plan amendment and the conditional use permit. Budget Impact The approval of acomprehensive plan amendment and a conditional use permit do not have any direct impact on the city’s budget. The selling of the fire station property has been addressed by the city council in other actions. Recommendations A.Approvethe resolution adoptinga comprehensive land use plan amendment from G (government) to C (commercial) for 1177 Century Avenue North. Approval is based on the following reasons: 1.The property is presently dormantand is proposed to be sold to and utilized by a private businesswhich would be compatible with a land use classification of C (commercial). 2.The site is already zoned business commercial which is compatiblewith the land use designation of C (commercial) and the other commercial properties to the south. This action is subject to the approval of a comprehensive plan amendment by the Metropolitan Council. B.Approve the resolution approvinga conditional use permit for exterior storage at 1177 Century Avenue.The storage area will be located directly west of the building. Approval is subject to the findings required by ordinance and subject to the following conditions: 1.All exterior storage must be contained to the area indicted by the site plan, date- stamped July 21, 2014. Staff may approve minor changes. 2.The city council shall review this permit in one year. 3.The proposed usemust be substantially started within one year of council approval or the permit shall become null and void. The council may extend this deadline for one year. 4.The proposed fence must be 100 percent opaque and be built with either cedar boards or a maintenance-freevinyl material. 5. Broken or knocked down fence portions shall be repaired. 6.Comply with the building permit requirements of the city’s building inspection department. 7.The applicant shall work with the building official, fire marshal and environmental planner to ensure compliance with applicable codes. 8.The open area to the north of the building shall not be used for any exterior storage purposes. 9.Any future changes to the site or building will require design review by the city. Citizen Comments Staff surveyed the owners of the 57Maplewood and Oakdale properties within 500 feet of the site for their comments. Of the tworeplies, both were in favor of approval. In Favor 1. We welcome the business of LCS Lawn Services to the 1177 Century Ave North site.We see no distraction or problems of the screen and fenced-in area for storage on the west side of the building. MEMORANDUM TO: Melinda Coleman, Interim City Manager FROM: Tom Ekstrand, Senior Planner DATE: August 6, 2014 SUBJECT: Approval of the 2015-2019 Capital Improvement Plan Introduction Attached is a memorandum by Gayle Bauman, finance director, concerning the 2015-2019 Capital Improvement Plan (CIP) draft for review by the planning commission. The CIP is quite lengthy with 164pages. Its purpose isfor the city council to plan for major projects, purchases and expenditures. The planning commission must review the CIP and forward a recommendation to the city council, making the finding that the CIP is consistent with the goals of the comprehensive plan.Simply stated, the goals of the comprehensive plan are to guide the future growth and development of the city in an orderly and fiscally responsible fashion. By approving the CIP, the council is not committed to any of these projects or expenditures. The CIP is only a budget planning document. The council must consider each item individually and take specific action to actually commence any of these projects or to commit funds to any proposal. Recommendation Approve the 2015-2019 Capital Improvement Plan, based on the finding that doing so meets the goals of the comprehensive planby guiding the future growth and development of the city in an orderly and fiscally responsible fashion. Attachments 1.Memorandum from Gayle Bauman, Finance Director, dated August 5, 2014 P:CIP2015-2019\PC Cover Report to CIP Memo Attachment 1 MEMORANDUM TO: Melinda Coleman,Interim City Manager FROM: Gayle Bauman, Finance Director DATE: August 5, 2014 SUBJECT: 2015-2019 CIP Plan Review Introduction The Capital Improvement Plan is an annually prepared document that coordinates the planning, financing and timing of major equipment purchases and construction projects. The 2015-2019 CIP document has been released for review by the various Commissions and a Public Hearing on the CIP will be held at the Planning Commission meeting in August. As part of our paperless efforts, a copy of the CIP is available in electronic format on the City’s webpage. A Public Hearing has been called for 7:00 pm and is on the Planning Commission agenda to allow the Planning Commission to review the draft CIP as proposed by the staff and discuss our proposed debt levels. A finding by the Planning Commission on the CIP that “…the proposed CIP is consistent with implementing the goals of the Comprehensive Plan.” is recommended. Following thereceipt of recommendations from all the Commissions, the City Council will be asked to adopt the CIP in September 2014. Adopting the CIP does not commit the council to the proposed projects, nor implement the assumptions made during the preparation; however, this is the basis for the 2015 Budget as we continue with its preparation. CIP Summary A copy of the draft 2015-2019 Capital Improvement Plan can be found on the City’s website at www.ci.maplewood.mn.us.The Transmittal Letter highlights the major projects within the Plan for consideration. The document explains each of the proposed projects, as well as analyzes the impacts on the budget for the various funds, along with the tax impact necessary to implement these projects as proposed. The staff submits projects based upon goals set at the Council/Management Team retreats. The finance staff analyzes the funds available for capital projects along with the impacts of the staff proposals. A number of revisions are made in the project submittals based upon the analysis of finance, as well as management priorities to achieve the attached CIP plan. The attached table shows the changes that were made to the original requests based on the City’s financial meansand meetings with the various department heads. Planning Commission Consideration There are a couple of programs that are important to consider for the Planning Commission to make their finding during the 5-year planning period covered by this CIP as follows: 1.Housing Replacement Program: a.Proposes $80,000 in 2016 and again in 2018. Attachment 1 b.The proposal is that the HEDC develop a program for housing rehabilitation or improvement on an every other year basis. c. This is consistent with the Comprehensive Plan goals for reinvestment into the City’s housing stock. 2.Commercial Property Redevelopment a.Proposes expenditures of $1,500,000, including Prior Year investments. b.Revenue from this program comes from the sale of property that has been purchased and redeveloped [$1,200,000 is estimated], plus the annual levy of $89,270. c. The proposal is that the HEDC will be involved in the purchase of redevelopment properties, improve the property and then resell the property for increased tax base. The HEDC would make recommendations to the Economic Development Authority. d.This is consistent with the Comprehensive Plan goals for business retention and expansion. 3.Gladstone Area Redevelopment a.Proposes $5,425,000 of expenditures over the 5-year period. b.The proposal calls for use of grantfunds to continue needed public improvements and possible acquisition and/or investment into property in accordance with the approved Gladstone Master Plan. 4.Upgrades to Fire Stations and new regional Public Safety Training Facility a.Proposes $4,650,000 of expenditures over the 5-year period. b.The proposal calls for upgrades to the Hazelwood and Gladstone stations while abandoning the stations on Londin Lane, Century Avenue and McMenemy Street in an effort to consolidate service for overall operational cost savings, while improving response times. c. This is consistent with the Comprehensive Plan by maintaining an effective and cost-efficient Public Safety services. 5.Park System Investments a.Proposes $7,181,290, including Prior Year investments into the Park System for upgrades and replacements. b.This is consistent with the Comprehensive Plan by maintaining an effective and quality Park and Open Space system. Recommendation It is recommended that the Planning Commission review the projects within the 2015-2019 Capital Improvement Plan and make a finding to the City Council that the 2015-2019 Capital Improvement Plan is consistent with the goals of the Comprehensive Plan. Note: EachCommission may have appointed a representative to deliver their recommendation on the CIP to the Planning Commission. The finding of Consistency with the Comprehensive th Plan needs to delivered the City Council on September 8; a representative should deliver the PC recommendation that evening.
