A meeting of the Commissionwas held in the City Hall Council Chambers and was called to order
at 7:00p.m.by Chairperson Fischer.

Church Planned Unit Development, 2696 Hazelwood Street

commission.

ii.Director of Administration, First Evangelical Free Church, 2696 Hazelwood Street,
Maplewood, Nathan Greenwalt, addressed and answeredquestions of the commission.
Chairperson Fischer opened the public hearing.
Nobody addressed the commission for the public hearing.
Chairperson Fischer closed the public hearing.
Commissioner Desai moved to approvethe resolution amending the conditional use permit for
the First Evangelical Free Church, located at 2696 Hazelwood Street, to allow the expansion of
the gymnasium. (Deletions are crossed out and additions are underlined.)
1.All construction shall follow the plans that the city stamped July 24, 1995 with the building
addition shown on plans date-stamped subject to the following conditions:April 18, 2013.
City staff may approve minor changes.
a.All construction shall follow the site plan approved by the city and the school shall follow
the building and floor plans submitted to the city. The interim director of community
development may approve minor changes. The city council may approve major changes.
b.Dropping the two parking spaces along the south property line at the east end of the
parking lot.
2.The proposed gymnasium expansion shall begin in one year or this approval shall end.school
use on the property parking lot expansion construction must be started within one year after
the council approves this permit or the permit shall end. The council may extend this deadline
for one year.
3.The council shall review this permit revision in one year.
4.The school shall have no more than 500 students.
5.The property owner or manager shall sweep and restripe the parking lot before the school
occupies their space. This includes having the required handicapped parking spaces in the
parking area near the building entrance.The applicant shall comply with all requirements of
the engineer’s report dated May 9, 2013.
6.The applicant shall comply with all conditions of the assistant fire chief and building official.
The school, the church, the fire marshal and the city building official shall agree on a plan for
the school and church to make any necessary or required life safety and building
improvements to the building. This plan shall incude the installation and maintenance of:
a.The required fire protection (sprinkler) systems.
b.An early warning fire protection system (smoke detection and monitoring).
c.Additional emergency lights and exit signs (if necessary).
d.Updated doors and hardware (if necessary).
e.Updated doors and hardware (if necessary).
f.A proper address on the building.
g.Any other changes the fire marshal or the building official deem necessary.

conditional use permit revision for the Tubman Center East. Commissioner Bierbaum was
scheduled to attend but staff presentedthe item which passed ayes all.
b.Commission representation for the June 10, 2013, city council meeting. Commissioner
Kempe is scheduled to attend. The item scheduled for review is the conditional use permit
revision for the First Evangelical Free Church.

Consideration of Commercial vs. Residential Land Use and
SUBJECT:
Zoning for Van Dyke Street Properties
DATE:May 28,2013
INTRODUCTION
The city is selling the property shown on the attached map. This property has135.38
feet of frontage and 296.68feetof lot depthfor anarea of .92square feet. It is currently
zoned R1 (single dwelling residential) and guided LDR (low density residential)in the
comprehensive plan.This parcel could be developed with onesingle dwelling home, but
does not have enough lot width for two dwellings, unless a variance is approved.Code
requires a minimum of 75 feet of lot width to be a buildable site.
Also to be considered is the abutting single dwelling parcel to the southat 2260 Van
Dyke Street. This property is for sale and being sold with the anticipation for commercial
development by that property owner. This lotis the same size as the city-owned parcel.
Request
Staff would like the planning commission to comment on whether they feel single
dwelling development is the best use for thesepropertiesor should the city consider
revising the land use plan and zoning map for both to commercial.
The city has received inquiries about ourproperty and all have been for commercial
purposes. If the planning commission feels that commercial development is appropriate,
staff would like theirguidance in order to proceed with development requests as we get
them.
If the planning commission supports commercial land use and zoningclassifications,
staff would likelythenpropose toreclassify and rezone theselotsto commercial. We
could then be ready for such development proposals. So far, examples ofthe types of
commercial uses that have been brought forth are: car wash, coffee shop, restaurant
and retail. There have been no formal requests made to develop either parcel.
DISCUSSION
Factors that may affect development on theselotsare:
Building setbacks for commercial development:
When acommercial lot abuts
residential property, city code requires a commercial building to be set back 50to
100 feetfrom abutting residential land.Theincrease to 100 feet is required if the
side of the building facing a residential lot line exceeds 3000 square feet.
The street to the north, Cope Avenue, has not been vacated. This means that only
the normal 30-foot front setback requirement must be met on thatside. Likewise,
Lark Street, south of 2260 Van Dyke, has not been vacated, therefore, a commercial
building could be setback 30 feet from that right-of-way.
Parking setbacks for commercial development:
A commercial parking lot must
be at least 20 feet from abutting residential land.
Staff mentions these setbacks since they would affect the developable area of these
properties.
Combination of both properties:
Combining both parcels would create a more
developable property than each could be individually.
The city-owned parcel fronts on the roundabout intersection:
The city-owned
lot lies on the east side of the Van Dyke Street/Cope Avenue roundabout. Staff
doesn’t feel this constitutes an obstacleto development, but, some commercial
developers desire more visibility to their properties.
RECOMMENDATION
Give staff guidance as to whether the subject city-owned propertyand the parcel to the
south, 2260 Van Dyke Street, should remain guided and zoned for single dwelling
development or should they be reclassified as commercial.
