The reasons for this are: (1) an unanticipated $990 charge in 1980 from the Ramsey County Data Processing Consortium for an adjustment of 1979 billings (2) higher than anticipated costs of converting the City's payroll system from Tabulating Service Bureau to the consortium's payroll system (3) higher than anticipated billings for the accounting system data processing. Actj.On bJ CM;ncjl: MEMORANDUM TO City Manager FROM Finance Directors RE State Aid Transfers - Beam Avenue Projects DATE December 10, 1980 PROPOSAL ' It is proposed that $22,000 be transferred from the Street Construction State Aid Fund to the Special Assessment Fund to provide additional financing for legal costs of the Beam Avenue special assessment appeals. BACKGROUND The construction accounts within the Special Assessment Fund for the Beam Avenue improvements (Projects 70 -5 and 71 -15) were left open after the comple- tion of these projects to account for the legal costs of the special assessment appeals. These construction accounts currently have a deficit of $19,000 and additional expenditures anticipated through the end of this year will increase the deficit to about $22,000. As Beam Avenue is a state aid designated street, it would be appropriate to transfer money from the City's Street Construction State Aid Fund which currently has a cash balance of over $250,000. The special assessments being appealed for the Beam Avenue improvements are pledged toward the retirement of the five bond issues which financed the improvements. If any of the special assessments are revised due to legal action, property taxes will have to be increased to amortize the additional amounts needed over the terms of the bond issues which financed the projects. FIRE PROTECTION AGREEMENT CITY OF MAPLEWOOD RAMSEY COUNTY, MINNESOTA WHEREAS the City of Maplewood (hereinafter referred to as the "City" is authorized by taw to provide fire protection for all of the property in said City; and WHEREAS the Gladstone Fire Department (hereinafter referred to as the "Department ") is a volunteer fire department operating as a non - profit association under the law of the State of Minnesota; and WHEREAS said Department owns fire equipment, trucks, etc., for the purpose of fighting fires, which equipment is housed in its fire stations located at 1900 Clarence and 1530 E. County Road C in said City; NOW THEREFORE, the City and the Department, in consideration of the following provisions and covenants, do hereby enter into this agreement on the date hereunto subscribed: SECTION 1. The City agrees A. To engage the services of the Department to answer fire calls and fight fires within the City for the period beginning January 1, 1981 and ending January 1, 1982. B. To pay the Department for its services during the period here - inbefore specified A sum of One Hundred Ninety Five Thousand Two Hundred Sixty Four and No /100 ($195,264) Dollars in quarterly installments. Charges billed directly to the City by the City of St. Paul or County of Ramsey for radio services or other special services directly related to fire protection, if paid by the City, shall be deducted from the service fee herein provided. C. That the moneys to be paid by the City to the Maplewood Fire Relief Association will be paid in addition to the face amount of this agreement. D. City to provide one advanced life support Paramedic Unit, to be housed at each fire station and said vehicles to be equipped and maintained at City expense. SECTION 2. The Department agrees A. To answer all fire, emergency, emergency medical Paramedic assist requests, and related alarms of any nature or description directed to it by the public for assistance within the legal limits of the City as hereinafter specified. B. To aid any other department, volunteer or otherwise, within the limits of the City whenever it is called out for that purpose by the Chief or officer in charge of such other department. C. To fully and completely report all facts, information and data required by the City as specified on the form to be provided by the City for that purpose. Such form shall be subscribed by the Chief or other officer of the department who was in charge and present at the fire so reported. D. The Department is hereby specifically assigned to the following described area of the City and shall be primarily responsible for fire protection within said area, to -wit: ,I All that portion of the City lying West of Highway N,61, North of County Road C and North of a line described as follows: commencing at the intersection of the extended line of Larpen- teur Avenue and Highway N61; thence East along the center line of Larpenteur to McKnight Road; thence North along the center line of McKnight Road to Holloway Street; thence East along the boundary line of the City to Century Avenue. The Department also agrees to answer fire calls in other parts of the City , as provided in Section 2.8. hereof. SECTION 3. A. The City assumes no responsibility for any acts of the Department, nor for any injuries or losses to members or to the equipment or trucks of the Department; the Department hereby agrees to keen its men, equipment and trucks properly covered by insurance at no expense to the City so as to protect the Department, its members and third persons for any loss by reason of negligence or misconduct on the part of the Department or its members. B. Nothing in this contract shall be construed so as to obligate the City for operation, maintenance, repair or replacement of any equipment or trucks of the Department. C. It is agreed by both parties to this agreement that at the time the City acquires fire equipment of its own, either through purchase or otherwise, so that the City will be operating a City fire department as defined by Minnesota Statutes, this agreement may be terminated one year from date of termination notice. It is further understood that this contract shall be renegotiated each year at least thirty (30) days prior to the date of its expiration. D. Nothing in this agreement shall prevent the Department from entering into contracts with other municipalities or governmental units located outside of the City to provide fire protection services for a fee or other compensation during the term of this agreement. Nothing in this agreement shall prevent the Department from entering into contracts with any person, firm or corporation to provide, for fee or compensation, extraordinary services within the limits of the City, such as contractual stand -by services at the scene of any hazardous activity, fire fighting demonstrations and other similar activities, it being understood that such extraordinary services shall not in any way limit the obligation of the Department to answer fire calls, emergency calls and related alarms of any nature and description directed to it by the public for assistance within the legal limits of the City. The Contractor's adjusted price of $1.70 per cubic yard for subgrade excavation is in line with the bid unit price of the other bidders on this project. Other revisions included in this amendment are the addition of excavation and backfill for new water service installation by others and the deletion of all wet tap watermain connections. Odegard, Director of Community Services Date: December 11, 1980 Subject: Gas Fired Boiler For Heritage Center - 2005 Edgerton I have contacted four plumbing and heating contractors regarding the installation of a new gas fired boiler for the Heritage Center and removal of the present oil fired boiler. There has been concern that the present oil fired furnace is costly, not only due to the increase in cost of oil but also in repairs. Each of the contractors inspected and measured the house and made their recommendations. As was to be expected, each came with his own suggestions and costs for installation of a new unit. After consult - ing with Northern States Power regarding sizing of unit, I feel that the gas fired boiler recommended by Maplewood Plumbing & Heating would adequately supply the house with heat. Maplewood Plumbing & Heating of 1690 English Street, Maplewood, has estimated that the cost of a new furnace, electrical hookups, expansion tank, addition of a radiator in a bedroom upstairs, removal of the old boiler and tank, etc. will be $2,145.00. If a chimney liner is needed, an additional $443.00 will be charged. (The other three bidders indi- cated that they felt a new liner was needed) Funds for this project are available through the Park Maintenance Build- ing Improvement (143 -4730) which has a present balance of $3,377.00. It is my understanding that $1,945.00 was carried over from the 1979 budget for the new furnace and that an additional $1,500.00 was included for the installation of electricity in the Heritage barn. I discussed with the Park and Recreation Commission the appointment procedures that they have been following in the past. They prefer to interview new appointments and also to review re- appointments before recommending them to the City Council for consideration. It is my opinion that they have a healthy attitude regarding re- appointments in that they are willing to look at their fellow members and the con- tribution that they are making to the Park and Recreation Commission. I concur with the Commission's motion that Bernard Grover - 1725 East Laurie Road, Marvin Mahre - 2095 Prosperity Avenue, and John Chegwyn 1631 E. Sextant all be re- appointed for three year terms. It is my feeling that all three men understand community needs and reflect the best interests of the people in Maplewood. They all make meaningful contributions to the Commission and provide knowledge, stability, and experience. Their attendance at Commission meetings is excellent. Site Description Location: See enclosed Maps Lot Size: A rectangular shaped, 4.6 acre lot of approximately 1065 feet long and 100 feet deep. Existing Land Use: Undeveloped with a 230 foot NSP easement over the northerly 300 feet. Proposal Creation of three.parcels, none of which would have frontage on a dedicated and maintained public street. Parcel A (see property linemap) is the only parcel of the three, presently being proposed for development. It would contain 13,500 square feet with 150 feet of frontage. Surrounding Land Uses North: An undeveloped, land locked parcel, zoned F, Farm Residence and planned for RL, Residential Low Density. East: An undeveloped 29 acre parcel, zoned and planned for residential use South: An undeveloped 40 acre parcel. A preliminary plat .proposal(Voyvera Lakeside) is presently being considered for this property. The plat proposes a southerly extension of Carey Heights Drive, eventually connecting with Beam Avenue. West: An unimproved private roadway (Carey Heights Drive). Across the roadway, a single family dwelling and undeveloped land, zoned and planned for residential use. Past Actions 1. June 1964: The Village Council approved a preliminary plat for this area. 2. 8- 13 -64: A second preliminary plat was approved by the Council. Council also approved a building permit for Mr. Carey at 1174 County Road D. (See enclosed map) subject to an agreement between himself and the Village that he will not request any Village maintenance on his private driveway, nor will he object to the construction of, and assessment for, a standard Village street in the future. 3. 10- 21 -66: A building permit was issued to Richard Barrett at 1176 E. County Road D. (See enclosed map). 4. 11 -9 -66: Richard Barrett Signed an agreement waiving his right to a Village street or maintenance of the private drive to his property, Further agreeing to construct and maintain a private drive to his property, 5. 11- 10 -66: The Village Engineer reported to the Council that the private drive did not meet Village Street standards and was not constructed to approved plans. Council authorized a building permit to be issued to Mr. Barrett subject to: Mr, Barrett complying with the conditions in the Engineer's report, 6. 11- 17 -66: The Planning Commission recommended approval of a preliminary plat for Richard Barrett consisting of four lots on the west side of Carey Heights Drive and the half streets required by Council action of 11- 10 -66. 7. 11- 17 -66: Council approved a preliminary plat for the Carey Addition. This plat comprised of only a portion of the Carey property including right -of -way for Carey Heights Drive, Woodlyn Avenue and Lydia Avenue. 8. 4 -4 -77: The Planning Commission recommended that the Council table consideration of variances requested by Mr. Novak (build on a substandard lot, without frontage to a dedicated public street) to allow the Applicant an opportunity to pursue the matter of dedication of the right -of -way (Carey Heights Drive) and pursual of a variance to standards of street and utility construction. 9. 9 -1 -77: Mr, Carey petitioned the City to improve Carey Heights Drive from County Road D, southward approximately 1500 feet, 10. 9- 28 -77: Council ordered a feasibility study for the improvement of Carey Heights Drive, f E 11. 1- 26 -78: Council approved a lot area variance, but denied two street access variances as requested by Mr. Richard Novak, based on the following findings: 1. The street access variances do not meet the "spirit and intent" of the ordinance. y 2. A precedent would be set for similar lots in other areas of the City. 3. There may be times of the year when emergency services could not gain access to the property. 4. There is no hardship that is "unique to the individual property under consideration ". 12. 4- 20 -78: Staff recommended that the Council declare the Carey Heights Drive improvement project not feasible and proceed no further with the project. Council tabled consideration to allow Mr. Carey "to contact his own source in regard to providing utilities on Carey Heights Drive ". Planning 1. Land Use Designation: RL- Residential Low Density 2. Zoning: F -Farm Residential 3. Code considerations: a. Section 1005.010(5) states that all lots shall abut on a publicly dedicated street. b. Section 501.020 states that, "No building permits will be issued for any construction within the Village unless the building site is located adjacent to an existing street which is dedicated and maintained as a Village street, or unless provision for street construction has been made in full compliance with this code and in no case until grading work as provided herein has been completed and certified to the clerk by the Village Engineer; except that in isolated instances the Council may enter an agreement with a property owner for special handling of an unusual situation which agreement shall be re- corded so as to run with the land affected ". c. Section 912.040 states that, "No building shall hereafter be erected or altered unless there is direct access to it from a street or highway through an open space at least as wide as the dwelling and on the same lot ". 4. Statutory Considerations: Section 462.357, Subdivision 6 (2) of the Minnesota State Statutes states that the Board of Appeals and Adjustments has the power to "hear requests for variances from the literal provisions of the ordinance in instances where their strict enforcement would cause undue hardship because of circumstances dnique to the individual property under consideration, and to grant such variances only when it is demonstrated that such actions will be in keeping with the psirit and intent of the ordinance ". 3 Public Works 1. There are no utilities presently installed in Carey Heights Drive, the residences maintain on -site well and septic tank systems. 2. Council ordered a feasibili study for street and utilities on .&eptember 28, 1977. The Study showed that the project would be cost - prohibitive. 3. There is a steep grade in Carey Heights Drive from County Road D to the Applicant's lot that may make it difficult for emergency vehicles to climb during the winter or after a hard rain. Public Safety Each time another residence is built on this street, it makes it more difficult to deliver emergency services. Some of the reasons are: 1. address confusion 2. dirt road surface subject to wash out and soft spots 3. no scheduled snow removal 4. no fire hydrant availability 5. limited access, due to steep unimproved roadway Park and Recreation The Brauer and Associates Park and Open Space Study calls for a City park in the vicinity of the Applicant's south property line. Parks Commission has recommended approval of the Comprehensive Plan update which no longer recommends a park in this vicinity. Analysis Approval of the requested variances would be inconsistent with the "spirit and intent" of the Zoning Code. Approval would also set a precedent that would allow the develop- ment of the remainder of property along Carey Heights Drive as well as the development of other properties with similar circumstances throughout the City. The intent of the Ordinance is to assure public as well as private access to each home in the City. Without a public street, there may be times of the year when emergency public safety services could not be provided, such as police, fire and ambulance, due to a lack of snow plowing or an unstable road surface. This could open the City up to potential law suits. The two existing homes at the south end of Carey Heights Drive are examples of the kind of situation that the City should not allow to happen. It is 1150 feet from County Road D to Mr. Carey's house over a dirt road. Access to_ these houses in the winter or when the ground is soft after hard rains would be very difficult. The only water for fighting a fire must be delivered by tank truck. Once the tank truck is in, it only takes one other vehicle behind it to block the access out for more water. Both houses could easily be lost. A more tragic situation could occur if an ambulance could not get access. 4 Approval of these variances would set legal precedents that may obligate the Council to approve similar requests throughout the City. In other words, approval may well have the effect of lowering of the City's development standards. Recommendation Denial of the three public street access variances, on'the basis that: 1. The street access variances do not meet the "spirit and intent" of the ordinance. 2. A precedent would be set for similar lots in other areas of the City. 3. There are times of the year when emergency service access to the property would be difficult, if not impossible. 4. Mr. Rupert indicated that he believed the proposed site would front on Carey Heights Drive, but he was unsure of the location of the proposed lot. Without specifics regarding lot size or location, I indicated that I could only give out general information. As a matter of general policy, I always attempt to give perspective applicants as much preliminary information and feedback as possible regarding their requests. Any initial reaction to a proposal is, however, always tempered by a statement that I cannot be sure of the fate of any proposal until at least an application is submitted and the files are subsequently researched. My response to Mr. Rupert's inquiry was no exception. Unfortunately, at the time of Mr. Rupert's inquiry I was unaware that Carey Heights Drive is a private road, rather than a public street. My intial reaction to Mr. Rupert's request was that as long as the lot would meet minimum area and width requirements and have frontage on a public street, his request would probably be approved. Before he left I indicated that the processing time for a lot split, together with an application for a building permit is typically two to three weeks. I recommended that he:come back to see me once he had a legal description of the proposed site. Within the week, Mr. Carey showed me a survey of the property that he proposed to sell to Mr. Rupert. While Mr. Carey was in my office, I checked with the Engineering Staff is to the availability of water and sewer to the proposed site. At that time I learned that Carey Heights Drive is a private drive. As such, I informed Mr. Carey that an access variance would have to be approved by the City Council before a lot division could be approved. It was indicated that the pro- cessing of a variance typically can take six to eight weeks. Lot division and variance applications were given to Mr. Carey. On November 3, 1980, Mr. Carey made application for the required iccess variances, on behalf of Mr. Rupert. Mr. Rupert had signed the variance application on October 24, 1980. Analysis Mr. Rupert was made aware of the Code requirements for approval of a lot division. He chose to ignore Staff's suggestion - to further discuss the potential of his proposal once a legal description of the site had been obtained. Mr.Rupert was also made aware that until an application is received, staff does not devote time to the detailed analysis of proposals. In the face of this pol -icy, he chose to disregard the necessity for making application and receiving formal City approval of the proposed lot division, before committing to the sale of his home. In so doing, the burden of making sure that the proposed lot division would meet all Code requirements shifted from Staff to Mr. Rupert. Recommendation Denial of the requested access variances for the reasons outlined in the Staff report. Commissioner Fischer asked why it was determined not feasible to construct the street. Secretary Olson said he thought it was because there is a steep incline from County Road D going south on Carey Heights Drive, would require a lot of grading work to get the street to an acceptable grade. Talmadge Carey, owner of the property, said it was suggested to have access through to Beam Avenue rather than County Road D. A turn around would then have to be provided at the north end of Carey Heights Drive. Aaron Rupert, applicant, said he wished to review the events as to what happened with this application. He felt he has a hardship as he did receive information from the City that he could get a building permit for construction of a home on Mr. Carey's property. Therefore, he has sold his present home and wishes to construct a new home on the subject property. Commissioner Fischer asked if the proposed plat of the property to the south, owned by Voya Piletich, has street alignment connecting to Carey Heights. Secretary Olson said yes. Mr. Carey said he had informed Mr. Ruppert originally that he would not sell him property because he did not think the Council would issue a permit for the property. After Mr. Ruppert came back with the information he stated earlier, then he agreed to sell the property for development. He said they do provide maintenance of the roadway and snow removal. The County Engineer did design, grade and stake out the roadway. Chairman Prew asked if Secretary Olson was aware if Staff had given information to Mr. Rupert that he could build a home on the property. Secretary Olson said he was not aware of this information being given to the applicant. However, Mr. Carey did inform Mr. Rupert that he had to go to the Planning Commission. Chairman Prew said he thought this was a matter for the .City Council to resolve. The Planning issues are a matter of history, a� Mr. Carey is aware there has been a problem through the years, most recently the request for variances in 1978. Commissioner Fischer said she would like information from the Staff as to what was told to the applicant when he asked for information on the lot. However, if misinformation was given, this could then be a unique hardship case and it could have an effect on her vote. Commissioner Pellish said he thought the function of the Planning Commission was to review the documents presented to them with the guidance of the Comprehensive Plan and Zoning Ordinances and arrive a ir a decision. What staff may or may not say to an applicant should not havd an influence -on the Planning Commission. Commissioner Kishel asked if Carey Heights Drive was a dedicated right -of -way. Secretary Olson said no, it is private property. Commissioner Sletten asked if another feasibility study could be done on the roadway. Chairman Prew said that is something that would have to be petitioned for and scheduled through the City Council. Commissioner Pellish moved the Planning Commission recommend to the Board of Adjustments and Appeals denial of the applicant's request for the following variances: 1. Create lots which would not abut a publicly dedicated street. 2. Develop a lot which is not located adjacent to a dedicated and maintained City street. 3. Develop a lot which would not have direct access to it from a street or highway through an open space at least.as wide as the dwelling on the same lot. Denial is recommended, based upon the following findings: 1. The street access variances do not meet the spirit and intent of the ordinance. 2. A precedent would be set for similar lots in other areas of the City. 3. There are times of the year when emergency service access to the property would be difficult, if not impossible. Analysis Staff does not see much of a difference between this proposal and a sign plan review for a multi- tenant shopping center. In both cases we are dealing with multi -use buildings. Also, the size of the building, being over 250 feet long, lends itself to the use of additional signs without looking cluttered. The owner of the property has not signed the application since he is away on vacation. Staff feels that Mr. Hall's approval should also be obtained. Therefore, the City should only issue temporary sign permits requiring the signs to be removed within a specific time period, unless the owner indicates his approval of the signs in writing. Recommendation Approval of the sign variance for the Maplewood Bowl for the proposed mansard letters based on the finding that permitting these signs will be no different than permitting individual tenant signs for a multi- tenant commercial center. 3 E Approval is subject to: 1. Site Description The subject right -of -way is 165 feet long and 60 feet wide. It is unimproved, with a steep incline down to Sylvan'Street over the westerly 40 feet. Proposal Combine the north half of the right -of -way with the adjacent substandard lot to create a 78 X 165 foot residential lot, Surrounding Land Uses North: A vacant, substandard 48 foot wide lot, zoned and planned for single family use. East: An improved portion of the Kingston Street right -of -way bounded by single family dwellings. South: A single family dwelling. West: Sylvan Street. Across Sylvan Street, a vacated portion of the Kingston Street right -of -way, bounded by property owned by the City of St. Paul and planned for open space, presently referred to as "Water Works Park ". Sylvan Street, although graveled in this vicinity is a maintained public street. Past Actions 7- 21 -77: Council denied a request to vacate the right -of -way on the grounds that: 1. It serves as the only public walkway between the neighborhood to the east and the undeveloped "Water Works Park" located to the west of Sylvan Street. 2. Lack of adequate area for a cul -de -sac. 3.. Above ground utility poles are located on the north right -of -way line. 4. The City maintains a sanitary sewer line along the right -of -way center line. 1 o 12 -7 -78: Council vacated Kingston Avenue, west of Sylvan Street, subject to retention of an easement for a future storm sewer. Planning 1. Chapter 412.851 of the Minnesota State Statutes States: 'The Council may by resolution vacate any street, alley, public grounds, public -way, or any part thereof, on its own motion or on petition of a majority of the owners of land abutting on the street, alley, public grounds, public way, or part thereof to be vacated. No such vacation shall be made unless it appears in the interest of the public to do so after a hearing preceded by two weeks' published and posted notice ". Public Works 1. Sanitary sewer is located in the right -of -way. 2. No water service is available. 3. No public need exists to develop the subject right -of -way for a street. 4. Development of the right -of -way would be cost - prohibitive, due to a steep incline and the inability to assess the cost to adjacent properties. These properties presently gain access from an alley and Sylvan Street. 5. NSP maintains an above ground line along the right -of -way. 6. The easterly 30 feet of right -of -way should be retained to provide for a paved turn around. It would be limited in width to the existing 60 feet of right - of -way. 7. Storm sewer is planned for the right -of -way. An alignment has not been determined. Parks and Recreati "Water Works Park ", presently undeveloped, is located west of Sylvan Street the only pedestrian access to the park from the east, short of Larpenteur Avenue, is the right -of -way. If the right -of -way is vacated, a walkway easement should be retained. To allow enough room for a walkway to traverse the steep incline, the easement should be over the entire 60 foot right -of -way. Other Agencies NSP has no objection to the requested vacation, provided the north 10 feet of the right -of -way is retained as a utility easement. Analysis Council should reconsider their previous decision to deny a vacation of this right - of -way. The principal reasons for denial were based upon the desire to protect the City's utility and potential pedestrian walkway interests. The City need not retain the right -of -way to achieve these objectives. Vacation, subject to. he dedication of necessary easements, is a more desirable alternative for the reason - outlined below. Since the street is not in the public interest to develop, the presAce of a right - of -why unnecessarily restricts development of the adjacent properties i.e., the requirement for a 30 foot setback from a right -of -way and adherence to corner lot standards for lot width. If the right -of -way were to be vacated, the applicant's substandard lot would increase in width and area, exceeding minimum lot standards for single family development. Secondly, poor maintenance of this undeveloped right -of -way is a concern of area property owners. If the right -of -way were to be vacated, maintenance responsibility would become a private concern,, rather than a responsibility of the public, as at present. In lieu of vacation of the right -of -way, the applicant could also be permitted to build on the lot, if variances were to be granted for setback, lot area, and width standards. This would not, however, resolve the maintenance problem. Approval of variance is also a more complicated approach to achieve the same objectives. Instead of proving a lack of public need for a street, the applicant would have to prove a hardship and circumstances unique to her property. Recommendation Staff recommends, that the Kingston Street point 134.9 feet easterly, be vacated for public such uses as, but not limited to, p a pedestrian walkway, and snow storage. .Approval is recommended on the basis that: right -of -way, from Sylvan Street to a street purposes only, reserving unto the ower lines, sanitary and storm sewer., 1. It is cost prohibitive to construct and assess a street on the subject right -of- way. It is in the public interest to vacate the subject right -of -way. There is no question that inflation is hurting all employees, therefore to minimize its effect, plus that of increased social security, and for salaried employees a division of their yearly salary by 27 rather than 26 (something which occurs on bi- weekly pay periods every 7 or 8 years), I would like to recommend an initial increase of 4.5% on the base only of 1980 salaries and wages for all city employees effective January 1, 1981. It should be clearly understood that my recommendations specifies this as an initial increase which would be absorbed as part of any final union settlement or final disposition for non -union employees. For example, if a union settlement provided for an 8.5% increase for 1981 and the settlement was signed March 1, with increases retroactive to January 1, then these employees would have a 4% retroactive payment coming since they would have already received 4.5%.
