MEMORANDUM TO: City Manager t FROM: Director of Public Works DATE: August 12, 1 SUBJECT: ACORN GREENHOUSE PROPERTY This item was tabled so the developer could investigate alternative sanitary sewer systems and information could be gathered at the Council's request. The developer discussed the possibility of a gravity system dis- charging north on McKnight Road with the staff. This alternative seemed reasonable at first glance. Upon further investigation a capacity limitation on Larpenteur Avenue was identified in the old 1972 comprehensive sewer plan. The area planned to discharge through this part of the system would have completely filled the pipe when fully developed. The new Comprehensive Land Use Plan presently being reviewed for approval recommends lowering the density for the area under con- sideration. If the Comprehensive Plan is adopted as proposed, the addition of the Acorn Greenhouse's flow to the sewer system will not create a capacity deficiency. Approval of the PUD and preliminary plat is recommended with the following conditions: 1. Designate the common land around the quads as outlot B. The quad association's by -laws and declaration must be approved by the City Attorney to assure maintenance of the property. 2. Designate the stub street south of Montana Avenue as Currie Street. 3. The 10 foot utility easements adjacent to the public rights - of -way serve no purpose and should be omitted. 4. An additional 16.5 feet of right -of -way for McKnight Road should be provided in addition to that shown on the plat. 5. A blanket public easement over Outlot B should be provided for utility and drainage installation and maintenance. 6. Approval of the final grading, drainage and utility plans by the Director of Public Works. 7. Provision of a signed developer's agreement within one year for the construction of proposed public improvements which shall include a gravity sanitary sewer serving the development. y 8. The first building permit must be applied for within two years. 9. Acquisition of all off -site easements required for installation of utilities shall be the sole responsibility of the developer.
