CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the council Chambers, Municipal Building, and was called to order at 7:02 P.M., by Mayor Greavu. B. Meeting No. 88 -6 (March 28, 1988) Councilmember Anderson moved that the Minutes of Meeting No. 88 -6 (March 28, 1988) be approved as submitted. Seconded by Councilmember Rossbach. Ayes - all. D. Mayor Greavu convened the meeting for a public hearing regarding the proposal to construct water main, service connections, storm sewer, street with curb and gutter and related work on Geranium Avenue from Ferndale Street to Century Avenue and on Ferndale Street from Maryland Avenue to Stillwater Road. b. City Engineer Ken Haider presented the Staff report. c. Commissioner Bob Cardinal presented the Planning Commission recommenda- tion. d. Mayor Greavu called for persons who wished to be heard for or against the proposal. Mayor Greavu convened the meeting for a public hearing regarding the pro- posal to construct sanitary sewer, storm sewer, water main, service connec- tions, street with curb and gutter and associated work on Boxwood Avenue from McKnight Road to Dorland Road, City Project 87 -19. - 2 - 4/11 b. Mayor Greavu introduced the followings. resolution and moved its adoption: WHEREAS, the City Engineer for the City of Maplewood has been authorized and directed to prepare a report with reference to the im- provement of Boxwood Avenue from McKnight Road to Dorland Road, City Project 87 -19, by construction of sanitary sewer, storm sewer, water main, service connections, street with curb and gutter, and associated work, and WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer proposed improvement on Boxwood Dorland Road by construction of water main, service connections and associated work is feasible proposed, is hereby received. advising this Council that the Avenue from McKnight Road to sanitary sewer, storm sewer, street and curb and gutter, and should best be made as 2. The Council will consider the aforesaid improvement in accor- dance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to MSA Chapter 429, at an estimated total cost of the improvement of $248,020. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the eleventh day of April, 1988, at 7:10 P.M. to consider said improvement. The City Clerk shall give mailed and published notice of said hearing and improvement as required by law. Seconded by Councilmember Juker. Mayor Greavu convened the meeting for a public hearing regarding an alternative to the proposed public improvement project described in the Ski Jump Property Drainage Improvements, City Project 87 -21, for con- struction of storm sewers, ponding area, pumping station, force main, access road, and appurtenances. b. Manager McGuire presented the Staff report. c. City Engineer Haider presented the specifics of the proposal. d. Commissioner Bob Cardinal presented the Planning Commission recommenda- tion. e. Mayor Greavu called for persons who wished to be heard for or against the proposal. The following were heard: Mr. John Daubney, attorney representing the developer, Mr. Bredahl. Plan Amendment (4 Votes) b. Rezoning (4 Votes) c. Conditional Use Permit 1. Mayor Greavu convened the meeting for a public hearing regarding improvements to the H.C.O. building and property located at 2228 Maplewood Drive. 2. Manager McGuire, presented the Staff report. Mayor Greavu recessed the meeting at 8:55 P.M. Mayor Greavu reconvened the meeting at 9:00 P.M. 3. Geoff Olson, Director of Community Development, presented the specifics of the proposal. 4. Commissioner Bob Cardinal presented the Planning Commission Recom- mendation. 5. Mayor Greavu called for persons who wished to be heard for or against the proposal. Mayor Greavu introduced the foll adoption: (Plan Amendment - 4 Votes WHEREAS, Hoffman Corner Oil initiated an amendment to the Maple- wood Comprehensive Plan from RM, medium density residential to SC, service Commercial for the property at the northeasterly corner of Highway 61 and County Road B. This property is more commonly described as 2228 Maplewood Drive. WHEREAS, the procedural history of this plan amendment is as follows: 1. The Maplewood Planning Commission held a public hearing on March 21, 1988, to consider this plan amendment. Notice thereof was published and mailed pursuant to law. All per - sons present at :said hearing were given an opportunity to be heard and present written statements. The Planning Com- mission recommefided to the City Council that said plan amendment be approved. 2. The Maplewood City Council considered said plan amendment on April 11, 1988. The Council considered reports and recom- mendations from the Planning Commission and City Staff. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the above - described plan amendment be approved on the basis of the following findings of fact: 1. The SC classification is compatible with the existing land use and an appropriate classification for highway frontage property. 2. It is not likely or practical to expect the demolition of this building for the construction of a double dwelling which is what could be built under the current land use plan designation. 3. This lot has been in commercial use since the 1940s. 4. The proposed improvements would improve the appearance and traffic safety at this corner. Seconded by Councilmember Rossbach. Ayes - all. - 5 - 4/11 8. Councilmember Anderson introduced the following resolution and moved its adoption: (Rezoning - 4 Votes) WHEREAS, Hoffman Corner Oil initiated a rezoning from F, farm residential to M -1, light manufacturing for the following - described property: S 100 ft. of part of SE 1/4 of SW 1/4 ELY of STH 61/1 and N of Co. Rd. B in Sec. 9, Tn. 29, Rge. 22; This property is also known as 2228 Maplewood Drive, Maplewood; WHEREAS, the procedural history of this rezoing is as follows: 1. This rezoning was initiated by Hoffman Corner Oil, pursuant to Chapter 36, Article VII of the Maplewood Code of Ordi- nances. 2. This rezoning was reviewed by the Maplewood Planning Commis- sion on March 21, 1988. The Planning Commission recommended to the City Council that said rezoning be approved. 3. The Maplewood City Council held a public hearing on April 11, 1988, to consider this rezoning. Notice thereof was pub- lished and mailed pursuant to law. All persons present at said hearing were given an opportunity to be heard and present written statements. The council also considered reports and recommendations of the City Staff and Planning Commission. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the above - described rezoning be approved on the basis of the following findings of fact: 1. The proposed change is consistent with the spirit, purpose and intent of the zoning code. 2. The proposed change will not substantially injure or detract from the use of neighboring property or from the character of the neighborhood, and that the use of the property adjacent to the area included in the proposed change or plan is ade- quately safeguarded. 3. The proposed change will serve the best interests and con- veniences of the community, where applicable, and the public welfare. 4. The proposed change would have no negative effect upon the logical, efficient, and economical extension of public ser- vices and facilities, such as public water, sewers, police and fire protection and schools. Councilmember Juker introduced the following resolution and moved its adoption: (Conditional Use Permit) 88 -4 -51 WHEREAS, Hoffman Corner Oil initiated a conditional use permit to construct a canopy addition within 350 feet of a residential district at the following- described property: S 100 ft. of part of SE 1/4 of SW 1/4 ELY of STH 61/1 and N of Co. Rd. B in Sec. 9, Tn. 29, Rge. 22; This property is also known as 2228 Maplewood Drive, Maplewood; WHEREAS, the procedural history of this conditional use permit is as follows: 1. This conditional use permit was reviewed by the Maplewood Planning Commission on March 21, 1988. The Planning Com- mission recommended to the City Council that said permit be approved. 2. The Maplewood City Council held a public hearing on April 11, 1988. Notice thereof was published and mailed pursuant to law. All persons present at said hearing were given an oppor- tunity to be heard and present written statements. The Council also considered reports and recommendations of the City Staff and Planning Commission. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL THAT the above - described conditional use permit be approved on the basis of the following findings -of -fact: 1. The use is in conformity with the City's Comprehensive Plan and with the purpose and standards of this chapter. 2. The establishment or maintenance of the use would not be detrimental to the public health, safety or general welfare. 3. The use would be located,_designed, maintained and operated to be compatible with the character of that zoning district. 4. The use would not depreciate property values. 5. The use would not be hazardous, detrimental or disturbing to present and potential surrounding land uses, due to the noises, glare, smoke, dust, odor, fumes, water pollution, water run -off, vibration, general unsightliness, electrical interference or other nuisances. 6. The use would generate only minimal vehicular traffic on local streets and shall not create traffic congestion, unsafe access or parking needs that will cause undue burden to the area properties. 7. The use would be serviced by essential public services, such as streets, police, fire protection, utilities, schools and - 7 - 4/11 parks. 8. The use would not create excessive additional requirements at public cost for public facilities and services; and would not be detrimental to the welfare of the City. 9. The use would preserve and incorporate the site's natural and scenic features into the development design. 10. The use would cause minimal adverse environmental effects. Approval is subject to the following conditions: 1. Adherence to the site plan presented at the April 11, 1988 Council meeting, unless a change is approved by the City's Community Design Review Board. A copy of this plan shall be filed with the Community Development Department. 2. The site shall be kept free of rubble, junk, junk cars and parts, and debris. Non -paved areas shall be kept mowed and planted with grass, including boulevards. 3. There shall be no light or glare onto the home to the east. 4. Any sound from exterior speakers shall not be audible at the easterly property line. 5. There shall be no gas deliveries before 7:00 A.M. or after 10:00 P.M. 6. Construction of an eight- foot -high fence along the east side of the site. 7. Hours of operation shall be from 6:00 A.M. to 11:00 P.M. Seconded by Councilmember Anderson. Code Amendment: R -2 Lot Width (2nd Reading - 4 Votes) a. Manager McGuire presented the Staff report. b. Director of Community Development Geoff Olson presented the specifics of the proposal. c. Commissioner Bob Cardinal presented the Planning Commission's recommenda- tion. d. Mayor Greavu called for persons for or against the proposal. The following were heard: Richard Schrier, 2125 Desoto Carol Braaten, 2056 Bradley George Sater, 565 Skillman A petition signed by area residents was presented to Council by Mr. Sater. Bill McGuire, 2080 Bradley Susan Dickenson, 2130 Bradley Orgene Brosten, 2056 Bradley 2. Varience: Bradley (Desoto) a. Councilmember Rossback moved ine on 1. There is no hardship caused the applicant due to circumstances "unique to the property." 2. This variance is not unique to this lot. There are two other undeveloped R -2 lots with substandard widths of 84 and 75 feet in this neighborhood. Approval of a variance would set a prece- dent for approving double dwellings on these lots. 3. The property can be put to a reasonable use - a single dwelling. The three lots to the north are also zoned R -2. 4. The basis for the variance is primarily economic. 5. The lot was substandard before the applicant purchased it. - 9 - 4/11 Seconded by Councilmember Anderson 3. Noise Ordinance (2nd Reading) Ayes - Mayor Greavu, Councilmembers Anderson, Bastian and Rossbach Nay - Councilmember Juker. a. Manager McGuire presented the Staff report. b. Mayor Greavu introduced the following ordinance and moved its adoption: ORDINANCE NO. 623 AN ORDINANCE AMENDING THE MAPLEWOOD CODE PERTAINING TO NOISE PERMITS FOR CONSTRUCTION Section 1. Section 19 -50 is hereby amended as follows: Sec. 19 -50. Construction activities. No person shall engage in or permit construction activities involving the use of any kind of electric, diesel, or gas - powered machine or other power equipment except with a permit issued by the City Clerk after complying with requirements and fees set by the City Council, for purposes of noise control. The permit shall be issued at the same time as the building permit or permits required by the City for construction activities. If the person contests the requirements of the permit, then, and in that event, he or she shall have the right to appeal to the City Manager for final determination. Section 2. This ordinance shall take effect upon its passage and publication. Seconded by Councilmember Anderson. Ayes - all. I. NEW BUSINESS 1. Selection of Insurance Agents a. Manager McGuire presented the Staff report. b. Councilmember Rossbach moved that Ekblad, Pardee & Bewell, Inc. be selected as insurance agents and be assigned to the League Program. Seconded by Councilmember Juker. Ayes - all. 2. McKnight Road between Larpenteur Avenue and Holloway Avenue - Approval of Preliminary Plans. a. Manager McGuire presented the Staff report. b. City Engineer Haider explained the specifics of the proposal. c. Mayor Greavu introduced the following resolution and moved its adoptions: 88 -4 -52 WHEREAS, Ramsey County has prepared plans for reconstruction of McKnight Road within Maplewood from Larpenteur Avenue to Holloway Avenue. - 10 - 4/11 WHEREAS, the City Engineer has reviewed such plans and presents said plans to the Council for approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD, MINNESOTA: The preliminary plans for reconstruction of McKnight Road from Larpenteur Avenue to STH 36, State Project 68- 668 -25, City Project 87 -04, are approved. This approval is independent of proposed cooperative agreements for the construction of this project. Seconded by Councilmember Anderson. Ayes - all. d. Mayor Greavu introduced the following resolution and moved its adoption: 88 -5 -53 WHEREAS, the County has planned the improvement of McKnight Road (CSAH 68) from Larpenteur Avenue to T.H. 36; and WHEREAS, the County will be expending county state aid highway funds (S.P. 62- 668 -25) on the improvement of said street; and WHEREAS, said improvement does not conform to the approved minimum standards as previously adopted for such county state aid streets and that approval of the proposed construction as a county state aid street project must, therefore, be conditioned upon certain parking restric- tions; and WHEREAS, the extent of these restrictions, that would be a neces- sary prerequisite to the approval of this construction as a county state aid project in the City, has been determined. NOW, THEREFORE, IT IS HEREBY RESOLVED, that the City requests the County to restrict the parking of motor vehicles on both sides of McKnight Road from Larpenteur Avenue to Holloway Avenue. Seconded by Councilmember Anderson. Ayes - all. 3. Edgerton and Roselawn Trunk Storm Sewer City Project 85 -08 - Schedule Public Hearing. a. Manager McGuire presented the Staff report. b. City Engineer Haider explained the specifics of the proposal. c. Mayor Greavu introduced the following resolution and moved its adoption: 88 -4 -54 WHEREAS, the City Engineer for the City of Maplewood has been authorized and directed to prepare a report with reference to the improvement of the area roughly bounded by McMenemy Street, County Road B, DeSoto Street, Skillman Avenue, Arcade Street and Larpenteur Avenue by construction of trunk storm sewer, ponds, and pumped storm sewer outlet; City Project 85 -08, and - 11 - 4/11 WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer advising this Council that the proposed improvement of the area roughly bounded by McMenemy Street, County Road B, Desoto Street, Skillman Avenue, Arcade Street and Larpenteur Avenue by construction of trunk storm sewer, ponds, and pumped storm sewer outlet; City Project 85 -08 is feasible and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accor- dance with the report and the assessment of benefited property for all or a portion of the cost of the improvement according to MSA Chapter 429, at an estimated total cost of the improve- ment of $1,595,000.00. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the 16th of May, 1988, at 7:30 P.M. to consider said improvement. The City Clerk shall give mailed and published notice of said hearing and improvement as required by law. Seconded by Councilmember Juker. Mayor Greavu introduced the following resolution and moved its adoption: 88 -4 -55 WHEREAS, THE City Engineer for the City of Maplewood has been authorized and directed to prepare a report with reference to the im- provement of the drainage area roughly bounded by English Street, State Trunk Highway 36, White Bear Avenue and Ryan Avenue by construction of trunk storm sewer and miscellaneous drainage improvements, City Project 87 -32, and WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: - 12 - 4/11 R 1. The report of the City Engineer advising this Council that the proposed improvement on the drainage area roughly bounded by English Street, State Trunk Highway 36, White Bear Avenue and Ryan Avenue by construction of trunk storm sewer and mis- cellaneous drainage improvements, City Project 87 -32 is feasible and should best made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to MSA Chap- ter 429, at an estimated total cost of the improvement of $1,444,200. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the 16th of May, 1988, at 6:30 P.M. to consider said improvement. The City Clerk shall give mailed and published notice of said hearing and improvement as required by law. Seconded by Councilmember Anderson. Mr. Supan stated that busses and trucks are operating on Hazelwood Avenue. He inquired if road limits are being enforced. b. City Engineer Haider explained the load limit restrictions. c. Background Effective July 1, 1987, the deductible on all City insurance coverages was increased to $25,000 for each occurrence, with an annual aggregate of $50,000. If the annual aggregate is reached, then the deductible decreases to $1,000. Claims that count toward the deductible must be a minimum of $1,000. The high deductible reduced premiums by $41,082. Over the last few years, the average claims have been $14,972. Therefore, the net annual savings should average $26,110. Fireworks Damages Claims have been settled by our insurance adjustor for damages resulting from the City's July 4, 1987 fireworks display. The claims were from four individuals: one individual received burns and three others had damage done to their cars. Settlement of these claims has cost $10,086.07. The Parks and Recreation Director has indicated that smaller rockets will be used at all future firework displays to prevent similar damages in the future. Action Required Council approval of a budget transfer from the General Fund Contingency Account is needed to cover settlement of the fireworks damage claims. DFF /ch Agenda Number '? The Harvester Avenue Trunk Storm Sewer Outlet (City Project 87 -31) being considered in 1988 will not increase water levels on the Nature Center Pond at this time because no new drainage area will be added to the pond's watershed. However, after all of the storm sewer is completed in the area tributary to the Nature Center Pond, as shown In the City's Comprehensive Drainage Plan, the Pond level would be expected to fluctuate more frequently than under present conditions. This is not due to additional development within the tributary area, but rather the existing runoff will reach the pond faster through a storm sewer than it does flowing overland. In order to evaluate the fluctuation In the pond, we reviewed the topographic maps of the areas and reviewed the City's Comprehensive Drainage Plan. The contour maps indicate the pond runs out to the southwest at about elevation 999. The pond may also run out to the southeast through the cemetery, but this is not as well defined on the topographic maps. The Nature Center Pond is divided into a west pond and an east pond by a park trail. The west pond contains 1/4 to 1/3 of the available storage and the east pond contains the remainder. It is assumed that there is some type of equalizer culvert under the park trail because water levels appear to be the same in both ponds. The Comprehensive Drainage Plan shows that about 26 acre -feet of storage is required for the 100 -year storm. Available storage between the 999 and 1000 contours Is 21.8 acre -feet. Therefore, If the pond were at its runout elevation of 999 at the beginning of the 100 -year storm, the pond would rise to slightly above elevation 1000. The high level is temporary and the pond will recede to its runout elevation in a few days. 1, Mr. Bruce Irish March 30, 1988 Page Two We understand that there is a park shelter at about elevation 1002. Based upon our preliminary analysis, the park shelter is not in danger. However, we would recommend when major storm sewers on Harvester Avenue and Stillwater Road are constructed, that the pond outlet be maintained so that flow is not impeded, that the park trail between the two ponds be raised slightly, and the equalizer capacity be checked to make sure that both ponds can be fully utilized for storage. BACKGROUND On April 27, 1987, the city council received a petition dated March 4 1987, requesting the installation of water main along Meyer Street between Bush Avenue and Minnehaha Avenue. Preparation of the feasibility study was ordered by the city council in October 1987, in response to a petition received from Metropolitan Imported Autos, Inc. It is requested that the city council adopt the attached resolution which schedules a public hearing for this project. BACKGROUND The feasibility study is divided into two phases. Phase I concerns extension of a dead end 12 -inch diameter water main north to Metropolitan Imported Autos from the existing tee at Kohlman Avenue. The consulting engineer was requested to evaluate the feasibility of completing the loop between Kohlman Avenue and Beam Avenue under Phase II of the feasibility study. The construction of a 12 -inch diameter main between Kohlman Avenue and Beam Avenue, in addition to trunk =water mains on Beam Avenue extended from Hazelwood Avenue and on Kohlman Lane extended from County Road C, is part of the recommendations of Maplewood Water System- -Water Service From St. Paul to provide service to the area west of Highway 61 and north of Beam Avenue. It is extremely unlikely that construction of a water main along Kohlman Lane extended from County Road C would ever be economically feasible. Therefore, the looping of the water main on Highway 61 is the only practical method to provide a redundant source of supply to the area north of Beam Avenue and west of Highway 61. This loop was also analyzed in terms of strengthening fire flow capacities. It is recommended that both Phase I and II be ordered which has a total estimated project cost of $213,120. BUDGET IMPACT If Phase I alone is ordered, then it is proposed that the entire cost of the project be assessed to the benefited property owners. Benefit can only be demonstrated for the properties on the east side of Highway 61. If both Phase I and II are ordered, then it is proposed to assess the properties on the east side of Highway 61 for the cost of the water main and services up to Radatz Avenue. The cost of the completion of the loop between Radatz Avenue and Beam Avenue on Highway 61 is proposed to be paid from M the Maplewood hydrant fund. The benefits of this connection between Radatz Avenue and Beam Avenue are systemwide. The following tables give assessment units, rates and costs proposed for Phase I alone or Phase I and II combined. A significant factor in the proposed assessment rates is that it does not seem feasible to demonstrate benefit to the frontage on the west side of Highway 61 and on the east side of Highway 61 north of Radatz Avenue. If these properties were to ever develop in such a way that connection to the water main were required, then the property should be charged a cash connection fee. If such a connection were to take place within five years from the date that the project is ordered, it is proposed to proportionally recompensate the assessed properties. BACKGROUND The revised proposed cooperative agreement and supporting data are attached. It should be noted that the estimated amounts receivable on the revised proposed cooperative agreement include engineering costs payable to Ramsey County, whereas the original proposed cooperative agreement showed only construction costs in the tabulation of estimated amounts receivable. The revised roadway with concrete curb and gutter estimated total cost is $51,077"05 in comparison with the cost based on the original cooperative agreement of $62,492"31. The amount recoverable by assessment at the established rate of $36.50/F"F. is $58 It is proposed to retain this assessment rate for roadway and make the sidewalk total construction cost of $6,925.35 (based on the revised estimated construction cost of $5 multiplied by 1°32 for engineering by Ramsey County and Maplewood) incidental to roadway assessment. The combined estimated total cost of roadway, concrete curb and gutter, and sidewalk is $58,002.40^ This essentially equals the amount recoverable by assessment at the established rate for MSA streets. The proposed assessments and estimated costs for utility construction and storm sewer are unaffected by the revised proposed cooperative agreement. At your proposed assessment rate of $36.50 per foot, this represents a potential of $13,140 in assessments. We believe that the utility improvements under your Project 86 -25 are of little benefit to the Open Space property. The Open Space property is also downstream of the storm sewer improvements and therefore did not contribute your cost participation for this item. Similarly the sidewalk is on the other side of the street. However, we concur that the cost of Maplewood participation in roadway outside the center 24 feet including the curb and gutter should be adjusted to reflect the Open Space frontage. We have taken that 360' and added it to your 1609' of assessable frontage, then ratioed the percentage of cost participation in the applicable items by increasing the county's share by 360/1969 x 75% = 13.7 %. This, added to our original 25 %, results in a county share of these items of 38.7% and correspondingly reduces the cities share from 75% to 61.3 %. In our Engineers Estimate of February 18, 1988, the construction cost of these two Items was $47,342.66. Based on the revised distribution percentages, the cities construction cost as shown in our Engineers Estimate revised March 24, 1988 is now $38,694.74. This is a reduction of $8,647.91 in city construction cost participation plus 16% in engineering. We concur with your request that Open Space should be responsible for a share of the proposed street improvements and believe the above is a fair treatment. Accordingly, we have contacted the State Aid Office and revised the plan to increase our state aid participation and reduce your municipal state aid participation. The County shall prepare the necessary plans, specifications and proposals, take bids, and with concurrence of the City and the City of North St. Paul, award a contract for the construction of this project, S.A.P. 62- 623 -30; the County shall perform the construction inspection; the City shall assist the County in the inspection of Project 86 -25. 2. The City shall acquire and pay for all rights of way and easements required for the construction of the project within the City except those on County -owned property. 3. All County Road C rights of way and temporary easements will be in the name of the County, and parking and other regulations will be controlled by the County. Any rights of way which cannot be negotiated will be acquired through eminent domain proceedings and thereafter assigned by the City to the County. 4. The storm sewer system as shown in the plans and specifications is estimated to be eligible for partial reimbursement from County State Aid Highway funds based on the Minnesota Department of Transportation Hydraulics Memorandum and this portion shall be paid by the County. 5. The City shall pay for that portion of the storm sewer system attributable to drainage from outside the road right of way within the City and not eligible for reimbursement from County State Aid Highway funds. 6. Upon completion of the project the County shall own and maintain the storm sewer catch basins and leads and the City shall own and maintain the storm sewer trunk lines within the City and laterals servicing property outside the road right of way. 7. The City shall pay to the County 100% of the cost of the new sidewalk constructed within the City which does not replace existing sidewalk. 8. The City shall pay to the County (75% x 1609.7/1969.7) = 61.3% of the cost of concrete curb and gutter constructed within the City and the County shall pay the remaining (25% + 75% x 360/1969.7) = 38.7 %. 12. Quantities within the City of Pay Items No. 2105.501, Common Excavation, 2130.501, Water, and 2502.541, 4 Perforated Pipe Drain shall be distributed 50% to the center 24 feet and 50% to the remainder of the work. 13. The County shall pay 100% of the cost of items assigned to the center twenty -four feet (two twelve -foot travel lanes). 14. The City shall pay to the County 61.3% of all the remaining construction costs not otherwise provided for above and the County shall pay the remaining 38.7 %. 15. Any utilities or facilities modified or added to those provisions presently made in the plans and specifications may be incorporated in the construction contract by supplemental agreement and shall be paid for as specified in the supplemental agreement. 16. The City shall pay 8% of its share of the construction cost, as determined by the contract as awarded, minus costs for City Project 86 -25, to the County as a preliminary engineering fee. The City shall also pay 2% of the construction cost, as determined by the contact as awarded amounts for City Project 86 -25, to the County as a preliminary engineering fee. This total preliminary engineering fee shall be due upon award of the construction contract. 17. The City shall pay 8% of its share of the construction costs, as determined by the final contract amounts, minus costs for City Project 86 -25. The City shall also pay 2% of the construction cost, as determined by the final contract amounts for City Project 86 -25, to the County as a construction engineering fee. This total construction engineering fee shall be due upon notification to the City of the final amounts due to the contractor. 18. The City shall not assess or otherwise recover any portion of its costs for this project through levy on County -owned property. 19. The City will pay ninety percent (90 %) of its share of the cost for City Project 86 -25 after award of contract but prior to start of construction and the contractor shall then be paid by the County. 20. Councilmember Juker's suggestions are listed on page 3. 2. On January 11, the council directed staff to revise the ordinances to grant home occupations to individuals, through licensing, rather than to the property with a conditional use permit. 3. Brian Donnelly (2922 Chippewa Avenue) has requested a code amendment to allow up to three nonresident employees in a home occupation. He has made a separate application for a home occupation permit to operate a heating, air conditioning and refrigeration repair business. Code restricts nonresident employees to one. The nonresident employees are self- employed subcontractors that Mr. Donnelly dispatches to the homes of his clients. The subcontractors stop at Mr. Donnelly's home once a day for about 5 to 10 minutes to drop off invoices and client payments. s One of the work items suggested by the planning commission is a review of the permitted uses in the zoning ordinance. Discussion This ordinance would make the following major changes: 1. Home occupation permits would be issued to individuals, through a license, rather than going with the property, through a conditional use permit. 2. A new restriction on parking for nonresident employees who work off site has been added, as well as a restriction on an on- street parking. 3. A new home occupation questionnaire has been written to provide more information on the home occupation. 4. Sales of goods produced off -site would be limited to 20% of gross sales. The current ordinance requires that such sales be subordinate to the principal business. 5. A conditional use permit would be required to park a heavy commercial vehicle on residential property. One light commercial vehicle would be allowed. Additional light commercial vehicles would need a conditional use permit. Current ordinance permits unlimited commercial vehicles if they are stored in a garage. 6. The restrictions on commercial vehicles have been extended to the other residential districts. 7. Project 87 -21 Public Hearing DATE: April 4, 1988 INTRODUCTION As an alternative to the proposed public improvement project described in the Ski Jump Property Drainage Improvements, City Project 87 -21 feasibility study, the developers in conjunction with the St. Paul Ski Club, Inc. have proposed on April 4, 1988, a privately executed plan to address the drainage concerns. BACKGROUND The engineering department has reviewed the proposed plan. The following items were discussed as part of an alternative to the public improvement project. 1. A permanent 50 acre -foot storm water ponding easement shall be dedicated to the City of Maplewood. The developers, Maplewood Highlands and Highwood Estates, shall procure the easement from the St. Paul Ski Club, Inc. The developers shall arrange for and pay for legal costs of drafting the easements. The developers shall arrange for and pay costs of a registered land surveyor to determine a traverse around the proposed easement such that there is 50 acre -feet of storage within the bounds of the traverse available for storm water storage based on a field survey of the site. 2. r A 14 acre -foot sedimentation basin shall be constructed within the proposed storm water easement. The developers are to . pay for engineering and construction costs of the sedimentation basin. The City of Maplewood undertakes the responsibility of removing sediment buildup within the sediment basin such that sediment volume does not exceed three acre feet. 3. All storm sewers within the tributary area shall discharge to the sediment basin. The developers shall secure easement for the storm sewers and shall dedicate to the City of Maplewood. The developers shall pay all costs for engineering and construction of the storm sewers. 4. An access road is to be constructed from Sterling Street to the southeast corner of the sediment basin. The westerly 250 feet of the access road, which is proposed to be located on a steep grade, should be paved with a bituminous surface to prevent erosion. The remaining access road is to have a gravel surface to avoid conflict with ski jump land areas. 5. A manhole, 24 inch diameter RCP gravity outfall, and energy dissipator shall be constructed from within the St. Paul Ski Club, Inc. property to the Interstate 494 ditch. This outfall will allow the St. Paul Ski. Club, Inc. to convey the discharge from temporary pumps to the freeway drainage ditch without causing erosion problems. The developers shall construct the gravity pump discharge structure as approved by the city engineer and MnDOT. B. The City of Maplewood will apply to MnDOT for discharge of storm water to the freeway ditch. Private use of the discharge line shall conform to permit conditions established by MnDOT. 7. The developers shall construct needed improvements to the Interstate 494 ditch and culvert as requested by MnDOT. 8. The developers shall construct a wire fabric fence and gates on the west property line of the St. Paul Ski Club site. The fence shall extend to natural barriers on north and south ends. The gate shall deter unauthorized use of the pond access road. 9. The developers shall compensate the City of Maplewood for all engineering costs incurred by engineering department staff or consultants to date. The developers will be charged engineering time for review during construction of the foregoing items. A copy of the position paper developed by the St. Paul Ski Club, Inc. is attached. A copy of the agenda report submitted with the feasibility report is also attached for reference. In addition, notice of said restrictions shall be posted at the Maplewood City Hall. Said restrictions shall be promptly removed when high water levels have subsided. (g) Exemptions. The attached resolution schedules a public hearing for this project. BACKGROUND The feasibility study for this project was ordered in April 1987" The feasibility study was initiated by petition from the owner of the parcel south of Holloway Avenue between Beebe Road and Furness Street, The developer requested that the right-of-way between Beebe Road and Furness Street either be improved or vacated. The major finding of the feasibility study is the revision of estimated traffic from the estimate initially developed for Holloway as one segment from North St" Paul Road to Century Avenue" The projected traffic on the segment from North St. Paul Road to McKnight Road is only one-third of the volume used for the design of Holloway Avenue from McKnight Road to Century Avenue, The intersection of Beebe Road and Holloway Avenue was planned to facilitate extension of Holloway Avenue to the east to McKnight as a 44-foot wide street" Similarly, Holloway Avenue east of McKnight Road is 46 feet wide. Due to the limited length of the proposed improvement it would be out of scale to taper down the width of the road and then widen it again" It also seems difficult to implement a narrower road section in view of the fact that to maintain MSA funding no parking restrictions would have to be implemented on existing frontage which is not currently restricted" In conflict with the facts dictating that Holloway Avenue, if built, should be 44 feet wide is the limited projected traffic" The projected volume of traffic is not consistent with the level of service contemplated . The City of North St. Paul has indicated an interest in the proposed road to provide access to allow development of the portions of lots that would front on Holloway Avenue" The connection of North St" Paul Road to McKnight Road via Holloway is not required to provide for development of property within Maplewood" If the road construction is not ordered then consideration should be given to ordering the construction of the proposed water main independent of the roadway" A utility easement for the existing sanitary sewer and proposed future water main must be retained in any case. BUDGET IMPACT The assessments and financing proposed are predicated on MSA funding and North St" Paul and Ramsey County cost participation as indicated in the feasibility report" In accord with established policy the proposed assessment for street construction on an MSA route would be $36,50/front foot" This assessment rate would recover $61,000 out of the estimated Maplewood share for roadway cost of $90,000^ The balance would be funded through MSA. Maplewood is eligible for an estimated $107,350 for street construction plus engineering costs at 18% from MSA" The majority of Maplewood's estimated share of proposed storm sewer costs results from drainage from the MSA right-of-way" It is, therefore, eligible for MSA funding" It is proposed to directly assess properties tributary to the storm sewer to recover only the balance of storm sewer costs not covered by MSA funding" The water main and sanitary sewer costs are directly attributable to the parcel south of Holloway Avenue between Beebe Road and Furness Street. Duration This Agreement shall be effective from 1 -1 -88 through 12- 31 -89. 2. Dental Insurance The City agrees to pay 100% of employee dental insurance. 3. Merit Pay Employer agrees to establish Merit System by contributing 3% of bargaining units total pay. No employee shall receive over 5 %. Employees are not eligible until completion of their probationary period. Employer shall present plan for comment before implementation. 4. Comparable Worth The Employer agrees to implement Comparable Worth by paying 50% of the applicable adjustments on 1 -1 -88 and 50% on 1 -1 -89 (See Appendix A). City agrees to re -test and /or review Assistant Finance Director's position after one year and negotiate a new rate, if appropirate. New rate will not increase, or decrease more than $200.00 per month and will be effective 1 -1 -90. 5. Deferred Compensation The Employer agrees to increase its monthly contribution from $40 to $50, effective 1- .1 -88. 6. Cost of Living Adjustment - (See Appendix A) 1988 - 3.5% increase 1989 - 4.0% increase 7. Life Insurance ' Life insurance coverage shall be increased from $20,000 to $25,000. Page Two 8. Initial charges will be included as part of the written disciplinary action.
