Mr. Mueiler was the planning commission representative at the August 23, 2004, city council meeting. The only planning commission item discussed was the Hillside Estates Preliminary Plat & Zoning Map Change for Spdngside Drive, passed ayes all with some concerns that were discussed. b. Mr. Bartol will be the planning commission representative at the September 13, 2004, city council meeting. The only planning commission item to discuss will be the Cottages at Legacy Village. c. Ms. Dierich will be the planning commission representative atthe SePtember 27, 2004, city council meeting. There are possibly two items to discuss which include the Ramsey County Suburban Courts Building and possibly the Summerhill Senior Housing. Ms. Fischer will be the planning commission representative atthe October 14, 2004, city council meeting. Items to discuss have not been determined yet. VI. STAFF PRESENTATIONS a. Commissioner's Appreciation Picnic -Wednesday, September 15, 2004 Mr. Roberts reminded planning commissioners of the appreciation picnic to be held Wednesday, September 15, 2004, from 5:30 p.m. to 8:00 p.m. atthe Battle Creek Park. This picnic isto thank board and commission members for their service time. **THE PLANNING COMMISSION TOOK A 15-MINUTE RECESS BEFORE BEGINNING THE PUBLIC HEARING AT 7:30 p.m. PUBLIC HEARING (7:30 p.m.) a. Ramsey County Suburban Courthouse (2050 White Bear Avenue) Mr. Roberts said David Chase of Kraus-Anderson Construction and Ramsey County, is proposing to build a 15,150 square-foot suburban courts building on the vacant city-owned property at 2050 White Bear Avenue. The building would have two courtrooms, office space, meeting rooms and associated space for the suburban courts operation. Mr. Chase is requesting that the city approve: 1. A lot division to create a new, separate lot for the courts building. Planning Commission Minutes of 09-08-04 -3- A conditional use permit (CUP) to construct a public building. Section 44.1092 of the city code requires a CUP for a public service or public building uses in any zoning district. Commissioner Pearson asked what type of formula was used to determine the number of handicapped parking spaces for this proposal? Mr. Roberts said the architect can answer that but that is something the building code dictates. Commissioner Bartol asked for additional information on the background of the current courthouse and the reason for the new building? Mr. Roberts said the courthouse is leasing space in a commercial building on weave near Radatz Avenue and the facility is too small and there are security issues. Because it isa leased space and they don't wantto put a lot of money into the leased building space, Ramsey County thinks it is time to have their own free standing facility rather than leasing or renting space in another building. There will still be two courtrooms and the number of parking spaces stays the same but there will be more clerical and office space. Commissioner Bartol said since Maplewood is giving this land to Ramsey County for free, what would happen if the courthouse outgreW the new building, wou~d the city get the land back? Mr. Roberts said unless the city negotiates something different, the city loses the land permanently. Commissioner Bartol asked if Mr. Roberts could explain briefly why this would benefit Maplewood? Mr. Roberts said as he understood it, the city council felt it was important to keep the suburban court in Maplewood primarily for the convenience for the police officers to appear in court with the time constraints of having to drive to another facility, park and appear in court taking more time away from their duties. This land is not now on the tax role and would probably never be put on the tax role; rather, it could have been a park or expansion of the community center. Giving the land to Ramsey County was an incentive to keep the courthouse in Maplewood and that was the decision made by the city council Commissioner Bartol thanked Mr. Roberts for clearing that up for him. Chairperson Fischer asked the applicant to address the commission. Mr. Bruce Thompson addressed the commission. He is the Assistant Director of Property Management for Ramsey County and the Project Manager for RamseY CountYi Ramsey County operates the suburban court facility and is mandated by state law to do so. They are leasing 1300 square feet in a commercial building. The court facility is on two different floors and there are many issues regarding to security and with the space that is sectioned off~ The County did not want to spend a lot of money to retrofit the space to their needs, Back in February, the county board sent a letter out to the suburban cities stating Ramsey county wanted to build a new building and that the county was ~ooking for cities to donate the land to the county for the suburban court facility. Maplewood was the only community that really stepped up and said they had land that would fit Ramsey County's needs. Planning Commission Minutes of 09-08-04 Mr. Thompson said because police officers in Maplewood are often required tobe in court and wait until they are called, it takes them Out of semite while they are at the court facility. Being farther away from the court facility takes officers away from their street job longer. Mr. Steve Lanak, Architect with DSGW Architects, 548 Apollo Drive, Suite 10, Lino Lakes, addressed the commission. He said they are working with Kraus Anderson to design the courthouse facility. Mr. Lanak gave a new design plan to Mr. Roberts to display on the monitor. The applicant said they would be providing new plans to Mr. RobertS on FridaY September 10, 2004. This plan has relocated the parking to the back of the property and they have moved the building to the south and lowered the building a few feet to balance the site better from a soils condition. By moving the building to the south it creates a larger grassy area between the path and the pond area to treat the runoff. Benefits from changing the site plan are that they pickup 14 more parking stalls in the front of the building, it creates better site drainage, and better Cost. He said regarding the handicapped parking question, they looked at the historical need for handicapped parking at the current court facility and estimated they need 100 parking stalls. Therefore, they used the ratio of 1 handicapped parking space per 25 parking spaces and came up with 2 handicapped spaces in the front of the building and 2 in the back of the building. Commissioner Dierich asked if she heard correct that the parking drainage was going to go from the parking lot into the pond and not into a holding pond or is that a holding pond? Mr. Roberts said as he understand it with this plan, the applicant wants to sheet drain the drainage into the grass and run over the grass before it eventUally gOes over land to the wetland area. In fairness to the city engineer they have not seen this new Plan and will have to review this and see if this is acceptable or not. Commissioner Bartol asked if this land was fairly flat and if there was a need for a retaining wall? Mr. Lanak said the land is fairly flat and there is probably four or five feet of slope from the south to the north towards the pond. There is not any significant change ingrade need for a retaining wall and he believes the wording in the report was general wording used by the city. Commissioner Bartol said he believes the revised site plan is vew good and it opens more space up to the back where the path goes through and appreciates the Change in the plan. Commissioner Mueller asked why they would have 2 handicapped parking spaces in the rear of the building? Mr. Lanak said he sees that point and that may be something they may need to change since the majority of the handicapped needs would probably be in the front of the building and not in the rear of the building. Commissioner Dierich asked if there were changes in the exterior of the building? Mr. Lanak said yes there are changes to the building exterior and they expect to have those revisions to staff later this week. Chairperson Fischer asked if anybody else in the audience wanted to speak regarding this item? planning Commission MinUtes of 09-08-04 -5- Nobody in the audience came forward. Commissioner Peamon moved to approve the lot division shown on the survey on page 14 of the staff repo~. This lot diviSion creates a new, separate parcel forthe Ramsey COunty Suburban CoU~house facility at 2050 White Bear Avenue. This lot division approval is sUbject tothe city and the county signing access and maintenance agreements for the property and for the parking lot(s). Commissioner Pearson moved to approve the resolution on pages 24 and 25 of the staff report. This resolution approves a conditional use permit for the Ramsey CoUntY SUbUrban CoUPs facility at 2050 white Bear Avenue. The coUncil bases the Permit On the findin~s required by COde and it is subject to the following conditions: All construction shall follow the site plan approved by the city. The director of community development may approve minor changes. Any future expansions or major changes to the site or to the building require the approval of a revision to the conditionaJ use Permit bY the city council. 2. The applicant must begin construction within one year after the CoUnCil approves this permit or the permit shall end. The city council may extend this deadline for one year. 3. CT: LOCATION: ADDPd~SS: APPLICANT: DATE: City Manager Rose Lorsung, Planning Intern Conditional Use Permit - Car Rental Business Sears Building, Maplewood Mall 3001 White Bear Avenue AVIS Rent A Car September 20, 2004 INTRODUCTION Project Description Mr. Jeff Higginbotham, representing Avis Rent a Car, is requesting that the city approve a conditional use pewit (CUP) to set up an automobile rental office in the Sears store at Maplewood Mall (See the applicant's statement and maps starting on page 4)~ The request would include a service counter and the storage of about 10 rental vehicles on the weSt side of the Sears store, north of Beam Avenue (See the site plans and floor plans starting on page 7). Request An autornobile rental office in a Business Commercial Zoning District (BC) requires city council approve a conditional use permit (CUP). DISCUSSION Conditional Use Permit The proposed automobile rental office on this site would be compatible with the adjacent auto- related business (Sears Automotive). Parking The proposed business would have 10 designated parking stalls for the rental vehicles. Article I. Section 44-17 (7) of the city's zoning code states that Shopping Centers having enclosed, nonteasable common areas must have 1 parking space for each 200 sq~e feet or poaion thereof of leasable floor area. The most recent parking study for the mall, conducted by Edwards and Kelcey, ca~lculated the parking ratio for the Maplewood Mall m be 1.003~ which slightly exceeds the city code requirements of 1 parking space/200 square foot leasable area. The applicant states that Avis Rent a Car offers pick-up services for customers within 5 miles of the location, which also reduces the number of customer parking stalls needed. The average number ofrentals at an Avis Rent a Car neighborhood location is 10,15 rentals per day, with 1 to 2 employees working at the store. Neighborhood Comments Of the 52 neighbors the city surveyed, we received 1 response. This response was in favor of the automobile rental office. Other Comments Nick Carver, Assistant Building Official, stated that a building permit is required for the remodel of the leased space. Mr. C~er also noted that the applicant must follow the newly adopted Minnesota Building and Fire Code (MSBC) and International Building Code (IBC) for commercial buildings. Shann Finwall, Planner, stated that the applicant needs a separate sign permit for the three newly proposed signs. SUMMARY The city is not aware of any major issues regarding the proposed conditional use permit to set up an automobile rental office at this site. The proposal will meet the city parking requirements and the use would not create excessive traffic or additional costs for public services. RECOMMENDATION Adopt the resolution on pages 11 and 12. This resolution approves a conditional use permit for an automobile rental office inthe Sears Store at 3001 White Bear Avenue. The apProval is subject to the following conditions: 1. The owner or operator shall follow the site plan approved by the city. The director of community development may approve minor changes. 2. The city council shall review this permit in one year. 3. TO: FROM: SUBJECT: PROJECT: LOCATION: DATE: MEMORANDUM Richard Fursman, City Manager Ken Roberts, Planner EAW, Land Use Plan and Zoning Map Changes, Conditional Use Permit and Design Approval Maplewood imports Auto Center 2450 Mapiewood Drive September 28, 2004 iNTRODUCTiON Project Description Jon Hanson, of LeJuene Investments and Maplewood Imports, is proposing to build four new automobile dealerships and a support services building on the 32-acre property at 2450 Maplewood Ddve. This complex would include 4 separate dealership buildings (each with sales and service facilities), a support services building and up to 2,224 parking spaces for inventory, customers and employees. The city has planned and zoned this site CO (commercial office) and M-1 (light manufacturing.) (Refer to the applicant's project narrative on page 6 and the maps on pages 7 through 19.) Requests Mr. Hanson is requesting that the city approve: 1. A land use plan change for part of the site. This change would be from CO (commercial office) to M-I (light manufacturing). (See the land use plan map on page 10.) 2. A zoning map change for part of the site. This change would be from CO (commercial office) to M-1 (light manufacturing). (See the property iine/zoning map on page 11 .) 3. A conditional use permit (CUP) for the motor vehicle maintenance garages. 4. The design plans (architectural, site, landscape, and lighting plans) for the Audi dealership site and building. (See the project plans on pages 14 - 23 and the separate enclosures.) BACKGROUND iVliggler Addition On September 22, 1986, the city approved the Miggler Addition preliminary plat for this site. (See the map on page nine.) On Apdi 27, 1987, the city council dropped a lot from the plat and also changed the zoning for the Miggier property. The city made thiS change so the zoning line between the M-1 and CO zoning districts lined up a lot line in the plat. (This is the zoning that is now in place for the area.) On September 26, 1988, the city council extended the preliminary plat approval for one year and revised the conditions for final plat approval. On January 24, 1994, the city council terminated the approval of the Miggler Addition preliminary plat because: Government regulations and policies have changed significantly since the city first approved the preliminary plat in 1986. Over seven years have passed since the city held a public headng on this plat. There may be new neighbors near the plat site and they should have a chance to comment on the p~ans to develop this property. 3. There had been no physical activity to develop this plaL DISCUSSION Environmental Assessment Worksheet (EAW) City staff has been researching the need or possibility of having the developer prepare and EAW for the proposed project. An EAW is a preliminary environmental review of a proposal to look at how the development could potentially affect the environment. The state has designed the EAW to gather and disclose information about potential environmenta~ effects from a proposed proj~. The EAW a~so reviews ways or methods to avoid or minimize any environmental effects. An EAW has a list of standardized questions that cover issues such as land use and habitat, storm water, wetlands, air emissions and pollution and traffic. As proposed, the project does not meet the minimum size thresholds set by state rules to mandate an F_AW. However, the city can require the deveJoper to prepare an EAW if the city decides that the project "has a potentia~ for significant environmental effects." In their review of the proposal, Chds Cavett and Chuck Vermeersch of the city engineering department noted several concems with the proposed plans. (Please see their comments starting on page 27.) They concluded their comments by recommending that the city council require the preparation of an EAW for the proposal. It is important to note that if the city requires the developer to prepare an F. AW, that the city cannot process or approve the spec~c development requests, including zoning changes and conditional use permits, until after the EAW is done and approved by the city and by the state. That is, the city's 60-day review of the proposal cannot start until after all the steps of the EAW process are complete. CITY LAND USE APPROVALS The applicant has applied to the city for several land use approvals to build the project. These include changes to the land use plan and zoning map, a conditional use permit and design approval for the proposed Audi dealership. As ~ noted above, the city cannot act on these requests until after the completion of the EAW preparation and review process. As such, I am not now preparing a discussion or review of those requests. 2 RECOMMENDATIONS Make the determination that there is a need for an Environmental Assessment Worksheet (EAW) for the proposed Maplewood Imports Auto center project at 2450 Maplewood Ddve. The city is requiring the preparation of the EAW for this project because: City staff has identified several concerns with the project including storm water issues, wetland protection concerns, potential impacts on public utilities and the potential for negative traffic impacts. 2. The project as it is now designed has the potential for significant environmental effects. Direct city staff to contract with a city consultant for the preparation of an EAW for the proposed Maplewood Imports Auto Center at 2450 Maplewood Ddve. The city must first receive an escrow payment of $25,000 from the project applicant before finalizing the contract for the preparation of the E. AW. Take no action on the requested land use plan and zoning map changes, conditional use permit and design approval for the proposed Maplewood Imports Auto Center at 2450 Maptewood Drive. This delay in action is necessary because the city cannot not proceed with taking action on the Project applications and requests until after the completion of the EAW review process. CITIZEN COMMENTS I surveyed the owners of the 42 properties within 500 feet of project site and received no responses. Any change, however, should be consistent with the goals and policies in the comprehensive plan. 2. Rezoning: Section 44-1165 of the city code requires that the city council make the following findings to rezone property: a. The proposed change is consistent with the spidt, purpose and intent of the zoning code. The proposed change will not substantially injure or detract from the use of neighboring property or from the character of the neighborhood and the use of the property adjacent to the area included in the proposed change or plan is adequately safeguarded. c. The proposed change will serve the best interests and conveniences of the community, where applicable, and the public welfare. The proposed change would have no negative effect upon the logical, efficient, and economical extension of public services and facilities, such as public water, sewers, police and fire protection and schools. 3. Conditional Use Permits Section 44-512(8) requires a CUP for maintenance garages. Section 44-1097 states that the city council may approve a CUP, based on nine standards. 4 4. Design Review Section 2-290(b) of the city code requires that the community design review board make the following findings to approve p~ans: That the design and location of the proposed development and its relationship to neighboring, existing or proposed developments, and traffic is such that it will not impair the desirabi]ity of investment or occupation in the neighborhood; that it wi~ not unreasonabiy interfere with the use and enjoyment of neighboring, existing or proposed developments; and that it wiil not create traffic hazards or congestion. That the design and location of the proposed deveiopment is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, ordedy and attractive development contemplated by this article and the city's comprehensive municipal plan. That the design and location of the proposed development would provide a desirable environment for its occupants, as wel~ as for its neighbors, and that it is aesthetic, ally of good composition, materials, textures and colors. Application Date The city received the complete applications and plans for this request on August 27, 2004. State law requires that the city take action within 60 days of receiving complete applications for a land use proposal, unless there is an environmental review conducted, such as an EAW or an ElS. Although we anticipated growth, it would have been impossible to predict the unprecedented growth in the industry and our brands in particular. From I993 to now our vehicle sa~es are up 267%, service attendance is up 269% and our parts sa~es are up 342%. From 1993 to today, the available models from each manufacturer has grown tremendously. ~n 1993, Audi had 6 models, today they have 23, Mercedes-Benz had 14, today they have 46 and Porsche had 5, today they have 13. This does not account for all the trim level variants or engine options. It is a business necessity to inventory an example of most of the models plus approximately 60 days supply. On average, we carry 260 units in inventory. Frequently that number is increased by pressure from the manufacturers to take additional inventory, in addition to inventory, new and used sales customer parking, service customer parking, parts customer parking we need to park 50 service loaners and 90 employee vehicles as well as provide space for transport-trucks unloaded. ~n representing European high-end vehicles we have learned we need to provide ample parking spaces (beyond that required by domestic or Japanese brands) to accommodate, in some cases, the vehicle size, but in all cases the vehicles value. Another distinction between our facility and a higher volume brand is our lower traffic flow. Our intensity of use is much lower due to acquisition price, quality and the exclusive nature of the brand. With the growth we have experienced and our limited space, it has become exceedingly difficult, often times impossible, to provide the superior customer experience that is the trademark of our organization. The three manufacturers we represent Mercedes-Benz, Audi and Porsche are all requiring dedicated, stand-alone facilities. Each facility is required to provide distinctive imaging, brand identification and life-style elements that allow the customer to identify with the product and the brand. With our mission statement to exceed customer expectations in everything we do, business necessity due to growth and demands placed on us from the manufacturers we represent it is our desire to construct an automotive park on the Maplewood site for the sale and service of automobiles. We have been a corporate citizen of Maplewood for eleven years and feel we have been a good citizen and neighbor. Our proposal would be appropriate uses of the land given our direct neighbors are either industrial or automotive. Our current time line would have site grading and preparation performed this year, construction of building #1 in 2005 construction of building #2 in 2006.
