INTRODUCTION
On March 2, 2012, the City Council adopted as their Number One Goal for 2012 – 2013:
PUBLIC SAFETY
Complete the plan for rebuilding and relocating fire stations, from five to three, including
securing the 3M site. Develop and commit to a plan for meeting the space needs of the
police department.
This agenda item on the Work Session is intended to provide the Council with options for
implementing the second part of this goal, that being “…meeting the space needs of the police
department.” The discussion will be limited to information on the financing options available to
the Council to proceed with the Police Department expansion project. Mary Ippel from Briggs
and Morgan, Terri Heaton from Springsted, Inc., Gayle Bauman, City Finance Manager, and
Chuck Ahl, Assistant City Manager will discuss options for proceeding with the financing of the
proposed improvements at City Hall to meet these space needs over the next 2-3 years.
BACKGROUND
During 2011, the City Council authorized preparation of a study of space needs within the Police
Department. The architect performing the study, Larry Koch, of SEH, Inc. provided a summary
of the findings and options for expanding the Police Department. That report was finalized and
approved by the Council. On February 6, 2012, the City Council reviewed the various options for
expansion, including a full project expansion that was the preferred plan of the Police
Department and Chief Thomalla, but was estimated to cost in excess of $8.5 million. After much
discussion, the Council directed staff to proceed with a plan for using existing City Hall space
and relocating some of the City departments to other City Campus facilities that reduced the
project cost to approximately $4.3 million.
On March 2, 2012, the City Council continued the discussion of the City facility needs and
directed staff to proceed with implementation by making Public Safety facilities one of their top
goals for staff to implement during 2012 – 2014. The City staff implemented this direction and
called a Public Hearing on the sale of Capital Improvement Bonds for the purpose of financing
the Fire Station expansion process along with the Police Department Expansion. Those bonds
were estimated at $5.25 million for the 3M Fire Station and $4.25 million for the Police
Department Expansion. The Public Hearing was held in combination with the adoption of the
Capital Improvement Plan for all public projects to be implemented during the 2013 – 2017
timeframe. However, adoption of the Capital Improvement Plan under general law does not
require a Public Hearing [one is held at the Planning Commission to determine whether the
Capital Improvement Plan is consistent with the Comprehensive Plan], while a proposal to sell
Capital Improvement Bonds does require that the City Council conduct a Public Hearing on the
plan for capital improvements that consist of a city hall, library, public safety facility or public
works facility and the proposal to issue this type of debt and allow for a petition process for a
referendum on the debt.

At the March 26th Public Hearing, four individuals addressed the Council with two of those
individuals commenting about the fire station at 3M and the concern with the City debt
associated with that process. There were no comments about the Police Department project.
After the Public Hearing, the Council voted unanimously to approve the Capital Improvement
Plan and to approve the authority for issuance of the CIP Bonds for the Fire Station project in the
amount of $5.25 million and for the Police Department Expansion project in the amount of $4.25
million. It was explained at the hearing that the proposed CIP Bonds are a tool that can [they are
optional for the Council] be used to finance a city hall, library, public safety facility or public works
facility. And, the proposed use of bonding for the Police Department and Fire Department
projects is also the only issue subject to the petition. A petition can only be a request for a
referendum on the use of CIP Bonds for the projects and amounts, not a petition for a
referendum on the projects. If the Council decides not to use CIP Bonds, the question of a
referendum is not considered.
On April 25, 2012, a petition was received regarding the use of CIP Bonds for the Police
Department-City Hall Expansion project and the construction of a new Fire Station on the 3M
Campus. The petition was evaluated and determined to not contain adequate persons who
would be considered registered voters as defined by statute. We remain confident of that
determination, but, there remains the question of intent of the statute based on the issue of
registered voters versus eligible voters. While we are confident in our interpretation of the
language on the petition it would also be necessary to convince our bond counsel and eventually
the agency that may purchase the proposed bonds of that same issue. Our bond counsel needs
to provide an unqualified bond opinion for the bonds. After a lengthy discussion with a number
of representatives who would be involved in a bond issue, it was determined by staff, that we
had extensive concerns that a challenge to our determination is a possibility. That potential for
challenge creates a bond counsel concern with issuing an unqualified opinion on the CIP bond.
In short, a potential for a lengthy court proceeding in order to prevail casts a potential doubt over
the decision to use the CIP Bond approach for these two projects. Also, the bonding proposal in
May was only considering the first part of the Police Department – City Hall project; not the new
Fire Station on the 3M Campus, since the Fire Station project has numerous months and
discussion needed prior to being ready for consideration by the City Council, if ever. The Fire
Station project may never need to use CIP Bonds, and was only added for discussion in the
process as a possible tool. Again, it is a possible tool and not a requirement because it was part
of the original plan.
Given the discussion and based upon our bond counsel’s concern, the staff did not bring
forward a proposal for any bonding for the Police Department – City Hall Expansion project as
part of the bond proposal considered by the City Council at the May 14th Council Meeting.
Bonding was approved for public improvement street projects that were previously approved by
the Council as well as an equipment certificate issue and a bond refunding proposal. It was
never the intent to bring forward bonding for the new Fire Station on the 3M Campus at this time,
because that project is not ready for bonding consideration and CIP Bonds may never be
necessary.

This decision and concern for the potential litigation over the interpretation on the validity of the
petition does not mean that either project cannot be considered. As noted previously, the CIP
Bonds are a financing tool and the petition was for a referendum on the use of those bonds for
the two projects. By not proposing the use of the CIP Bonds, we are confident that the issue of
the petition is no longer relevant and the City would avoid a potentially protracted legal
discussion before the use of bonding could be finalized. There are other methods for financing
of the Police Department Expansion and New Fire Station improvements that have been
successfully used by other municipalities to finance these types of projects. Those approaches
are the subject of this discussion.
FINANCING OPTIONS
In reviewing the options for the Police Department Expansion Project, that includes the February
2012 direction from the Council to use existing space and relocate Departments to facilities
within the City Hall Campus, the following estimates on timing and costs have been developed:

Financing Option #1
The first option and least costly option is to consider using the CIP Bond approach. This would
be similar to the original bond but is being considered given the background information
provided earlier in this report. It has been staff’s observation that the petition and public
comment have been directed to the CIP Bond and debt discussion related to the Fire
Department project at the 3M site, as well as the closure issue surrounding abandonment of 3 of
our local fire stations [Londin Lane, Century Avenue, McMenemy Street] that is part of the Fire
Department’s Strategic Vision. An expansion of the Police Department, which is noted to have
only 44% of the space needs being met, have not been controversial based upon information
observed by the staff. This option would provide for removing the Fire Station authorization from
the proposed CIP Bond and to hold a new CIP Bond Hearing later in 2012 for issuing $3.4 to
$4.3 million in bonds during 2013. It should be noted that the City recently issued bonds at a
rate of 1.766%, which is at historically low levels, and the City’s bond rating was re-affirmed at a
half-point below the top level nationally, so concern about City debt levels by the national rating
agencies is minimal.
The amount of the proposed bonds could be as low as $3.4 million if the Council chose to use
internal sources of cash; or the entire project could be funded at the $4.3 million level. Given
that the CIP Bond would be at this lower level, rather than the original March 2012 proposal at
$9.5 million and that it would only include Police Department Expansion, staff feels confident in
proceeding with this approach. It would be subject to a 30-day referendum petition process, but
given the uncertainty of the previous petition, holding another hearing seems appropriate.

Financing Option #2
The second option is available immediately or as a backup plan should another referendum
petition be filed on the project. This option is the issuance by the Economic Development
Authority [EDA] of a Lease Revenue Bond. In connection with the issuance of the Lease
Revenue Bond, the EDA would lease the financed facilities to the City. Pursuant to the Lease,
the City would make annual lease payments sufficient to pay the annual debt service payments
on the Bonds. It would likely be slightly more expensive than a CIP Bond and much more
complex. This approach has been used successfully by a number of other municipalities. The
new Police Expansion area as well as the entire Park Maintenance Building would be financed
by the Lease Revenue Bond issued by the EDA. The EDA debt is not considered City debt, as
the Lease must contain the right of the City to terminate the lease at the end of any year. This
approach would be limited to the $3.4 million level in the above list [last three items listed] as the
lease payments can only be toward the new items that are part of the lease. The first $900,000
in expenses listed above would be paid by using existing sources of cash that the City
maintains, or simply, using existing internal funding. This approach has not been used by
Maplewood in the past, so Mary Ippel, our bond counsel from Briggs and Morgan along with
Terri Heaton, our financial advisor from Springsted, will be present to explain this option.
Funding Discussion
As we continue our evaluation of the Council’s goal to look at facility needs, this type of expense
is being incorporated into the long-range financial planning for the City. If the Council were to
approve the $3.4 - $4.3 million expenditure in 2012 to 2014 to help address these needs, the
impact on City expenditures will be limited. During 2011 and 2012, the City staff began
reductions to set aside $200,000 in annual expenses by keeping two Police officer positions
vacant. The cost of this type of bonding or lease would be $325,000 to $375,000 annually, so
this current plan could be implement for an additional $125,000 to $175,000 per year for 15
years to pay that type of debt.
Discussion
While we fully recognize the need for providing for our police department needs and the fact that
there has been zero investment in providing additional space for the Police Department since
the original construction in 1984-85, completing the full project at an $8.5 million expenditure
would require approximately $600,000 to $700,000 annually in debt service. That type of debt
may require a larger discussion to center around a possible referendum for the police station.
We believe that the above approach is consistent with the financial sustainability goals and will
address a majority of the Police Department needs moving forward and the debt impact could
require up to a 1.0% levy increase.
RECOMMENDED ACTION
It is recommended that the City Council discuss the financing options for the Police Department
Expansion project. It is requested that the Council provide input and guidance as to the direction
for further analysis of the financial options. No formal action is required.

INTRODUCTION
During the June 11 Council Workshop, the City Council discussed the current process for
Charitable Gambling and asked for some information to be brought back for further discussion.
Staff has collected the information requested and has brought it back to the Council for
discussion and direction.
BACKGROUND/DISCUSSION
Each year, the City Council conducts a process to award the limited charitable gambling funds
that are provided through the collection of a percentage of charitable gambling within the City
limits. The past few years, total award amounts have been in the $25,000 - $30,000 range.
Maplewood’s City Code addresses lawful gambling, which is attached for reference. City Code
states that any organization conducting lawful gambling within Maplewood must contribute ten
percent of its net profits derived from lawful gambling in the city to a fund administered and
regulated by the city. This fund is referred to as our Charitable Gambling Fund. The following

The process of distribution of these funds usually starts in July or August with awards
determined by mid October. The amount of funds available to distribute is determined during the
budget preparation for that year. In July, staff begins to advertise for applications for requests of
Charitable Gambling funds. Applications are mailed to all previous applicants. The application
deadline is usually in the beginning of September. Staff then compiles all of the applications and
then presents them to the City Council during a work-session. The Council then fills out a ballot,
which is turned into staff to calculate the proposed awards. Award amounts are calculated by
averaging the amounts voted by each Councilmember. Currently the Council has a policy of
awarding $0 if the applicant does not receive 2 or more votes for funds allocation.
At the following regular meeting, staff presents the proposed award amounts to the City Council
for a vote. Once the Council approves the award amounts, all applicants are mailed a letter
notifying them of the results of the vote. If they are awarded funds, they are given 1 year from
the date of the award letter to make requests for funds; however, they cannot make a request for
reimbursement until after the first of the year. In order to receive the reimbursement, the
organization must give proof of the expenditure. This is done by writing a letter to the City
Manager and providing an invoice with receipts attached. This request is then approved by the
City Manager and forwarded to the Finance Department to mail a check to the organization. With
Some awards are given to Maplewood run programs (i.e. Police Reserves, Maplewood Youth
Scholarship Program, etc.) are handled internally with Finance as the reimbursement requests
maybe numerous with smaller amounts requested at a time. If funds are not reimbursed within
one year of the award letter, the unclaimed amounts are left as a fund reserve. A list of
organizations, their requests and award amounts from 2009-2012 is attached for your reference.
Also attached is a list of request summaries from 2009-2012.
DISCUSSION
During the last Work-session, the Council discussed a few different possible changes to the
City’s process of distributing Charitable Gambling funds. Some ideas discussed were to allow
space on application for applicant to explain how funds would be utilized if not awarded their full
request and capping the request amount. Staff has revised the application to give space to
explain how funds would be utilized if not awarded the full request. This revised application, as
well as the original application, are attached for your reference.
As for a possible cap on requests, for discussion purposes, below is a table of average requests
and awards for 2009-2012:

ACTION
It is recommended that the City Council discuss the process for distribution of Charitable

The provisions of Minn. Stats. ch. 349, as they may be amended from time to time, with reference to
the definition of terms, conditions of operation, provisions relating to sales, and all other matters
pertaining to lawful gambling are hereby adopted by reference and are made a part of this article as if
set out in full. It is the intention of the council that all future amendments of Minn. Stats. ch. 349 are
hereby adopted by reference or referenced as if they had been in existence at the time this article was
adopted.

Sec. 22-3. - City may be more restrictive than state law.
The council is authorized by the provisions of Minn. Stats. § 349.213, as it may be amended from time
to time, to impose, and has imposed in this article, additional restrictions on gambling within its limits
beyond those contained in Minn. Stats. ch. 349, as it may be amended from time to time.

Sec. 22-4. - Purpose.
The purpose of this chapter is to regulate lawful gambling within the City of Maplewood, to prevent its
commercialization, to insure the integrity of operations, and to provide for the use of net profits only for
lawful purposes.

Sec. 22-5. - Definitions.
In addition to the definitions contained in Minn. Stats. § 349.12, as it may be amended from time to
time, the following terms are defined for purposes of this chapter:

Board means the State of Minnesota Gambling Control Board.
City means the City of Maplewood.
Council means the City Council of the City of Maplewood.
Licensed organization means an organization licensed by the board.
Local permit means a permit issued by the city.
Raffle means an activity that requires no skill in order to win a prize. Prizes are awarded through the
purchase of chances.
Trade area means the City of Maplewood and each city and township contiguous to the City of
Maplewood.

Sec. 22-6. - Lawful gambling permitted.
Lawful gambling is permitted within the city provided it is conducted in accordance with Minn. Stats. §§
609.75—609.763, inclusive, as they may be amended from time to time; Minn. Stats. §§
349.11—349.23, inclusive, as they may be amended from time to time; and this chapter.

Sec. 22-7. - Location.
(a) Lawful gambling under license issued by the state lawful gambling board may be conducted only
at the following locations:
(1) In the licensed organization's hall where it has its regular meetings. No organization shall
rent, lease, or occupy, directly or indirectly, any other property for the purpose of conducting
gambling, except an on-sale establishment as permitted in this chapter.
(2) In licensed on-sale liquor, wine, and beer establishments.
(3) Notwithstanding subsections (a)(1) and (2) of this section, raffle-only licenses may be
approved for any proper location.
(b) No location shall be approved for gambling unless it complies with the applicable zoning, building,
fire, and health codes of the city.

Sec. 22-8. - Conditions.
The conduct of lawful gambling under license issued by the state lawful gambling control board shall be
subject to the following conditions in the city:
(1) No sale, consumption, or possession of liquor, wine, 3.2 percent malt liquor shall be
permitted during gambling conducted by a licensed organization, except as permitted under a
valid on-sale liquor, wine, or 3.2 percent malt liquor license or a bottle club permit; provided,
further, that no sale, consumption, or possession of liquor, wine, or 3.2 percent malt liquor shall be

permitted in the room where a bingo session is taking place.
(2) The organization must have been in existence for three years preceding the license
application as a registered Minnesota nonprofit corporation or as an organization designated as
exempt from the payment of income taxes by the Internal Revenue Code. The organization must
have at least 15 active members.
(3) Before any person may serve as gambling manager for any organization licensed to conduct
gambling in the city, that person must have satisfactorily completed a course of instruction
conducted by the state lawful gambling control board on the duties and responsibilities of the
gambling manager.

Sec. 22-9. - Lawful gambling at on-sale establishments.
Lawful gambling at on-sale liquor, wine, and 3.2 percent malt liquor establishments shall be conducted
in compliance with the following:
(1) Only licenses for lawful gambling and raffles may be issued, except where the licensed
gambling organization also holds the on-sale liquor, wine, or 3.2 percent malt liquor licenses for
the premises, in which case any gambling license may be issued.
(2) On-sale establishments shall be limited to one licensed gambling organization at any one
time in the licensed premises and any rooms adjoining the premises under the same
management. No lease shall be made with one organization while another lease is in effect for the
same on-sale establishment.
(3) Every agreement between a nonprofit organization and an on-sale premises for gambling
shall be in the form of a written lease. The written lease shall be the complete agreement between
the parties, and there shall be no unwritten terms or conditions. There shall be no other
compensation paid to the on-sale establishment, directly or indirectly, other than the rental fee
provided in the lease agreement. The lease shall specifically provide that the lessee shall operate
only after issuance of a license and shall be subject to the terms of this chapter. Rental payments
shall not exceed:
a. For booth operations - ten percent of gross profits (net after taxes) with a maximum of
$1,750.00 per month.
b. For bar operations - 20 percent of gross profits (net after taxes) with a maximum of
$2,000.00 per month.
(4) A copy of any lease agreement between a nonprofit organization and an on-sale licensee
shall be filed with the city clerk and the police chief with the gambling license application.
(5) All gambling shall be conducted from a booth or the bar services area. The physical layout of
the area set aside for gambling shall be subject to approval of the police department.
(6) If gambling is conducted from a booth, it shall be constructed and maintained by the
organization licensed to conduct gambling and shall be under the exclusive control of that
organization.
The organization licensed to conduct gambling shall prominently display its name and license

number and shall indicate that all profits from gambling are for the benefit of the organization.
(7) No person shall be jointly employed by both the nonprofit organization and the on-sale
establishment. This section shall not apply when the licensed gambling organization is also the
holder of the on-sale license for the establishment where the gambling is conducted.
(8) No gambling funds shall be commingled with funds of the on-sale establishment.
(9) No food, drink, or entertainment discounts or other promotions shall be offered in conjunction
with the sale of gambling devices or chances.
(10) The on-sale establishment shall allow the organization to conduct gambling at any time
during its lawful business hours and shall prohibit gambling at any time other than its lawful
business hours.
(11) The on-sale licensee shall make no agreements with any gambling equipment distributor
requiring the use of his gambling equipment in the establishment.
(12) The city council may disapprove a gambling license application for an on-sale establishment
in which gambling violations have previously occurred.

Sec. 22-10. - Council approval.
Lawful gambling authorized by Minn. Stats. §§ 349.11—349.23, inclusive, as they may be amended
from time to time, shall not be conducted unless approved by the council, subject to the provisions of
this chapter and state law.

Sec. 22-11. - Application and local approval of premises permits.
(a) Any organization seeking to obtain a premises permit or bingo hall license, or renewal of a
premises permit or bingo hall license from the board shall file with the city clerk an executed, complete
duplicate application, together with all exhibits and documents accompanying the application as filed
with the board. The application and accompanying exhibits and documents shall be filed not later than
three days after they have been filed with the board.
(b) Upon receipt of an application for issuance or renewal of a premises permit or bingo hall license,
the city clerk shall transmit the application to the chief of police for review and recommendation.
(c) The chief of police shall investigate the matter and make its review and recommendation to the
city council as soon as possible, but in no event later than 45 days following receipt of the notification
by the city.
(d) Organizations or bingo halls applying for a state issued premises permit shall pay the city an
investigation fee as set by state statute for cities of the second class. This fee shall be refunded if the
application is withdrawn before the investigation is commenced.
(e) The applicant shall be notified in writing of the date of which the council will consider the
recommendation.

(f) The council shall receive a report from the city clerk that includes pertinent information from the
background investigation and consider the application within 45 days of the date that the application
was submitted.
(g) The council shall, by resolution, approve or disapprove the application within 60 days of the
receipt of the application.
(h) The council shall disapprove an application for issuance or renewal of a premises permit for any of
the following reasons:
(1) Violation by the gambling organization of any state statute, state rule, or city ordinance
relating to gambling within the last three years.
(2) Violation by the on-sale establishment or organization leasing its premises for gambling, of
any state statute, state rule, or city ordinance relating to the operation of the establishment,
including, but not limited to, laws relating to alcoholic beverages, gambling, controlled substances,
suppression of vice and protection of public safety within the last three years.
(3) Lawful gambling would be conducted at premises other than those for which an on-sale
liquor license has been issued.
(4) Lawful gambling would be conducted at more than four premises within the city.
(5) Failure of the applicant to pay the investigation fee within the prescribed time limit.
(6) Operation of gambling at the site would be detrimental to health, safety, and welfare of the
community.
Otherwise, the council shall pass a resolution approving the application.

Sec. 22-12. - Local permits.
(a) No organization shall conduct lawful gambling excluded or exempted from state licensure
requirements by Minn. Stats. § 349.166, as it may be amended from time to time, without a valid local
permit.
(b) Applications for issuance or renewal of a local permit shall be on a form prescribed by the city.
The application shall contain the following information:
(1) Name and address of the organization requesting the permit.
(2) Name and address of the officers and person accounting for receipts, expenses, and profits
for the event.
(3) Dates of gambling occasion for which permit is requested.
(4) Address of premises where event will occur.
(5) Copy of rental or leasing arrangement, if any, connected with the event including rental to be
charged to organization.
(6) Estimated value of prizes to be awarded.

(c) When filing an application for the issuance of a local permit under this section, the applicant must
pay to the city clerk, in full, the amount of the permit fee as imposed, set, established and fixed by the
city council.
(d) Upon receipt of an application for issuance or renewal of a local permit, the city clerk shall transmit

(2) Violation by the on-sale establishment, or organization leasing its premises for gambling, of
any state statute, state rule, or city ordinance relating to the operation of the establishment,
including, but not limited to, laws relating to the operation of the establishment, laws relating to
alcoholic beverages, gambling, controlled substances, suppression of vice and protection of public
safety within the last three years.
(3) The organization has not been in existence for at least three consecutive years prior to the
date of application.
(4) The organization does not have at least 15 active members.
(5) Exempted or excluded lawful gambling will not take place at a premises the organization
owns or rents.
(6) Exempted or excluded lawful gambling will not be limited to premises for which an on-sale
liquor license has been issued.
(7) Exempted or excluded lawful gambling will occur at more than four premises within the city.
(8) More than one licensed, qualified organization will be conducting exempted or excluded
lawful gambling activities at any one premises.
(9) Failure of the applicant to pay the permit fee within the prescribed time limit.
(10) Operation of gambling at the site would be detrimental to health, safety, and welfare of the
community.
Otherwise, the council shall approve the application.

Sec. 22-13. - Revocation and suspension of local permit.
(a) A local permit may be revoked, or temporarily suspended for a violation by the gambling
organization of any state statute, state rule, or city ordinance relating to gambling.
(b) A license shall not be revoked or suspended until notice and an opportunity for a hearing have first
been given to the permitted person. The notice shall be personally served and shall state the provision
reasonably believed to be violated. The notice shall also state that the permitted person may demand a
hearing on the matter, in which case the permit will not be suspended until after the hearing is held. If
the permitted person requests a hearing, the council shall hold a hearing on the matter at least one
week after the date on which the request is made. If, as a result of the hearing, the council finds that an
ordinance violation exists, then the council may suspend or revoke the permit.

Sec. 22-14. - License and permit display.
All permits issued under state law or this chapter shall be prominently displayed during the permit year
at the premises where gambling is conducted.

Sec. 22-15. - Notification of material changes to application.
An organization holding a state issued premises permit or a local permit shall notify the city in writing
whenever any material change in the information submitted in the application occurs within ten days of
the change.

Sec. 22-16. - Contribution of net profits to fund administered by city.
(a) Each organization licensed to conduct lawful gambling within the city pursuant to Minn. Stats. §
349.16, as it may be amended from time to time, shall contribute ten percent of its net profits derived
from lawful gambling in the city to a fund administered and regulated by the city without cost to the
fund. The city shall disburse the funds for lawful purposes as defined by Minn. Stats. § 349.12, subd.
25, as it may be amended from time to time. An organization's receipts from lawful gambling that is
exempt from licensing under Minn. Stats. § 349.166 are not subject to ten percent contribution imposed
by this section.
(b) The ten-percent contribution imposed by this section shall be paid to a fund administered and
regulated by the city, without cost to the city, for disbursement for lawful purposes on a monthly basis
and shall be reported on a duplicate copy of the gambling tax return filed with the state lawful gambling
control board each month. The report shall be an exact duplicate of the report filed with the state lawful
gambling control board, without deletions or additions, and must contain the signatures of organization
officials as required on the report form. At the time of submitting a copy of the gambling tax return, each
organization shall also file a computation of charitable contribution form.
The gambling tax return and payment of the contribution due must be postmarked or, if hand-delivered,
received in the office of the finance director on or before the last day of the month following the month
for which the report is made.
An incomplete gambling tax return will not be considered timely unless corrected and returned by the

due date for filing. Delays in the mailing, mail pickups, and postmarking are the responsibility of the
organization.

(c) There shall be an interest charge of eight percent per annum on the unpaid balance of all overdue
contributions owed by an organization under this section.
(d) The city council shall disapprove any pending application for renewal or the original issue of a
lawful gambling license for any organization which owes delinquent contributions to the city. Further,
the police chief may notify the state lawful gambling board of any organization owing delinquent
contributions to the city and may request that the board revoke or suspend the organization's license
during the license year. The city council shall not issue or renew any on-sale or off-sale alcoholic
beverage license, bottle club permit, or food license to any organization which owes delinquent
contributions to the city. The remedies in this subsection are not exclusive and shall be in addition to
any other powers and remedies provided by law.

Sec. 22-17. - Designated trade area.
(a) Each organization licensed to conduct gambling within the city shall expend 51 percent of its
lawful purpose expenditures on lawful purposes conducted within the city's trade area.
(b) This section applies only to lawful purpose expenditures of gross profits derived from gambling
conducted at a premises within the city's jurisdiction.

Sec. 22-18. - Records and reporting.
(a) Organizations conducting lawful gambling shall file with the city clerk one copy of all records and
reports required to be filed with the board, pursuant to Minn. Stats. ch. 349, as it may be amended from
time to time, and rules adopted pursuant thereto, as they may be amended from time to time. The
records and reports shall be filed on or before the day they are required to be filed with the board.
(b) Organization licensed by the board shall file a report with the city proving compliance with the
trade area spending requirements imposed by section 22-16. Such report shall be made on a form
prescribed by the city and shall be submitted annually and in advance of application for renewal.

Sec. 22-19. - Penalty.
Any person who violates:
(1) Any provision of this chapter;
(2) Minn. Stats. §§ 609.75—609.763, inclusive, as they may be amended from time to time; or
(3) Minn. Stats. §§ 349.11—349.21, as they may be amended from time to time, or any rules
promulgated under those sections, as they may be amended from time to time, shall be guilty of a
misdemeanor and shall be subject to a fine of not more than $1,000.00 or imprisonment for a term
not to exceed 90 days, or both, plus in either case the costs of prosecution.

Sec. 22-20. - Severability.
If any provision of this chapter is found to be invalid for any reason by a court of competent jurisdiction,
the validity of the remaining provisions shall not be affected.

Sec. 22-21. - Effective date.
This chapter becomes effective on the date of its publication, or upon the publication of a summary of
the ordinance from which this chapter derives, as provided by Minn. Stats. § 412.191, subd. 4, as it
may be amended from time to time, which meets the requirements of Minn. Stats. § 331A.01 subd. 10,
as it may be amended from time to time.

CITY COUNCIL POLICIES ON AWARDS OF
CHARITABLE GAMBLING TAX FUNDS
1. All licensed charitable gambling organizations within the City are required to
contribute 10 percent (10%) of net profits derived from lawful gambling
activity in the City to the Charitable Gambling Tax Fund. These funds are
dispersed by the City Council for lawful expenditures.
2. Charitable Gambling Tax Funds shall be distributed for projects, equipment,
or activities that are based in the community and which primarily benefit of
Maplewood residents.
3. The allocation of Charitable Gambling Tax Funds is an annual award and
receipt of funds does not in any way guarantee or commit the City of
Maplewood to funding in any subsequent year. Each years funding requires a
new, separate application.
4. Projects which involve the purchase of equipment, supplies, or specific items
will be looked upon more favorably than requests for salaries or general
operating costs.
5. All funds are required to be expended for the requested project within one
year of the date of receipt of the award letter. Grantees shall submit such
receipts or other proof of expenditure for the proposed purpose with their
request for payment of the grant award.
6. No employee or department of the City of Maplewood shall solicit a donation
from a licensed charitable organization without City Manager approval. If
there is a financial need for a specific program that was not funded in the City
budget, staff may submit a request to the City Manager for the use of
Charitable Gambling Tax Funds.
7. In general, requests from organized athletic groups will not be funded.
Funding for these programs should be from participating families or
community auxiliary groups. There are so many athletic organizations within
the community that the City of Maplewood is not capable of funding their
financial requests nor fairly determining appropriate recipients.
8. The City of Maplewood grants funds from Lawful Gambling Tax Fund to
support activities and services benefiting Maplewood residents.. The first
priority in the granting of funds will be given to the City of Maplewood
domiciled organizations. The second priority or consideration will be given to
funding requests from other organizations which are used primarily for the
benefit of Maplewood residents.
9. All applications must be complete and submitted by the application deadline
established by the City Manager.
