4. Budget Transfer
Accepted the donation of $1,250.00 from the Maplewood Moose Lodge, North St. Paul
VFW and Champion Paper Company of St. Paul for the purpose of purchasing hydrant
marker flags. Approved the transfer of $1,250.00 from the hydrant charge contingency
account into the hydrant charge maintenance materials account.
5. Change Order - Holloway Avenue Improvement
Resolution No. 84 -10 -142
WHEREAS, the City Council of Maplewood, Minnesota has heretofore entered into
a Joint Powers Agreement with Ramsey County and North St. Paul and has ordered made
Improvement Project No. 81 -12 and has let a construction contract therefor pursuant
to Minnesota Statutes, Chapter 429; and
WHEREAS, it is now necessary and expedient that said contract be modified and
designated as Improvement Project No. 81 -12, Change Order- No. 3.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that
the Mayor and City Clerk are hereby authorized and directed to modify the existing
contract by executing said Change Order No. 3.

7. Maplewood Project 82 -9 Stipulation (Hedlund)
Resolution No. 84 -10 -143
WHEREAS, the . Parcel No. 22 is owned by Gordon Hedlund and is described as follows:
Lot 21, Block 31, Gladstone Plat 2, Property ID Number 57 29810 210 31, Ramsey
County, Minnesota.
WHEREAS, that owner pursuant to the provisions of Minnesota Statutes , Sections
429.061 and 429.081 has taken timely appeal from that special assessment for local
public improvement Project No. 82 -9 for storm drainage;
WHEREAS, Respondent adopted a special assessment for local p u b l i c improvement
Project No. 82 -9 so far as the same pertains to said Parcel 22 in the amount of $437.00
on August 11, 1983;
NOW, THEREFORE, it is agreed by and between the parties hereto as follows:
1. That as to Parcel 22, the assessment levied by the City Council, on August
11, 1983 for development of a storm drainage system is hereby dismissed.
2. That the effective date of the dismissal of the assessment shall be October
8, 1984,
3. That the owner, through the undersigned, their attorney hereby waive any and
all right of further notice and appeal as provided forth in Minnesota Statutes
Section 429 as amended.
4. That the above proposed d i s m i s s a l of assessment is accepted by the City Council
through the undersigned, its City Attorney and shall constitute the special assessment
for local p u b l i c improvement project against said Property Identification No . 57
29810 210 31.

5. That the terms and provisions of Ma p pMaplewoodCitytyCouncilResolutionsadopting the
original assessment role insofar as they are not otherwise inconsistent herewith,

transmit a certified duplicate of the rescinded assessment as determined hereunder
to the Ramsey County Auditor to be removed on the property and the owner shall not
be liable for penalties and interest through and including the date hereof,
7. That the above entitled action having been hereby fully compromised and settled,
is stipulated and agreed that the same may be, and hereby is d i smi s-sed on its merits
with prejudice and the Clerk of said above named District Court upon filing of the
Stipulation, is hereby authorized and directed to dismiss any action of record.

BE IT FURTHER RESOLVED that authorization is hereby given to transfer $230,000
of revenue sharing monies to the General Fund to partly finance the contracts
between the City and its three fire departments: Gladstone, Parkside and East
County Line.
BE IT FURTHER RESOLVED that the transfer of appropriations among the various
accounts within a department budget or within a non - departmental expense category
shall only require the approval of the City Manager, except that any transfer
of appropriations within a departmental budget so as to increase the salary approp-
riation shall require the approval of the City Council.
BE IT FURTHER RESOLVED that all appropriations which are not encumbered or
expended at the end of the fiscal year shall lapse and shall become a part of
the unencumbered fund balance which may be appropriated for the next fiscal year
except appropriations for capital improvement projects which shall not lapse until
the project is completed or cancelled by the City Council.

In accordance with Minnesota Statutes 475.61 and 273.13, Subd. 19 (3), (a),,
b), (c) and Chapter 297a and Chapter 162 of Minnesota Statutes, the County
Auditor of Ramsey County is hereby authorized and directed to reduce by the
amounts above mentioned the tax that would be otherwise included in the rolls
for the year 1984 and collectible in 1985.

a Mayor Greavu convened the meeting for a p u b l i c hearing regarding the request
of Albert and Marilyn Galbraith for a side yard setback variance of 18.5 feet
to construct an addition to their house.
b. Manager Evans presented the staff report.
c. Commissioner Lorraine Fischer presented the following Planning Commission
recommendation:
WHEREAS, Albert and Marilyn Galbraith applied for a variance for the following-
described property:
Lots 10 and 11 and the south 6 feet of lot 9 in block 8, Lakeside Park
Th. i s property is also known as 1770 Edward Street, Maplewood;
WHEREAS, Section 36 -71 (1) of the Maplewood Code of Ordinances requires a 30 foot
side yard setback on the street side of a corner lot
WHEREAS, the applicant is proposing an 11.5 foot setback, requiring a variance
of 18.5 feet;
WHEREAS, the procedural history of this variance is as fo l l ows :
1. This variance was applied for on September 7, 1984.
2, This variance was reviewed by the Maplewood Planning Commission on October
1, 1984:. The Planning Commission recommended to the City Council that said variance
be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD PLANNING COMMISSION that the above
described variance be approved on the basis of the following findings of fact:
1. There is an undue hardship on this lot because it is substandard in width
70 feet). Code requires 100 feet of width. The required side yard setback of
30 feet unduly restricts the buildable width of the lot and the house is already
built to the minimum setback on the north side.
2. The spirit and intent of the ordinance is to keep a uniform setback from public.
streets and provide adequate sight distance at the corner. The intent of the
ordinance is met, because:
a. Sophia Street is a short street without uniform setbacks.
b. Council approved a variance in 1972 to allow the house across the street
1763 Edward Street) to be built with a side yard setback of 15 feet.

c. While there are no records of variances, aerial photos show that the garage
at 1756 Edward Street and the hosue at 1758 Phalen Place appear to be built
at the right of way line,
d. The existing garage is already bu i 1 t 9.5 feet from the right of way l i n e .
e. The addition would not be seen by any other houses, except the house to the
south, because of existing trees.
f 'The addition would not interfere with the sight distance at the corner.

Larson, Pellish, Sigmundik, Whitcomb."

h. Councilmember Maida introduced the following resolution and moved its adoption:

of Mogren Landscaping for a $1,200,000 Industrial Revenue Note to acquire land
and construct and equip a 15,000 square foot office building to be located on
the east side of White Bear Avenue between Lydia Avenue and Beam Avenue, directly
north of the Maplewood East Shopping Center.
b. Manager Evans presented the staff report.
c. Ms. Mary Ippel, Briggs and Morgen, explained the specifics of the proposal.
d. Mayor Greavu called for proponents. None were heard.

COMMERCIAL FACILITIES DEVELOPMENT PROJECT
GIVING PRELIMINARY APPROVAL'TO THE PROJECT
PURSUANT TO THE MINNESOTA
MUNICIPAL INDUSTRIAL DEVELOPMENT ACT
AUTHORIZING THE SUBMISSION OF AN APPLICATION
FOR APPROVAL OF THE PROJECT TO THE

ENERGY AND ECONOMIC DEVELOPMENT
AUTHORITY OF THE STATE OF MINNESOTA
AND AUTHORIZING THE PREPARATION OF
NECESSARY DOCUMENTS AND MATERIALS
IN CONNECTION WITH THE PROJECT
WHEREAS,
a) The purpose of Chapter 474, Minnesota
Statutes, known as the Minnesota Municipal Industrial
Development Act (the "Act ") as found . and determined by the
legislature is to promote the welfare of the state by the
active attraction and encouragement and development of economi-
cally sound industry and commerce to prevent so far as possible
the emergence of blighted and marginal lands and areas of
chronic unemployment;
b) Factors necessitating the active promotion
and development-of economically sound industry and commerce are
the increasing concentration of population in the metropolitan
areas and the rapidly rising increase in the amount and cost of
governmental services required to meet the needs of the
increased population and the need for development of land use
which will provide an adequate tax base to finance these
increased costs and access to employment opportunities for such
population;
c) The City Council of the City of Maplewood
the "City ") has received from Mogren Landscaping, a general
partnership organized under the laws of. the State of Minnesota
the "Company ") a proposal that the City assist in. financing a
Project hereinafter described, through the issuance of a
Revenue Bond or Bonds or a Revenue Note or Notes hereinafter
referred to in this resolution as "Revenue Bonds" pursuant to
the Act;
d) The City desires to facilitate the selec-
tive development of the community, retain and improve the tax
base and help to provide the range of services and employment
opportunities required by the population; and the Project Will
assist the City n achieving those objectives. The Projecty
will help to increase assessed valuation of the City and hel p
maintain a positive relationship between assessed valuation and
debt and enhance the image and reputation of the community;
e) The Company is currently engaged in the
business of sod and landscaping. The Project to be financed by
the Revenue Bonds is an approximately 15,000 square foot office
building to be located on the East side of White Bear Avenue
betwsen Lydia Avenue and Beam Avenue directly North of the
Maplewood East Shopping Center in Maplewood, Minnesota to be
leased to Edina Realty and consists of the acquisition of land
and the construction of buildings and improvements thereon and
the installation of equipment therein to be initially owned and
operated by the Company, and will result in the employment of
additional persons to work within the new facilities;

f ) The City has been advised ,by , representa-
tives of Company that conventional, commercial f i.nanci.ng to pay
the capital cost of the Project is available only on a limited
8basisandatsuchhigh costs of borrowing that the economic
feasibility psibilitofoperating the Project would be significantly
d ced but Company has also advised this Council that . with

he aid of municipal financing, and its resulting low borrowing
cost, the Project is economically more feasible;
g) Pursuant to a resolution of the City
Council on1adoted September 10, 1984, a public hearing on the

City of Maplewood, Minnesota, as follows:
The Council here gives preliminary approval to the

proposalosal of Company that the City undertake the Project
pursuant to the Minnesota Municipal Industrial Development Act
Chapter nneso474, Minnesota Statutes), consisting of the acqul-
sition, construction and equipping of an approximately 15,000
square foot office building to be located on the East side of
White Bear Avenue between Lydia Avenue and Beam Avenue directly
north of . the Maplewood East Shopping Center in Maplewood,
Minnesota, to be leased to Edina Realty pursuant to Company's
specifications suitable for the operations described above to
be initially owned and operat by the Company and pursuant to
a revenue agreement between. the City and Company upon such
terms and conditions with provisions for revision from time to
time as necessary, so as to produce income and revenues
sufficient to pay, when due, the principal of and interest on
the Revenue Bonds in the maximum aggregate principal amount of
1 200 , 0QO to be issued pursuant to the Act to finance the
acquisition, construction and equipping of the Project, and
said a 1 reement. may also provide for the entire interest of
Company therein to be mortgaged to the purchaser of the Revenue
Bonds; and the City hereby undertakes preliminarily to issue
its Revenue Bonds in accordance with.such terms and conditions;
2. On the basis of information available to this Council
t appears, and the Council hereby finds, that the Project1pP
ersonalconstitutesproperties, real and p , used or useful in
connection with one or more revenue producing enterprises
engaged Ynaedinan business within the meaning of Subdivision la of
Section 474.02 of the Act; that the Project furthers the

Project would not be undertaken but for the availability of

Company, and the purchaser of the Revenue Bonds as to the u lti-
mate details of the financing of the Project;
4. In accordance with Subdivision 7a of Section 474.01
Minnesota Statutes, the Mayor of the City is hereby authorized
and directed to submit the proposal for the Project to the
Authority requesting its approval, and ot'ner officers,
employees and agents of the City are hereby authorized to
provide the Authority with such preliminary information as it
may require;
5. Company has agreed and it is hereby determined that
any and all costs incurred by the City in connection with the
financing of the Project whether or -not the Project is carried
to completion and whether or not approved by the Authority will
be paid by Company;
6. Briggs and Morgan, Professional Association, acting as
bond counsel, and ,
investment bankers, are authorized to assist in the preparation
and review of necessary documents relating to the Project, to
consult with the City Attorney, Company and the purchaser of
the Revenue Bonds as to the maturities, interest rates and
other terms and provisions of the Revenue Bonds and as to the
covenants and other provisions of the necessary documents and
to submit such documents to the Council for final approval;
7. Nothing in this resolution or in the documents pre-
pared pursuant hereto shall authorize the expenditure of any
municipal funds on the Project other than the revenues derived
from the Project or otherwise granted to the City for this
purpose. The Revenue Bonds shall not constitute a charge, lien
or encumbrance, legal or equitable, upon any property or funds

of the City except the revenue and proceeds pledged to the
y payment thereof, nor shall the City be subject to any liability
thereon. The holder of the Revenue Bonds shall never have the
right. p Yht. to compel an exercise of the taxingpower of the City to

interest thereon, or to enforce payment thereof against any
property o€ the City. The Revenue Bonds shall recite in
substance that the Revenue Bonds, including interest thereon,

authorized to make such expenditures and advances toward

financed from the proceeds of the Revenue Bonds as Company con-
siders necessary, including the use of interim, short -term
financing, subject to reimbursement from the proceeds of the
Revenue Bonds if and when delivered but otherwise without
liability on the part of the City;
9. If construction of the Project is not started within
one Y ear from the date hereof, this resolution ,shall thereafter
have no force and effect and the preliminary approval herein
granted is withdrawn;

low borrowing costs, the Project is

the financing program and the amendment of
the "Housing Revenue Bond Program portion
of the City's 4620 Housing Plan therefor was
held at 7:20 p.m. on October 8, 1984, after
notice was published, all as required by
Minnesota Statutes, Section 462C.05 subd. 3,
at which public hearing all those appearing
at said hearing who desired to speak were

h) No public official of the City has
either a direct or indirect financial
interest in the Project nor will any public

WOW THE BE IT RESOLVED by the City Council of
the City of Maplewood, Minnesota, as follows s
1. The City hereby gives' preliminary approval to the
proposal of the Developer that the City undertake the Project,

pursuant to Minnesota Statutes, Chapter 462C, consisting of the
construction and equipping of multi - family rental housing
facilities within the City pursuant to the Developer's
specifications and to a revenue agreement between the City and

income and revenues sufficient to pay, when due, the principal
and interest on the Bonds in a total principal amount of approx-
imately $3,800,000 to be issued pursuant to the Act to finance
the construction and equipping of the Pro ject f and said
agreement may also provide for the entire interest of the
Developer therein to be mortgaged to the purchaser or
purchasers of the Bonds, or a trustee for the holder (s) of the
Bonds; and the City hereby undertakes. preliminarily to issue
its bonds in accordance with such terms and conditions;

the City's 462C Housing Plan as herein proposed to be amended
in hereby approved and adopted and the City Clerk is authorised

of Castle Design and Development Company to revise the conditional use permit
for Maple Greens planned unit development to substitute 64 rental apartment units

c. Commissioner Lorraine Fischer presented the following .Planning Commission
recommendation:
Commissioner Whitcomb moved the planning commission recommend the City Council
adopt the following resolutions vacating the plat and streets and amending the
conditional use permit for the Maple Greens planned unit development to substitute
eight eight -plex apartment structures for 13 four -plex town house (quad) structures
originally approved south of Geranium Avenue along Evar Street and Jessamine Avenue
presently platted as block one and lots one through 36, block two) Sterling Glen
Addition:
WHEREAS, Castle Design and Development initiated a revision to the conditional
use permit for the Maple Greens planned unit development at the following described
property:
Block one and lots one through 36, block two Sterling Glen Addition, Section
25, Township 29, Range 22;

WHEREAS, the procedural history of this conditional use permit is as follows:
1. This conditional use permit was initiated by Castle Design and Development,
pursuant to the Maplewood Code of Ordinances.
2. This conditional use permit was reviewed by the Maplewood Planning Commission

on September 17, 1984. The Planning Commission recommended to the City Council
that said permit be approved
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the above
described conditional use permit revision be approved on the basis of the following
findings of fact:
1. The use is in conformity with the City's Comprehensive Plan and with the
purpose and standards of this chapter.
2. The establishment or maintenance of the use would not be detrimental to
the p u b l i c health, safety or general welfare,
3. The use would be located, designed, maintained and operated to be compatible
with the character of that zoning district.
4. The use would not depreciate property values.
5. The use would not be hazardous, detrimental or disturbing to the present
and potential surrounding land uses, due to the noises, glare, smoke, dust, odor,
fumes, water pollution., water run -off, vibration, general unsightliness, electrical
interference or other nuisances.
6. The use would generate only minimal vehicular traffic on local streets
and shall not create traffic congestion, unsafe access or parking needs that w i l l
cause undue burden to the area properties.
7. The use would be serviced by essential public services, such as streets,
police, fire protection, utilities, schools and parks.
8. The use would not create excessive additional requirements at public cost
for p u b l i c f a c i l i t i e s and services; and would not be detrimental to the welfare
of the City.
9. The use would preserve and incorporate the site's natural and scenic features
into the development design.
10. The use,would cause minimal adverse environmental effects.
11. The revision is consistent with the original planned unit development.
Approval is subject to the following conditions:
1. The applicant vacating the underlying platted 1 of s and street rights of
way from the Sterling Glen Addition .
2. Construction beginning within one year, unless Council authorizes a time
extension, if necessary.

3 . Adherence to the site plan dated September 11, 1984, with the following
revisions:
a. Increase the parking s t a l l s to 20 feet of depth,
b. Increase the separation between the open parking stalls and the dwelling
units to at least 15 feet.
4. Approval of the site, building and landscape plans by the Community Design
Review Baord.
5. Submission of an erosion control plan for approval by the City Engineer,
WHEREAS, Castle Design initiated proceedings to vacate the p u b l i c interest
in the following described real property:
Block one., lots one through 36, block two, Sterling Glen Addition, Section
25, Township 29, Range 22, including Evar Street and Jessamine Avenue
WHEREAS, the procedural history of this vacation is as follows:
1. This vacation was initiated by Castle Design.
2. A majority of the owners of property abutting said streets have signed
a petition for this vacation.
3. This vacation was reviewed by the Planning Commission September 17, 1984.
The Planning Commission recommended to the City Council that this vacation be
approved.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD PLANNING COMMISSION that it

An Ordinance Regarding Liquor License Bonds
Section 1. Section 5- 109.of the Maplewood City Ordinances regarding bonds required
from licensees is hereby amended to read as follows:
a ) No "on sale,,." license under this d i v i s i o n shall be ranted until a bondbegranted
in the amount of three thousand dollars ($3,000.00) has been furnished, approved
by the City Council and filed with the proper City officers. Such bond shall
cover both the regular "on sale" license and any Sunday sales license issued to
the same licensee.
b) No "off sale" license under this division shall be granted until a bond
in the sum of one thousand dollars ($1,000,00) sha i i be furnished and approved
by the State Commissioner of Public Safety and the City Council, and filed with
the proper City Officers.
c) The surety on a bond required by subsection (a) or (b) of this section
shall be a surety company duly licensed to do business in the State and the bond
shall be approved as to form and execution by the City Attorney.
d) All bonds required by subsection (a) or (b) of this section, when approved
by the proper City or State officers, shall be deposited with the City Clerk.
e) All bonds required by subsection (a) or (b) of this section, whether
for an "off sale" or "on sale" license, shall be conditioned as follows:
1) That the licensee will obey the law relating to such licensed business.
2 ) That the licensee w i l l pay to the City, when due, all taxes, license
fees, penalties and other charges provided by law.
3) That in the event of any violation of the provisions of any law re-
lating to the business which the license has been granted for the sale of
intoxicating liquor,, such bond shall be forfeited to the City or in lieu of
forfeiture at the City's option, and upon agreement of the City and licensee
the licensee shall pay to the City an agreed amount up to the total amounts
of the bond.
4) That the licensee will pay, to the extent of the principal amount
of such bond, any damages for death or injury caused by or resulting from
the violation of any provisions of law relating to the business for which
such licensee has been granted a license, and further conditioned that such
recovery may be had also against the surety on his bond. The amount specified

in any bond required is declared to be a penalty and the amount recoverable
shall be measured by the actual damages, provided however, that the surety
thereon shall not be liable for any amount in excess of the penal amount of
the bond.
5) All such bonds shall be for the benefit of the obligee and all persons
suffering damages by reason of the breach of the cond i t i ons thereof. Such
bonds shall run to the City as obligee, and in the event of a forfeiture of
any such bond for violation of the Taw, the District Court of Ramsey County
may forfeit the penal sum ofthe said bond, or any part thereof. to the City.

Public Employees Retirement Association (PERA); and
WHEREAS, cities raise property taxes which are contributed to PERA as the
employer share of retirement benefits for City employees; and
WHEREAS, the Association of Minnesota Counties' trustee on the PERA Board,
in conjunction with the League of Cities appointed trustee and other appointed
and elected trustees , raised significant quest i ons regarding the appointment process
used to hire an interim exective director of PERA;
NOW, THEREFORE, BE IT RESOLVED that the City of Maplewood supports the actions
of the Association of Minnesota Counties' trustee and other members to remove
the interim director and to proceed with an open process of selection for PERA
executive director. I
BE IT FURTHER RESOLVED that the Legislative Auditor conduct a five year com-
pliance audit of the PERA fiscal operat i ons .
BE IT FURTHER RESOLVED, that the City of Maplewood w i l l not enter into any
services offered by PERA (such as life insurance or auto insurance programs) until
it is clear that the management of PERA is consistent with good public policy.

There have not been any compla received regarding this use and all
building and fire safety code requirements are being met.
Recommendation
Adoption of the resolution on page 8 renewing the conditional use
permit . for the Gladstone Community Center at 1945 Manton Street for
five years, subject to the following conditions
1. Council may review any future use, not presently in the Gladsto
Community Center, excepting those classes and programs conducted by
School. District 4622 or other public, parochial or private schools.
20 All building and fire code regulations must be met and a
certificate 'of occupancy must be issued for each new use.

tory, mausoleum or any other place for the disposal of the human
dead,
b. Section 36-442(e) st that all conditional use permits
shall be reviewed by the council within one year of the date of
initial approval, unless such review is waived by council

decision or ordinance, At the one year review, the council may
specify an indefinite term or specific term, not to exceed five
Years, for subsequent reviews. The council may impose. new or
additional conditions upon the permit at the time of the initial
or subsequent reviews,

Maplewood revised description number 181, a specific part of MW

Gladstone Plat No. 2, E 1/2 of vacant alley adjoining and

WHEREAS, the procedural history of this conditional use permit iS

the following findings -of -fact:
1. The use is in conf ormi ty with the city's comprehensive plan
and with the purpose and standards of this chapter.
2. The establishment or maintenance of the use would not be
detrimental to the public health, safety or general welfare.
3. The use would be located, designed, maintained and operated
to be compatible with the character of that zoning district.
4. The use would not depreciate property values.
5. The use would not be hazardous, detrimental or disturbing tc
present and potential surrounding land uses, due to the noises, glare,
Smoke, dust, odor, fumes, water pollution, water run-off, vibration,
general unsightliness, electrical interference or other nuisances.
610 The use would generate only minimal vehicular traffic on
local streets and shall not create traffic congestion, unsafe access
or parking needs that will cause undue burden to the area properties.
7. The use would be serviced by essential public services, such
as streets, police, fire protection, utilities, schools and parks.
8. The use would not create excessive additional requirements
at public cost for public facilities and services; and would not be
detrimental to the welfare of the city.

and scenic features into the development design.
lo. The use would cause minimal adverse environmental effects.
11. There have not been any complaints received regarding this

PROPOSAL
It is proposed that a transfer from the Payroll Benefit Fund to the Workers'
Compensation Reserve Fund be authorized to close the latter fund.

The Workers' Compensation Reserve Fund was established effective October 4, 1979
to provide a reserve to cover potential extra costs that could result from the
Clity*ls conversion from a prospective to a retrospective ratin 9 plan for workers'
compensation insuran The basic difference between these two rating plans is
that under the retrospective rati. ng plan there is a greater adjustment of the
annual premium for losses incurred. The annual premium on the City's workers'
compensation insurance is charged to each operating department and deposited
into this fund. From this fund, the premium installments are paid and temporar
monies on hand are invested. Thi fund also receives. all premi cred and
finances extra premium charges,
In 1983, the City changed back to a prospective rating plan due to a higher
level of claims being incurred. This factor, along with higher dividends being
paid on prospective rating plans decreased the financial incentives of retrospective.
rating plans. Therefore, there is ho longer a need to place money in a reserve fund
because the City is no longer exposed to potential extra workers' compensation cost
Currently there is a deficit in the Workers' Compensation Reserve Fund of $4,356.59.
It would be appropriate to eliminate this deficit by a transfer from the Payroll
Benefit Fund as this fund is designed to finance the cost of employee insurance
benefits.
RECOMMENDATION
It is recommended that authorization be given for a transfe of $4,356.59 from the
Payroll Benefit Fund to the Workers' Compensation Reserve Fund to close the latter
fund.

Minnesota Statutes, Chapter 475.553 provides for destruction of cancelled bonds and
coupons the City receives 'periodically from its paying agents.
This section does not rov i de for any time frame that the City must retain bonds andp .
coupons prior to destruction. However, these bonds and coupons are contracturalP
obligations between the City and the holders of the obligations, and a re subject to
the six Pearstatuteoflimitation eriod for a contract claim. For this reason,y
the City may wish to retain the cancelled bonds and coupons for such a six year period.
Assuming this to be true, . the City Council may order the Clerk or other appropriate
nofficial, by resolution,'-to1ution, to properly destroy the cancelled bonds and couponss for which
the six year statute of limitation has expired.

Attached is a feasibility study of the storm drainage and sanitary
sewer systems for the Beaver Lake area that was prepared by TKDA, Inc.
This study summarizes the , proj ected storm water rates and required
pond storage and sedimentation volumes to control these flows. The
study also summarizes the projected flow rates and available
capacities in the sanitary sewer system. Based upon the findings of
this study and additional calculations made by the engineering
department, the following plan is proposed to provide adequate storm
drainage and sanitary sewer capacity for this area:

study, pond #5 and pond #4 should be combined and referred to as pond

2. The existing site of pond #4 provides an adequate storage
capacity of 56.93 acre -feet without excavation to a maximum high water
elevation of 965.80 during the 100 -year design event. Design
standards recommend that approximately two feet of freeboard be
provided between the lowest floor elevation fronting on the pond and
the maximum high water elevation during the 100 --year design, storm.
39 Some minor excavation and ditching would be required in the
existing pond #4 site to provide proper drainage to the 35 inch RCP
culvert connecting pond #4 to pond #20
49 A drainage easement should. acquired from the developer, Castle
Design and Development Co., Inc., for the proposed pond #4 site. The
developer has used the density credit from the proposed pond #4 site
in his development plans for the Beaver Creek Carriage Home
condominiums.
50 As part of the development of the Beaver Creek Carriage Home
condominiums, the developer has submitted site grading plans, which
call for development of pond #2. This pond should be graded to
provide 12.4 acre -feet at a maximum high water elevation of 965.70.
As part of the development, Castle Design will dedicate the drainage
easement to the city.
6. The existing site is adequate to provide the necessary storage
for pond # 1. An easement should be acquired for this site.
7. Sediment basins should be constructed at the outlets from pond #2
and pond #1 to control pollutants from entering Beaver Lake.
80 The ditch between pond #2 and pond #1 should be channelized and
riprapped to provide adequate flow capacity and erosion protection.

t 90 The. current 48 inch outlet under Lakewood Drive from pond #1 is
adequate, but the inverts are below the normal lake level which create
serious maintenance problems, This culvert should be raised as p ar t
of the McKnight Road project to the normal lake level, No work should
be performed as part of this project on the culvert.
10. The sanitary sewer pipes are adequate f or current f lows but are
projected to be under capacity when the area becomes fully developed,
Development of the Beaver Lake Hills site is uncertain at this time,
it is. recommended that no ' work be performed on the sanitary sewer
pipes at this time as part of this project.
116 Lift station #6 handles all the sanitary sewer flow for this
area It is currently under capacity and will be upgraded as a
budgeted item in 1985. The flows as calculated for this project will
be used to adequately meet the projected future demand. No work on
lift station . #6 is recommended as part of this project.
12. The cost to implement this plan is estimated to be.$650,000.00
including land acquisition, sediment basins, excavation, riprap and
indirect costs . The proposed as area contains approximately
10,515,000 square feet, which leaves a proposed assessment rate of
0615/foot.
It is requested that the city council considered this study and plan.

FACILITIES DEVELOPMENT PROJECT
PURSUANT TO THE MINNESOTA MUNICI PAL
INDUSTRIAL DEVELOPMENT ACT AUTHORIZING
THE PUBLICATION OF A NOTICE OF THE HEARING
WHEREAS,
a) Chapter 474, Minnesota Statutes,
known as the Minnesota Municipal Industrial
Development Act (the "Act ") gives muni-
cipalities the power to issue revenue bonds
for the purpose of the encouragement.and
development of economically sound industry
and commerce to prevent so far as possible'
the emergence of blighted and marginal lands
and areas of chronic unemployment;
b) The City Council of the City of
Maplewood (the "City ") has received from
2960 Associates, a - general partnership to be
organized. under the laws of the State of
Minnesota with Gerald C Mogren, Robert C.
Mogren and Lee Clintsman as general partners
and others to be named (the "Company ") a
proposal that the City assist in financing a
project - hereinafter described, through the
issuance of its industrial revenue bonds
which may be in the form of a single debt
instrument) (the "Bonds") pursuant to the
Act;
c) Before proceeding with consider-
ation of the request of the Company it is
necessary for the City to hold a public
hearing on the proposal pursuant to Section
474.01, Subdivision 7b, Minnesota Statutes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Maplewood, Minnesota, as follows:
1. A public hearing on the proposal of the Company
will be held at the time and place set forth in the Notice of
Hearing hereto attached.

Description of Project

The maximum aggregate estimated principal amount of

property of the City except the project and such bonds or
obligations will not be a charge against the City's general

Request
Approval of a lot width variance to create an 85 foot wide corner lot.
Proposal
1. A 160 x 133 foot single- dwelling parcel would be split into two
single dwelling lots - -85 x 133 feet and 75 x 133 feet. (Refer to the
map on page 9) .
2. The garage on proposed Tract B (page 9) would be relocated to
Tract A. The driveway access to the relocated garage would continue
to be from Sophia Avenue
3. If council approves this variance request, the'lot division will
be processed administratively.
Comments
This request is consistent with the requirements for approval of a
variance. Approval would also not compromise the intent of the
subdivision or zoning codes.

Approve the enclosed resolution (page 12) , approving a 15.91 f oot lot
r!_ width variance to subdivide 1700 Clarence Street into an 84.81 foot
wide corner lot and a 75.19 foot wide interior lot, on the basis that:
10 Strict enforcement of the zoning code would cause an undue
hardship unique to this property because:
a. The proposed corner lot is similar in width to the majority
of developed corner properties in this vicinity.
b. The essential character of the locality would be enhanced
because the substandard front yard setback of the garage would be
eliminated.
C. This is the only remaining lot in this area that is large
enough to be considered for subdivision.

met because:
a. Approval of this. request would not result in a sight distancE

Site Description
Size: 21,280 square feet with 133 feet of frontage on Clarence S tre_t
and 160 feet of frontage on Sophia Avenue
Existing land use: a single dwelling and garage. The dwelling is
located 8.25 feet from the Clarence Street right -of -way. The garage
complies with the maximum area requirement of not more than 75 perce-t
of the habitable area of the dwelling,
Surrounding Land Uses
North: Sophia Avenue. Across the street are single dwellings locat =d .
on corner lots with 80 and 75 feet of width.
East: single dwelling
South: a single dwelling on an 87 foot wide corner lot
West: Clarence Street. Across the street are single dwellings.
Past Actions
10-10-83:
Council approved lot width variance of seventeen feet to create an 83 ,
foot wide corner lot at 2108 McMemeny Street for Martha Wegleitner, rn
the basis that:
1. The city has approved comparable corner lot width variances in tie
past.
2. The resulting lot would be in keeping with the spirit and intent
of the code because all setback requirements could be met,
3. The existing house was constructed prior to adopting of city
zoning codes. As such its placement presently precludes compliance
with minimum lot frontage requirements.
4. Four similar sized corner lots have been developed in this
neighborhood.

Council approved lot width variances of 21 feet for two corner lots in
Robert Tilsen's Maplewood Heights #13 plat (page 10) on the basis than:
1. Strict enforcement of the code would cause an undue hardship
because of circumstances unique to this property.
2. The variances meet the spirit and intent of the code.

3. The lots would be in character with the neighborhood.
The dwelling at 2266 County Road D is too close to McKnight Road but
was in existence before McKnight Road was improved, similar to the
circumstances of this . request. The proposed density was also 18.8
people /net acre in an area. planned for 14 people /net acre.

40 Compliance with land use laws:
a. State law.
1) Section 462.357, Subd. 6 requires that the following
findings be made before a zoning variance can be granted:
a) Strict enforcement would cause undue hardship
because of circumstances unique to the individual
property under consideration. Undue hardship as used
in connection with the granting of a variance means tie
property in question cannot be put to a reasonable us
if used under conditions allowed by the official
controls, the plight of the landowner is due to
circumstances unique to his property not created by tle
landowner, and the variance, if granted, will not alter
the essential character of the locality. Economic
considerations alone shall not constitute an undue
hardship if reasonable use for the property exists
under the terms of the ordinance.
b) The variance would be in keeping with the spirit
and intent of the ordinance.
2) Section 462.358, Subd. 6 states "subdivision regula-
tions may provide for a procedure for varying the
regulations as they apply to specific properties where an
unusual hardship on the land exists,. but variances may be
granted only upon the specific grounds set forth in the
regulations."
b. City Code:

1) Section 30 -11 (subdivision requirements) states "the
4 planning commission may recommend variations from the
requirements of this chapter in specific cases which, in i - s
opinion, do not ,affect the general plan or the intent of
this chapter. Such recommendations shall be communicated to
the council in writing, substantiating the recommended
variations. The council may approve variations from the
requirements of this chapter in specific cases which, in i :s
opinion, do not adversely affect the plan and spirit of this
chapter."
2) Section 30 -8 (f) (2) requires. single dwelling corner
lots to have at least 100 feet of width.
3) Section 36 -71 requires a dwelling to have at least a
thirty foot wide, side -yard setback from a street right -of-
way. The dwelling at 1700 Clarence is'8.25 feet from the
Clarence Street right-of-way.
4) Section 36 -19 states "wherever the width of a street
right-of-way i increased by action of any governing
authority having the right of condemnation, and such
increase in the width of the street causes the setback
of buildings existing on the abutting property to be less
than the setback provisions set forth in this chapter . .
such resulting reduction in . . setback distance shall nct
be considered a violation of this chapter and shall :n
all respects be considered to be in conformity with this
chapter . . . Such decreased setback . . . is valid and
consistent with the requirements of this zoning ordinance;
provided that, the . . . setbacks of the structure or
structures on the lot or lots prior to said street widening
were lawful, and all uses thereof which were lawful prior io.
such change in . . . setback per to i n -ing thereto shall
continue as permitted uses thereafter as if such reductions
in . 40 setback had not occurred."
The dwelling at 1700 Clarence Street was built prior to
19509 on 9 -9 -52, the east 33 feet of the Clarence Street
right -.of -way was deeded to New Canada Township (Document
1289995)0 The present owner purchased the property on July
1, 1957.
50 The average width of the improved corner lots south of
Ripley Avenue in the area depicted on the enclosed property line
map (page 2) is 87.5 feet.

1. Clarence Street is a local residential street with a right -of -way
width of 66 feet. The present standard for a local street is sixty
feet of right -of -way width.

2. If Clarence Street is ever improved to a standard 32 foot wide
street with curb and gutter, the boulevard area for the property would
be seventeen rather than the typical fourteen feet.
30 There is no need on the part of the city or on the part of the
property owner which would justify requiring the vacation of the eas_
three feet of this right -of -way at this time. The amount of area the t
would be assessable in the event a storm sewer improvement were to b-z
undertaken would be negligible., The applicant cannot be required to
vacate this three feet of right -of -way because the substandard

stipulates that this assessment appeal will be dismissed if the
subject right-of-way is vacated,
Comments
There is no reason to retain this portion of right -of -way. It had
been used for the former alignment of Gervais Avenue,

Approve the resolution (page 9) , vacating a portion of the
Gervais Court right-of-way located south of the intersection of
realigned Gervais Avenue and Gervais Court, subject to the retention
of a utility easement over the entire property.

Enclosed herewith is the feasibility report on the above- referenced
improvements which has been prepared at the council's request. The
report addresses the engineering feasibility of the proposed
improvements, and outlines a proposal for a joint agreement with the
Ramsey . County Public Works Department for construction and cost
sharing of the project..
We are requesting council acceptance of the report and passage of the
attached resolution calling for a public hearing tentatively scheduled

AN ORDINANCE EXEMPTING NONSTRUCTURAL CONSTRUCTION WORK,
WITH LESS THAN $1500 IN VALUATION FROM A BUILDING PERMIT
T H E MAPLEWOOD CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS:
Section 7.Section 9.24 is hereby amended as follows (additions are underlined):

issuance of permits and conduction of inspections pursuant to this articleTheissup
shall be as provided for in Chapter 3 of the Uni orm Building Code, except that a
building permi t shall not be required for nonstructural residential construction of
less than $1500 in valuation. Any fee or charge required to be paid to the city
under the cit y building code shall be imposed, set j establ i shed and fixed by the
cit y council by resolution or as outlined in Section 304 (amended) UBC Table 3a.
The building official shall establish a system for the issuance of required permits

Council requested that staff consider exempting certain types or
value of construction from a building permit.
Reason for the Request
This came up when Mr Todd, at 2800 White

The building code requires a permit for "the construction,
alteration, moving, demolition, repair and use of any building or
structure within the municipality, except work located primarily
in a public way, public utility towers and poles, mechanical
equipment not specifically regulated by the node, and hydraulic
flood control structures" (2 MCAR 1.10201) .
A permit is not required for nonstructural maintenance, such as
replacing doors or windows. A permit was required of Mr. Todd
because he made structural changes in his windows -- changing sizes
and creating bay windows on the front. The valuation was $5,000.
The specific exemptions allowed by the building code are listed
i n . attachment two from the city attorney. The city cannot allow
any other exemptions. While some cities are allowing exemptions
under a minimal dollar valuation, this is not allowed by the
building code.
The building code does allow the city to vary its permit fees.
We should omit fees for permits that do not need inspections,
Recommendation
I. Take no action in regard to exempting types of construction
from a permit, on the basis that:
1. The city is obligated to enforce the building code
without modification. Allowing an illegal exemption may
create liability for the city and defeats the purpose of
having a uniform code.
2. Exempting a minimal dollar valuation may allow struc-
tural changes to be made, even though minor, that should be
inspected.

Effect on Taxes
Greg Bonrothkurch, of the . Ramsey County Assessor's office,, stated th .zt
the assessed value of a house is not increased for maintenance
improvements and generally not increased for remodeling under $1,0oo
in value. Improvements over $1,000 would not effect the assessed
valuation if the improvement did not increase the sales value. As am
example, if a $5,000 improvement were made that did not increase the
sales value of the house, the assessed value would not change.
Likewise, if a $5,r000 improvement resulted in an increase in the sal_s
value of $3,000, the assessed valuation would increase by $3,0000

Enclosed is a survey of cities closest to us in population and those
adjacent to us (attachment one). Over half of the cities closest to
us in population do n . ot exempt any construction 'from a building
permit. The rest exempt construction under a minimal dollar
valuation, ranging from $100 in Fridley to $1500 in Woodbury.
Legal Considerations
Attachment two is a legal opinion from the city attorney listing the
exemptions allowed under the building code and stating that "the c i tr
has the obligation -to enforce the state building code without
digressing or attempted modifications."

I. Purpose of the B u i l d i n g Code
The State of Minnesota has adopted the Minnesota State
Building Code the purpose of this code i's to provideP
uniform standards "to safeguard l i f e or limb, health,
property and public welfare by regulating, controlin
design, const.ructi on, quality materials, use and
occupancies of all buildings and structures. State
Building Code shall apply state wide and supersede
the Building Code of any municipality.
The terms "must" and "shall" have the same meaning
in both mandatory terms.

Code shall apply to the construction, alteration, moving,
demolition, repair and use of any building or structure within
the muni ci pa 1 i ty, except work located primarily in a public

Investigation fees are governed by Section 304(d) including
work without a permit.

investigation shall be made before permit ma

FEE. An - i nvesti gation fee, in addition to the permit fee
shall be collected whether or not a permit is then or

The minimum investigation fee shall be the same as the

VII. POWERS AND DUTIES OF BUILDING OFFICIAL
Section 202 (a) states the building official is herebauthorizedanddirectedtoenforcealltherovisions f

Section 202(d) states that whenever work is be i n done

VIII. MODIFICATIONS,
In Section 106 allows the. building official to grant
modifications in for individual cases. Specifically
when there are practical difficulties involved in
carrying out the provisions of the - b u i l d i n g code, the
building official may grant modifications for individual
cases, provided he shall first find a special and valid reason
that makes a strict letter of the building code mpract= cal
and that the modification is in conformity with the i me A
and purpose of the code . and that such modification does
not lessen any fire protection reg6 rements or any de rer
of structural integrity. The details of any action
grant ng modi f cati on s 1 be recorded and entered i n. tie
files of the code enforcement agency.
IX. NON PERMIT WORK - BUILDING OFFICIAL
Pursuant to my conversation with the state bui 1 di nq offi ri al
the only work that does not require a permit is spelled rut
in Section 301(b). The city building official does have
some discretion with respect to i nterpertati on or modi fi ati on
of the code as pointed out in Section 106. 0ne of the
i nterpertati ons is with respect to permits required,
specifically, whether or not the work is classified as
repair work or mai ntance, tea i ntance on a roof would ent:;i 1
replacing a number of shingles. Haintance on windows w uld
entail replacing a window but not modifying size or addi -i ona 1
placement of headers.
The city has the obl i gati on to enforce the State Bui 1 di ng Core
without digressing or attempted modifications.
