Mayor Greavu convened the meeting for a p u b l i c hearing regarding amending the environmental protection ordinance by consolidating it into one ordinance with the c r i t i c a l area ordinance and adding a requirement for Council approval to make significant a l terat i ons to major slopes of 25/ or more in grade. b. Manager Evans presented the staff report. c. D i rector of Community Development Geoff Olson presented the following Planning Commission recommendation: "Commissioner Fischer moved the P l a n n i n g Commission recommend to the City Council approval of the proposed environmental protection /critical area ordinance. Also that he is being charged twice for inspections. b Council stated they would meet .with staff September 13, 1984 at 9:00 A.M. at the Public works facility to discuss assessment policy. 2. Pha 1 en Place a. Councilmember Wa s i i uk commented on the complaints of speeding along Rip 1 ey Avenue by the area residents. b. Staff to investigate. F. PUBLIC HEARINGS 2 7:10 P.M. Code Amendment with P l a t t i n g a. Mayor Greavu convened the meeting for a public hearing regarding amending the section of the code requiring an automatic rezoning from F, farm residence to R- 1, single dwelling when a property is platted, to requiring that the City initiate a rezoning at the developer's request. b. Manager Evans presented the staff report. c. Councilmember Anderson moved to refer the proposed Code Amendment back to Staff for further review. Seconded by Councilmember Bastian. Ayes - all. 3. 7:20 P.M. Street Vacation - Ripley Avenue (Ruppert) a. Mayor Greavu convened the meeting for a public hearing regarding the request of Gregory L. Huppert to vacate Ripley Avenue lying between Ruth Street and the Mounds Park Academy property. b. Manager Evans presented the staff report. c. Director of Community Development Geoff Olson presented the following Planning Commission recommendation: "Commissioner S l etten moved the P l a n n i n g Commission recommend the City Counc i 1 approve the following resolution: WHEREAS, Gregory Huppert initiated proceedings to vacate the public interest in the following described real property: That part of Ripley Avenue right of way lying north of lot one, block two, Stanich Highlands. WHEREAS, the procedural history of t h i s vacation is as follows: - 4 -- 8/27 1 . This vacation was i n i t i'ated by Gregory Huppert on August 3, 1984; 2, A majority of the owners of property abutting said street right of way have signed a petition for this vacation; 3. Mayor Greavu convened the meeting for a public hearing regarding the request of Patrick Goff for an area variance for a single dwelling lot at 1000 County Road C. b. Manager Evans presented the staff report. c. Director of Community Development Geoff Olson presented the following Planning Commission recommendation: Commissioner E l l of son moved the P l a n n i n g Commission recommend the City Council approve the following resolution: WHEREAS, Patrick Goff applied for a variance for the following described property: The E 247.5 feet of the N 888.8 feet of the W 112 of the NE 1/4 of the NW 1/4 of Section 9, Township 29, Range 22, except the N 145 feet of the W 147.5 feet thereof, subject to County Road C and subject to road easement over the south 105.5 ft of the East 30 feet thereof. - 6 - 8/27 This property is also known as 1000 East County Road C, Maplewood .WHEREAS, section 36 -566 (c) (2) (d) of the Maplewood Code of Ordinances requires a minimum average lot area of 15,000 square feet for this property: WHEREAS, the applicant is proposing 11,200 square feet, requiring a variance - of 3,800 square feet; WHEREAS, the procedural history of this variance i s . as follows: 1. This variance was applied . for on August 13, 1984, 2. This variance was reviewed by the Maplewood Planning Commission on August 20, 1984. The P l a n n i n g Commission recommended to the City Counc i 1 that s a i d var - fiance be approved. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD PLANNING COMMISSION that the above described variance be approved on the basis of the following findings of fact: 1. The applicant would suffer an undue hardship due to circumstances unique to this site. The only acceptable access to the undeveloped property to the south is from Cypress Street, prohibiting this lot from having the adequate depth to satisfy the 15, 000 square foot minimum area, 2. The request would be consistent with the intent of the City Code. This lot, together with the proposed Lots to the south, would exceed the required minimurli average lot area requirement for the area. 3. It would be a p u b l i c interest to approve this variance to avoid an undesir- able double frontage lot,, Commissioner Sletten seconded. Zone Change - White Bear Avenue South of Lydia (4 votes) a. Mayor Greavu convened the meeting for a public hearing regarding the request of Edina Realty for a zone change from F - Farm Residence to- LBC - Limited Business Commercial to construct a two story office building on the east side of White Bear Avenue south of Lydia Avenue. b. Manager Evans presented the staff report. C. Director of Community Development Geoff Olson presented the following Planning Commission recommendation: "Commissioner Whitcomb moved the Planning Commission recommend the City Council approve the following resolution: WHEREAS, Edina Realty, Inc. initiated a rezoning from F, farm residence to LBC, limited business commercial for the following described property: The southerly 150 by 430 feet of 2980 White Bear Avenue legally descr i bed as: that part of the SW 1/4 of the NW 1/4 Section 2, Township 29, Range 22:. commencing at a point on the easterly right of way l i n e of White Bear Avenue 731.5 feet north- erly of the southerly l i n e of said SE 1/4 of the NW 1/4i thence easterly and p a r a l l e l with said southerly l i n e of a distance of 430 feet; thence northerly at right angles to said southerly l i n e a distance of 150 feet; thence westerly on a line drawn p a r a l l e l to said southerly l i n e of the SE 1/4 of the NW 1/4 section 2, 'township 29, range 22, to its point of intersection with the easterly l i n e of White Bear Avenue; thence southerly along said easterly right of way to a point of beginning; This property is a l s o known as 2980 White Bear Avenue, Maplewood; WHEREAS, the procedural history of this rezoning is as follows: . 1. This. rezoning was initiated by Edina Realty, Inc., pursuant to Chapter 36, Article VII of the Maplewood Code of Ordinances. 2. This rezoning was reviewed by the Maplewood Planning Commission on August 2011 1984. The Planning Commission recommended to the City Council that said re- zoning be approved. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the above described rezoning be approved on the basis of the following findings of fact. 1. The proposed change is consistent with the spirit, purpose and intent of the zoning code. 2. The proposed change will not substantially injure or detract from the use of neighboring property or from the character of the neighborhood, and that the use of the property adjacent to the area included in the proposed change or plan is adequately safeguarded. 3. The proposed change will serve the best interests and conveniences of the community, where applicable, and the public welfare. 4, The proposed change would have no negative effect upon the logical, efficient, and economical extension of public services and facilities,, such as public water, sewers, police and fire protection and schools. - 8 - 8/27 Commissioner Hejny seconded. Manager Evans presented the staff report. b. Mr. Jean Parranto, representing Hess Kline, the applicant, spoke on behalf of the proposal. c. Councilmember Anderson moved approval of the development of a Mitsubishi car dealership on the M -1, light manuf act uring zone d propert northwest o H ighway an 'Connor Avenue, on a asis a 1. The proposal is compatible with the permitted uses within the M - light man - ufacutr i ng district and, as such, would not interfere with the proper development of the district. 2. The proposal is compatible with the character and development of the area. 3. Council has approved three other new car dealerships within the immed area. Approval does not include the site plan. The site plan must be approved by the Community Design Review Board. Seconded by Councilmember Bastian. Ayes - all. 2. Tax Exempt Mortgage Revenue Bond Financing - Multiple Family - 9 - 8/27 4 a . I.D.R.'s New Regulations a. Manager Evans presented the staff report. b. Mr. James Lacina, City Administrator for Woodbury, requested a joint powers agreement which would stipulate the conditions for Maplewood reserving a share of its allocation for use on a Woodbury project. c. Councilmember Was i1uk moved - to.submit a check for $52,619 to reserve the I.D.R. allocation for Maplewood and that further discussion w! Counc i lmember Ander son , questioned if City employees, who are volunteer firemen, are released when on duty-to answer fire calls, b. Staff stated they were released, but were expected to notify their foreman or person in charge before leaving work. 50 Elevations a. Councilmember Anderson questioned how staff gets involved with elevations and how closely are they watched. b. Staff will review policy, I. NEW BUSINESS (continued) 2. Tax Exempt Mortgage Revenue Bond Financing - Multiple Family a. Manager Evans presented: the staff report. b. Mrs. Lorraine Fischer, representing the H.R.R., explained this type of financing and how it could affect Maplewood. c. Mrs. Mary I ppe 1, Briggs and Morgan, Bond Counsel, also spoke on behalf of the proposal. d. Councilmember Bastian moved to adopt the following fees and criteria to approve tax- exempt mortgage revenue financing for mul developments: am 10 - 8/27 1. Findings required for Council approval: a a . The development shall be consi with the Comprehensive Plan. b. The development will not have a negative impact on the vacancy rates of existing multiple dwellings in the City. c. There is reasonable assurance that th development will be able to comply with the 20 percent low to moderate income requirement over the l i f e of the bond issue. For items b and c, � a cert ified wri opinion from a qualified expert, accept - able to the City, shall be 'submitted with the application to document why a devel- opment will conform. 2. Fees a. An unrefundable $2,000 application fee shall be submitted with the applica- tion, b. A program participation fee shall be required. Council shall have the option of requiring an annual or lum sum fee as follows: 1 ) At bond c l o s i n g , , a lump sum fee shall be paid in the amount of one percent of the bond issue, not to exceed $20,000,, less the application fee, subject to federal arbitrage restrictions. 2 ) An annual fee payable on . each anniversary of the bond issue not less than 1/8 of one percent of the unpaid bal One - quarter of one percent of the bond issue shall be paid �at bond closing, subject to federal arbitrage restrictions. 3. The bond indenture agreement shall require: a. The deve to annuall certif on each ann iversary to the City, compliance with the federal low-to-moderate i ncome requi (The frequency of certifi- cation shall be determined on a case - - case basis.) b. PHASE 1 Upon receipt of the Owner's authorization to proceed, the Design /Builder will begin Phase 1 within 60 days, the following activities and submittals will be developed for the Owner: a. It would be Design/ Builder's intent that the plans and specifications reflect the original project scope requirements and that the GMP would be within defined budget dollar requirements. -3- PHASE III The Design /Build Contract Upon completion of Phases i and 11 and Owner approval, Design /Builder would enter into a mutually agreed to Design /Build Contract, which will be predicated upon Phase 11 development documents. More specifically, Phase I I 1 will take the project from the planning and development stage (Phases 1 and 11) through document completion and construction and up through Owner acceptance and occupancy. Phase 1 I 1 will consist of the following elements: 1. Completion of design documents and specifications. 2. Negotiating and /or competitively bidding all construction contracts by Design /Builder. All contracting for construction work will be conducted in full compliance with applicable public bidding regula- tions governing the project. 3. Full-time Design /Builder project management services and quality control to construct the building. 4. Value engineering by Design /Builder. 5. Scheduling by Design /Builder. 6. Cost control and estimating by Design /Builder. 7. Project completion by Design /Builder a. Punch-listing b. Contract close -out c. Owner acceptance Phase III will be fully defined in a separate Des ign /Build Services Contract which will include a GMP furnished to the Owner as part of that Design /Build agreement. The plans and specifications being developed under Phase 11 of this agreement will become part of that Design /Build agreement and will be attached as an exhibit thereto. The GMP guarantee means that the total included cost to the Owner for the Work covered by the Des i gn / Bu i Id agreement w i l l not/ exceed the GMP unless the scope of the Work is changed by the Owner. Payment in full is to be made within 10 days of receipt of the invoice. interest will be charged at the rate of 1-1/2% per month on all unpaid invoices, or portions of invoices. The compensation will cover all costs including labor and reimbursable charges such as travel, per diem, printing, etc. The Compensation to Design /Builder under this Interim Services Agreement will be included in the GMP submitted and such compensation will be credited against reim- bursable cost of the Work covered by the GMP. The Design /Builder shall perform additional services to provide ren- derings and /or models or other services as directed. by the Owner. Any additional services are not included in the fee for basic services but shall be compensated for on the basis of 2.5 times Direct Personnel Expenses (DPE) *, plus out -of- pocket expenses as incurred. Attached are three excerpts from the reDOrt: Overview of the Report (pages 1 -3); Introduction (page 4) and Transition Plan - Option 3 - Recommended Voluntary Measures to Improve Accessibility (pages 33 -34). It is recommended that the Council consider endorsement of the Transition Plan - Option 3. Federal regulations require adoption of a transition plan for non- structural compliance by October 17, 19840 DFF:1nb Overview Of The Report On October 17, 1983 the Office of Revenue Sharing (ORS) published federal reQUlations requiring local governments receiving revenue sharing funds to comply with Section 504 of the 1973 Rehabilitation Act. Section 504 mandates recipients of federal funds to make programs and services accessible to the handicanoed. In general, the regulations require governments to a) provide notice of non - discrimination Policies, b) desi Qnate a res ' ons i bl e emnl ogee to oversee the compliance process c) adoot a grievance procedure, d) conduct a structural and non - structural accessibility self - evaluation and e) prepare - a transition plan for non - structural, como.l i ance by October 17, 1984 and structural compliance by October 1.7, 19860 Last spring the City provided oroper notice and designated Barry Evans, City Manager, as the responsible employee. The City has an existinq grievance procedure which meets . y the requirements of the regulation. Employers must also make 'reasonable accommodati for a handi canoed appl icant or employee. The Minnesota Human Rights Act includes much of the same language. Hiring managers should be aware of the following implications of both State and Federal Laws 1) Reasonable accommodation must be provided in the recruitment, selection and hiring processes. If auxiliary aids, such as sign language interpreters, are necessary for the applicant to communicate, the City must provide such service. 2) As a voluntary affi rmative action employer, the City should incorporate organizations representing the handicaDDed to its list of affirmative action agencies notified of .job openings, 3) The Ci appl ication form should not include auesti ons regardi race, religion, sex, marital status , �di sabi i i ty, ape, arrest record, national origin or status with regard to Dublic assistance unless it is directly related to the applicant's abil itv to perform the duties of the position. Several change are recommended in this report regarding the applica- tion form. 4) The City needs to clarify its policy and practices regarding the Dre- employment physical examination. 5) The Park and Public Works Maintenance I and II job descriptions should be revised to require oredeterm -ined and consistently used testing methods. PROGRAM ACCESSIBILITY The most important aspect of the regulations is program accessibility. Handicapped citizens are to have full benefit of orograms and servi offered by a local g overnment. tian1 ewood imposes no 1 imit on the number of handi canoed individuals that can be involved in its programs. Although the building was constructed prior to accessibility reputations q and technically the City is not r to make accommodations in this area to comply wi th O RS regulations, it is an important issue which the City needs to address. -2- ,. TRANSITION PLANS Three transitions plan options are provided. Plan I is the Minimum COMDliance Plan under ORS regulations. Plan II includes the optional steps the City would need to take to comply with Section 514 of the Rehabilitation Act. Transition Plan III i s a set of recommended measures which are not required, but are low -cost sterns to providing greater accessibility for the handi canned citizens of Maplewood. This third ooti on is a compromise between Plans I and II, Under the ORS requlations, the City does not have to make any changes, structurally or non - structurally. The fire departments provide services that qo to the public and are not inaccessible to anyone. OTHER APPLICABLE LEGISLATION Minnesota Law has two areas of impact for the City. First, any new bui l di no or renovation work would have to comply with accessibility standards outlined in Chanter 55 of the State Building Code. Second, under the Human Rights Act, the City may have to improve accessibility If a grievance is filed with the Human Rights Department and the Commissioner ruled against the City. The Hunan Rights Act affects both program access and employment practices. It does contain a clause that if the City can prove that compliance would cause an undue hardshio on the City, to be determined on a case by case basis, it may be exempt. - 3- Introduction The ORS regulations strongly encourage recipient governments to involve disabled members of the community in the self - evaluation process and consult with outside organizations which represent the handicapped. The entire self - evaluation process has been conducted by a Hamline University graduate student who is disabled. Mr. Scott Rostron, a member of Maplewood's Human 'Relations Commission, has served as a voluntary consultant throughout the self - evaluation. Mr. Rostron's professional exDertise as Title V Coordinator for the Minnesota Division of Vocational Rehabi l.i tati on, Deoartment of Economic Securi tv and personal knowledge of accessibility issues has been of great value to the City. As you, may know, City Hall was built in 1965, prior to the implementa- tion of accessibility standards for public buildings, and is not accessible. We .would l i k e to make the following suggestions to disabled and elderly members of our community to make access more convenient for you: "a) To register to vote, acquire a license or permit (other than a driver's license) or pay an assessment in person, call the City Clerk's office at 770 -4500 to make arrangements to have a staff member meet you downstairs to conduct the business. (For driver's licenses, pictures must be taken. We will be glad to assist those unable to navigate the stairs, otherwise the Department of Trans- portation Building on Rice Street is accessible.) "b) Most Commission and City Council meetings are held in the City Council chambers in City Hall. If you would like to attend a Council meeting and cannot navigate stairs we would be g l a d to provide assistance. Please call the City Clerk at 770 -4500 and we will attempt to make arrangements for assistance." "c) If you would l i k e to register for a program offered by Community Services, when in- person registration is required, call the Community Services Department at 770 -4570 to make alternate arrangements. Look for accessible entrance signs at Parks i de, Gladstone, Hazelwood and East County Line #1 Fire Stations and at St. Jeromes, Edgerton, Carver, Beaver Lake, Gladstone and Maplewood Junior High Schools. Also at Concordia Arms and the Ramsey County Home. For an absentee ballot, call the City Clerk's office at 770 -4500. "We realize that these suggestions do cause some inconvenience. We ask your cooperation and patience with our efforts in trying to provide services while operating in an inaccessible building. If you have any suggestions, please call the City Manager's office at 770-4525. -33- Structural Measures a Have the Public Works Department correct the high threshold problems at Carver and Maplewood Jr. High Schools . The crew could either put down a small amount of tar to smooth out the lift or cut boards to be used on voting days b) Have Public Works make designated parking signs for the Community Services crew to install at all parks. c) Have Public Works make accessible entrance signs for voting loca- tions. They should be made so they can be posted temporarily on voting days. They should be used at St. Jeromes and Edgerton Schools and Gladstone and Hazelwood Fire Stations. d) Hazelwood Fire Station could be easily made accessible by installing a curb cut. This would make Hazelwood an option for meeting relocation, it does have a nice meeting room. Another suggestion would be to incorporate the affirmative action agency l i s t provided in the report into the City's personnel practices. The current list does not include an agency representing the handicapped. Lastly, I would recommend updating the City's application form and. clarifying personnel policies as suggested in the report. This is a vulnerable area for the City. Specifically, if a . disabled person applying for a position were to file a grievance, it would be in the City's best interest to have as much of its employment practices in compliance as possible. .34. Comments The code now requires that a driveway maintain at least a five- foot setback, "except by special permission or by agreement with the owner of the adjacent property to have said driveway near to said line." It is not clear from this requirement who must grant special permission - -the city or adjacent property owner. This ordinance would allow the city council to approve driveways within the five foot setback, where there would be no adverse effect on the adjacent lot or owner. This may be necessary when two adjacent property owners are .having a personal dispute or when the adjacent owner is not available (deceased or nonresident).
