The firm is experienced in municipal audits and presently has fifteen cities as clients including White Bear Lake, New Briahton, Shoreview, Mounds View, Stillwater, Oakdale, Woodbury, South St. Paul, and Cottage Grove. The 9 ro osed agreement for the 1981 audit reflects a 10/ increase in P p hourly rates. It is anticipated that the 1981 audit will cost approxi- mately $18,700 which is $1,766 more than the 1980 audit cost. Of particular interest is the location 'of the Perkins Cake & Steak Restau: ant . This facility is visible from the freeway. It attracts businessmen and families to the area for a meal while traveling in the 1•1aplewood area. An economy motel located adjacent to the Perkins would also expo.nd the service provided at this location to reasonable priced lodging as wall as the food service. The subject property is also located very close to the Mapl ewood Mall which attracts salesmen from out -of -tom and other service personnel associated With a facility of that size. : `Because of its visibility from .the freeway, the subject property offers the best opportunity for expanding the r.Lmnber of rooms aTJailable at this inter- section. The only other motel rooms' avail -able in the area at this time are those at the Itaplewood - Holiday Inn. These rooms are offered at a price con - .s:i.derably higher than the proposed rates for the economy motel. Also, when the Holiday Inn is full, potential customers are f orced to go to other com- munities for a place to stay. Since the right -of -way is serving a public purpose for pedestrian traffic and telephone poles an easement should be retained. November 16, 1978: Council approved the vacation of the right -of -way along the Fifth Street alignment, subject to the retention of a utility easement only (not a walkway easement) . No mention was made of the a l i g n m e n t or width, Consequently, an easement was retained over the entire right-of-way. DEPARTMENT CONSIDERATIONS Planning Chapter 412.851 of the Minnesota State States States: "The Council may by resolution vacate any street, alley, public grounds, public way, or any part thereof, on its own motion or on petition of a majority of the owners of land abutting on the street, alley, public grounds, public way, or part thereof to be vacated. When there has been no petition, the resolution may be _ adopted only by a vote of four - fifths of all members of the Council. No such vacation shall be made unless it appears in the interest of the public to do so after a hearing preceded by two weeks' publ i .shed and posted notice." Public Works 1. A water main was constructed in August 1981, from Ferndale Street to Carlton Street, along the vacated Fifth Street alignment (See Map 3 for alignment) . 2. The St. Paul Water Department requires a 30 foot easement along the water main. 3. A buried telephone cable is located along the water main within the easement to be retained. 4. No future u t i l i t i e s are proposed along this alignment. Citizen Comments All four adjacent property owners have been contacted and are in agreement P P with the proposal. CONCLUSION Analysis A utility easement was retained over the entire vacated street right -of -way, because the alignment requirements for any future u t i l i t i e s were uncertain at he time of the street vacation. With the recent construction of a water mai n along this corridor, the utility alignment has been established. The easement in excess of the public, need should be vacated. 2 Recommendation (Requires at least four, votes for approval) Approval of the enclosed resolution, partially vacating the utility easement along the vacated Fifth Street right -of -way, between Ferndale and Carlton Streets, on the basis that: 1. This is a State -wide requirement. In Maplewood, the shorel ands of the following public waters must be regulated: Gervai s Lake, Kohlman Lake, Keller Lake, Oehrline's Lake, Round Lake, . Phalen Lake, Wakefield Lake, Casey Lake, Silver Lake, Beaver Lake, Pond, Tanner's Lake, Battle Creek, Fish Creek and Carver Lake. Several cities in the Metropolitan area are being asked- to pass si milar resolutions. Recommendation Approval of the enclosed resolution* Ac f r Enclosures: Resolution A RESOLUTION OPPOSING THE CURRENT STRUCTURE OF PROPOSED RULES FOR EQB EiVVIRONMENTAL REVIEW PROGRAM WHEREAS, the Minnesota Environmental Quality Board (EQB) is required to ar the Minnesota Environmental Policy Act by the 1980 Minnesota State Legislature, WHEREAS, the purpose of these amendments are to streamline the EQB review process for processing Environmental Assessment Worksheets or Environmental Impact Statements, and WHEREAS, these rules are scheduled fora public hearing on October 26, 1981, and WHEREAS, the proposed rules for commercial, industrial, and residential development provide for threshold numbers, rather than basing the need for an EAW on environmental criteria, and WHEREAS, the residential thresholds for a mandatory EAW have been reduced from 100 units in an unsewered area and 500 units in a sewered area to 50 un- attached or 75 attached units in an unsewered area and 150 unattached or 225 attached units in a city of the second class, and WHEREAS, all cities and government agencies have a responsibility to reduce the cost of housing, and WHEREAS, the EAW process creates added cost in loss of . time, as well as expense, which is often passed on to the homebuyer. NOW, THEREFORE, BE IT RESOLVED, that the Minnesota Environmental Quality Board reject the proposed thresholds and develop criteria that relate specifically to potential environmental problems.
