CALL TO ORDER A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building, and was called to order at 7:00 P.M. by Mayor Greavu. B. Playcrest Park Approved transfer of $10,000 from Commercial P.A.C. Funds to Playcrest Park account for preliminary grading at the park site. 4. Goodrich Park Approved that $4,000 be assigned from the Commercial P.A.C. Fund to the Goodrich Park fund to permit necessary curbing. 5. Mrs. Mary Ippel, Briggs and Morgan, presented a resolution that would create a Development District No. 1 and three tax increment financing districts. b. Mayor Greavu introduced the following resolution and moved its 85 - 9 -:141 RESOLUTION CALLING A PUBLIC HEARING ON THE PROPOSED ESTABLISHMENT BY THE CITY OF DEVELOPMENT DISTRICT NO. 1, THREE TAX INCREMENT FINANCING DISTRICTS CONSISTING OF ECONOMIC DEVELOPMENT DISTRICT NO. 1 -1, HOUSING DISTRICT NO. 1 =1 AND HOUSING DISTRICT NO. 1 -2, AND THE ADOPTION OF THE DEVELOPMENT PROGRAM AND THE TAX INCREMENT FINANCING PLANS THEREFOR BE IT RESOLVED by the City Council (the "Council ") of the City of Maplewood, Minnesota (the "City "), as follows: 1. This Council shall meet on Monday, October 21, 1985, at approxi- mately 7:10 P.M., to hold a public hearing on the following matters: (a) the proposed establishment of Development District No. 1; (b) the proposed adoption of the City's Development Program for Development District No. l; (c) the Droposed establishment of Economic Development District No. 1 -1, Housing District No. 1 -1, and Housing District No. 1 -2, therein and (d) the proposed adoption of Tax Increment Financing Plans relating thereto, all pursuant to and in accordance with Minnesota Statutes, Chapter 472A, as amended and Minnesota Statutes, Sections 273.71 to 273.78, inclusive, as amended. 2. The City Clerk is authorized and directed to cause notice of the hearing, substantially in the form attached hereto as Exhibit A, to be given as required by law, to place a copy of the Development Program and the Tax Increment Financing Plans on file in the Clerk's Office at City Hall and to make such copies available for inspection by the public no later than October 14, 1985. Mayor Greavu convened the meeting for a public hearing regarding the re- quest of Ed Cave and Sons, Inc., for preliminary plat approval to replat fourteen substandard lots into seven new lots and approval of a rezoning from R -1 to R -2 for the easterly 185 feet of the site located on the south side of Cope Avenue west of the railroad tracks. b. Director of Community Development Olson presented the Staff report. C. Commissioner Dennis Larson presented the Planning Commission recommendation. d. Mr. Sam Cave, Ed Cave and Sons, Inc., spoke on behalf of the proposal. e. Mayor Greavu called for persons who wished to be heard for or against the . proposal: George Rossbach, 1406 E. County Road C, presented his views. f. Mayor Greavu closed the public hearing. g. Mayor Greavu moved to approve the Cave' lots into seven new lots on the south side of Avenue west of the railroad tracks subject to the following 1. Entering into a developer's agreement, with required surety, to repair Cope Street where additional water and sewer services are to be constructed and proof of installation contracts with NSP and Bell Telephone at the time of building permit issuance. 2. Dedication of the east thirty feet of lot one as a utility and drainage easement. 3. City Engineer approval of final utility and grading plans. The grading plan shall include an erosion control plan. 4. Change Cope "Street" Addition to Cope "Avenue" Addition. Seconded by Councilmember Wasiluk. Ayes - all. h. Mayor Greavu introduced the following resolution and moved its adoption 85 - 9 - 142 WHEREAS, Ed Cave and Sons, Inc., initiated a rezoning from R -1, resi- dence district (single dwelling) to R -2, residence districts (double dwelling) for the following described property: Lots 1 -4 and the Easterly fourteen feet of Lot 5, that part of Lots 30 through 33, together with that part of the alley way - 4 - 9/23 adjoining said line described as commencing at the Northeast corner of Lot 1, Block 4; thence South 28'35" West along the East line of said Lot 1 and its southerly extension 163.92 feet to the point of beginning of the line to be described; thence North 84 44' West 310.04 feet; thence North 89 52' West 225 feet to the West line of Lot 14, Block 4, and there terminating. All in SABIN ADDITION TO GLADSTONE, Ramsey County, Minnesota. WHEREAS, the procedural history of this rezoning is as follows: 1. This rezoning was initiated by Ed Cave and Sons,. Inc., .pursuant to Chapter 36, Article VII of the Maplewood Code of Ordinances. 2. This rezoning was reviewed by the Maplewood- Planning Commission on August 19, 1985. The Planning Commission recommended to the City Council that said rezoning be approved. 3. The Maplewood City Council held a public hearing on September 23, 1985, to consider this rezoning. Notice thereof was published and mailed pursuant to law. All persons present at said hearing were given an opportunity to be heard and present written statements. The Council also considered reports and recommendations of the City Staff and Plan- ning Commission. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the above - described rezoning be approved on the basis of the following findings of fact: 1. The proposed change is consistent with the spirit, purpose and intent of the zoning code and the comprehensive plan. 2. The proposed change will not substantially injure or detract from the use of neighboring property or from the character of the neighborhood, and that the use of the property adjacent to the area included in the proposed change or plan is adequately safeguarded. 3. The proposed change will serve the best interests and conveniences of the community, where applicable, and the public welfare. 4. The proposed change would have no negative effect upon the logical, efficient, and economical extension of public services and facilities, such as public water, sewers, police and fire protection and schools. Seconded by Councilmember Wasiluk. Ayes - all. 2. 7:10 P.M., Easement Vacations Highland Townhouses (Goff) a. Mayor Greavu convened the meeting for a public hearing regarding the request of Pat Goff for a vacation of the five foot wide drainage and utility easement in the Edgerton Highlands Plat. - 5 - 9/23 R c Director of Community Development Olson presented the Staff report. Commissioner Dennis Larson presented the Planning commission recommendation. d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. Mayor Greavu closed the public hearing. g. Councilmember Anderson introduced the following resolution and moved its adoption 85 - 9 - 143 WHEREAS, Patrick Goff initiated proceedings to vacate the public interest in the following described property: Drainage and Utility easements being five feet on each side of all side and rear lot lines in Lots 1, 2, and 3, Block 1, Edgerton High- lands. WHEREAS, the procedural history of this vacation is as follows: 1. A majority of the owners of property abutting said easements have signed a petition for this vacation; 2. This vacation was reviewed by the Planning, Commission on September 16, 1985. The Planning Commission recommended to the City Council that this vacation be approved. 3. The City Council held a public hearing on September 23, 1985, to consider this vacation. Notice thereof was published and mailed pursuant to law. All persons present at this hearing were given an opportunity to be heard and present written statements. The Council also considered reports and recommendations of the City Staff and Planning Commission. WHEREAS, upon vacation of the above- described easements, public interest in the property will accrue to the following described abutting properties: Lots 1, 2 and 3, Block 1, Edgerton Highlands NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that it is in the public interest to grant the above - described vacation on the basis that the replatting of this property into a town .house subdivision makes these easements obsolete. Seconded by Councilmember Maida. Ayes - all. - 6 - 9/23 3. 7:20 P.M., Easement Vacations and Final Plat : Frattalone Addition a. Mayor Greavu convened the meeting for a public hearing regarding the request of Frank Frattalone to vacate three obsolete utility easements and approve the final plat for the Frattalone Addition of four single dwelling lots and two outlets. b. Director of Community Development Olson presented the Staff report. c. Commissioner Dennis Larson presented the Planning Commission recommendation. d. Mayor Greavu called for proponents. None were heard. e. Mayor Greavu called for opponents. None were heard. f. Mayor Greavu closed the public hearing. g. CouncilmemberMaida introduced the following resolution and moved its adoption 85 - 9 - 144 WHEREAS, Frank Frattalone initiated proceedings to vacate the public interest in the following described properties:. The East ten (10) feet of Lots Two, Three, Four, Five and Six, Block One, Lake Gervais View Addition, lying South of the North five feet of said Lot Two, Block One; and A strip of land ten feet in width, lying West of the East Ten feet of Block One, Lake Gervais View Addition, and lying five feet either side of the following- described centerline: Beginning at the Southeast corner of said Lot Three, Block One; thence Westerly along the South line of said Lot Three, Block One a distance of 65 feet and there terminating; and That part of the West ten feet of Lot One, Block .Three, Lake Gervais View Addition lying South of the Easterly extension of the North line of Lot Two, Block One, of said Addition and lying Northerly of the Easterly extension of the South line of Lot Six, Block One of said Addition. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that it is in the public interest to grant the above - described vacation on the basis that these easements are obsolete and it would be in the public interest to vacate them. Seconded by Councilmember Anderson. Ayes - all. h. Councilmember Maida moved to approve the Frattalone Addition Final Plat subject to the City withholding signing of the plat until 1. The deferred water tower assessment is paid. 2. Revision of the plat to show a utility easement for sanitary sewer along Arcade Street acceptable to the City Engineer. 3. The City Engineer shall approve the drainage easement required on the easterly portion of the plat. 4. Dedication of a utility easement over the north five feet of Outlot B. The plat shall not be recorded until the resolution to vacate the obsolete utility easement has been recorded. Seconded by Councilmember Anderson. Ayes - all. G. AWARD OF BIDS 1. Street Flusher a. Acting Manager Haider presented the Staff report. b. Mayor Greavu introduced the following resolution and moved its adoption: 85 - 9 - 145 BE IT RESOLVED BY THE MAPLEWOOD, MINNESOTA, CITY COUNCIL that Borchort- Ingersol, Inc., is the lowest responsible bidder with a bid of $16,941,00 for a street flusher truck and that Staff is directed to execute the purchase. Seconded by Councilmember Anderson. Ayes - all. - 8 - 9/23 H . UNFINISHED BUSINESS -- 1. East Communities Family Center - Appointment a. Acting Manager Haider presented the Staff report. b. Mayor Greavu moved to representative on the East effective October 16, 1985 per Maida as Map Center's Board 1987. 0 Seconded by Councilmember Bastian Ayes - Mayor Greavu, Councilmembers Anderson, Bastian, and Wasiluk. Councilmember Maida abstained. 2. East Shore Drive - Speed a. Acting Manager Haider presented a letter from Mr. Edward J. Bachman and Mr. George M. Ashton requesting the Council that an adequate method be found to slow the traffic on Edward Street between Sophia and Larpenteur. b. The following area residents voiced their opinions: Mr. Edward Bachman, 1700 East Shore Drive Mr. Geroge Ashton Mrs. Thelma Nelson, 1672 East Shore Drive C. Council referred the matter to Staff for further investigation. 3. 1986 Wages - Sergeants. a. Acting Manager Haider presented the Staff report. b. Councilmember Anderson moved to approve the following 1986 Wages f the Ser- geants 1. Wages to be $320 above top Patrol Officers' Pay 2. Increase in uniform allowance from $250 to $300 3. Increase in deferred compensation to $40 per month (Same as Patrolmen in 1985) 4. Increase in paid life insurance to $15,000 (from $10,000) 5. Sergeants with over 2,400 hours sick time shall be able to trade two days sick time for one day in deferred income to be paid in a lump sum at the end of the year. Such sum shall not exceed the equivalent of 7 -1/2 days. This item shall be retroactive for the 1985 year with the rest being effective for 1986. Seconded by Councilmember Wasiluk. Ayes - all. - 9 - 9/23 4 1986 Wages - Patrolmen a. Acting Manager Haider presented the Staff report. b. Councilmember Anderson moved to approve the following 1986 Contract for the D o +vr.l mon . 1. 4.5% increase in basic wage schedule. 2. Educational incentive program to be omitted for all patrolmen hired after January 1, 1986. 3. A $10 per month increase on employer contribution to health insurance. 4. A $10 per month addition to the deferred income Program. Seconded by Councilmember Maida. Ayes - all. J. VISITOR PRESENTATION 1. Barry Mau, 2927 Howard a. Mr. Mau stated he is requesting a variance to occupy his newly constructed home at 3038 Standridge Place before the street is constructed. He has to be out of his present home by the end of the week. b. Ms. Joan Harrington, Tilsen Homes, spoke on behalf of Mr. Tilsen. C. Mr. Yorkavich, who is building a home at 3044 Standridge, has the same problem. d. Acting Manager Haider stated Mr. Tilsen, the developer responsible for the construction of the street, has barely started the street, although it was to be completed some time ago. e. Councilmember Bastian moved to refer this matter to the Acting Manager to meet with Mr. Tilsen to find out why the delay in the construction of the street and to inform Mr. Tilsen of his obligations Seconded by Councilmember Anderson. Ayes - all. K. COUNCIL PRESENTATIONS 1. Frost Avenue a. Councilmember Anderson questioned why Frost Avenue construction is being delayed. b. Acting Manager Haider stated one of the reasons was that Burlington Northern had not signed the right of way easement. C. Mayor Greavu stated he will contact Burlington Northern. - 10 - 9/23 2. A copy of the public hearing notice is attached for information purposes (Exhibit A). After the publ i c hearing is held, two resolutions need to be adopted. The first reso- lution formally adopts the 1986 Budget and is attached as Exhibit B. The expenditure amounts listed i n the proposed resolution i ncl ude the revisions made by the Council during their budget meeting. A second resolution (Exhibit C) must be adopted that l evi es taxes payable in 1986 that will provide an amount sufficient enough to support the 1986 Budget. The second part of this resolution adjusts the tax levies previously certified for al .1 existing bond issues. It should be noted that these previously certified bond issue tax levies were i ni ti al ly, establ i shed at the time bonds were sold and equal the estimated unassessed improvement project costs. The scheduled tax levies have to be adjusted annually to finance the debt service requirements based upon the special assessments actually levied, investment interest earnings, and the amount to be transferred from the General Fund. Council approved a 90 -day time extension for the Crestview Third Addition preliminary plat, subject to the original conditions. 10- 16 -80: Council approved a 90 -day time extension, subject to the original conditions, and also renewed the planned unit development for one year. 1- 22 -81, 4 -16 -81 and 8 -6 -81: Council approved ninety -day time extensions for the preliminary plat, subject to the original conditions. 9-13-82: Council approved a one -year time extension for the planned unit development and preliminary plat. In January 1983, the applicant chose to let the planned unit development expire. The development is now limited to single dwellings. Planning 1. Compliance with land use laws: a. State law: Section 412.851 of state statutes allows a city to vacate any interest in property when the council makes a finding that "it appears to be in the P ublic interest to do so." b. City code: Section 1005 (e) of the subdivision code provides that for one year following preliminary approval roval and for two years following final plat approval "unless the subdivider and the city agree otherwise, no amendment to a comprehensive plan or official control shall apply to or affect the use, development density, lot size, lot layout or dedication or platting required or permitted by the approved application. The standard for a street, such as Mailand Road, is only 60 feet of width. The street surface is 36 feet wide. If the north three feet were to be vacated, 12 feet of boulevard would remain. This is adequate area for snow storage and utility needs. 2. This subdivision is farther than 1/2 mile from Carver E lmentary School ( Upper Afton and Century Avenue) which means the children w i l l be bussed, c. Sidewalks were not required when the properties to the east and west developed. 2* The lilac hedge that had been proposed along the east side of the trail should not be permitted. According to the parks director, a hedge would create maintenance problems and provide a hiding area where assaults could occur. 5 3* Some filling along the trail corridor, east of the pond and north of Mailand Road is needed to eliminate a depression. The present grade changes are undesirable for bicycle traffic, according to the parks director, 4. Fencing along the trails is not necessary if a. The trail (s) will . be constructed before the dwel lings, or b. Where existing homeowners unanimously agree that fencing is not necessary. 5. The 15 -foot wide walkway easement recorded along Williams B rothers pipeline easement, as a condition of the Crestview First Addition, was never authorized by the pipeline company. Williams Brothers has, however, agreed to permit a trail to be constructed along this alignment, subject to their approval of the construction plans and the city maintaining responsibility for any repair of the trail should repairs have to be made to a pipeline(s), 6. The trail would be too steep if it continued to Londin Lane along the west edge of the storm water pond. INTRODUCTION ._ The proposed plat occupies the SEk NWk of Sec. 12, T. 28N., R. 22W. The plat is 40 acres in size. Total lot acreage is 28.3, street acreage is 9.3 and pond acreage is 2.3. The total number of lots is 97 with 22 of these being for double family dwellings and the remainin g 86 as single family, This report will evaluate the suitability of the existing soil and water resources for the proposed land use change. Any potential limitations of the site or any adverse offsite impacts that relate to the ro osed P P land use change will be discussed. Recommendations will be made to overcome potential difficulties. It should be noted that the soils information contained in this report is general in nature and applies to the top 5 -6 feet of the soil profile. Before decisions are made regarding the use of specific locations a professional soils engineer should be consulted on site investigation. II. EXISTING SOIL AND WATER RESOURCES A) Soils and topography The topography of the site is dominated by a large hill extending through the center of the plat. Slopes on the top and adjacent to its base are gentle (less than 12 %). The north face and south face are steep with slopes generally in excess of 18 %. Slope length is about 150 ft. on the south side and ranges from 150 ft. to 300 ft. on the north side. Slopes on the west side are roughly 300 ft. in length at about 10%. The soils of the area (see topographic map) have been placed in four groups for interpretive purposes. The descriptions, properties and building site potentials of each of these soils groups are g iven below; their approximate boundaries are drawn on the topographic map: Group 1= These soils consist of well drained silt loams underlain b gravelly coarse sand. Permeability is moderate in the upper silt loam material and very rapid in the underlying sands and gravels. The shrink - swell potential is moderate in the surface materials and low in the subsurface materials. Potential frost action Is moderate, \�J 14 Page 2 Building site potential is fair to good on these soils, The Drimary hazards are related to the underlying sands and gravels. Caving during excavation is a hazard. If top soil is removed during site preparation' revegetation will be extremely difficult; however, with the top soil in.place revegetation may be done with little difficulty. The hazard of erosion is also increased with the top soil removed due to the non- cohesive nature of the subsoils and the difficulties of revegetation. Group 3A: These soils consist of well drained silt loams underlain by foams and sandy loams. Permeability is moderate- moderately slow. The shrink -swell potential is low and frost action is moderate. Soil strength for supporting structures is good in the underlying loams and sandy loams but only fair in the surface silt loams. Building site potential is fair with frost action and the fair soil strength of the surface material being the principal hazards. The soil also has poor trafficability when wet. Group 5: These soils are poorly and somewhat poorly drained with silt loam surface material and silt loam or sandy loam underlying materials. Permeability is moderate to moderately slow. The seasonally high water table is within 0--3 feet of the surface. Building site potential is fair with frost action and wetness being the principal hazards. B) Water Resources The plat area presently contains.5 wetland areas. Three of these are landlocked. The remaining pair are located in the MV corner of the property and outlet to the north under Londin Lane. The plat, as proposed, will eliminate all but the wetland in the MV corner. One other wetland will be relocated to the SE corner of the property. The Maplewood Drainage Plan, prepared by.Barr Engineering, calls for three ponding .sites to be located on the plat, all outletting to the north, (see attached map). The proposed plat will eliminate all of one ponding site, a portion of another and relocate the third. The proposed plat does not show any outlet for this third pond (in the SE corner) as does the Maplewood drainage plan. The plat would direct all runoff to the 15 Page 3 north through only one ponding site rather than through three as recom- mended in the Maplewood Drainage Plan, III. CRITIQUE AND RECOIUJENDATIONS The proposed plat alter the existing topography of the site. To do so will change the existing soil profiles and create a situation with potential for severe soil erosion. The following recommendations are intended to reduce this potential: 1. As proposed, roughly 35 - 405 of the streets within the plat are r es exceeding � � located on slo P p eding 12%. It is recommended that this be r "7 reduced through relocation of Lakewood Drive ( eg: orientin g it east to west) and Deercrest Trail (eg: Moving it to the south 2. Erosion control measures should be applied to the entire site and maintained until permanent vegetative cover is established. These measures are especially critical on soil groups 1 and 3B. I) If areas opened by grading are to remain exposed longer P g than two weeks before final grading is completed and permanent vegetation established, they should be covered with straw mulch applied at the rate of 000- 00 P 3 0 lbs /acre. The high water table and occasional flooding hazards of soils in group 5 must be considered when determining the elevations of houses placed on soils in group 5. ..ter Alteration to the natural topography of the site will affect the water resources of the plat in addition to the soils. The primary impact will be.loss of local stormwater storage sites and a net increase in the runoff volumes from the site. These runoff volumes are to be directed northward into a pond (north of Connamera) known as "Johnson pond". This area has already experienced serious erosion problems. These will only be aggravated by the proposed plat. The following recommendations are intended to lessen the impact of stonnwater runoff from the proposed plat. 1. The capacity of the stormwater ponding sites located on the Maplewood Drainage Plan, prepared by Barr Engineering must be ensured. The plat, as presently proposed, does not provide location for the ponding sites recommended by the drainage plan. This should be done. 2. The stormwater storage pond located on the SE corner of the plat does not have an outlet provided. An outlet should be provided that will allow the recommended amount of storage (as per the Maplewood Drainage Plan) and, at the same time protect adjacent residents from f loo ding . 3. The pond on the NN! corner should provide the capacity recommended (again, per the Maplewood Drainage Plan). This may require eliminating lots 1, 2 and 3 in Block 2 to expand the pond. The proposed plat, with some adjustments made to accommodate the soils, topography and stormwater storage requirements, will provide an attractive setting for homes. A c o n d i t i o n of the p l a t was that the south 36 feet of the property had to be dedicated for Gall Avenue right -of -way. Planning Section 412.851 of State Statutes allows a city to vacate an interest in property y p p y when the council makes a finding that "it appears to be in the public interest to do so." Northern States Power Company (NSP) 1 . NSP w i l l permit the applicant's driveway to remain in its present location, crossing the property below their power, lines. The utility easement to be retained for NSP will prohibit any other improvements. 2. The applicant will be allowed to relocate the lines to the west but he must pay the entire cost. They have concluded that the project is feasible from an engineering standpoint and have addressed project in two phases.. The first phase involves the.. southern 1300 feet of the project to the northern boundary of the Homart property, with the second phase from Homart property north to County Road D. The consultant has estimated the construction cost of Phase I to be $200,000 and Phase II to be $360,000. Additional costs to the project will be the acquisition of the right —of —way along the entire alignment. This cost is estimated to be $590,000 including the purchase of the. existing 4 —lane private drive which is located on the proposed alignment and, which will be incorporated into the proposed roadway. This high acquisition cost in relation to the estimated construction cost is the reason for the phased construction proposal. It is projected that the right —of —way for •Phase II could be acquired through exaction from the developer at the time he develops. The right —of —way acquisition for Phase I could be considerably less. than estimated depending upon negotiations with the developers of the Homart property. Financing for the project is proposed to be by assessment to benefited properties, state —aid funds and tax — increment funds. Comments On May 20, 1985, the Park and Recreation Commission toured the property ad - jacent to the North Hazelwood Park. The Commission noted the excellent lo- cation of the property adjacent to the presently owned North Hazelwood Park and Ramsey County Open Space property. By combining he City and Count 9 Y y property, we could retain an Open Space atmosphere, as well as an active rec- reational area as a buffer between residential and commercial development, A comment was made that in the event that the lease was lost at Harvest we could use this area for athletic facilities such as softball diamonds. The property i s large enough (8.17 acres) to provide additional active recreation- al areas, as w e l l as plans for an extended trail system. The Park and Recreation Commission reviewed the appraisals ' pp lsals at their August meeting and recommended that the Director negotiate with the owners of the property. C Bruce Mogren PROPERTY DESCRIPTION Appraisal No. 85-8a The tract is rectangular shaped with approximately 478.11 feet of frontage on Kennard St. and a depth of 375.0 feet. It contains 179 square feet or 4.11 acres, more or less. In its natural state, the land was rolling and slightly higher in the south- east and at the north end. The owners have removed a quantity of granular fill material from the site and the adjacent tract under permit from the city. The permit allowed excavation of slightly more than 39,000 cubic yards of material. The grading plan is attached as an addenda to this report. The tract has no street improved access, Kennard St is platted between County Road C and Beam Ave., but it has not been improved. A trail used by trucks hauling fill material has been rough graded from the property north to Beam Ave., but the finished grade has not been established, and the trail has ' not been surfaced. Sanitary sewers are located at the northeast and northwest corners of the property. Public watermains are available in Beam Ave. 900 feet north and in County .Road C,12.50 feet south or in Gem St. 350 feet east. An exception measuring 30 feet by 100 feet lies between the east side of the leg and the northeast end of the foot. The tract contains 177,000 square feet or 4.06 acres, more or less. In its original s ta.te , the land was rolling and mostly open. The purchaser has removed a quantity of granular earth fill material from the site under permit from the City of Maplewood. It is .part of the Hazelwood Land Use Planning Area and extends frown County Road t C t on the south to TH A694 on the north and from White Bear Ave, on the east to TH #61 on the west, The con nercial improvements are dominated by Maplewood Mall Shopping Center, located northwest of the intersection of Beam Avenue and White Bear Avenue and its satellite facilities. A number of other commercial improvements are .scattered along hhite Bear Avenue, TH 1694 and TH 161. A major improvement is the new St. .john's Hospital Northeast on the north side of Beam Avenue at Hazelwood Avenue, The residential improvements are for the most part single family dwellings, although there is a multiple, dwelling development west of white Bear Avenue and south of Radatz Avenue. There is also . a senior citizens center pro- posed for Hazelwood Avenue south of Beam Avenue, The single family dwell- ings vary in age from new to forty years. Most are oumer occupied and well maintained. They fall generally in the medium price range, The abutting land west of Kennard Street is owned by the City and used for park and playground purposes. Most of the land east of Kennard Street and north of the subject is owned by Ramsey Co. and designated as open space. The land south of the subject is privately owned but also undeveloped. Public utilities are available to the developed property. The street net is incomplete because of the existence of several larger tracts of undevel- oped land, The trend in the area is to development of the commercially zoned property. Odegard, Director of Parks & Recreatio ti Subj: Purchase of 8.17 Acres of Property Adjacent to North Hazelwood Park Date: September 26, 1985 Request Reviewal of the Park Commission request to purchase two properties adjacent to North :Hazelwood Park by the Planning Commission for compliance with the Compre- hensive Plan, and amend the Comprehensive Plan to show rk expansion. P P Present North Hazelwood Facility The Parks Inventory Summary in the Maplewood Comprehensive Plan classifies the forty acre Hazelwood Park as a community playfield /neighborhood park. Community playfields are generally considered to be scheduled playfield facilities and often contain multi - purpose areas for use by all ages. A neighborhood park basically is at least five acres and serves the recreational needs of the immediate community. The Hazelwood complex includes a full sized lit soccer field on the upper level and a full sized field on the lower level. A small junior sized soccer field is located at the end of a parking lot. Although the North Hazelwood site is approxi- mately 40 acres in size, the present soccer facilities and parking lot comprise only thirteen acres (this is from County Road C north to the pond and from Kennard Street on the east to the western border on the hillside). The lower soccer field was designed as an overflow area for the pond. Park Standards While National standards of acres per population are useful for overall lannin P 9, it is important that they be put into their proper context in regard to the com- munity where they are applied. Because of the L- shaped configuration of Maplewood 9 P and the desire to provide leisure -time facilities all parts of the cit y, stan- dards have to be reconsidered. Maplewood also has to give consideration to p ark property that is owned and operated by Ramsey County and the State of Minnesota. The availability of private (Hill- Murray, Mounds Park Academy) and commercial rec- reational facilities (Saints North, Maplewood Bowl, golf courses) must also be con- sidered. Maplewood can no longer continue to depend on other agencies for recrea- t park property. School District #622 has sold Hazelwood School Harmony School, Hillside School, and Lydia /Mcknight. Public agencies such as the St. Paul Water Department have cancelled their lease for park property. The relationship with the churches for the use of their property has been very good, however, the now wish compensation for the use of their property. As an example of Maplewood not meeting generally accepted standards the number of playfields per population (soccer/football) i s one soccer f i el d er 5 000 0 p , p pula - ti on. Under this system Maplewood should only have five fields for football/soccer. Because Maplewood has a very strong soccer program, we are presently over 7 usin 9 eight fields. Need We anticipate at the end of the 1985 soccer season that we will no longer use the two fields at Mounds Park Academy due to their desire to have a rental fee for use of the f a c i l i t i e s . When the f a c i l i t i e s were part of School District #622, they were available to us free of charge. 21 Attachment six At this time there is a plan to excavate Gloster Park for use as an overflow pond - ing area for the Frost Avenue reconstruction. When that comes about, the Gloster soccer field will be. temporarily lost. Anticipated Use of North Hazelwood Complex Addition In keeping with the community pl ayf i el d. philosophy of serving the needs of scheduled athletics, it is anticipated the additional eight acres will be. designed for active recreation. At this time we would prepare the facilities with the intention of soccer fields without a crown. This would make it possible that in the event of the loss of Harvest Park, we could convert the area into softball facilities. With the area that we are interested in purchasing being adjacent to Ramsey County Open Space, it is natural for us to wish to include these two f a c i l i t i e s in a planned development. At this time we have discussed the expansion of a trail system for North Hazelwood and this would be a natural addition to the system. If more land becomes available in the area, it may be possible to expand to addi- tional recreational activities. Conclusion The Maplewood Comprehensive Plan on page 16 -3 indicates "the community playfield analysis suggests that future population increases without the addition of play- fields will result in serious problems in the delivery of active recreational opportunities. This anticipated playfield deficiency is potentially the city's greatest challenge in the area of Parks and Recreation over the next several decades." As the Comprehensive Plan indicates, the City has a definite defiency of land for community pl ayf i el ds . The addition of t h i s 8.17 acres is a start toward develop- ing a community playfield /neighborhood park for the City of Maplewood. 22 PLAN AMENDMENT RESOLUTION WHEREAS, the City of Maplewood initiated an amendment to the Maplewood Comprehensive Plan from residential low density to.park for- the property north of County Road C and west of Gem Street. WHEREAS, the procedural history of this plan amendment is as follows: .1. The Maplewood Planning Commission held a public hearing on October 7, 1985 to consider this plan amendment. Notice thereof was .published and mailed pursuant to law. All persons present at said hear— ' ing were given an opportunity to be heard and present written statements. The planning commission recommended to the city council that said plan amendment be . 2. The Maplewood City Council considered said plan amendment on October 9, 1985. The council considered reports and recommendations from the planning commission and city staff. ' Secretary Olson said most of the property around Kennard Street is open space ` and that is one of the reasons it cannot be extended south from Beam Avenue, there is no one to assess. Also, to have a cul—de—sac, going north from County Road C, the length would be about lGOO feet, the maximum length for a cul—de—sac according to the code is 1,000 feet. He sees this as an opportunity for the city to have a central park type of facility. This would also serve as a buffer between the commercial to the north and residential to the south. Director Odegard explained the method in which the funds are collected to purchase park property in the city (PAC charge). The commission questioned if the parks department or commission or anyone else in the city had . intention of requesting the vacation of Kennard Street. Director Odegard said they are not at that point yet, that i s ' somethi n g the city council would have to discuss. The commission thanked Director Odegard for appearing at the meeting. The commission indicated that the planning commission must make a determination if the proposal is consistent with the comprehensive plan prior to the purchase of the property. At this time the proposal does not conform with the comprehensive plan and will not until a change in the plan is made. Possibly this should be tabled until a change is made. TO: City Manager Modified.., FROM: Director of Community Development gejeeted SUBJECT: Comprehensive Plan Update to DATE October 2 1985 �` Earlier this year, council met with the planning commission to discuss updating the comprehensive plan. The last update was approved in 1982. Since then the following potential amendments have come up: 1. Council requested a study of the Beaver Lake neighborhood plan after a hearing on the Sterling Glen apartment project. 2. State law requires that the capital improvement program in the plan be updated every two years. 3. The planning commission's 1985 work program includes increasing the allowable density by bringing the people /unit formula into conformance with the 1980 census. This was also requested by Gene Wilson, a local realtor, at a recent council meeting. We should also consider changing maximum allowed density from people per net acre to units per net acre. 4. Last summer, council tabled several plan amendments, west of Highway 61 between Highway 36 and County Road C, and a rezoning at Clarence Street and Frost Avenue until an overall review of the plan is made. These amendments and rezoning should be completed. f 5. A general editing is needed to reduce the number of pages and make development policies easier to find and use by the council and commissions. Policies and information should also be updated. If policies in the plan do not reflect the. council's position, the plan - will work against them in court. Our city attorney advises us that the court looks on the comprehensive plan as the basic guide for the city in making development decisions. Decisions that are contrary to the plan will be difficult to enforce in court. It is also important to keep policies current so that staff and developers have a consistent guide for development proposals and residents know what to expect on undeveloped land. Recommendation Direct the planning commission to revise the comprehensive plan with at least the above changes. Council should add'any additional changes they would like considered. Action by Council.: Marketing Agreement Endorsed Modifie Between City of Maplewood and Merrill Lynch Realty /Burnet Re.ecte d.,.... This document is to outline the basic theme for marketing Maplewood Date City Hall located at 1380 Frost Avenue and to authorize Merrill Lynch Realty /Bu.rnet as the Exclusive Listing Company for the property. Open channels of communication shall be established between the selling committee for the City of Mapelwood (herein after refered to as the Seller) and Sharon Solberg, Gary McIntyre, and Mo Anderson as Listing Agents, for the purposes of communicating information and progress throughout the marketing duration. The Sellers and the Listing Agents realize that the marketing of this type of property is both expensive and time consuming and that often little or no results may be seen with the intial marketing efforts. To this end, the listing agreement will be entered into by both parties and shall have a termination date of October 31, 1986. Should the perfor- mance of either group not measure up to the expectations of the other, open negotiations using common sense and logic will be undertaken to correct the situation. If these communications break down completely, either party may terminate the agreement within thirty (30) days written notice. If this agreement is cancelled by the Sellers within the first 180 days of the listing agreement, the Sellers agree to reimburse the Listing Company and its Listing Agents for actual advertising expenses.
