Dear Sir:
This letter concerns the attached bill for grass cutting services performed by
your firm.
The Minnesota Department of Agriculture does not own any land in this state,
nor are we the caretakers for any land in this state. Of real concern to me,
and it should be to you as well, is who is telling you that we are responsible?
Grass cutting of this sort is usually done as a result of failure of the
landowner in complying with a city ordinance. It may well be that the land in
.question is state - owned. If such is the case, the city itself should take
action under their ordinance to collect the money from the State agency
responsible. Unless noxious weeds were involved, the Department of
Agriculture has no part in any enforcement of a city ordinance.
The possible state agencies that the city should check for ownership of the
land are the Department of Administration, Department of Natural Resources, or
the Department of Transportation.
Please make every effort to enlist the city in helping you resolve this
matter. We feel badly that you may be doing work for the state and not
getting paid for it, There is no reason that it should be this way. The
property owner should be listed in the property tax roles at the county
auditor's office.

WHEREAS, there exists in full force and effect Traffic
Control Signal Agreement No. 61159 dated December 3, 1982, entered
into by and between the State of Minnesota, Department of
Transportation, hereinafter referred to as the "State ", and the
City of Maplewood, hereinafter referred to as the "City"
WITNESSETH:
WHEREAS, the State has decided to install a flashing
yellow beacon with an advance traffic signal warning sign on each
T.H. 36 approach to English Street as an additional warning to
motorists as part of the traffic control signal being installed
under State Project No. 6211 -65; and
WHEREAS, it is anticipated that such work is eligible
for 90 percent Federal-aid funds; and
WHEREAS, the State and City recently mutually agreed to
additional terms and conditions in said agreement;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. The contract cost of the flashing yellow beacon
with an advance - traffic signal warning sign work, or if the work
is not contracted, the cost of all labor, materials and equipment
rental required to complete the work, shall constitute the "Beacon
Construction Cost" and shall be so referred to hereinafter.
2o The State with its own forces and equipment or by
contract shall install one (1) flashing yellow beacon with an
advance traffic signal warning sign on each Trunk Highway No. 36
approach at English Street. Participation in the Beacon

Construction Cost is 50 percent State and 50 percent City of the
amount remaining after the Federal -aid participation is deducted .
Estimated Beacon Construction Cost is $4,392.74. Federal-aid's
share is 90 percent. State's share is 5 percent. City's share is

39 The City shall advance to the State its portion of
the cost plus 6 percent of such amount for Engineering and
Inspection provided by the State as per terms of Agreement No.
61159, paragraph No. 6.
4. Upon final payment to the contractor and
computation of the City's share for the work provided for herein,
that amount of the funds advanced by the City in excess of their
shares will be returned to the City without interest and the City
and agrees to pay to the State that amount of their shares which
are in excess of the amount of the funds advanced by the City.
5. The City shall provide necessary electrical power
for their operation and shall be responsible for relamping the
flashers and cleaning and painting of the beacon pole, base and
cabinet. The State shall be responsible for all other beacon with
an advance traffic signal sign maintenance.
60 Except as provided for herein, all terms and
conditions contained in said Agreement No. 61159 shall remain in
full force and effect.

RESOLUTION
I
BE IT RESOLVED that the City of Maplewood enter into an
agreement with the State of Minnesota, Department of Transportation
for the following purposes, to wit:
To provide a flashing yellow beacon with an advanced
traffic signal warning sign in advance of the traffic
control signal on Trunk Highway No. 36 at English Street
in accordance with the terms and conditions set forth and

contained in Supplemental Agreement No. 1 to Agreement
No. 61159, a copy of which was before the Council.
BE IT FURTHER RESOLVED that the proper City officers be
and hereby are authorized to execute such agreement, and thereby
assume for and on behalf of the City all of the contractual
obligations contained therein.

Reason for the Request
The 1982 legislature passed a law requiring that mobile homes be treated
like single dwellings in zoning ordinances. The city may require HUD
certification. This would prohibit mobile homes built before 1976. The
ordinance also requires a moving permit for mobile homes previously lived
in. This would involve a public hearing and council approval. The definition
of mobil home & - should be amended to conform to State law. A letter of support
from the Minnesota Manufactured Housing Association is enclosed.

Manufactured home: A structure, transportable in one
or more sections, which in the traveling mode, is eight
body feet or more in width or 40 body feet or more in

permanent foundation when connected to the required
utilities, and includes the plumbing , heating , a i r
conditioning, and electrical systems contained therein;
except that the term i ncl udes any structure which meets
all the requirements and with respect to which the manu-
facturer voluntarily files a certification required by the
secretary and complies with the standards established under
chapter 365 of. the 1981 Minnesota State session laws.
"Secretary" means the secretary of the United States
Department of Housing and Urban Development or the head
of any successor agency with respons i bi 1 i ty for enforce-
ment of federal laws relating to manufactured homes.
Section 2. Section 36 -73 is hereby amended as follows (deletions
crossed out and additions underlined):

(a) All new installations of mobile homes shall be tied
to ground anchoring systems. Such installations
shall be in compliance with the current state rules
and regulations concerning such. installations. (Ord.

(b) Mobile homes must meet the most recent HUD certifi-
cation requirements. Mobile homes that have been
previously 1 i ved in require a moving permit under
sections 9 -61 to 9 -64.

Dear Mr. Olson:
Thank you for allowing me the opportunity to review
your proposed zoning ordinance amendments. Whereas
on paper the proposed amendments appear to be quite
simple they are very important amendments for the
City of Maplewood,.
The inclusion of the definition of manufactured homes
(Section 36 -6) is not only important because it makes
your zoning code consistent with statutory definitions
of mobile/manufactured homes, which I assume is located
in other sections of the ordinance, clearly means HUD
certified homes. Having been a professional municipal
planner I understand the importance of a city's use of
its basic police powers to ensure the public health,
safety and welfare of all its residents When permitting
types of housing in residential districts it is the city's
responsibility that the safety of the residents has
been provided for by zoning regulations. The State of
Minnesota recognizes two national construction codes for
single family dwellings: Uniform Bui Code and the
"HUD Code." Theref ore , . the inclusion of ,this definition
of manufactured homes requiring that the homes are con-
structed to the HUD Code, assures the City. that only
"safe" homes are allowed in its residential districts .
The second amendment requiring a moving permit is also an
excellent protection for the City. Building relocation
in most cities requires that the homes are brought up
to code (UBC Code) . The same should be true for pre-
viously occupied manufactured/mobile homes The manu-
facturer has a seal affixed to the home upon completion.
If the home has been lived in and is -to be relocated, the
city should require a moving permit and that the home

meets present HUD Code standards. This will assure the City that
the home has not been altered by the homeowners so that the home
is in noncompliance with the HUD Code. This proposed amendment
provides for the safety of the residents and should be in the
zoning ordinance.
The Minnesota Manufactured Housing Association supports these types
of ordinances which protect public safety. My industry under the
HUD Code in effect since 1976 constructs HUD certified homes.
Only these HUD certified homes which meet zoning code design criteria
should be recognized as equivalent to UBC,site built homes.

( "Department ") , through its Commissioner ( "Commissioner"

WHEREAS, a charge of discrimination was filed pursuant to
Minn. Stat . S 363. 06 (197 8) with the Department b the charging

basis of physical disability by refusing to hire him as a police
officer because his uncorrected visual acuity failed to meet
Maplewood' s standard; and
WHEREAS probable cause has been found by* the Department
to believe the allegations. - contained in the above - mentioned charge;

WHEREAS, respondent expressly denies that it has
discriminated against the charging party or against an other

WHEREAS, all parties to this agreement desire to
conciliate all issues in dispute between them in the above matter;
and
WHEREAS, the undersigned parties have agreed to a full
settlement of all issues in dispute between them.
NOW, THEREFORE, in consideration of the promises contained
in this document, the undersigned parties agree as follows:
1. This agreement is not intended to and shall not
constitute. an admission or any evidence of admission for any purpose
that respondent violated the Minnesota Human Rights Act, Minn. Stat.
363.01 et seq. (1982) or any other state or federal law or
regulation,,
2. Respondent agrees to pay to . the charging party within
fifteen (15) days of the execution of this agreement by all P arties

5. Respondent will cease and desist from requiring
applicants for the position of police officer to meet an uncorrected
visual acuity standard in both eyes of 20/30 (Suellen) or better.
6. This agreement establishes procedures which Maplewood
shall utilize after ascertaining the visual acuity of applicants for
the position of police officer (herein "applicants "). These
procedures establish two classes of applicants:
Class l: Any applicant whose uncorrected visual
acuity is determined - after testing to be better than
20/40 (Suellen) in both eyes shall be deemed to have
sufficient visual acuity.
Class 2: Any applicant whose uncorrected visual
acuity is determined after testing to be between
20/40 and 20/200 (Suellen) in one or both eyes shall
be offered an opportunity to appear before a visual'
acuity review board. This board shall be established
and operated as set forth below.
Applicants whose visual acuity does not place them in. either Class 1
or Class 2 are not affected by the terms of this agreement.
7. Respondent shall establish a visual acuity review
board consisting of three individuals: an ophthamol og ist , a police
officer with at least five years police experience, and a person
employed by respondent who is familiar with the job requirements of
a Maplewood police officer. Neither the ophthamolog ist nor the
police officer shall be employed by respondent for any purpose other.

8. All applicants rejected by Maplewood on the basis of
visual acuity who are members of Class 2 above shall be_ notified in

writing at the time of their rejection that they are entitled to
appear before the visual acuity review board. These individuals
( "Class 2 applicants ") shall also be notified at this time of the
procedure to be followed in order to obtain such an appearance.
919 The visual acuity review board shall at the request
of any Class 2 applicant determine by majority vote whether his
visual acuity (corrected or uncorrected) renders him unable to
safely and efficiently perform the job requirements of a Maplewood
police officer or would constitute a serious threat to his health
and safety or that of others if he were employed as a Maplewood
police officer. In such instance the visual acuity review board
shall determine whether the applicant's uncorrected vision is
relevant given the method and success of visual correction used. In
making its decision, the board 1) shall also determine whether the
applicant possesses job experience or skills similar to those
necesesary to perform police work which compensate for a decreased
visual acuity and 2) shall be provided by respondent with the visual
acuity of the members of the Maplewood Police Department,
10. The determination of the visual acuity review board
required by paragraph 7 above shall be rendered in such time as to
not limit or foreclose the employment opportunities of any Class 2
applicant for the position of police. officer who has sought such a
determ ination .

11. Each determination of the visual acuity review board
required by this agreement shall be in writing and served by mail
upon the individual requesting the review. Each determination shall:
include written findings which refer specifically to the job tasks
from the job description which the visual ac ui ty review board

12. In any document which notifies interested persons of
any visual acuity standard utilized by Maplewood in hiring its
police officers, notice .shall be included therein of the existence

Woodmark , Inc., developers of Bennington Woods and Somerset Ridge Condominiums,
nas requested that the sign ordinance be amended to permit signs for multiple
dwelling developments to be greater than eight square feet, but only by conditional
use permit.
Reason for Changes
To give equal consideration to signs for multiple dwelling developments as is given
to s i gnage for institutions in residential zones. Refer to-the applicant's letter
on page
Alternatives (In Order of Preference)
1.
Allow signs for multiple dwei l i n developments up to 24 square feet and signs from
25 to 32 square feet by conditional use permit. This alternative is consistent
with the permitted si gnage for institutions.
2. Allow signs up to eight square feet, but permit signs over eight square feet
only by conditional use permit.
Comments
.There is no reason to be more restrictive with multiple dwellings than with insti-
tutions. Both can be located in residential zones and may be found adjacent to
single-dwelling neighborhoods.
The advantage of the conditional use permit is that Council can control the location
and appearance of mul ti pl a dwelling signs. The disadvantages are:
1. A six to eight week time delay for getting a decision from Council. This time
would be spent for - staff review, revi by the Community Design Review Board
and a public hearing before the City Council.
2. It is expensive to pay the fees for a conditional use permit. The cost is
generallly about $200.00 ($125.00 for the conditional use permit and approxi-
mately $75.00 for an abstractor's list).
3. The conditional use permit procedure would create extra work for the city "and
applicant.
To be consistent with Council's recent amendment, staff recommends alternative one.
Staff also feels that language should be added to the permitted si gnage for insti-
tutional signs to limit the allowable number of signs to one for each street frontage,
as is the requirement for multiple dwelling development. Staff also wishes to
address the maximum six -foot width requirement. The width limitation would not have any
effect on the aesthetic .quality of the sign. A sign can be attractive or unattractive
with any shape provided the overall a rea is limited. Woodmark' s proposed sign
on page 7 for example, would be qui attractive and would measure ten feet

Staff's final concern is that it is. not necessary or a sign to have subsequent

reviews by the Council as a typical conditional use would. This requirement
should, therefore, be waived for signs which are approved as conditional uses.
Recommendation
.I. Approval of the proposed Sin Code amendment treating

for signs approved as conditional uses.
II. Approval of the proposed Code Amendment eliminating the one -year review of

RE: Bennington Woods Condominiums
Dear Mayor Greavu and Members of the City Council:
I hereby request a change in the zoning ordinance Section 36 -316
paragraph (3). The desired change is in the form of additional
wording as follows:
"Signs larger than eight (8) square feet shall only
be allowed by conditional use permit."
The code now allows for the conditional use permit for churches,
schools, libraries, and other insti tutions. I feel that con -
sideration should be available to for sale housing communities too.
Attractive, permanent site identification signs are an important part
of a quality condominium or townhouse community. The sign sets the
mood and image as well as making a statement. Properly executed, the
sign will be an asset to the community.
Maplewood would be able to review all signs to insure a minimum
quality through the conditional use permit process. As the ordinance
now reads, there is no control other than size limitations.
At this time, I also request the necessary conditional use permit for
a sign as shown on the enclosed drawing. This requested conditional
use permit is to run in tandem with my request for a zon i ng

Park and Recreation Commission

The Park and Recreati Commission at their October 17,'1983,
meeti requested that a joint meeting be scheduled for Monday,
November 21, at 7:00 p.m. with the City Council. If that i s
not convenient, pl ease consider an alternate date.
The Park and Recreation Commission has not met with the City
Council for a number of years and they would like to informal-
ly talk about parks and recreation.

Subj : Recommendation to Acquire Property Adjacent to
{ Goodrich Softball Diamond #1 Owned by School District #622
Date October 14, 1983
The Park and Recreation Commission at their September meeting
+ toured the property on the north.end of Goodrich softball complex
which is owned by'School District #622. The-School District in
August of 1983 notified the City that they were interested in
selling the small triangular piece of property between Goodrich
softball diamond and the property that the School District sold
to .Sauro Realty Company on Holloway between Beebe Road and
North St. Paul Road. The following motion was discussed and
passed:
Commissioner Fox moved that the Park and Recreation
Commission recommend to the City Council that they
enter into negotiations with School District #622
for a parcel of property (all that part of the-W; of
SE-1/4 of Section 14, Township 29N, Range 22 West of
the Fourth Principal) at a price not to exceed $7500.00,
and that negotiations also be entered into concerning
the parcel of proper -ty off the south parking lot (trian-
gular piece 50'x237.5' adjacent to city -owned .parking
lot) at a cost not to exceed $4500.00; Seconded by Com-
missioner Quall Ayes: All.
Please find attached a diagram indicating the piece of property
that the School District wishes to sell to the City and also
the property 50'x237.5' that we would also like to discuss
with the School District as far as an additional acquisition.
From telephone conversations with Mr. Engen, Director of Busi-
ness Affairs with the School District, he has stated that they
wish to sell the property and not negotiate a lease. There is
also presently concern that the School District will sell the
Hillside School property to the Academy which would include
these two triangular pieces of property next to our softball
.complex.
Please note that the ece of property that the City should

purchase includes the area that we now use for parking and the
drive area arou nd softball diamond #1.

Dear Mr. Odegard:
Pursuant to our recent telephone conversations, I have enclosed herewith
copy of survey and legal descri ption ' on the referenced property.
The net return to the School District on the sale of the four acres lying

directly to the east is $.753. At $.75 /square foot, the small parcel
(.29,711 square feet) calculates out at $22,283,,00,,
Recognizing that the market value of the referenced parcel does not directl
compare to the large piece the School District would consider selling at a
1 owe r price per square foot. Discussions with the Di stri ct' appra i s or
indicate $15,000.00 would be a fair selling price.
The School District is first offering the property to the City of Maplewood,
and would be pleased to consider your offer.
